Reiman approximately 7:00 P.M. on Thursday, October 7, 2004, Municipal Court/Police Facility, 230 Roosevelt Avenue, Carteret, New Jersey. Upon individual roll call, the following were noted present: ROLL CALL Councilmember Randy Krum " Susan Naples " Frank Parisi " Ronald Rios " Joseph Sitarz " Brian Sosnowski Noted absent was Borough Attorney, Robert J. Bergen, Esq. NOTED ABSENT Mayor Reiman said Borough Attorney Robert J. Bergen was noted mMMENTS absent because of the death of his father; Robert Roesener from Windels, Marx, Lane and Mittendorf would be representing him. The meeting was opened with a moment of Silent Prayer and The PRAYER, PLEDGE Pledge of Allegiance led by Mayor Daniel J. Reiman. OF ALLEGIANCE The Clerk stated that on January 6, 2004, the 2004 Annual Meeting STATEMENT OF Notice was published in The Home News Tribune, The Star-Ledger MEETING NOTICE and posted on the bulletin board. Upon MMS&C, by Councilmembers Rios and Sitarz unanimous APPROVAL OF affirmative vote of the full membership present, the minutes of MINUTES September 9 & 23, 2004 were approved as transcribed and engrossed by the Clerk. The Clerk stated Ordinance #04-27 was introduced and passed upon ORDINANCE # 04-27 First Reading at a Regular Meeting of the Borough Council held on AMENDING SALARY September 9, 2004. It was duly published in the Home News Tribune ORDINANCE #71-9, on September 13,2004 with notice that it will be considered for final RE: EMS passage after Public Hearing to be held on October 7, 2004 at approximately 7:00 P.M. Upon MMS&C, by Councilmembers Rios and Sitarz ORDINANCE #04-29 BOND ORDINANCE #04-29 IN FULL "ORDINANCE APPROPRIATING $150,000.00 FROM THE CAPITAL IMPROVEMENT FUND FOR THE WATERFRONT PHASE II PROJECT IN AND BY THE BOROUGH OF CARTERET, IN THE COUNTY OF MIDDLESEX, NEW JERSEY" BE IT ORDAINED BY THE BOROUGH COUNCIL OF THE BOROUGH OF CARTERET, IN THE COUNTY OF MIDDLESEX, NEW JERSEY AS FOLLOWS: Section I. $150,000.00 is hereby appropriated from the Capital Improvement Fund for the improvements and/or development of a Green Acres Recreation area to include Waterfront Park Phase II improvements, including the installation of a new floating dock, fixed timber platform and gangway system on the northern side of Veteran's Memorial Pier, including all work and materials necessary therefore and incidental thereto in and by the Borough of Carteret, in the County of Middlesex, New Jersey. The Borough will receive $150,000.00 from the County Open Space, Recreation and Farmland and Historic Preservation Trust Fund. Section 2. The capital budget of the Borough of Carteret is hereby amended to conform with the provisions of this Ordinance to the extent of any inconsistency herewith. The Resolution in the form promulgated by the Local Finance Board showing full detail of the amended capital budget and capital program as approved by the Director of the Division of Local Government Services is on file with the Clerk and is available there for public inspection. Section 3. This Ordinance shall take effect as provided by the law. was finally adopted. Upon MMS&C, by Councilmembers Rios and Sitarz ORDINANCE #04-30 BOND ORDINANCE "BOND ORDINANCE AMENDING BOND ORDINANCE #95-16 # 04-30 IN FULL OF THE BOROUGH OF CARTERET, IN THE COUNTY OF MIDDLESEX, NEW JERSEY FINALLY ADOPTED APRIL 6, 1995 IN ORDER TO AMEND THE DESCRIPTION OF THE PROJECT" BE IT ORDAINED BY THE BOROUGH COUNCIL OF THE BOROUGH OF CARTERET, IN THE COUNTY OF MIDDLESEX, NEW JERSEY (not less than two-thirds of all members thereof affirmatively concurring) AS FOLLOWS: Section One. Section 3(b) of Bond Ordinance #95-16 of the Borough of Carteret finally adopted April 6, 1995 is hereby amended to read as follows: .. \ 4 OCTOBER 7, 2004 \ .. (b) Construction of an addition to and the renovation of the existing BOND ORDINANCE health building and parks department building in the Borough, # 04-30 IN FULL including acquisition and installation of equipment and furnishings and (Continued) all work necessary therefore or incidental thereto. A copy of each Resolution was placed on the table for public review MEETING OPENED prior to the meeting in accordance with the Rules of Council and upon PUBLIC INPUT ON MMS&C, by Councilmembers Sitarz and Rios and unanimous ALL RESOLUTIONS affirmative vote of the full membership present, the meeting was opened for public input on all Resolutions/Agenda items and any new business. Mr. Rosanski explained that the bushes planted on Washington CDMMENTS Avenue by the shopping center for the Streetscape Project are dangerous. Mayor Reiman said the Clerk would make a note of it and speak to the engmeer. Mr. Rosanski asked if there was a problem finishing the Streetscape Project from Washington Avenue to Louis Street because they ran out of money. 5 OCTOBER 7, 2004 I ~... PUBLI C DISCUSSION Mayor Reiman said we are doing it all and explained it will done in (Continued) several phases. He said the project is funded, there is plenty of money in the project and it will be complete this year. Mr. Rosanski asked if Leibig Lane was going to be made a one way. Mayor Reiman said it is a good possibility. Mr. Rosanski asked about the OEM building. Mayor Reiman said the Council awarded a contract for renovations to the OEM building at the last meeting, the inside has been cleaned out and they have to start construction. Marion Smeal, 2 Washington Avenue spoke about the work being done on Washington Avenue she said she was told they were not going to do work by the guardrail. Mayor Reiman said they would be doing it and he would speak to the contractor. Councilmember Sitarz said Streets and Roads took the guardrail down today they may have been waiting for that before continuing. Mayor Reiman briefly explained about safety issues. He said Ms. Smeal should give the Borough Clerk her phone number so someone could get back to her. Len Scheno, 280 Washington Avenue thanked the Mayor and Council for the Senior Rebate on behalf of all the seniors. Mayor Reiman said this is the first and only Senior Rebate in the state and hoped they would be able to continue this. Councilmember Naples said the multiple disabled class from the high school helped fold and stuff the envelopes. Mrs. Gaydos, Hermann Street couldn't flush her toilet for twelve hours because of the hurricane. Mayor Reiman explained why this might have happened. Mrs. Gaydos spoke about the hotel project and the houses being built on Clauss Street. Mayor Reiman said he felt the hotel was a fantastic project and they paid two hundred thousand dollars into the sewer system which is a separate sewer system that will not impact her side of West Carteret. He said the houses on Clauss Street that were approved a few years ago and went through a legal battle will have a minimal impact on the sewer system on her side. Mrs. Gaydos said houses are being built by contractors to make money and not built by people who want to live here. She said she felt they were crowding in houses. .. \ 6 OCTOBER 7,2004 \ .. Mayor Reiman said ninety percent of the houses are being built by PUBLIC DISCUSSION contractors to sell. (Continued) Mrs. Gaydos asked ifhe felt it was fair. Mayor Reiman said she should go to the Zoning Board meetings. Mrs. Gaydos said she went to the Zoning Board and was laughed at and was told by the man in charge she should sit down. Mayor Reiman said at the Zoning and Planning Board meetings you can only speak about a specific site plan or a specific variance you can not go there to speak about any issue. Sue Gaydos, Mrs. Gaydos's daughter said she was told if she did not like the results she should go to Superior Court. Mayor Reiman said the Council is considering an Ordinance to ban new duplexes or two family houses in Carteret. He said they are gathering information and hoped to take action in the near future. Mrs. Gaydos asked about Resolution #04-305 for T &M Associates. She wanted to know why they are getting $50,000.00 for a booklet. Mayor Reiman explained and said it was done incorrectly. He said it is for preparation of the bid documentation concerning problems with the Hill Street and West Carteret Sanitary Sewer System. Marion Smeal asked if there was an Ordinance for the size of the land according to the building. Mayor Reiman said we have section Chapter 160 which oversees all land use and development in the Borough and he explained. The Zoning and Planning Board under state law can give any kind of variance if there is a hardship. He said he implores the residents to go to the meetings since the Council has no jurisdiction over Zoning and Planning. He said he felt it was better to have a side by side duplex than a top and bottom two family and said he felt they are better off with single family homes rather than two family homes at all. Joel Reuter, 68 Marion Street thanked the Mayor and Council on behalf of all his neighbors for the letters and road work on Marion Street. Mayor Reiman explained that Resolution #04-306 was appropriating the money for this and they will start construction in the spring of next year. Sue Gaydos said there is new company in West Carteret which was operating on Hermann Street and asked if they could put a sign that reads no trucks and paint lines. Mayor Reiman said Councilmember Sitarz would check with the traffic division. Councilmember Sitarz said he thought it might be in Woodbridge. 7 OCTOBER 7, 2004 I PUBLI C DISCUSSION Mayor Reiman asked which side. (Continued) Ms. Gaydos said by the car wash. Councilmember Sitarz said it is in Carteret. Councilmember Rios said the Mayor, Council and Borough Attorney are reviewing having weight limits in neighborhoods with vehicles. Councilmember Krum said he had complaints that vehicles are not making the left turn they are going straight coming into West Carteret off the bridge. Councilmember Sitarz said that is for the county to paint. Mayor Reiman asked Borough Clerk Kathleen Barney which Resolutions needed to be added. Borough Clerk explained. Mayor Reiman asked for a motion to amend the Agenda to add the two Resolutions. MOTION TO AMEND Upon MMS&C, by Councilmembers Rios and Sitarz and unanimous AGENDA, RE: TWO affirmative vote of the full membership present a motion was made to RESOLUTIONS ADDED amend the Agenda to include Resolutions #04-316 and #04-317. MEETING CLOSED There being no further comments or objections to the Resolutions, Mayor Reiman declared the Public Hearing to be closed, upon MMS&C, by Councilmembers Rios and Sitarz and unanimous affirmative vote of the full membership present. CDNSENT AGENDA The Borough Clerk asked if any Councilmembers had any objections on the Consent Agenda and asked for a motion. Upon MMS&C, by Councilmembers Rios and Sitarz and unanimous affirmative vote of the full membership present, Resolutions #04-297 to #04-317 were approved. .. \ 8 OCTOBER 7, 2004 \ .. STANDING BUILDINGS & GROUNDS: Committee Chairperson Naples thanked CDMMITTEES the Buildings and Grounds staff who wired the Community Center and Library for the temporary relocation of some Borough Offices. She said bids were rejected and would be rebid in two weeks for Borough Hall. She explained that the Borough has applied for a Cultural Heritage Grant from the County for Borough Hall renovations. She said they have also applied for a $200,000.00 grant from the Department of Community Affairs. FINANCE & ADMINISTRATION: Committee Chairperson Parisi said the Senior Sewer Rebate checks have been sent out. He spoke about the tax sale; collected $110,000.00 in outstanding taxes was collected from sixty five properties. FIRE: Committee Chairperson Krum spoke about the Open House that will be held on October 9th at Fire Headquarters and explained. He said everyone should attend. He reported progress. .. \ 16 OCTOBER 7, 2004 \ .. POLICE: Committee Chairperson Sitarz said Police Officer Robert STANDING Spolizino retired on October I, 2004. He spoke about the eleven CDMMITTEES county residents that were trained for the Police Domestic Response Team. He said the Neighborhood Watch Program would be held on October 13th and the topic would be DWI. He spoke about the Click- It-Or-Ticket Program and said Carteret was in the top four towns of the county. He reported progress. PUBLIC WORKS: Committee Chairperson Sosnowski said Streets & Roads has been patching potholes. He said the street sweepers have been out everyday; weeds have been removed and plants and shrubs have been planted around the firehouse. He said the Leaf Program for pick-up of leaves starts on the 23rd and recycling bags are available and explained the program. He said the Sewer Department is cleaning out catch basins and did some work washing the fishing pier down. He said they are installing guards on the catch basins. He said the Mayor and Council approved the purchase of a new garbage truck for the Recycling Department. He reported progress. BOARD OF EDUCATION: Committee Chairperson Naples October 12th and October 19th there would be a Superintendant's Forum she explained the topics. She spoke about the state mandated School Violence Week which will be held October 18 through the 31 is School Violence Awareness/ Red Ribbon Week. She said the Human Relations Committee is having a program on Bias Crimes and Harassment on October 21" at Carteret High SchooL She commended Councilmember Rios and Chairwoman Alexandra Lopez on the job the Human Relations does in the community. Mayor Reiman read the following proclamation: PROCLAMATION SPINAL HEALTH MONTH SPINAL HEALTH MONTH WHEREAS, 80 percent of Americans will suffer from back pain at some point in their lives; and WHEREAS, the majority of school-age children carry backpack loads that are too heavy for their developing bodies; and WHEREAS, overweight backpacks have been contributing to spinal problems in children; and 17 I OCTOBER 7, 2004 , PROCLAMATION SPINAL HEALTH WHEREAS, spinal health IS essential to proper growth and MONTH (Continued) development; and WHEREAS, chiropractic examination can reveal spinal problems; and WHEREAS, good spinal health makes it possible for all the organs in the body to function efficiently; and WHEREAS, every individual should be made aware of the benefits of spinal health; NOW THEREFORE, BE IT RESOLVED, that the Borough of Carteret in the state of New Jersey officially joins with the New Jersey Chiropractic Association in proclaiming the month of October as Spinal Health Month, and urges that this month be dedicated to informing citizens of the great Borough ofCarteret in the state of New Jersey of the health benefits of spinal health and the dangers of overweight backpacks. ORDINANCE # 04-28 The Clerk stated Ordinance #04-28 was introduced and passed upon ADOPTING First Reading at a Regular Meeting of the Borough Council held on REDEVELOPMENT September 2, 2004. It was duly published in the Home News Tribune PLAN-CARTERET on September 16, 2004 with notice that it will be considered for final LANDFILL passage after Public Hearing to be held on October 7, 2004 at RECLAMATION approximately 7:00 P.M. The Ordinance was posted on the bulletin IMPROVEMENT DISTRICT board and copies were made available to the general public and according to law, she read the Ordinance by title. PUBLIC HEARING Upon MMS&C, by Councilmembers Sitarz and Rios and unanimous affirmative vote of the full membership present, the Mayor declared the Public Hearing to be open: CDMMENTS Mayor Reiman explained the Landfill Reclamation Ordinance. Sue Gaydos asked if the public would be able to see a picture of this area. Mayor Reiman said they have seen a picture of the area, he explained this has been going on for three years. Unidentified voice asked if this was Daumann. Mayor Reiman said yes. Resident from Marion Street asked if anyone was interested in opening up a business in this area. Mayor Reiman said he had a significant interest and briefly explained.
