HomeMy Public PortalAbout84-132 (12-18-84)RESOLUTION NO. g4-132 A RESOLUTION DF THE CITY COUNCIL OF THE CITY OF LYNWOOD ESTAEfLISHING UNDERGROUND UTILITY DISTRICT NO. b The City Council of the City of Lynwood does hereby resolve as follows: WHEREAS, by Resolution No. 84-121, a public hearing was called for December 4, 1984, at the hour of 7:~C~ p.rn., in the Council Chambers in the City Hall, Lynwood, California, to ascertain whether the public necessity, health, safety, or walfare requires the removal of poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electric, communication, or similar associated service, within that certain area of the City described as follows: The full road easemen± on Norton Aven~ie from the east property line of San Luis Avenue and continuing eastwards on Imperial Highway to the west property f"` line of Carson Drive. WHEREAS, City Council at its meeting of December 4, 1984, decided to continue the public hearing until December 18, 1984, in order to provide additional time for public comments. WHEREAS, notice of sucl-~ hearing has been given to all affected property owners as such are shown on the last equalized assessment role and to all utilities concerned in the manner and within the time required by law; and WHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to he heard. NOW, THEREFORE, FtE IT RESOLVED by the City Council of the City of Lynwood as follows: 1. F^ursuant to Ordinance No. 848 of the City of Lynwood, the above-described area is hereby declaredan Underground Utility District, and i.s designated as Underground Utility District No. b of the City of Lynwood. Attached hereto, marked Eihibit "A", and hereby incorporated as a part of this resolution, is a map and legal description delineating the I~, boundaries of said District. 2. The Council does hereby fi:: February i, 1986, as the date on which affected property owners must be ready to l ' receive undergound service, and does hereby order the removal of all poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service within Underground Utility District No. 6 or. or before September 1, 1986, date of completion may be e::tended by written agreement of both parties; 3. The City Clerk is hereby instructed to notify all affected utilities and all persons owning real property within Underground Utility District No. b of the adoption of this resolution within ten (l~l) days after the date of such adoption. Said City Clerk shall further notify said property owners of the necessity that if they or any person occupying such property cie<.aire to continue to receive electric, communication or other similar or associated service, they or such occupant shall, by the date filed in this resolution, provide all necessary facility changes on their premises so as to receive such service from the lines of the supplying utility or utilities at a new location, subject to applicable rules, regulations and tariffs of the re~~pective utility or utilities on file with the Public Utilities Commission of the State of California. Such notification shall be made by mailing a copy of this resolution together with a copy of said Ordinance No. 848, to all affected property owners as such as shown on the last equalized assessment roll and to the affected utilities. 4. The City Council hereby finds and determines that the Underground Utility District herein created is in the general public interest for the following reason: The streets, road or right-of-way in the district are eitensively used by the general public and carry a heavy volume of pedestrian and vehicular traffic. .~.~.
