COUNCIL MINUTES
ADJOURNED MEETING
AUGUST 11, 1970
INITIATION:
1. Mayor Merritt called the adjourned meeting of the City Council
to order at 7:40 p.m.
2. The invocation was given by the Reverend Ian Holland, St. Luke's
Catholic Church, 9451 Broadway, Temple City.
3. The Pledge of Allegiance to the Flag was led by Mayor Merritt.
4. ROLL CALL:
PRESENT: Councilmen- Briggs, Gilbertson, Harker, Tyrell, Merritt
ABSENT: Councilmen -none
ALSO PRESENT: City Manager Koski, City Attorney Martin, Planning
Director Dragicevich, Traffic Engineer Envall
5. APPROVAL OF MINUTES:
It was noted by Councilman Gilbertson, that in the adjourned
portion of the minutes of the meeting of July 21, 1970, the motion
to offer $12,500 for purchase of Live Oak Park addition should be
corrected to read that Councilman Tyrell made the motion, seconded
by Councilman Gilbertson. Councilman Tyrell moved to approve the
minutes as corrected, seconded by Councilman Harker and unanimously
carried.
UNFINISHED BUSINESS:
6. PUBLIC HEARING: 7:30 p.m. Re. Change of Zone from R -1 to M -1,
Leroy Miller, 9352 E. Lower Azusa Road, owner.
City Manager Koski advised that the matter of zone change from R -1
to M -1 for property at 9352 E. Lower Azusa Road had been before
the Planning Commission on July 14, 1970, and that the Planning
Commission had unanimously passed Resolution No. 70 -382PC recommend-
ing approval of the change of zone. Planning Director Dragicevich
presented background information, advising that it had become
apparent that technical errors had occurred in the preparation and
adoption of the City zoning map, and that this was the only parcel
zoned R -1 westerly of Miller Drive, and that two parcels adjacent
to the property are zoned M -1. He advised that it was recommended
that the property be zoned M -1 because: 1) everything else adjacent
to the property, westerly of Miller Drive, is zoned M -1, and to the
south of the property it is zoned M -2, and 2) that the preliminary
general plan indicates the entire area south of Lower Azusa as
potential use for industrial development in the future.
Mayor Merritt declared the public hearing open and invited those
in favor of the zone change to come forward.
Leroy Miller, 9352 Lower Azusa Road, Temple City, owner of the
property, spoke in behalf of the zone change, advising that at the
time he had purchased the property in 1964 he was under the
assumption that the property was M -1, along with the other two pieces
of property. He advised that the property was presently being used as
R -1 in that it contained his residence, however that he felt the
error should be corrected.
Roy Holton, 9334 Lower Azusa, advised that he owned the property
adjoining Mr. Miller's, and that he concurred in the finding that
a mistake had been made in the zoning of the property in 1964, which
mistake should be officially recognized and corrected.

No one else came forward to speak in favor of the matter. Mayor
Merritt invited those present who wished to speak against the
matter to come forward.
Don Moyers, 4808 N. Alessandro, stated that he opposed the checker-
board rezoning concept and preferred to wait until the master plan
was completed. He stated that it appeared that the matter was a
convenient mistake and that now that Miller Drive exists, the line
is being changed. It was explained to Mr. Moyers that Miller Drive
had previously existed as a private street, and that it had been
acquired by the City as a result of a tax sale; further, that the
development of the street had been paid for by Mr. Miller. Mr.
Moyers stated that it was his understanding that the zoning in the
area had been inherited by Temple City, which was noted by Council-
man 3riggs as a statement not confirmed by fact, that hearings had
been held on the matter prior to the adoption of the zoning ordinance
by the City.
Gary Barker, 4827 N. Alessandro, opposed the zone change since he
believed properties north of Lower Azusa would devaluate and be
put up for sale because Mr. Miller has not indicated what is going
to be put on the property.
Frank Newman, 4826 N. Alessandro, was concerned as to what would be
put on the property.
J. P. Rogers, 9361 Lower Azusa Road, stated that he felt this zone
change would devalue the properties in the area unless the other
side of Lower Azusa, where he resided, was also rezoned. It was
explained to Mr. Rogers that this would present a greater problem
to the residential area to the north where there was no buffer of
any kind, whereas presently Lower Azusa Road provided a buffer
between the two zones.
Raymond Guthrie, 4802 Alessandro, advised that he had purchased his
property assuming that the Miller property was R -1, and thought it
should remain as such until the whole street was rezoned.
No one else came forward to speak. Councilman Gilbertson moved to
close the public hearing, seconded by Councilman Tyrell and unanimously
carried.
In Council discussion on the matter, it was noted that the alleged
error had been brought to the attention of the City staff in 1968,
and that much research had been made into the matter since that
time by the staff and the Planning Commission; that at the time of
the hearings before the City Council in 1964 for the total area, that
it. was planned that the access street was to be a buffer zone to
separate R -1 from M -1; that the planning consultants working with
the. City at that time had recommended .a buffer zone; that it was
apparent that an error had been made; and that as a matter of
proper zoning a change from R -1 to M -1 is justified.. Councilman Gil -
bertson moved to approve the recommendation of the Planning Commission
and to instruct the City Attorney to prepare an ordinance amending
the Temple City Municipal Code by changing the zone from R -1 to M -1
for the subject property. The motion was seconded by Councilman
Harker and carried by the following roll call vote:

7. ORDINANCE No. 70 -309: 2nd read. Re. Amendment to Temple City
Municipal Code Relating to Personnel.
City Attorney Martin presented Ordinance No. 70-309 entitled AN
ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTIONS 2302 and
2368 OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO PERSONNEL, for
second reading by title only, and adoption. Councilman Tyrell
moved to waive further reading and adopt, seconded by Councilman
Gilbertson and unanimously carried.

NEW BUSINESS:
8. REQUEST FOR MODIFICATION OF ZONE VARIANCE GRANTED BY RESOLUTION
No. 69 -929, adopted July 1, 1969 (ZV Case No. 69 -283)
City Manager Koski advised that a request had been received for
modification of zone variance granted by the City Council by Resol-
ution No. 69 -929, in that plot plans and exhibits did not show
the location and number of signs relating to existing and proposed
use of convalescent hospital complex in an R -1 zone. Councilman
Harker moved to set public hearing for Tuesday, September 1, 1970,
at 7:30 p.m. in the Council Chambers of the City Hall, seconded
by Councilman Briggs and unanimously carried.
9. RESOLUTION NO. 70 -1032: Vacation of Alley, north of Las Tunas,
Cloverly to Oak.
City Manager Koski advised that Gino's, Inc. had recently submitted
plans to construct a restaurant on the northeast corner of Las Tunas
Drive and Oak Avenue, and that vacation of the alley would provide
better utilization of the property adjacent to the subject alley.
Property owners abutting the alley had been approached and were
interested in the vacation of same, and that Resolution No. 70 -1032
had been prepared to provide for public hearing on the matter, to
be set for September 1, 1970, at 7:30 p.m. in the Council Chambers
of the City Hall. Councilman Tyrell moved to adopt Resolution
No. 70 -1032 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TEMPLE CITY, CALIFORNIA, DECLARING ITS INTENTION TO VACATE THAT
CERTAIN ALLEY LOCATED NORTHERLY OF LAS TUNAS DRIVE RUNNING BETWEEN
CLOVERLY AVENUE AND OAK AVENUE IN SAID CITY, AND FIXING A TIME AND
PLACE FOR HEARING OBJECTIONS TO THE PROPOSED VACATION, seconded by
Councilman Briggs and unanimously carried.
10. RECOMMENDATIONS FROM TRAFFIC COMMISSION - Meeting of August 5, 1970.
A. EL MONTE AVENUE: LOWER AZUSA ROAD TO LIVE OAK - Crosswalk
Markings and Speed Limit Signs.
Traffic Engineer Envall advised that the Traffic Commission
recommended the placement of white pedestrian crosswalk across
El Monte Avenue at the north line of Olive Street, and two
additional 35 miles per hour speed limit signs on El Monte Avenue
north and south of Freer Street for additional safety. It was
moved by Councilman Gilbertson, seconded by Councilman Briggs and
unanimously carried to accept the recommendation of the Traffic
Commission to provide the additional regulations.
B. LA ROSA DRIVE AT ARDEN - Additional Regulations.
Traffic Engineer Envall advised that the Traffic Commission
recommended: 1)placing 100 feet of double centerline striping on
Arden Drive at the north and south approaches to La Rosa Drive,
2) placing 150 feet of double centerline striping on La Rosa
Drive westerly of Arden Drive, 3) placement of "Stop Ahead"
pavement markings on La Rosa Drive in conjunction with existing
stop sign, and 4) placement of intersection signs on both sides
of Arden Drive in advance of La Rosa Drive in order to provide
additional warning to motorists approaching this intersection.
Councilman Briggs moved to approve as recommended, seconded by
Councilman Gilbertson and unanimously carried.
C. ROSEMEAD BOULEVARD - Removal of Joggle Bars
Traffic Engineer Envall advised that the State Division of Highways
had made an oral request for permission to remove joggle bars in the
median island which are creating a problem in cleaning. The joggle
bars fall somewhat short of providing a traffic barrier and are not
proving practical because of the maintenance problem. Council con-
curred that there was no objection to permitting their removal and
it was moved by Councilman Briggs, seconded by Councilman Harker and
unanimously carried that permission be granted as requested.

D. LAS TUNAS DRIVE - Rosemead to Muscatel - Modification of
Marked Parking.
Traffic Engineer Envall advised that in reviewing a request for
short -time parking in front of Bank of America, further study
indicated that marked parking on both sides of Las Tunas Drive
from Rosemead Boulevard to Muscatel Avenue would better utilize
curb space in the area, and recommended that marked stalls be
placed on the north side of Las Tunas Drive, from Rosemead
Boulevard to Muscatel Avenue, and on the south side of Las Tunas
Drive from Muscatel Avenue to the Eaton Wash Bridge. Council dis-
cussed the additional costs that would be necessitated for install-
ation and maintenance if the additional markings were approved,
and questioned whether it would be practical to undertake this
additional work. Councilman Briggs moved to deny the request,
seconded by Councilman Harker and the motion was defeated by the
following roll call vote:

NOES: Councilmen - Gilbertson, Tyrell, Merritt
Councilman Tyrell moved to approve a modification of the recommend-
ation to provide for three marked parking spaces on the north side
of Las Tunas Drive, between Rosemead and Reno in front of the Bank
of. America, with two spaces separ -Dted from the third space by red
curb markings. The motion was seconded by Councilman Gilbertson
and carried by the following roll call vote:

NOES: Councilmen - Briggs, Harker
11. ORDINANCE No. 70 -310: 1st read.. Re. Revision to Municipal Code
Relating to Terms of Commissioners:
City Attorney Martin presented Ordinance No. 70 -310, entitled
AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTION 2715.1
OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO COMMISSIONS, for
first reading, advising that this would bring the terms of all
Commissioners to a single expiration date to provide uniformity.
Councilman Tyrell moved to waive further reading, seconded by
Mayor Merritt and unanimously carried.
12. REFUND OF DEPOSITS FROM FIREWORKS STANDS:
City Manager Koski advised that all fireworks stands had now
been cleared by both the Fire Department and Building Department
pursuant to requirements of Ordinance No. 61 -37, and that eleven
organizations were eligible to receive refunds of deposits as
outlined in memorandum dated July 31, 1970 to the City Council.
Councilman Harker moved to approve and to authorize the drawing
of warrants, seconded by Councilman Gilbertson and unanimously
carried.
13. PERSONNEL APPOINTMENTS: RESOLUTION NOS,70 -1033 AND 70 -1034.
City Manager Koski presented Resolution No. 70 -1033 entitled
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
APPOINTING TEMPORARY PERSONNEL. Councilman Tyrell moved to
adopt, seconded by Councilman Gilbertson and unanimously carried.
City Manager Koski presented Resolution No. 70 -1034 entitled
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
APPOINTING PERSONNEL. Councilman Gilbertson moved to adopt,
seconded by Councilman Briggs and unanimously carried.

14. PART -TIME RECREATION SALARIES:
City Manager Koski advised that existing part -time Recreation
Leader's salary schedule has been in existence since the formation
of the Recreation Department in 1961, and recommended an hourly
increase proposal on five -step plan for this position, with
increase scheduled after the first 500 hours and thereafter each
succeeding 500 hours to maximum step, on merit basis, and a flat
hourly rate schedule for Recreation Helper, as outlined in
memorandum of August 7, 1970, to the City Council. Councilman
Briggs moved to approve as recommended, and to appropriate
additional funds in the amount of $600 from the General Fund and
amend the adopted budget accordingly. The motion was seconded
by Councilman Gilbertson and unanimously carried.
15. RESOLUTION No. 70 -1036: Setting Tax Rate (no City Tax) for
Fiscal Year 1970 -71.
City Manager Koski presented Resolution No. 70 -1036 entitled A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY INDICATING
NO CITY TAX RATE FOR FISCAL YEAR 1970 -71. Councilman Tyrell moved
to adopt, seconded by Councilman Harker and unanimously carried.
16. RESOLUTION No. 70 -1037: Setting Tax Rate for Temple City
Municipal Lighting District for Fiscal Year 1970 -71.
City Manager Koski presented Resolution No. 70 -1037 entitled
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
LEVYING A SPECIAL ASSESSMENT TAX WITHIN THE TEMPLE CITY MUNICIPAL
LIGHTING DISTRICT FOR THE FISCAL YEAR 1970 -71. Councilman Tyrell
moved to adopt, seconded by Councilman Briggs and unanimously
carried.
17. RESOLUTION No. 70 -1035: Warrants & Demands, Demand Nos. 2589 -2738
in the amount of $113,006.73
Councilman Tyrell moved to adopt Resolution No. 70 -1035 entitled
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $113,006.73, DEMAND
NOS. 2589 thru 2738, seconded by Councilman Briggs and unanimously
carried.
18. COMMISSION APPOINTMENTS:
Councilman Tyrell moved to confirm the appointments to the
Traffic Commission of Keith Corzine, Richard Sale and William
Cole, for two -year terms to 1972, seconded by Councilman Gilbertson
and unanimously carried.
19.. COMMUNICATIONS:
There were none.
20. TIME FOR THOSE IN AUDIENCE WHO WISH TO SPEAK:
Leroy Miller and Roy Holton, who spoke previously in the
meeting relative to Item 6, expressed appreciation to the
Council in correcting the mistake in zoning property adjacent
to Miller Lane, south of Lower Azusa Road.
21. MATTERS FROM CITY OFFICIALS:
A. Councilman Harker advised that he had attended the League of
California Cities meeting held on August 6, 1970, at which time
City of Temple City Resolution No. 70 -1031B entitled A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY OPPOSING COUNTY-
WIDE CONSOLIDATION OF PARKS AND RECREATION FACILITIES was an
agenda item, and that a report was given advising that the County
Parks & Recreation Department was not interested in merging City
Park Departments, that their interest in assisting cities with
regional parks of 50 acres or more had been misunderstood.

B. Councilman Tyrell advised that parking in front of Foreign
Motor Service appeared to be excessive. Staff was directed to
check into the matter and advise.
C. City Manager Koski reported that repair of the S.P.R.R. tracks
at Temple City Boulevard crossing was scheduled as the next job
to be undertaken by S.P.R.R. crews, on their completion of work
at Peck Road and S.P.R.R, within the next three to four days.
D. City Manager Koski advised that a request for anti- litter
sign on Agnes at Las Tunas Drive had been referred to the
Council by the Traffic Commission. Council concurred with
staff recommendation that litter was minimal at the location,
and that the area was being properly maintained, making signs
unnecessary; and that use of signs may be disturbing to
residents.
E. City Manager Koski presented an estimate from Krelle and Lewis,
Engineers, for additional work for newly acquired property at
5563 Gracewood, Live Oak Park addition, in the amount of
$1,486.54, for sprinkler and landscaping project currently in
process. Councilman Tyrell moved to authorize the additional
work as outlined by the City Manager, seconded by Mayor Merritt
and unanimously carried.
22. ADJOURNMENT:
Councilman Tyrell moved to adjourn to a study session, seconded
by Councilman Gilbertson and unanimously carried. The meeting
adjourned at 9:20 p.m.
Next regular meeting of the City Council will be held on Tuesday
September 1, 1970, at 7:30 p.m. in the Council Chambers of the
City Hall.
