water company. He asked that the members be cognizant -
o£ the fact that at some future time we may have to put
in an additional water line and advised that the Town
of Bay Harbor Islands has employed engineers to try and
find another source of water, perhaps from North Miami.
Mr. Hart asked the Village Attorney to prepare the
proper resolutions for the retiring Councilmen and thanked
them for their time and efforts in the past.
Mr. Faulkner advised of a letter and resolution
received from Mayor Robert King High regardingtthe
Dupont interests in Florida and asked for an expression
from the members on this matter. Mr. Landis moved that
the matter be given further study. Motion seconded by
Mr. Faulkner and unanimously voted.
Mr. White moved to adjourn. Motion seconded by
Mr. Faulkner and unanimously voted.

Mayor
The Council of Bal Harbour Village met at 9:30 A. M.
Saturday, May 29, 1965 at the Village Hall.
Present: Messrs: Faulkner, Hart and Taplin.
Absent: Messrs: Landis and White.
Also present were W. H. Webb, Village Manager; Mary
T. Wetterer, Village Clerk; and Thomas H. Anderson, Village
Attorney.
Upon motion of Mr. Taplin, seconded by Mr. Faulkner
and unanimously voted, the minutes of the previous meeting
of April 19, 1965 were approved as submitted, without being
read.

Mr. Webb reported that he, Mr. Anderson and several of
our Councilmen appeared before the Dade County Commission
meeting nn May 4th and appealed to the Commission for a county
appropriation to provide annual beach nourishment in Ba.l Har-
bour. The County Commission agreed to have the County Manager,
Mr. Porter Homer, check into the matter and see if an amount
could be appropriated in the new budget on October 1, 7965.
Mr. Webb further advised that he had written Mr. Homer for
an appointment, but as of this date nn reply had been received.
Mr. Anderson reported that pursuant to the authorization
by the Village Council, the transaction with Mrs; Gifford for
the purchase of Lots 1 and 2, Block 1. Residential Section
of Bel Harbour has been practically completed. The mortgage
and note have been executed, a cheek drawn for $24,680.65
representin,* the balance down. and the dent will he closed on
.Tune 1, 1965.

were read to the members. Mr. Faulkner moved to adopt Resolu-
tion No. 126 and Resolution Nn. 127. Motion seconded by Mr.
Taplin and unanimously adopted.
Unon motion of Mr. Faulkner, seconded by Mr. Taplin and
unanimously voted, the signature of the Mayor or the Village
Manager was approved for bank accounts and safety deposit box
at the Community National Bank & Trust Company and Chase Fed-
eral Savings & Loan Association.
The six months audit was then presented to the members
and after consideration, on motion of Mr. Fnnikner, seconded
by Mr. Taplin and unanimously voted, the audit was accepted
as presented.
The Village Manager informed the members that upon un-
animous votes of both the Police and Fire Departments, the
members elected two men from each department to serve as
Trustees for the Police Retirement Fund and the Fire Depart-
ment Pension Fund and asked the Council for confirmation of
these appointments. Mr. Faulkner moved to accept the appoint-
ments of Benton F. Chambers and Alan P. Harold as Trustees
for the Police Officers' Retirement Fund and John R. Flood
and John Taaffe as Trustees for the Firemen's Pension Trust
Fund. Motion seconded by Mr. Taplin and unanimously voted.

requesting the Florida State Legislature to give full con-
sideration to the critical beach preservation needs and act
favorably on Senate Bill No. 380 and House Bill No. 1028.
Mr. Taplin moved to adopt Resolution No. 128. Motion second-
ed by Mr. Faulkner and unanimously voted.
Mr. Anderson read
RESOLUTION NO. 129
urging the Florida State Legislature to reapportion Dade
County into Legislative and Senatorial districts. Mr.
Faulkner moved to adopt Resolution No. 129. Motion second-
ed by Mr. Taplin and unanimously voted.
Mr. Webb showed the members a tentative sketch of the
parking layout on Lots 1 and 2, Block 1, Residential Section
of Bal Harbour and asked permission of the Council to move
the barricade one block to Bal Bay Drive and Park Drive.
Mr. Faulkner made a motion to permit the Village Manager to
move the barricade back one block to Bal Bay Drive and Park
Drive. Motion seconded by Mr. Taplin and unanimously voted.
The Village Manager advised that 88 new voting precincts
have been added to Dade County and Bal Harbour has been assign-
ed Precinct No. 252 which will comprise all of Bal Harbour and
Haulover Park. In view of the fact that we now have our own
precinct, he has advised the Supervisor of Registration that
our Fire Station can be used as a polling place for future
elections if they so desire.
Mr. Webb informed the members of a Dade County resolu-
tion regarding governmental agencies exchanging or acquiring
public land and after discussion, the Council tabled this
item.
The Village Manager advised that on January 23 through
January 26, 1966, the Americana Hotel is having a convention
of Food Processors in conjunction with the National Canners
Convention and have requested permission to erect a small
tent about 1401 x 401, with center poles, and 18 feet high,
outside the hotel. He informed the hotel that Council per-
msion would have to be granted and since then numerous
letters and wires, directed to our Mayor, have been received
requesting a favorable response by the Council inasmuch as
this convention will bring into our area between five and
seven thousand persons. After discussion, Mr. Faulkner
moved to allow the Americana Hotel to erect a tent, on a
temporary basis, for the duration of the convention in
January, 1966. Mr. Webb was also instructed to inform the
Americana that this would not be permitted in the future.
Motion seconded by Mr. Taplin and "unanimously voted.
Mr. Webb read a letter from Mr. Bogdahn of the Americana
Hotel requesting permission to use the lower garage area as
an exhibition hall for six conventions during the period of

July 15, 1065 through December 3, 1965. After discussion,
Mr. Faulkner moved to allow the Americana Hotel to use the
lower garage area for the conventions listed in their Letter
providing all fire requirements are met. Motion seconded by
Mr. Taplin and unanimously voted,
The Village Manager rend a letter directed to Congress-
man Claude Pepper and Dr. Irving Muskat from Councilwoman
Gladwin of the Town of Surfside objecting to the proposed
House and Senate Bill under consideration which would allow
the State to build a hotel. -motel industry within the Interama
property. She also requested that Bal Harbour go on record
opposing this industry. After consideration, the Council
authorized the Vtl.l;Ige Manager to direct a letter to Con-
gressman Pepper and Dr. Irving Muskat expressing our opinion
as being against this proposed industry.
Mr. Webb appraised the members of the fact that Dade
County is considering the building of a series of incinerators
to do away with the land fill nperati.nn in Dade County and
the first one to be built will he in the northwest section,
near the Veldn Dairy nrnperty nn Route 9. When and if this is
completed, the County will order all the north end cities to
bring their garhape to this incinerator., in this connection,
the Town of Surfside is opposing the incinerators as their
revenue from the dump. presently being used, will be eliminat-
ed. The County estimates the cost will be about $3.00 per
ton as ai-ainst the present rate we are now paying Surfside
of 8.22 per cubic yard. This amount. Mr. Webb advised,
would he about four times the rate we nre currently paving,
but the haul would he shorter thereby reducing the wear and
tear and tire upkeep nn our garbage trucks.
The Village Manager advised of a letter received from
Mayor Board of ?Inv Harbor Islands asking our Council to Pass
a resolution, joining with them, as being opposed to the
City of North Miami acquiring the spoil Lands in the bay,
After discussion, the Council requested the Village Manager
to direct a communication to the Internal Improvement Board

Mr. Wehh advised that Mr. Whitman had approached him
regarding interpretation of our liquor zoning ordinance
wherein it is stated that nn liquor run he sold within ';(ln

The Village Manager rend a letter from Mr. Richard A.
Gerstein, State Attorney. asking the Vi11a:re Council to pass
an ordinance entitled "Step and Frisk" which would allow our

Police Officers to search a suspicious person without mak-
ing an arrest. Mr.'Anderson stated he is definitely
against
any such 'ordinance .pointing out this particular ordinance
was too 1oose1ywored and stating that this type'ordinance
has been declared unconstitutional in many areas of the
country. tAfter discussion, the Village Manager was in-
structed to obtain a recommendation from our Chief of
Police and submit same at the next meeting.
Mr. Faulkner made a motion to adjourn. Motion se-

The Council of Bal Harbour Village met at 9:30 A. M.
Saturday, June 26, 1965.
Present: Messrs: Hart, Taplin and White.
Absent: Messrs: Faulkner and Landis.
Also present wire W. H. Webb, Village Manager; Mary
T. Wetterer, Village Clerk; and Thomas H. Anderson, Village
Attorney.
Upon motion of Mr. Taplin, seconded by Mr. White and
unanimously voted, the minutes of the previous meeting of
May 29, 1965 were approved, without being read.
Mr. Webb reported receiving a reply to his letter to
the Internal Improvement Board regarding the spoil islands
in the bay in which they advised that said islands are de-
dicated for public parks and recreational use under the
supervision of the City of North Miami. The title.will re-
main with the Trustees of the Internal Improvement Boar&
with a provision for reverting same in the event of non-use.

ation that a Resolution be forwarded to the Internal Improve-
