HomeMy Public PortalAbout84-134 (12-18-84)RESOLUTION NO. 84-134 RESOLUTION OF TIIE CITY COUNCIL OF TIC CITY OF LI'NWOOD AMENDING RESOLUTION NO. 84-76 GRANTING A PERMIT 'I'O USE CER'T'AIN STREET PROPERTY FOR RAILROAD PURPOSES (EAST' ALAMFDA STREET AND LYNWOOD ROAD) WIIEI2EAS, by application dated March 8, 1984, Southern Pacific Transportation Company applied to the City for a permit to construct, re- construct, maintain and operate one drill track across East Alameda Street and one spur track across Lynwood Road, respectively; and WHEREAS, Pursuant to the authority of California public Utilities Code Section 7555, the City may grant such rights upon reasonable terms and conditions following a public hearing thereon; and WHEREAS, notice of such hearing has been published, and mailed to affected property owners and the applicant, and a public hearing thereon has been duly held; and 19IIEREAS, the City Council deems it to be in the public interest to grant such permit subject to the conditions set forth herein; NO~V, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lynwood as follows: 1. The City Council hereby grants Co Southern Pacific Transportation Company (the "Applicant"), for a term of 50 years, the right to construct, reconstruct, maintain and operate (1) a drill track across East Alameda Street along the center line and covering the public street property described in Exhibit "A" hereto, and (2) a spur track across Lynwood Road along the center line and covering the public street property described in Exhibit "B" hereto. 2. This franchise is conferred subject to the following terms and conditions: (a) The specific indicated portion of East Alameda,Street and Lynwood Road shown on Exhibits "A" and "B", respectively, shall be dedicated to the City of Lynwood for right-of-way improvement purposes prior to the commmencement of any construction activities. The applicant shall cause to be prepared and obtained all necessary plans and documents for such dedications. (b) Prior to the commencement of any construction activities, street improvement plans and storm drain plans shall be submitted to the Public Works Director/City Engineer for approval. Such plans shall accomr~odate railroad/street transition requirements in accordance with the Public Utilities Commission's requirements and the design standards of the County of Los Angeles Road Department and shall address drainage requirements in accordance with the County of Los Angeles Flood Control District's standards. (c) Street right-of-way and railroad improvements will be constructed in accordance with the approved plans. Applicant shall furnish a labor and material bond and a performance bond as required by the Public Works Director/ City Engineer. All required permits of the City of Lynwood shall be obtained prior to the corm~encement of any construction activities for which such permit is required. (d) Applicant shall initially furnish and install all required crossing/warning devices, signs and street markings along the public streets relating to the railroad crossing in accordance with the requirements of the California Public Utilities Commission, California Public Utilities Code, California Vehicle Code and Traffic Manual by Caltrans. (e) Applicant shall at all times maintain the drill track and spur track and related railroad crossing in a clean and safe manner, having due regard for public safety, and in accordance with the Public Utilities Commission's requirements and the Public Utilities Code. 3. The City hereby determines that the granting of this franchise is in the public interest of the City, that it will promote the commercial and industrial base of the City and promote other valid public purposes, and that there can be no bona fide compensation in bidding for said permit. 4. The City hereby determines that the Negative Declaration prepared by the Community Development Department for this project in compliance with the California Environmiental Quality Act (CEQA) is certified.
