CITY OF TIFFIN ORDINANCE NO. 2015-372
AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF TIFFIN,
IOWA, CHAPTER 90, WATER SERVICE SYSTEM AND CHAPTER, 96,
BUILDING SEWERS AND CONNECTIONS, REGARDING
CONNECTION FEES AND TO" REPEAL ANY CONFLICTING
ORDINANCES AND RESOLUTIONS WHICH SET FORTH WATER OR
SEWER CONNECTION FEES
BE IT ENACTED by the, City Council of the City of Tiffin, Iowa:
Section I. Purpose: The purpose of this ordinance is to amend Chapter 90 and
Chapter 96 of the Municipal Code -of Tiffin, Iowa, to include a connection fee.
Section II. Amendment. Chapter 90 is hereby amended as follows:

WATER SERVICE SYSTEM
90.05 PERMIT. Before any person makes a connection with the public water
system, a written permit must be.obtained from the City. The application for the
permit shall include a legal description of the property, the name of the property
owner, the _name and address of the person who will do the work, and ,thee general
uses of the water. If the proposed work meets all the requirements of the Code dnd if
all fees required under this chapter have been paid, the permit shall be issued. Work
under any permit must be completed within sixty (60) days after the permit is issued,
except that when such time period is inequitable or unfair due to conditions beyond
the control of the person making the application, an extension of time.,within which
to complete the work may be granted. The permit may, be revoked at any time for any
violation of the Code.
90.06 PERMIT FEE. Before any permit is issued, the person who makes the
application shall pay $250 to the Clerk.
Section III. Amendment. Current Section 90.06 shall be renamed 90.07; and
current section 90.07 shall be renamed 90.08; and current section 90.08 shall be
renamed 90.09; and current section 90.09 shall be renamed 90.10; and current section
90.10 shall be renamed 90.11; and current section 90.11 shall be renamed 90.12; and
current section 90.12 shall be renamed 90.13; and` current section 90.13 shall be
renamed 90.14; and current section 90.14 shall be renamed 90.15; and current section

90.15 shall be renamed 90.16; and current section 90.16 shall be renamed 90.17; and
current section 90.17 shall be renamed 90.18; and current section 90.18 shall be
renamed 90.19; and'current section 90'.19 shall be renamed 90.20.
Section IV. Amendment. Chapter 96 is hereby amended as -follows:

CHAPTER 96
BUILDING SEWERS AND CONNECTIONS
96.01' PERMIT. No unauthorized person shall uncover, make any connection with
or opening- info, use, alter, or disturb any public sewer or appurtenance thereof
without first obtaining a- written permit°from the City. The application for the permit
shall' set forth the location- and description of the property to be connected with the
`sewer system and the ,purpose for which the sewer is to be used, and shall be
supplemented by'any plans, specifications, or other information considered pertinent.
The permit shall require the owner to complete construction and connection of the
building sewer to the public sewer within sixty (60) days after the issuance of the
permit, ,except that when a property' owner makes sufficient showing that due to
conditions beyond the owner's control or peculiar hardship, such time period is
inequitable or unfair, an extension of time within which to.'comply with the provisions
herein may be granted. Any sewer connection permit may be revoked at any time for
a violation of these chapters.
96.02 PERMIT FEE. The person who makes the application shall pay a``fee in the
amount of $200.00 to the Clerk.
Section V. Amendment. Current Section 96.02 shall be renamed 96.03; and
current section 96.03 shall be renamed 96.04; and current section 96.04 shall be
renamed 96.05; and current -section 96.05 shall be renamed 96.06; and current section
96.06 shall be renamed 96.07; and current section 96.07 shall be renamed 96.08; and
current section 96:08 shall be renamed 96.09.
Section VI. Repealer. Any conflicting ordinances or resolutions which set forth
water and sewer connection fees are hereby repealed. All ordinances or parts of
ordinances in conflict with the provisions'of this Ordinance are hereby repealed.
Section VII. Severability Clause. If any section, provision or part of this
ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not

affect the validity of the ordinance as a whole or any section, provision or part thereof
not'adjudged invalid or unconstitutional.
Section VIII. When Effective. This ordinance shall be in effect after its final
passage; approval, and posting as provided by law.
On the 25T' day of March 2015, at a regular meeting of the Tiffin,City Council, `
Tiffin, Iowa, Councilperson Havens introduced Ordinance No. 2015-372, and moved
that it be given its first reading. The motion was seconded by Councilperson Upton.
Ayes: Upton, Bartels, Havens, Ryan, Kahler
Nays: NONE
Five members of the Council being present and having voted "Aye", Mayor Steve
Berner declared the motion carried, and Ordinance No. 2015-372, was read the first,
time, discussed, and placed on record.
On the 8t" day of April 2015, at a regular meeting of the Tiffin City Council, Tiffin,
Iowa, Councilperson Ryan introduced Ordinance No. 2015-372, and moved that it be
given its second reading. The motion was seconded by Councilperson Havens.
Ayes: Joann Kahler, Mike Ryan; Peggy Upton, Jim Bartels, Al Havens
Nayes: NONE
FIVE members of the Council being present and having voted "Aye", Mayor Steve
Berner declared the motion carried, and Ordinance No..2015-372, was read the
second time -and discussed.and placed on record.
On the 22nd day of April 2015, at a regular meeting of the Tiffin City Council, Tiffin,
Iowa, Councilperson Kahler introduced Ordinance No. 2015-372, and moved that it
be given its third and last reading. The motion was seconded by Councilperson
Havens.
Ayes: Joann Kahler, Peggy Upton, Jim Bartels, Al Havens
Nayes: None'
Four members of the, Council being present and having voted "Aye", Mayor Steve
Berner declared the motion carried, and the ordinance was passed and adopted.

Whereupon the Mayor declared that Ordinance No. 2015-372 be adopted and
signified his approval of same by fixing his signature thereto. Passed by the Council
on the 22nd day of April, 2015 and approved by the Mayor on the 22nd day 'of April
2015. `
