AN ORDINANCE OF THE VILLAGE OF KEY BISCAYNE,
FLORIDA, ADOPTING THE ZONING MAP AS REQUIRED
BY THE LAND DEVELOPMENT REGULATIONS;
PROVIDING FOR REZONING OF ALL PROPERTY IN THE
VILLAGE OF KEY BISCAYNE IN CONFORMANCE WITH
THE ZONING DESIGNATIONS CONTAINED ON THE
ZONING MAP; PROVIDING FOR INCLUSION IN THE
CODE AND AN EFFECTIVE DATE.
WHEREAS, the Village's Land Development Regulations require the preparation of an
official zoning map to implement the Land Development Regulations; and
WHEREAS, the Village has held numerous Workshop Meetings and obtained extensive
input and participation by the public through these meetings; and
WHEREAS, a new zoning map has been prepared by the Director of Building, Zoning and
Planning for the proper preservation of the public peace, health, safety, and welfare of the Village;
and
WHEREAS, the Village Council, sitting as the Local Planning Agency, has held a public
hearing upon the Zoning Map and has recommended adoption of the Zoning Map to the Village
Council; and
WHEREAS, the Village Council has held public hearings upon the adoption of the Land
Development Regulations pursuant to this Ordinance; and
WHEREAS, in accordance with the Village's procedures and Section 166.041, Fla. Stat.,
public notice has been given of the public hearings for the proposed passage of this Ordinance
adopting the Zoning Map as required by the Land Development Regulations.
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS:
Section 1. Recitals Adopted. That the recitals set forth above are hereby adopted and
incorporated herein.
Section 2. Adoption of Zoning Map. That the Zoning Map attached as Exhibit "A" is
adopted as the official zoning map of the Village of Key Biscayne, and that all property within the
Village is hereby rezoned in accordance with the Zoning Map.

Section 3. Repeal of Zoning Map and Designations. That the Zoning Map that was
adopted by the Village Charter (the Miami -Dade County Zoning Map), along with any amendments
thereto, is hereby repealed and replaced as of the effective date of this Ordinance.
Section 4. Conflicts. That all ordinances and parts of ordinance in conflict herewith are
hereby repealed insofar as they are inconsistent or in conflict with the provisions of this ordinance
or the Land Development Regulations, and the Land Development Regulations shall replace the
provisions of the Miami -Dade County Zoning Code to the fullest extent allowed by law. However,
the repeal of ordinances and the replacement of the Miami -Dade County Zoning Code shall not
affect any offense or act committed or done or any penalty or forfeiture incurred, or any contract or
right established or accruing before the effective date of this ordinance.
Section 5. Effective Date. That this ordinance shall be in full force and effect on the date
of passage and adoption.
