HomeMy Public PortalAbout09-19-1960r VILLAGE OF MEDINA HAMEL. MINNESOTA Sept. 19, 1960 The meeting of the Medina Planning Commission was called to order by Chairman fortin at 8:0 5 P.M. Attending were Kenneth Fortin Herb Gaspar, Gerald Dykhoff, Alex Schumacher, Ella Christenson and Anne Theis. (1) Hearing on Petition to Rezone. The petition to rezone the proposed site of the V.F.W. Post was read to the Commission. Chairman Fortin stated that everyone interested would be heard but he wished them to limit their comment to five minutes. JOHN STEWART-- a resident of Medina Manor wished to protest on the strength of the residential zon'_ng of the area in both 1954 and 1958 and also because no indication had been given as to the proposed commercial use of the site in question. He also expressed an objection to piecemeal rezoning. DAVID REISER--stated that his brother, father and neighbor(Mrs Marie Scherer) and also himself were in favor of the V.F.W. Club being located on the site in question. JOHN STEWART--stated that he did not object to the Club itself or to the location but basicaly to rezoning established properties. GORDON TAUER--raised the question as to whether the site in question was now zoned R-A or R- C. ARCHIE CARTER --stated that the intent of the zoning at the time it was done was that all the white area on the map was irtedded as R-A classification. GORDON TAUER--stated that according to his calculation the nearest dwelling was about .25 .Wile and couldnt this area between be considered as a buffer zone. He also asked if this rezoning is denied will other future owners of corner sites in this area also be denied? JOE RASKOB--asked if a Club of this type is classified as commercial. ARCHIE CARTER --stated that the feeling should be that this use would be permitted in R-C and not permitted in R-A. PAUL MERZ--stated that he is attempting to develope a large area in high sirs class homes and that he had been advised by professional realestate men that this Club would seriously effect the value of his property therefor he wished to object to the rezoning. ARCHIE CARTER --stated that previously he had been questioned about what was used to make the Medina Village Map and he wished to inform everyone that the Half section maps had been used. At that time Ieinzen-Ditter owned the area in question but he was not aware that this represented a V.F.W. Club. JOHN STEW RT--stated that he had had experience on the Richfield Council and it had been their experience that isolated areas should not be rezoned. An intire area should be considered instead of one lot. GERALD DYKHOFF--stated that while studying the Medina Map it had occurred to him that the zoning had been done in the broad sense and that he anticipated the necessit7 of changes being made in the future. GORDON TAUER--brought out *he point of securing a broader tax base by securing commercial property of this type. He stated that the botilding will be worth about 25 thousand aad also have a playground, ball field, picnic a -ea etc. PAUL MERZ--questioned Tr. Tauer as to whether this Club would be the type of commercial property we would wish to have. He also stated that he had started the ball rolling in this area as a residential area. DAVID REISER--stated that Mr.Merz had built three ho7ses and sold two and that if residential property was so good it should sell better. PAUL MERZ--stated that his homes would bring the Village about one thousand dollar, in taxes next year and that he felt he had ts fight for his property (2) VILLAGE OF MEDINA HAMEL., MINNCSOTA ANNE THEIS--asked the question as tr, whether the picnic area, building, ball field and playground would all be 6n the less than 2 acre site. GORDON TAUER--andwered that they would all be on the site. ELLA CHRISTENSON--stated that changes would be necessary in zoning and that initial zoning is a basis of operation for the future. SI,e felt that areas should be considered rather than specific sites. ARCHIE CARTER --explained that the V.F.W. would definitely fall in the R-C classification and that it did call for rezoning. ELLA CHRISTE3ON--stated that it was not wise to rezone on a single plot but it should be done or considered in areas. She stated that it would be difficult to render a decision on this question. ARCHIE CARTER --noted that according to the ordina_ce the Planling Commission has sixty days to act on this matter and if after sixty days they take no action t,e Council can act on their own. KENNETH FORTIN--asked if land was bought for a specific purpose does this have any thing to do with a non -conforming use. ARCHIE CARTER --stated that land bought for a purpose but not used for it at the time of zoning would not be considered as being used for commercial or whatever purpose it had been bought for and would not come under the non-conf orming use. If the purchase had been widely publicized at the time consideration would have been given to the intent. GORDON TAUER--asked if the size of the site would be the factor in giving consideration to rezoning for a special purpose. ARCHIE BARTER --stated that publicity was a foctor as to the intent of the use of the site. GORDON TAUER--stated that if the V.F.W. had been aware of the R-A classificat ion they would have petitioned for consideration when the zoning work was being done. JOE RASKOB--stated that he felt that highway 24 would be a good commercial developement area. CLIFF RASKOB--asked for consideration of the distance from housing and stated that the residents should not be concerned with commercial develop- ment so far removed. HERB GASPAR--in answer tc Mr. Tauer stated that at the hearing before the zoning was passed no question was raised on this problem. ROBERT ROEHL--stated that he was aware of the ownership of the area by the V.F.W.at the time 68 the zoning work and had mentioned it once. GREG REISER--stated that he knew of other areas where there were housing and Clubs of this sort and that there didnt seem to be any objections. DAVID REISF.R--stated that we were bound to have small commercial develop- ments in residential areas. KEtdNETH FORTIN--asked if the Planning Commission members felt that they had heard all the information and wished to act on the petition. LAURENCE ETZEL--stated this Club would be a private club and you must be a member and there would not be much activity at any time. ELLA C ISZINSON--asked if this was the first request to rezone that the Medina Planning Commission had had. She was informed bt Mr. Fortin that this was the third such request. ALEX SC UMACHER--felt Chet a larger area would have to be considered for action. ELLA CHRISTENSOI?--felt that the Commission should take time to study this with the idea in mind of doing a larger area. GERALD DYKHOFF--stated that it might well be good to consider a larger area For commercial rezoning and the so,�ner done the better. 4 (3) VILLAGE OF MEDINA HAMEL. MINNESOTA ELLA CEeISTE"SOI'--stated that she felt we could not avoid rezoning but that careful thought must be given to the question before rezoning. A.tCITIE CARTER --stated that the site in question was less than 800 feet from lot 3 block 2 Medina Manor. DAVID REISER--stated that his property would be cicseKto tee proposed Club. BEERY --asked if corners had been classified as limited commercial in Medina. Sites for such things as drug stores and clinics. ARCHIE CARTER --stated that Medina had no limited commercial unless you consider R-C as such. ROBERT ROEHL--stated that R-C is very limited commercial. ARCHIE CASTER --read uses peraeitted in R-C from the zoning ordinance. KENNETH FC 2TIN--asked if the members had now heard all and wished to vote on the petition or study it further. HERB GASPAR--stated that he felt more study was needed. ELLA CERISTENSOTI--stated that she would not wish to vote without further study KENNETH FORTIN--asked what the plans were for the buliding in case a permit was secured. LAURET CEET7.F.T,--said they wished to build before writer and submitted a rough draft of the proposed building. JOE RASKOB--pointed out that this hearing was being held because ofa specific petition for a specific site. KETN?TETH FO T$--asked for action on the question. Motion by Ella Christenson that the Planning Commission take time to study and consider all aspects of the question or rezoning. Motion seconded by Herb Gaspar. Carried. 1'•otion by Gerald Dykhoff to meet at earliest convenience suggested date Seot. 26, 1960. Seconded by Alex Schumacher. Carried. (2) Mr. puck Steinke appeared in connection with his apish to buy a lot from Iirs. Striebel. Amos Dayon appeared to represent Mrs. Striebel. We were infBrmed that Firs. Striebel was going tr plat a portion of her land. Archie Carter called the attention of the Plane.ng Commission to t' e fact that it would not be wise to allow an entrance on to County Road 116 from each of the proposed lots in the Striebel Plat. He submitted two alternate sug estiens that would provide road access to the back acreage and also limit the entrances onto 116. Archie Carter will meet with the surveyor Mr. Jackson and re -submit a suggested plat for the Striebel property at the October Planning Meeting. (3) The question of drainage on the property being developed by Rochie Begin was discussed. Archie Carter submitted his suggestions as to how to handle the water darinage Rroblem. He suggested either a continuous culvert or a culvert under each of the driveways in question. He stated that the drainage should slope from the houses a:d then to the street. he stated that a large culvert would have to be used, at least 18 to 24 inches. It was also brought to the attention of the Planning Members that Mr. Begin has installed 2 inch well in at least one of these houses. It was suggested that Attorney Hedlund be contacted and asked about the proceedure for obtaining a restraining order to stop construction by Mr. Begin until this is sittled. Archie Carter will as': Mr. Begin how much he is willing to do to correct the errors in this area and will inform the Planning Commission as to Mr. 3egins answer. (4) The recreation program was discussed and Mrs. Theis asked to have a ttahtative plan and cost estemate submitted before the 23rd so that she could tale the matter of including a Recreation Program in the Village budget when she meets with. the Village Auditor.
