HomeMy Public PortalAboutResolution 85-23411 1 1 RESOLUTION NO. 85 -2341 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DECLARING CERTAIN PREMISES TO BE A PUBLIC. NUISANCE AND ORDERING ABATEMENT THEREOF FOR THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE AS FOLLOWS: WHEREAS, the Planning Commission of the City of Temple City has, by Resolution No. 85- 1165PC, determined that a public nuisance as de- fined in the Municipal Code, exists on certain premises and recommends abatement thereof; and WHEREAS, no appeal has been taken from said determination with re- spect to time in which to abate the nuisance; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE: SECTION 1. That a public nuisance, as defined in the Municipal Code of the City of Temple City, exists on the premises designated as 5535 Pal Mal Avenue, City of Temple City, California, and more particu- larly described as Lot 13, Tract 28607, Map Book 719, pp. 14 -15 of Maps in the Office of the County Recorder, County of Los Angeles, State of California, in the following particulars: A. Maintenance of premises so out of harmony or conformity with the maintenance standards of adjacent properties as to cause substantial diminution of the enjoyment, use or property values of such adjacent properties. Section 4230(r) B. Neglect of premises: (1) to spite neighbors, or (2) influence zone changes, or (3) to cause detrimental effect upon nearby property or property values. Section 4230(g) SECTION 2. The property owner is ordered to abate the nuisance within thirty (30) days by the following methods: A. Removal of debris (trash cans, bathtub, ladders, broken con- crete, plastic sheeting, wheelbarrows, etc.) from all yard areas. B. Mow front, side and rear yard areas and institute a regular maintenance program for the property. SECTION 3. If said abatement is not accomplished by the expira- tion of thirty (30) days, the City Manager is hereby authorized and directed to cause said public nuisance to be abated by City forces or private contractor pursuant to the Municipal Code. SECTION 4. The City. Clerk is hereby directed to cause a copy of this Resolution to be served on the owner of said premises pursuant to the Municipal Code. SECTION 5. The City Clerk shall certify to the adoption of this Resolution. APPROVED and ADOPTED this 19th day of March, 1935.
