A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF LYNWOOD REQUESTING THAT THE CITY
OF LYNWOOD BE INCLUDED IN THE ROSTER OF
CITIES AUTHORIZED `1'0 RECEIVE CRIMINAL-

59HE?EAS, Perlal Code Section 11105 (b) (10) and 13300 (b) (10)
authorized cities, counties and districts to access state and

ing or certification purposes; and
WHEREAS, Penal Code Section 11105(b)(10) and 13300(b)(10)
requires that there be a requirement or exclusion P'roni e^!ployment,
licensing or certification, based on specific criminal conduct on
the part of the subject of the record; and
WHEREAS, Penal Code Sections 11105(b)(10) and 13300(b)(10)
require the City Council, Board of Supervisors, or governing body
of a city, county or district to specifically authorize access
to summary criminal history information for employment, licensing
or certification purposes:
NOW, THEREFORE, the City Council of the City of Lynwood
does hereby find, determine, order and RESOLVE as follows:
Section 1. That the City Council of the City of
Lynwood and its designees are hereby authorized to access summary
criminal history information f or employment, licensing or cer-
tification purposes;
Section 2. That the City of Lynwood be added to the
roster o~ cities authorized to receive criminal histories in-
formation from the Records and Stastics Bureau, Technical Ser-
vices Division;
Section 3. The City of Lynwood shall not consider a
person who has been convicted of a felony or a misdemeanor involy-
ing moral turpitude eligible for employment or licensing; except
that such conviction may be disregarded if it is determined that
mitigating circumstances exist, or that the conviction is not
related to the employment or license in question.
Section 4. This Resolution shall become effective
immediately upon its adoption.
