Reiman at 7:00 September 9, 2004 P.M., Municipal Court, Police Facility, 230 Roosevelt Avenue, Carteret, New Jersey. Upon individual roll call, the [allowing were noted present: ROLL CALL Councilmember Randy Krum " Frank Parisi " Ronald Rios " Joseph Sitarz " Brian Sosnowski Noted Absent was Councilmember Susan Naples. Also noted present was Borough Attorney Robert Bergen. The meeting was opened with a minute o[ silent prayer and the PRAYER, PLEDGE OF Pledge of Allegiance led by Mayor Daniel J. Reiman. ALLEGIANCE The Assistant Clerk stated that on on January 6, 2004, the 2004 SfATI'MENr OF MEETING Annual Notice was published in The Home News Tribune, The OOITCE Star Ledger and posted on the Bulletin Board on January 6,2004. Upon MMS&C by Councilmembers Rios and Sitarz and MINUl'E'S APPROVED unanimous a[firmative vote of the five (5) Councilmembers present, the Minutes of August 26, 2004, were approved and transcribed and engrossed by the Assistant Clerk. Mayor Reiman then explained that since our Agenda Meeting, two Mayor" Reiman, Re: (2) ordinances have been added to the Order o[ Business; #04-29 a Or-dinances Bond Ordinance [or $150,000.00, because we had already adopted our budget and anytime we receive a large grant at this point o[ time in the year we have to adopt an ordinance and #04-30, which will amend a Bond Ordinance !Tom 1995, where there is an existing $39,560.45 o[ [unds to be re-appropriated and used [or improvements [or the Carteret Parks and Hot House. He went on to explain that #04-25, which is on [or Public Hearing, which is a $500,000,000 Ordinance [or Special Improvement District, that was approved by our Local Finance Board yesterday. New Jersey Finally Adopted April 6, 199' ORDINANCE #04-30 in oroer to Amend tho Description of the Amending Bond Ordinance #95-16 to re-appropriate $39,560.45 Project [rom renovation o[ the existing Board of Health Building to Improvements and Renovations to Parks Department. First Reading BE IT ORDAINED BY THE BOROUGH COUNCIL OF THE BOROUGH OF CARTERET, IN THE COUNTY OF MIDDLESEX, NEW JERSEY (not less than two-thirds o[ all members thereo[ affirmatively concurring) AS FOLLOWS: 95-16 of the Borough o[ Carteret finally adopted April 6, 1995 is hereby amended to read as follows: (b) Construction of an addition to and the renovation o[ the existing health building and the parks department building in the Borough, including acquisition and installation of equipment and [urnishings and all work necessary therefor or incidental thereto. Section Two. The capital budgct of the Borough of Carterct is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency herewith. The Assistant Clerk stated that Ordinance #04-25 was introduced ORDINANCE 4104-25 and passed upon First Reading at an Agenda Meeting of the Bond Oroinance Borough Council of the Borough of Carteret held on August 12, Appropria ting 2004. It was duly published in The Home News Tribune on $5,000,000, Re: Special Improvement August 23, 2004 with notice that it will be considered for final District passage after Public Hearing to be held on September 9, 2004 at approximately 7:00 P.M. The Ordinance was posted on the bulletin board and copies were made available to the general public and according to law, she read the Ordinance by title. 3 SEPTI'MBER 9, 2004 ORDINANCE 4104-25 Upon MMS&C by Councilmembers Rios and Sitarz and Public Hearing unanimous affirmative vote of the five (5) Councilmembers present, the Mayor declared the Public Hearing to be open. Hearing Closed There being no further comments or objections to the Ordinance, the Mayor declared the Public Hearing to be closed upon MMS&C by Councilmembers Sitarz and Rios and unanimous affirmative vote of the five (5) Councilmembers present. Upon MMS&C by Councilmembers Rios and Sitarz ORDINANCE #04-25 "BOND ORDINANCE PROVIDING FOR VARIOUS IMPROVEMENTS WITHIN THE SPECIAL IMPROVEMENT DISTRICT IN AND BY THE BOROUGH OF CARTERET, IN THE COUNTY OF MIDDLESEX, NEW JERSEY, APPROPRIATING $5,000,000 THEREFOR AND AUTHORIZING THE ISSUANCE OF $5,000,000 BONDS OR NOTES OF THE BOROUGH TO FINANCE PART OF THE COST THEREOF" Adopted was finally Adopted. Upon individual roll call vote, Councilmembers Krum, Parisi, Rios, Sitarz and Sosnowski voted in the Affirmative. Councilmember Naples was noted Absent. BE IT ORDAINED BY THE BOROUGH COUNCIL OF THE BOROUGH OF CARTERET, IN THE COUNTY OF MIDDLESEX, NEW JERSEY (not less than two-thirds of all members thereof affirmatively concurring) AS FOLLOWS: Section I. The improvement described in the Section 3 of this bond ordinance is hereby authorized to be undertaken by the Borough of Carteret, New Jersey as a general improvement. For the improvement or purpose described in Section 3, there is hereby appropriated the sum of $5,000,000. No down payment is required pursuant to NJ.SA. 40A:2-11(c) as this bond ordinance authorizes obligations solely for a purpose described in NJ .S.A. 40A:2-7 (d). Section 2. In order to finance the cost of the improvement or purpose, negotiable bonds are hereby authorized to be issued in the principal amount of $5,000,000 pursuant to the Local Bond Law. In anticipation of the issuance of the bonds, negotiable bond anticipation notes are hereby authorized to be issued pursuant to and within the limitations prescribed by the Local Bond Law. Section 3. (a) The improvement hereby authorized and the purpose for the financing of which the bonds are to be issued in any and all capital improvements within the Borough's special improvement district, including but not limited to improvements to andlor installation of curbs, sidewalks, decorative street lighting, shade trees, pavers and road improvements within the Lower Roosevelt Avenue Redevelopment Area, and the following roads: Roosevelt Avenue !Tom Washington AvenuelHolmes Street to Industrial Road, Roosevelt Avenue from Blair Road to Post Boulevard and Roosevelt Avenue from Edwin Street to Industrial 4 SEPI'lliBER 9, 2004 Road, including all work and materials necessary therefore and ORDINANCE 4104-25 Con incidental thereto. (b) The estimated maximum amount of bonds or notes to be issued for the improvement or purpose is as stated in Section 2 hereof. (c) The estimated cost of the improvement or purpose is equal to the amount of the appropriation herein made therefore. Section 4. All bond anticipation notes issued hereunder shall mature at such times as may be determined by the Chief Financial Officer; provided that no note shall mature later than one year from its date. The notes shall bear interest at such rate or rates and be in such form as may be determined by the Chief Financial Officer. The Chief Financial Officer shall determine all matters 10 connection with notes issued pursuant to this ordinance, and the Chief Financial Officer's signature upon the notes shall be conclusivc evidence as to all such determinations. All notes issued hereunder may be renewed from time to time subject to the provisions of the Local Bond Law. The Chief Financial Officer is hereby authorized to sell part or all of the notes from time to time at public or private sale and to deliver then to the purchasers thereof upon receipt of payment of the purchase price plus accrued interest !Tom their dates to the date of delivery thereof. The Chief Financial Officer is directed to report in writing to the Governing Body at the meeting next succeeding the date when any sale or delivery of the notes pursuant to this ordinance is made. Such report must include the amount, the description, the interest rate and the maturity schedule of the notes sold, the price obtained and the name of the purchaser. Section 5. The capital budget of the Borough of Carteret is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency herewith. The resolution in the form promulgated by the Local Finance Board showing full detail of the amended capital budget and capital program as approved by the Director of the Division of Local Government Services is on file with the Clerk and is available tl,~re for public inspection. Section 6. The following additional matters are hereby determined, declared, recited and stated: (a; The improvement or purpose described in Section 3 of this bond ordinance is not a current expense. It is an improvement or purpose that the Borough may lawfully undertake as a general improvement, and no part of the cost thereof has been or shall be specially assessed on property spccially benefitcd thereby. (b) The period of usefulness of the improvement or purpose within the limitations of the Local Bond law, according to the reasonable life thereof computed from the date of the bonds authorized by this ordinance, is 15 years. © The Supplemental Debt Statement required by the Local Bond Law has been duly prepared and filed in the office of the Clerk, and a complete executed duplicate thereof has been filed in the office of the Director of the Division of Local Government Services in the Department of Community Affairs of the State of 5 SEPI'lliBER 9, 2004 ORDINANCE 4104-25 New Jersey. Such statement shows that the gross debt of the Cont: Borough as defined in the Local Bond Law is increased by the authorization of the bonds and notes provided in this bond ordinance herein by $5,000,000 and the obligations authorized herein will be within all debt limitations prescribed by Law. (d) An aggregate amount not exceeding $1,000,000 for items of expense listed in and permitted under NJ.S.A. 40A:2-20 is included in the estimated cost indicated herein for the purpose or improvement. Section 7. Any grant moneys received for the purpose described in Section 3 hereof shall be applied either to direct payment o[ the cost of the improvement or to payment of the obligations issued pursuant to this ordinance. The amount of obligations authorized but not issued hereunder shall be reduced to the extent that such funds are so used. Section 8. The Chief Financial Officer of the Borough is hereby authorized to prepare and to update from time to time as necessary a financial disclosure document to be distributed in connection with the sale of obligations of the Borough and to execute such disclosure document on behal[ of the Borough. The Chie[ Financial Officer is further authorized to enter into the appropriate undertaking to provide secondary market disclosure on behalf of the Borough pursuant to Rule l5c2-12 of the Securities and Exchange Commission (the "Rule") for the benefit of holders and beneficial owners of obligations of the Borough and to amend such undertaking from time to time in connection with any change in law, or interpretation thereof, provided such undertaking is and continues to be, in the opinion of a nationally recognized bond counsel, consistent with the requirements of the Rule. In the event that the Borough fails to comply with its undertaking, the Borough shall not be liable for monetary damages, and the remedy shall be limited to specific performance of the undertaking. Section 9. The full faith and credit of the Borough are hereby pledged to the punctual payment of the principal of and the interest on the obligations authorized by this bond ordinance. The obligations shall be direct, unlimited obligations of the Borough, and the Borough shall be obligated to levy and valorem taxes upon all the taxable real property within the Borough for the payment of the obligations and the interest thereon without limitation of rate or amount. Section 10. This bond ordinance shall take effect 20 days after the first publication thereof after final adoption, as provided by the Local Bond Law. Upon individual roll call vote, Adopted Councilmembers Krum. Parisi, Rios. Sitarz and Sosnowski voted in the Affirmative. Councilmember Naples was noted Absent. He then made a correction in the title of Resolution #04-285, saying it should read "Rejecting" not "Directing" Bid for Façade Improvement Project and Authorizing Re-bid. 7 SEPTI'MBER 9, 2004 Public Portion Upon MMS&C by Councilmembers Rios and Sitarz and on Resolutions/ unanimous affirmative vote of the five (5) Councilmembers Agenda I terns and present, the public portion on ResolutionslAgenda Items and New New Business Busness was opened to the public. Joe Novakowski Joe Novakowski, 17 Coolidge Avenue then spoke. He commended the people who organized and volunteered for the activities for Ethnic Day. Garbage, Re: A citizen of Carteret then spoke saying he has some people coming Turnpike to visit and the garbage pails by the Turnpike are full and there is trash all over the grass. which will make a bad impression of the town. Mayor Reiman said he would bring it to the Turnpike's attention, to maintain them or do away with them. Mrs. Melnick Mrs. Melnick, 64 Edgar Street, spoke, directing her problem to Councilmember Rios. She asked him i[ he remembered what she had gone through last November in reference to the political signs. She then went on to explain that she had a handicapped parking place in front of her house and the town came and changed the sign [or the $250.00 fine, etc Since November she has received threatening phone calls and dirty notes in her mail box. She gave the notes to the police. Now someone has written something dirty on her sign and she would like to have it removed. Mayor Reiman told her they would replace it tomorrow. Councilmember Rios then explained to the rest of the Council, who may not of been aware of Mrs. Melnick's problem, that she had put up a political sign for he and Mr. Sitarz and soon after she started receiving harassing and vulgar phone calls. She then asked him to remove the signs because of this and he did. Len Sheno Len Shena, 280 Washington Avenue spoke, saying there is a sign in Banick Park for Lady Ramblers Softball Champions for the year 2004, that needs updating. Councilmember Krum said that should be taken care of by the School Board. Mayor Reiman said the sign in Banick Park is on Municipal Property, so he directed Councilmember Rios, who is in charge of parks, to make sure it is taken care o[ . CD1MUNICA'ÌIONS The Assistant Clerk stated that she was m receipt of a Communication from NJ Division of Solid Waste Management- Public Hearing 919104, 6:00 P.M., New Brunswick, NJ-Re: Solid Waste Management Plan Amendment to include Mining Organics Management. Keasby, NJ. Upon MMS&C by Councilmember Sitarz and Rios, it was ordered to be received and placed on file. The Assistant C1erk stated that she was III receipt of a Communications from PSE&G -Public Hearing, 9/12/04, New Brunswick, NJ Re: Basic Generation Service Charges, upon MMS&C by Councilmembers Sitarz and Rios, it was ordered to be received and placed on file. PAYMENI' OF BILLS Upon MMS&C by Councilmembers Rios and Sosnowski, all bills appearing on the prepared list, properly audited and signed, were ordered to be paid. REPORTS Departments- Clerk's Office-August 2004. Inspection of Buildings-July 2004 10 SEPI'lliBER 9, 2004 Upon MMS&C by Councilmembers Sitarz and Rios and REPORTS Cont: unanimous affirmative vote of the five (5) Councilmembers present, all Reports were ordered to be received and placed on file. BUILDINGS & GROUNDS - Mayor Reiman explained that aMlITTEE'S Committeewoman Naples was not present. Committee member Krum then spoke on her behalf reporting all sa[ety inspections were completed during the month and all corrections were made. Borough (inaudible) are being put in the Library basement and are being sorted and placed as needed. The bus shelter program is in effect and the units are being checked several times a week. The Recyclable Building is being constructed to fit the Construction Zoning Planning and Engineering Departments. Progress. FINANCE & ADMINISTRATION - Committee Chairperson Parisi reported that the tax collections for the year were just finish;ng up and and there is a tax sale scheduled for October 6th, at the Annex, at 10:00 A.M. He said Mr. De Blasia told him that the Sewer Rebates should be done by the end of the month. FIRE - Committee Chairperson Krum reported we received a $75,000.00 grant !Tom the state for Diesel Exhaust Systems in both Fire Houses that are just about completed and a couple of career guys went to New Brunswick and volunteered their time working the Fire House while thcir firemen attended the funeral of a fireman. Progress. PARKS & RECREATION/SHADE TREE - Committee Chairperson Rios reported they are replacing the valve at the Carteret Pond and he was glad to see that a resolution was passed for its restoration. He reported that Ethnic Day was a complete success. He reminded everyone that on Saturday, September lith, there will be a Memorial Service at the World Trade Center Monument Area in Carteret Park at 7:00 P.M. and also that this coming Friday will be the final performance of the Concerts in the Park. He reported continuing Progress in the Parks. POLICE - Committee Chairperson Sitarz reported that the Carteret Police Department was represented at Ethnic Day and they set up booths representing our Dare Unit, which was their Neighborhood Watch Program and 911 Dispatchers and Domestic Violence Programs. He informed us that the Police Department has received a grant from the New Jersey Division of Motor Vehicles in the amount of $5, 621.00. The money represents a portion of the Court Fines imposed for issuance of overdue motor vehicle inspection tickets. This money will be used to purchase new equipment in the department. He went on to report that we had just purchased three (3) ntW police cars and they are being outfitted with the latest technology in police equipment. He said thcre will be warning II SEPTI'MBER 9, 2004 Conmittees Cont: tickets given out to eighteen (18) wheeler trucks parked on Borough streets. PUBLIC WORKS: Committee Chairperson Sosnowski reported that the Streets and Roads Department did a repair in the High School parking lot and they are also power washing and setting up some bait cables on the dock. The police cars are being serviced by the Borough Garage. They are doing tire inspections and replacing the bad tires. Preparation on the snow equipment is being started and they are doing some work in the Sewer Department, cleaning the catch basins in the Hill Section and putting on some guards in the catch basins to Parkview and Shorecrest. Parks. Progress. BOARD OF EDUCATION: The liaison Councilmember Parisi reported all is well and the first football game is Friday night. Mayor Reiman Mayor Reiman then spoke. He reported that we had our 29th Ethnic Day last Saturday and his second Charity Carnival, of which they made over $10,000.00 to support the charities in Carteret and have already given out over $43,000.00 in the last two (2) years. He then thanked and congratulated the volunteers and residents that had participated. He then went on to say they had gone out to bid on the Borough Hall Project and they anticipate the bids to come back on September 14th and may be awarding the bids on September 22nd, saying it would all depend on the [unding. He explained that we had just recently completed two (2) grant applications requesting an additional 1.2 million dollars in county and state funding in the Borough Hall Project and to date we have roughly 2.2. million dollars of which a little more than 55% has come from various grants and corporate donations. They have a $449,000.00 grant for the elevator from the State of New Jersey. He went on to say that this evening the Council rejected the bids for the Façade Program for Washington Avenue because there was only two (2) bids and they were higher than the estimates, so we will go out for new bids.
