Trustee Meyers in the Chair The minutes of the last regular meeting, adjourned th meetings of Dec 17 and Special meeting of Dec 10 were read and approved as read Monthly reports of Clerk, Marshal and Treasurer were read and ordered filed Opinion on The Town Attorney presented an opinion from the posting Ord- Chairman of the Judiciary Committee of the California inances League of Municipalities as to the legality of type- written, posted ordinance, wherein he stated that the process was legal. Town Hall th Livermore Cal Feby 5 1902 Adjourned Meeting The Board of Trustees of the Town of Livermore met pursuant to adjournment at 7.30 P. M. Roll Call Present Trustees Kennedy, Knox, Victor Absent Trustees Meyers, Murphy On motion Trustee Knox was elected temporary President. The following Resolution was read O Resolution N It is hereby resolved that the Clerk of the Town of Resolution Livermore, advertise for two weeks in a newspaper to advertise of general circulation printed and published in the for printing Town of Livermore, Alameda Co., for bids for the Town printing and advertising required by law, to be printed and published in a newspaper printed in said Town All bids shall be made in accordance with the following specifications, terms and conditions, "the price for square consisting of none lines of non pariel type, for the fist insertion, and the price for same for each subsequent insertion." The contract for said printing bid shall continue one year form the date of letting of the contract Said bids shall be delivered in a sealed envelope to the clerk of the town of Livermore, in person, marked "Bids for Town Printing, " and must be delivered to said clerk before the hour of 7 oclock PM Tuesday th February 25 1902 Said bids shall be opened by the Board of Trustees of said town in open session, and examined, and publicly declare the same Said Board of Trustees reserves the right to reject any or all bids The person receiving the award of the contract for the printing herein shall within three days thereafter enter into a written contract with the Town of Livermore for said printing for the period of one year, and shall Printing furnish to said town a good and sufficient bond in Bond $200- the sum of $200.00, with two good sureties, for the faithful performance of said contract Said bond to be approved by the Board of Trustees and shall be filed with the Clerk of the town The work performed under the contract shall be paid for monthly, in the was provided by law th Dated February 5 1902 On motion the resolution was adopted by the following vote Ayes Kennedy, Knox, Victor Noes None The Clerk was instructed to advertise i accordance with the above resolution On motion the Marshal was instructed to designate a suitable place for a public pound On motion the Board was constituted a Committee of the whole to investigate the matter of painting. and repairing the Town Hall and Jail to report th at an adjourned meeting to be held on Feby 12 and on motion the Board adjourned to that date Attest W H Wright Clerk Approved J F Meyers (signed) President of the Board of Trustees . Town Hall th Livermore Cal February 12 1902 Adjourned Meeting The Board of Trustees of the Town of Livermore met pursuant to adjournment at 7.30 P. M. Roll Call Present Trustees Kennedy, Knox, Meyers, Victor Absent Trustee Murphy Trustee Meyers in the Chair On motion plans and Specifications for painting and repairing the Town Hall and Jail were adopted and filed and a motion was made and adopted instructing the Clerk to advertise for bids in accordance rd therewith to be opened on March 3 at the regular meeting On Motion the Marshal was instructed to purchase beds and bedding sufficient for the use of the prisoners in the Town Jail The Clerk was ordered to procure 100 feet of 10 inch first class Iron stone pipe for culvert across J street on south side of First street The Street Committee reported that Lizzie and "L streets where the same crossed the Rail road reservation were in bad condition and needed grading. On motion they were instructed to have the necessary work done The Clerk was instructed to notify the property C owners on First street between MLeod and Maple to lay cement side walk in front of their property The Clerk was instructed to Notify the Livermore Water and Power company that the matter of fixing water rates for the coming year would be discussed and to request the presense of their th Agent or Manager at a meeting on Feby 25 On motion the Board adjourned to meet th on February 25 Attest W H Wright Clerk Approved J F Meyers (signed) President pro tem of the Board of Trustees . Town Hall th Livermore Cal Feby 25 1902 Adjourned Meeting The Board of Trustees of the Town of Livermore met pursuant to adjournment at 7.30 P. M. Roll Call Present Trustees Kennedy, Knox, Meyers Absent Trustees Murphy, Victor Trustee Meyers in the Chair Bids for public printing were opened and read, two were received as follows: W E Still, proprietor of the Livermore Echo, at the rate of 90 cents per square of 9 lines non pariel type, for first insertion and 40 cents per square for each subsequent insertion. A L Henry proprietor of the Livermore Herald at the rate of 75 cents per square of 9 lines non pariel type for first insertion and 50 cents for each subsequent insertion. The bid of A L Henry being considered the lowest was accepted and the contract was awarded to him to commence when his bond was accepted by the Board and filed with the Clerk The Ordinance Committee was instructed to prepare and ordinance fixing Water rates for the ensuing year, to be presented at the regular meeting rd on March 3 A communication from E J Denger President of the Livermore Water and Power Co was read. It referred to the fixing of Water rates and was filed for reference. The Town Attorney informed the Board that the case of the Town of Livermore vs Simons tried in the Recorders Court and won by the Town had been appealed to the superior Court and the Marshal informed the Board that a mandamus had been issued from the Judge of the Superior Court requiring him to issue a $2 license to said Simons or to th appear in Court on March 7 and show cause why such license was not issued On motion the Town Attorney was instructed to take care of the cases in Court at a fixed fee of 00 $25 for each case. Hotel Keepers against the collection of License of $2 per quarter from Aget license Hotel Keepers, It was referred to the ordinance Committee The bids for painting and repairing the Town Hall and Jail were then opened, Two bids were received Repairs & as follows: 00 painting A F Meyers $ 195 of Town Hall C W Bradshaw 219 00 00 On motion the bid of A F Meyers, being the lowest was accepted and the contract awarded to him The Clerk was instructed to communicate with dealers in regard to the purchase of 300 feet of Fire Hose The following Resolution was introduced and adopted Resolution Whereas the law relating to municipal corporation of the sixth class requires the members of the Board of Trustees of Towns of said class to call a general municipal election to be held therein on the second Monday of April in even numbered years, Therefore be it resolved, in accordance with the law in said cases made and provided, that the Board of Trustees of the Town of Livermore issue an election proclamation calling for the general municipal election to be held in the Town of Livermore on the second Monday in April 1902 and that the election proclamation be in the following form, to wit; Election Proclamation A general municipal election is called and a proclamation issued by the Board of Trustees of the Town of Livermore, Alameda County, State of California, for a municipal election to e held in the Town of Livermore th Alameda County, California on Monday the 14 day of April 1902 for the purpose of filling the following offices in the Town of Livermore, to wit: 1. Three members of the Board of Trustees for said Town 2. A Clerk for said Town. 3. A Treasurer for said Town 4. A Marshal for said Town the Clerk, Treasurer and Marshal shall hold office for the period of two years from and after the Monday next succeeding the day of such election and until their successors are elected and qualified The members of the Board of Trustees shall hold office for the period of Four years from and after the Monday next succeeding the day of such election and until their successors are elected and qualified Said general municipal election shall be held in accordance with the general election laws of the State of California so fart as the same may be applicable The polls at such election shall be opened at 6 o'clock on the morning of the day of such election and shall be Ordinance O N 48. Election Town Hall th Livermore Cal March 5 1902 Adjourned Meeting The Board of Trustees of the Town of Livermore met pursuant to adjournment at 2 oclock P M Roll Call Present Trustees Knox, Meyers, Murphy, Victor Absent Trustee, Kennedy President Murphy in the chair On motion the matter of grading First Street form the East corporation line to property owned by Ordinance Twisselman, was referred to the Street Committee with O N 48. power to act. Election The matter of extra work on Battlement of Town Hall, was referred to Trustee Meyers with power to have the work done Trustee Victor brought up the matter of purchasing a Street sprinkler. It was referred to the street Committee to report cost of sprinkler, Water, and labor for working the same. Town Hall th Livermore Cal March 12 1902 Adjourned Meeting The Board of Trustees of the Town of Livermore met pursuant to adjournment at 7.30 P M Roll Call Present Trustees Kennedy, Knox, Murphy, Victor Absent Trustee, Meyers The Chairman of the Street Committee asked for and was granted further time to report on matter of cost of Street sprinkler and expense of running some On motion it was ordered that Lizzie Street be graveled nd from 2 street to East Avenue and the Street Committee were empowered to have the work done at an expense not to exceed 50 cents per square cubic yard of gravel hauled The Town Attorney was empowered to have witnesses subpoenaed and their expenses paid in the case of Simons vs Town Marshal Smith The following resolution relative to the approaching session of the Grand Lodge of Dania was read and adopted by unanimous vote: Whereas, The Grand Lodge of the Dania Society of the State of California is to hold its annual session th in the Town of Livermore beginning on the 8 day of April 1902 _ and Whereas, The Board of Trustees of the Town of Livermore desire to express their pleasure at the preference shown our town by its selection by the Dania Society for its place of meeting. Now therefore be it Resolved, That we the Board of Trustees of the Town of Livermore, knowing the good that the order has accomplished in this community and believing in the beneficence of the institution, will accord the Dania Society of California, a hearty welcome to our town and beautiful valley, and as officers and citizens will do all in our power to make their visit memorable and pleasurable to themselves and their friends and also ask the citizens generally to show their appreciation of the honor and receive them in a manner befitting the distinguished occasion. April 7 1902 Regular Meeting The Board of Trustees of the Town of Livermore met in regular session at 8 oclock PM Roll Call Present Trustees Kennedy, Knox, Meyers, Victor Absent Trustee Murphy On motion Trustee Meyers was appointed temporary Chairman. The Monthly reports of the Clerk, Marshal, Treasurer and Health Officer were read and ordered filed The Ordinance Committee reported an ordinance fixing water rates, It was read and passed to a second reading In the matter of the protest of D H Vagts et als, the Ordinance Committee asked for and was granted further time. The Chairman of the Street Committee reported that Lizzie street, First Street, L street and Railroad Avenue had been graded and graveled and put in first class order. The Town Attorney reported that the Mandamus Suit against Marshal Smith was in a fair way to be decided in our favor and that the Appeal of Simons from the judgement in the Recorders Court had been dismissed by the Judge in the Superior Court. On motion the contract work done in repairing and painting the Town Hall and Jail, by A F Meyers, was accepted and the bill ordered paid. On motion the matter was deferred to the next meeting Wagoner On motion the Health Officer was instructed to notify instructed to H B Wagoner, in writing. to abate the nuisance attending abate nuisance the waste products of his winery, giving him to understand that legal proceeding would be commenced against him if the matter was not attended to Trustee Meyers was instructed to investigate the cost of lighting the Military parade ground On motion the Board adjourned to Wednesday the th 16 inst. Town Hall th Livermore Cal April 16 1902 The Board of Trustees of the Town of Livermore met pursuant to adjournment at 8 o clock P. M. Roll Call Present Trustees Kennedy, Knox, Meyers, Victor Absent Trustees Murphy On motion Trustee Meyers was elected temporary Chairman The Chairman stated that the question of purchasing fire hose was the object of the meeting, after some discussion Purchase of it was moved and seconded that this Board purchase 300 ft of hose 300 feet of Paragon Jacket Hose at 90 cents per foot, @ 90 cts coupled, from the Goodyear Rubber Co The motion was carried by unanimous vote The Clerk was instructed to notify the company aforesaid of the action of the Board The ordinance Committee was instructed to draft an ordinance regulating the riding of bicycles on the streets of the town On motion the Board adjourned Attest W H Wright, Clerk Approved President Protem of the Board of Trustees T E Knox (signed) Pres. pro tem . Town Hall th Livermore Cal April 21 1902 The Board of Trustees of the Town of Livermore met at 8 o clock P. M. Roll Call Present Trustees Kennedy, Knox, Meyers, Victor Absent Trustees Murphy On motion Trustee Meyers was elected temporary Chairman The Chairman stated that this was the appointed time to canvas the returns of the Municipal election held on th Election April 14 Returns The Clerk produced the tally sheets, and the Board proceeded with the canvassing of the returns resulting as follows Total number of votes cast 353 For Trustee Max Berlin received 268 votes For Trustee D G Murphy received 278 votes For Trustee T E Knox received 282 votes For Clerk M G Callaghan received 153 votes For Clerk W H Wright received 187 votes For Marshal Jacob Johnson received 70 votes For Marshal D A Smith received 270 votes For Treasurer W H Taylor received 261 votes The Chairman announced that Max Berlin, T E Knox and D J Murphy having received the highest number of votes were elected Trustees for the term provided by law. That W H Wright having received the highest number of votes was elected Clerk for the term provided by law. That D A Smith having received the highest number of votes was elected Marshal for the term provided by law. That W H Taylor having received the highest number of votes was elected Treasurer for the term provided by law The only new Trustees present - Max Berlin and T E Knox - were then sworn in and took the oath of office and took their seats as members of the Board, Trustee Victor retiring A vote of thanks was extended to C S Victor the retiring member of the Board for his efficient and faithful services during the period that he had filled the office of Trustee W H Wright was sworn in as Clerk, D A Smith was sworn in as Marshal and W H Taylor was sworn in as Treasurer with instructions to file their bonds as required by law A J Murphy On motion and a vote being taken Trustee D J Murphy elected Chairman was elected President of the Boars for the ensuing term. Sureties C S Victor, Rube Hunter and H P Winegar Bond of D A Smith, Marshal and ex officio Tax Collector in the sum C of $4000- J O MKown, E Pronzini, John Sweeny, and J Fletcher as sureties. Dec 24 1902 Adjourned Meeting The Board of Trustees of the Town of Livermore met pursuant to adjournment at 2 oclock P M Roll Call Present Trustees Berlin, Kennedy, Knox, Murphy, Meyers Absent None The President stated that the bids for the new bridge would now be considered On motion of Trustee Knox, Seconded by Trustee Kennedy it was ordered that the contract for building the new bridge by Contract for awarded to C W Bradshaw, his being the lowest bid, for bridge awarded the sum of $ 615.00. The motion was carried by unanimous vote to C W Bradshaw On motion the President and Clerk were instructed to sign the contract on behalf of the Board The bond of C W Bradshaw presented his bond in the sum of $400- with H Gardemeyer and F A Schrader as sureties. and on motion the bond was approved and accepted.
