RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD
GRANTING A PERMIT 'iC) USE CERTAIN STREET PROPERTY FOR
RAILROAD PURPOSES (EAST ALAMEDA STREET AND LYNWOOD
ROAD).
WHEREAS, by applicaticm dated March 8, 1984, Southern Pacific
Transportation Company applied tp the City for a perntit to construct,
reconstruct, maintain and operate one drill track across East Alameda
Street, and one spur track across Lyncx~od Road, respectively; and
WHEREAS, pursuant to the authority of California Public
Utilities Code Section 7555, the City may grant such rights upon reason-
able terms and conditions following a public hearing thereon; and
WHEREAS, notice of such hearing has been published, and mailed
to affected property owners and the applicant, and a public hearing thereon
has been duly held; and
WHEREAS, the City Council deems it to be in the public interest
to grant such permit subject to the conditions set forth herein;
NOW, TIIII2EE'ORE, BE IT RESOLUID, by the City Council of the
City of Lynwood as follows:
1. The City Council hereby grants to Southern Pacific Transpor-
tation Company. (the "Applicant"), for a term of 50 years, the right to
construct, reconstruct, maintain and operate (1) a drill track across East
Alameda Street along the center line and covering the public street
property described in Exhibit A hereto, and (2) a spur track across
Lynwood Read along the center line and covering the public street property
described in Exhibit B. hereto.
2. This franchise is conferred subject to the following terms
and conditions:
(a) The specific indicated portion of East Alameda Street
and Lynwood Road shown on Exhibits A and B, respectively, shall be
dedicated to the City of Lynwood for right of way improvement purposes
prior to the c~.nc~nent of any construction activities. The Applicant
shall cause to be prepared and obtained all necessary plans and doc~nents
for such dedications.
(b) Prior to the conur~ncement of any construction activities,
street improvement plans and storm drain plans shall be sulinitted to the
Public Works Director/City Engineer for approval. Such plans shall
accommodate railroad/street transition requirements in accordance with the
Public Utilities Commission's requirements and the design standards of
the County of IAS Angeles Road Department and shall address drainage
requirements in accordance with the County of Los Angeles Flood Control
District's standards.
(c) Street rights of way and railroad improvements will be
constructed in accordance with the approved plans. Applicant shall
furnish a labor and material bond and a performance bond as required by the
Public Works Director/City Engineer. All required permits of the City of
Lynwood shall be obtained prior to the commencement of any construction
' activities for which such pernuit is required.
(d) Applicant shall initially furnish and install all required
crossing/warning devices, signs and street markings along the public streets
realting to the railroad crossing in accordance with the requirements of the
California Public Utilities Commission, California Public Utilities Code,
California Vehicle Code and Traffic Manual.by,Caltrans.

(e) Applicant shall at all times maintain the drill track and t~°"
spur track and related railroad crossing in a clean and safe manner, having t/-~i
due regard for public safety, and in accordance with the Public Utilities
Commission's requirements and the Public Utilities Code. ~.,
3. The City hereby determines that the granting of this ~

franchise is in the pbblic interest of the City, that it will promote
the c~rcial and industrial base of the City and promote other valid '
public purposes, and that there can be no bona fide c~nsation in bidding i
for said permit. ~ ':

A drill track situate in the City of Lynwood, County of Los Angeles,
State of California, the center line of which is on a curve described
`; as follows:
'+'~Beginning at the point of intersection of said curved center line with
'the westerly line of Alameda Street 66 feet wide, said point being
distant South '7°32' East along said westerly line 283.64 feet from its
:intersection with the center line of Lynwood Road 63 feet wide, a radial
line from said curved center line at said point of beginning bears
North 55°43'13" East; thence southeasterly along the arc of said curved
` drill trsck that is concave northeasterly and has a radius of 357.43
' feet, through a central angle of 18°09'08" a distance of 113.24 feet
'to ;its intersection with the easterly line of said Alameda Street at a
~o3nt that is distant South '7°32° East along said Easterly line 334.28
feet from its intersection with the southerly line of said Lynwood Road,
a radial line at last said point from said curved center line bears

A spur track situate in the City of Lynwood, County of Los Angeles,
State of California, the center line of which is described as follows:
Beginning at the point of intersection of said center line with the
southerly line of Lynwood Road 63 feet wide, said point being distant
North 89°Ol' East along paid southerly line 852.94- feet from its inter-
section with the easterly line of. Alameda Street 66 feet wide; thence
North 0°5g' West along the center line of said spur track 63 feet to
its intersection with the northerly line of said Lynwood Road.
