Adopt the attached resolution opting not to list any unopposed candidates on the November 8, 1994 ballot in San Mateo, Santa Clara and Santa Cruz Counties. 2. Direct staff to inform the registrar of voters in Santa Clara, San Mateo, and Santa Cruz Counties, as necessary, of the Board's action. DISCUSSION As of the writing of this report on Thursday, August 11, 1994, it is not certain whether there will be more than one candidate for the position of director in Ward 5 and Ward 6. President Babbitt has called this special meeting in the event there is, after the close of the nomination period, only one candidate in any of the wards up for election this year. At this time, more than one candidate has filed nomination papers in Wards 1 and 2. Only the incumbents have filed papers in Wards 5 and 6. Section 5532(e) of the District enabling legislation (Public Resources Code) states in part the "The board of directors may permit the candidates running unopposed to have their names appear on the ballot, at the board's option. Section 2.12 of your Rules of Procedure (Unopposed Candidates and Candidates' Statements) has not been amended to incorporate the at the board's option" language and reads "in the case where there is a single candidate qualified to appear on the ballot, such candidate shall be permitted to have his or her name on the ballot at no cost to the candidate." I District election costs for Ward 5, are estimated to be $10,000 ($3000 for San Mateo County and $7,000 for Santa Clara County). Election costs for Ward 6 are estimated to be $23,000. In light of the District's critical budget situation this year, I am recommending that it would be financially prudent for the Board to exercise its option not to list any unopposed candidates on the ballot. The Board's decision on this matter must be made by Thursday, August 18. The Santa Clara County Registrar of Voters has informed District staff that he must be advised of the Board's decision not to list unopposed candidates on the ballot by the 18th. Prepared by: Jean H. RESOLUTION OF THE BOARD OF DIRECTORS OF THE MIDPENINSULA REGIONAL OPEN SPACE DISTRICT AUTHORIZING NOT LISTING ANY UNOPPOSED CANDIDATES FOR ELECTION ON THE NOVEMBER 8 BALLOTS OF SAN MATEO COUNTY, SANTA CLARA COUNTY, AND SANTA CRUZ COUNTY IIII WHEREAS, the District's enabling legislation states that the Board of Directors may opt not to permit candidates running unopposed to have their names appear on the ballot, NOW, THEREFORE, the Board of Directors of the Midpeninsula Regional Open Space District does hereby opt not to list the unopposed candidates for election on the November 8, 1994 ballots of Santa Clara, San Mateo, and Santa Cruz Counties.
