HomeMy Public PortalAboutResolution 85-2361 City Council support of Assembly Constitutional Amendment concerning nonpartisan officesRESOLUTION NO. 85 -2361 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY SUPPORTING THE ASSEMBLY CONSTITUTIONAL AMENDMENT CONCERNING NONPARTISAN OFFICES (ACA 7 - MOUNTJOY). THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE AS FOLLOWS: WHEREAS, the California Constitution provides that "judicial, school, county and city offices shall be nonpartisan "; and WHEREAS, a recent California Supreme Court decision has concluded that there is no provision in the California Constitution or in the statutes to prohibit a political party or political central committee from endorsing, supporting, or oppos- ing.a candidate for a nonpartisan office; and WHEREAS, ACA 7 (Mountjoy) reverses the California Supreme Court decision and prohibits such participation in local government elections by political parties or their central committees; and WHEREAS, it is the opinion of the City Council of the City of Temple City that it is inconceivable that a local office can be considered nonpartisan when political parties are supporting or opposing candidates for that office;, and WHEREAS, the implications of the California Supreme Court decision on the judicial process, on our schools, and at the city and county level are staggering. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Temple City endorses ACA 7 (Mountjoy) which advocates nonpartisanship in judicial, school, county and city offices.
