HomeMy Public PortalAbout2008.196 (12-16-08)RESOLUTION NO. 2008.196 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, DECLARING THE RESULTS OF THE SPECIAL MUNICIPAL ELECTION HELD ON NOVEMBER 4, 2008, AND SUCH OTHER MATTERS AS PROVIDED BY LAW WHEREAS, a special municipal election was held and conducted in the City of Lynwood, California, on Tuesday, November 4, 2008, which election was consolidated with the General Presidential Election and conducted as required by law; and I l,. WHEREAS, notice of the election was given in the time, form and manner as provided by law; voting precincts were properly established; election officers were appointed and in all respects the election was held and conducted and the votes were cast, received and canvassed and the returns made and declared in the time, form and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in general law cities; and WHEREAS, the Los Angeles County Registrar-Recorder/County Clerk has completed the canvass of returns of the election and has certified the results to this City Council, and the results are received, attached and made a part hereof as Exhibit "A". NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. The total number of ballots cast in connection with the Lynwood Special Election on November 4, 2008, was 14,709, and the whole number of ballots cast in the precincts and the whole number of ballots cast by absentee ballot are as indicated on Exhibit "A." SECTION 2. The voters of the City of Lynwood approved Measure HH by a vote of 7,790 "Yes" (in favor) to 5,252 "No" (against). Measure HH, the measure voted upon at the election was as follows: Measure HH. Priority for use of Utility User's Tax funds. Shall the Lynwood City Council make its top priority for use of Utility User's Tax revenue taw enforcement, gang suppression, crime and drug intervention, graffiti abatement, and prosecution of those engaged in prostitution? SECTION 3. The voters of the City of Lynwood approved Measure II by a vote of 8,211 "Yes" (in favor) to 4,353 "No" (against). Measure II, the measure voted upon at the election, appeared on the ballot as follows: Measure II. Reduction and Ratification of Utility User's Tax. To help preserve the safety and character of the City of Lynwood through general City services such as law enforcement, fire protection, street repair, park maintenance, and recreational services, shall the city's existing utility user's tax be reduced to nine percent, ratified and updated based on changes in technology and laws since it was instituted in 1990; provided that exemptions for senior citizens and disabled persons shall also remain? SECTION 4. The voters of the City of Lynwood approved Measure C by a vote of 9,633 "Yes" (in favor) to 3,305 "No" (against). Measure C, the measure voted upon at the election, appeared on the ballot as follows: Measure C. Term Limits; City of Lynwood. Shall a term limits ordinance be adopted in the City of Lynwood so that no member of the city council may serve more than two consecutive terms in office? SECTION 4. The City Council does declare and determine that: a) Lynwood Measure HH was duly approved by the voters. b) Lynwood Measure II was duly approved by the voters. c) Lynwood Measure C was duly approved by the voters. SECTION 5. Each of these measures shall take effect within 10 days of the date of i this Resolution. Since Measure II orders changes to the Utility User's Tax, the City ~1 Manager is authorized and directed to contact all applicable utility providers to notify them of said changes to ensure utility providers comply with the new law as soon as possible, and in no event more than 90 days, as required by law. SECTION 6. The City Clerk shall enter into the records of the City a statement of the results of the election showing: (1) the whole number of ballots cast in the City; (2) the measure voted upon; (3) the number of votes given at each precinct for and against the measure; and (4) the total number of votes given for and against the measure. SECTION 7. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the City's legislative records. PASSED, APPROVED AND ADOPTED this 16~' day of December, 2008.
