HomeMy Public PortalAboutORD16025BILL NO. 2019-121 SPONSORED BY Councilman Graham ORDINANCE NO. 11.005 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A $2,441.25 AGREEMENT WITH COLE COUNTY FIRE PROTECTION DISTRICT FOR THE ANNUAL TYLER TECHNOLOGIES' ENTERPRISE CAD SOFTWARE LICENSE AND MAINTENANCE AGREEMENT. BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. The Mayor and City Clerk are hereby authorized and directed to execute an agreement with Cole County Fire Protection District for the Emergency Reporting, Inc. through a customized interface from Tyler Technologies' Enterprise CAD software in the in the amount of $2,441.25 for annual maintenance charged to the City by Tyler Technologies under the Standard Software License and Services Agreement. Section 2. The agreement shall be substantially the same in form and content as that agreement attached hereto as Exhibit A. Section 3. This Ordinance shall be in full force and effect from and after the date of its passage and approval. Passed: 171 'j % Lel 200 Approved: Presiding Officer ATTEST: Mayor Carrie Tergin APPROVED AS TO FORM: Ci ' Clerk ' City elor EXHIBIT A MEMORANDUM OF UNDERSTANDING BY AND BETWEEN COLE COUNTY FIRE PROTECTION DISTRICT AND THE CITY OF JEFFERSON FOR EMERGENCY REPORTING SOFTWARE THIS Memorandum of Understanding ("MOU"), executed the date last executed by a party as indicated below by and between the Cole County Fire Protection District ("CCFPD") and the City of Jefferson ("City"). 1. Purpose. The purpose of this MOU is to provide a framework to proceed in a partnership whereby CCFPD and the City shall share information from the Tyler Technologies' Enterprise CAD software that is sent to Emergency Reporting, Inc. through a customized interface. Cost Share. The CCFPD agrees to pay the City Two Thousand Four Hundred Forty -One Dollars and Twenty -Five Cents ($2,441.25) for annual maintenance charged to the City by Tyler Technologies under the Standard Software License and Services Agreement, and any previous amendments, change orders, and renewals, entered into between the City and Tyler Technologies. Thereafter, the annual maintenance fee that the County agrees to pay the City will increase by five percent (5%) each contract term. 3. Term. This contract shall commence on the 1st day of November, 2020, and continue until the 31st day of October, 2021. 4. Renewal. This agreement shall automatically renew each year under the same terms and conditions, and any amendments, change orders, and renewals hereafter. The option to renew shall be considered exercised unless one party notifies the other six months in advance of its intention to opt out of this agreement. 5. Amendments. All amendments to this MOU shall be in writing by mutual agreement to the parties, and no oral amendments shall be in force or effect whatever. 6. Notices, Consents And Approvals.
