Minutes Special Council Meeting
Wednesday, March 7, 2012. 6:00 p.m.
°Springmier Community Library at CCA Middle School
The Tiffin city council met in special session on Wednesday, March 7, 2012 at the
Springmier Community Library. Mayor Berner called meeting to order at 6:00 p.m.
Members present: Chris Ball, Peggy Upton, Jim Bartels and Travis Weipert and Mike •
Ryan. Also present: Attorney Greenleaf.
Motion Ball second Upton to approve agenda. Carried unanimously.
Ryan introduced Ordinance No. 2012-308AN ORDINANCE REPEALING CHAPTER 18,,
OF THE TIFFIN CODE OFORDINANCES AND ADOPTING A NEW CHAPTER 18 TO
ESTABLISH THE POSITION OF CITY CLERK/ADMINISTRATOR and moved that it be
given its second reading by title only. Motion seconded by Bartels., Roll Call vote:
Ryan, aye; Ball, aye; Weipert, aye; Upton, aye; Bartels, aye.
Bartels introduced Ordinance No. 2012-308 AN ORDINANCE REPEALING CHAPTER
18 OF THE TIFFIN CODE OFORDINANCES AND ADOPTING A NEW CDHAPTER 18
TO ESTABLISH,THE POSITION OFCITY CLERK/ADMINISTRATOR and moved that
the requirement for reading atthree'consecutive meetings be waived and that it be
given its third and final reading by title only Motion seconded by. Weipert. Roll Call
vote: Ryan, aye;`Ball, aye; Weipert, aye; Upton, aye; Bartels, aye.
Motion Weipert second Upton to enter into closed session at 6:05 p.m'. under Code of
Iowa Ch. 21.5(1)(j) to discuss the purchase or sale of particular real estate only where
premature disclosure could be reasonably expected to increase the price the
governmental body would have to payfor that property or reduce the price the
governmental body"would receive for that property. Roll call vote: Ball, aye; Bartels,
aye; Weipert,,aye; Upton, aye; Ryan, aye;
Motion Weipert and Ryan to go into open session at 6:27 p.m.
Attorney Greenleaf reported that the council held a closed session regarding an offer
from an.,undisclosed purchaser to purchase lot 48 'and Outlot C of Timber Ridge View
Estates as a package, in order to discuss what direction to give the mayor in response
to the current offer, and the council did not authorize acceptance for a lesseramount
than the advertised amount of$160,000.
Motion Ryan second Ball to authorize Mayor.Berner to make an application to the Board
of Adjustment fora variance to rezone lot 48 and Outlot C of timber Ridge View Estates
if the P&Z Commission denies the request. Carried unanimously.
Motion Weipert second Bartels to adjourn at 6:30 p.m.
