HomeMy Public PortalAboutOrdinances-2015-3699 CITY OF TIFFIN ORDINANCE NO. 2015-369 AN ORDINANCE TO AMEND THE TIFFIN ZONING ORDINANCE, R- 1E, R -IA, -R-1B, R -IC, R-2, R-4, R-61 R-8, R-12, R=M, C-113, C-213, C-10, C-20 ZONES REGARDING DAYCARES, AND AMENDING SECTION 1.05 DAY CARE DEFINITION, AND AMENDING SECTION 7.04 REGARDING PARKING REQUIREMENTS FOR DAY CARES. . 3 BE IT ENACTED by'the City Council of the City of Tiffin, Iowa: Section. I. Purpose: The purpose of this ordinance is to amend various sections of the Tiffin Zoning Code regarding day care area requirements, to amend the definition of day cares, to change day cares to permitted uses in certain residential zones, and to add parking requirements for day cares. Section II. Amendment: Section 1.05(B) Day Care Facility is hereby amended as follows: - 1.05 RULES AN&DEFINITIONS B. Definitions I - Day Care Facility is a facility where seven or more children stay for part' of the day for care and instruction. A "Day Care Facility" must be' licensed by the State of Iowa. The term "Day "Care Facility" includes, by way of example, the following descriptions: nursery schools, childcare centers, day nurseries, kindergartens, preschools, and playgroups. The term does not include kindergartens or nursery schools operated by public or private school systems. Section III. Amendment: Sections R-1E:05(C); R -1A, R -1B, R-1C.05(C); R- 2.05(C), R-4, R-6, R-8, R -12.05(C); R-M.05(C); C-1B.05(C); C-2B.05(C); C -10.05(C); C -20.05(C), all describing area requirements for day cares, are hereby deleted. Bicycle parking: 10% y Section IX. Repealer. All ordinances or parts of ordinance in conflict with the provisions of this Ordinance are hereby repealed. Section X. Severability Clause. If any.section, provision or part of this Ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the Ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. Section XT. When Effective. This Ordinance shall be in effect after its final z passage, approval, and posting as,provided by law. The motion was seconded by Councilperson Upton. Ayes: Upton, Bartels, Havens, Kahler, Ryan Nays: None Five members of the Council being present and having voted "Aye", Mayor Steve Berner declared the motion carded, and Ordinance No: 2015-369„was read.the second time and discussed andFplaced on record. March 2015, at a regular meeting of the Tiffin City Council, Tiffin, Iowa, Councilperson Ryan introduced Ordinance No. 2015-369 and moved that it be given its third and last reading.
