Regular Meeting
The Board Trustees of the Town of Livermore met in
regular session at the above written place and date
at 7.30 PM. At roll call there were
Present Trustees Kennedy, Knox, Mathiesen(sic), Meyers, Murphy
Absent None
President Knox in the chair.
The minutes of the last regular and adjourned meetings
were read and approved
The regular monthly reports of Clerk, Marshal & Treasurer
were read and ordered filed

An application for a saloon license was made by M B
Saloon license Nunez to do Business in the Columbo Saloon on South side
granted to of First street bet J and K streets
M B Nunez On motion of Trustee Murphy, seconded by Trustee Mathiesen(sic)
a license was granted to M B Nunez on consideration that
it was merely a change of proprietors and not a new license
The Clerk informed the board that he had conferred with
Jas W Clark Attorney Jas W Clark in regard to the cost of codifying and
employed to revising the town ordinances and conforming them to the laws

revise Ordinances governing cities of the 6 class and that Mr Clark agreed
to do the same for the sum of $50.00
On motion it was agreed that Mr Clark be employed to
attend to the matter, to begin as soon as possible and the
work to be finished with two months
The matter of new fire hydrants was referred to the
Fire and Water Committee to repost at the next regular
meeting
On motion the Marshal was instructed to furnish one
of the cells in the Town Jail in a suitable manner for
women who were so unfortunate as to be confined there
On motion the Clerk was instructed to notify the
of Livermore to provide additional means of escape in case

of fire, from the 3 story of the Bank building
No other business appearing, on motion the board
adjourned.

Bill of E M Heller for 26.00 for cleaning cesspools on
lot of Estate of J S Dungan was laid over for future consideration
The Fire and Water Committee reported that 10 or more
new fire hydrants should be purchased. The Clerk was
instructed to write and get prices for the same.
The District Attorney sent a communication in which
he stated that complaint had been made of the condition
of our Town Jail, he stated the law in regard to the matter
and desired the Board to take measures to abate the
nuisance claimed_ After debate the matter was
laid over for future consideration
The Marshal was instructed to procure 2 iron buckets
for use in jail
The following Resolution was read
Whereas, several suits are now pending in the
United Sates Circuit Court at San Francisco and Los Angeles
where in it is claimed that this city has, by use of oil on its

public roads, infringed upon the patent N602,023, Known
as the Mattern Oil Roads Patent and
Whereas, all the cities in this state (including this city)
which have used of may hereafter use oil for road purposes
are threatened with similar suits based on said alleged patent;
and
Whereas, the defense of said suits is being conducted by a
joint Committee on behalf of all the towns and counties in
the state using oil for road purposes, which committee
is composed of the following persons, to wit: On behalf of
the Counties, Supervisors M J Dillman of Sacramento County
John Roll of Santo Clara County, O W Longden of Los Angeles
County, Philip Scott of Fresno County and J B Glover
of San Barnardino Count; and on behalf of the
municipalities, Frederick Baker of Long Beach, C L
C
MFarland of Riverside, L O Stephens of Fresno, John C
Ing of Sacramento and C N Kirkbride of San Mateo.
Now therefore, Be It Resolved: That this city hereby
authorizes said Joint Committee to Employ special
counsel to advise this city as to the validity of such
patent and to appear for and defend this city against
all claims made under such patent, until such final
adjudication be obtained as to the validity there of , and
also to search for the procure evidence to be used in
the defense of this city against such claim
And Be It Further Resolved: that this Council
hereby employs as such special counsel for this city,
the same counsel as are now or may be here after
employed by such Joint Committee, upon the terms
here in after specified, and this Board hereby agrees
to pay in that behalf the sum of $25.00 upon presentation
of demands there for in Legal form, approved by such
Joint Committee, it being understood that the same
shall be in full of all liabilities and charges what-
so ever under this resolution.
On motion the resolution was adopted by
unimous vote of the Board
The Annual Report of the Livermore Water & Power Co
was presented. It was referred to the Fire and Water
committee for investigation.
It having been brought to the notice of the Board that
some of the Saloons were allowing minors in their
places of business contrary to law, the Marshal was
instructed to notify each and every saloon Keeper in Town
that the law must and will be strictly inforced, under
penalty of having license revoked

The matter of fire hydrants was referred to the fire
and Water committee for further consideration.
The Clerk was instructed to procure the necessary
supplies for the municipal election.
The matter of fixing the gutters on 1st street was referred
to committee of the whole.

The Board of Trustees of the Town of Livermore met pursuant

The following proclamation, calling for a general municipal

election in the Town of Livermore, to be held on April 11 1904,
was read, signed by the President and Clerk, and ordered
published.
Proclamation
A General Municipal Election is called and a proclamation
is issued by the Board of Trustees of the Town of Livermore
Alameda County, State of California, for a municipal
election to be held in the Town of Livermore, Alameda County

State of California, on Monday, the 11 day of April 1904
for the purpose of filling the following offices of the Town
of Livermore, to wit:
(1) Three members of the Board of Trustees for said
Town, (2) A Clerk for said Town, (3) A Treasurer for
said Town. (4) A Marshal for said Town
The Clerk, Treasurer and Marshal shall hold office
for the period of Two years from and after the Monday
next succeeding the day of such election and until
their successors are elected and qualified.
Two members of the Board of Trustees shall hold
office for the period of four years, the third member
shall hold office for the period of two years from and
after the Monday next succeeding the day of such
election and until their successors are elected and qualified
Said general municipal election shall be held in
accordance with the general election laws of the Sate of
California so far as the same may be applicable.
The polls at such election shall be opened at 6 oclock
on the morning of such election and shall be kept open
until 5 oclock of the afternoon of the same day when
the polls shall be closed

by the following vote.

Ordinance N entitled "An Ordinance regulating
the fire department of the Town of Livermore," was read
a second time, and on motion of Trustee Kennedy.
Seconded by Trustee Murphy the Ordinance was adopted
and passed by the following vote; Ayes Trustees
Kennedy, Knox, Murphy; Noes None

Ordinance N entitled " Relating to the offense of
Misdemeanor; specifying acts and omissions which constitute
the same and fixing a penalty therefore", was read the
second time and on motion of Trustee Kennedy
Seconded by Trustee Murphy the Ordinance was adopted
and padded by the following vote; Ayes Trustees Kennedy
Knox, Murphy, Noes, None
The foregoing Ordinances are mostly old Ordinances
of the Town of Livermore revised and amended and are re Enacted
to correct all informalities when formerly passed

After passing the above ordinances Mr W Loewenthal
addressed the Board on behalf of Anspacher Bros and other
property owners within the fire limits, making a request
that the fire limit Ordinance be repealed, or at least amended
to permit the erection of certain structures of wood within the
limits_ The matter was discussed by several members of the
Board, Mr Loewenthal, Mr Schulz and others and finally
the matter was referred to the Ordinance Committee to report
at the next regular meeting

The Board of Trustees of the Town of Livermore met at
the above written place and date at 8 oclock P.M.

The President stated that this was the regularly appointed
time for canvassing the returns of the Municipal Election

held in the Town of Livermore on April 11 and there
being no objection the Clerk was instructed to brad the
seals and read the returns received by him from the
Board of Election
The returns were as follows:
Total number of votes cast 92
F Mathiesen(sic) for Trustee, full term received 82 votes
Election
Returns J D Ryan for Trustee, full term received 82 votes
C E Beck for Trustee, unexpired term, 2 years recd 85 votes
W H Wright for Clerk and ex officeo Assessor received 82 votes
W H Taylor for Treasurer received 82 votes
D A Smith for Marshal received 83 votes
Henry Hupers received 3 votes for Trustee and there were
4 scattering votes for that office. W Budworth received one
vote for Treasurer and Everette Horton received 3 votes for
Marshal
The President then declared as follows:
That F Mathiesen(sic) and J D Ryan having received
a majority of all the votes cast were duly elected
Trustees for the full term of 4 years.
That C E Beck having received a majority of all
the votes cast was duly Elected Trustee for the
unexpired term of 2 years.
That W H Wright was duly Elected Clerk, That
W H Taylor was duly Elected Treasurer, and that
D A Smith was duly Elected Marshal, for the terms
provided by law

On motion the Board adjourned to April 18

The Board of Trustees of the Town of Livermore met pursuant
to adjournment at the above written place and date at
8 Oclock P.M.
At Roll Call there were
Present Trustees Knox, Mathiesen(sic), Murphy
Absent Trustees Kennedy, Meyers
President Knox in the Chair
The newly elected members of the Board of Trustees viz:
F Mathiesen(sic) and J D Ryan elected for the full term
of 4 years and Chas E Beck elected for the unexpired
term of 2 years, being present were introduced and
sworn into office by the Clerk.
The Clerk, Marshal and Treasurer, the newly elected
Town officers presented their bonds as follows:
Bond of W H Wright, Clerk and ex officeo Assessor in

Bonds of the sum of 3000- with S L Savage, J O MKown and
Town officers E Pronzini as sureties

accepted Bond of W H Taylor, Treasurer in the sum of 4000-
with E Pronzini and R Hunter as sureties
Bond of D A Smith, Marshal and ex officeo Tax Collector
in the sum of $ 4000_ with John Sweeney, Jos Fletcher.

On motion the bonds were accepted and ordered
filed.
The Clerk, Treasurer and Marshal were then sworn
into their offices

Watchman Murphy, P Coughlin was appointed Night watchman
to serve during the pleasure of the board
Marshal On motion of Trustee Murphy, seconded by Trustee
appt'd Supt Mathiesen(sic), Marshal D A Smith was appointed
of Streets Superintendant of Streets to serve during the pleasure
of the board
At this stage of the proceedings, ex Trustee Kennedy,
Entered the hall and addressed the Board thanking
the members of the old Board for the uniform courtesy
he had always received from their hands while serving
with them and expressing the wish that the newly organized
board would work as harmoniously during the coming
tem as it had while he was a member.

Ordinance N 28 entitled "Codefying for publication
the Ordinances of the Town of Livermore and to that end
renumbering, reentitling and continuing in force
certain Ordinances, and parts of Ordinances and repealing
certain Ordinances and parts of Ordinances," was read
for the second time, and on Motion of Trustee Mathiesen(sic)
Seconded by Trustee Beck,. the Ordinance was adopted
and passed by the following vote

Ordinance N 29 entitled "An Ordinance providing for
the working of prisoners confined in the Town Jail of
the Town of Livermore", was read for the second time
and on motion of Trustee Murphy Seconded by Trustee
Mathiesen(sic), the Ordinance was adopted and passed by
the following vote

W Plath presented plans and specifications for a building
proposed to be erected by him within the fire limits for
the inspection and approval of the Board, it was referred
to committee of the whole
Trustee Mathiesen(sic) stated that in a conference with the Board
Insurance of Insurance Underwriters they had informed him that of
ordinance the present Ordinance in regard to the Insurance License
considered was enforced the combined companies would increase
the rates of insurance throughout the town. The matter
was taken under advisement

Permission The matter of granting permission to W Plath
granted to W Plath to erect a 2 story frame building on the N E corner
to erect building of 1st an L streets came up, and it appearing to
the board that it was a proper and suitable structure
to erect within the fire limits, the necessary permission
was granted.
The matter of equalizing the business licenses was
discussed and finally referred to the Ordinance Committee
to report at the next regular meeting.
The board debated the question of watering or oiling streets
for the coming year, after some discussion, without result.
The matter was referred to committee of the whole to report
at next meeting, also to report as to cost of watering plant.

The Board of Trustees of the Town of Livermore met pursuant
to adjournment at 8 oclock P. M.
Present Trustees Beck, Knox, Mathiesen(sic), Murphy, Ryan

President Knox presiding
The first business in order was the question of oiling or watering
the streets,_ Trustee Mathiesen(sic) stated that he had interviewed
a number of citizens in regard to the matter and found
that they were about equally divided as to which was best
Petition to A petition was presented from E Pronzini and 30
oil streets other persons or firms doing business in Livermore, requesting
the Board to oil First street, the same as last year
Mr DeCoamp of the firm of DeCamp and Mosher,
oil men, addressed the Board, advocating the use of oil.
Trustee Ryan stated that the price of sprinkling wagons
6 inch tire, was $ 435. each.
1st street ordered Trustee Mathiesen(sic) then moved that First street, from
oiled town line to town line, be oiled; the motion was seconded
by Trustee Beck and when put by the chair was passed
without a desenting vote.
No further business appearing the Board adjourned

On motion of Trustee Mathiesen(sic), seconded by Trustee Murphy
the petition was granted and the Clerk instructed to issue
a License.
J G Thomas presented a petition for a liquor License
to do business in the Colombo Saloon on South side
of First street between J & K streets, said application
was signed by free holders D F Bernal, J H Dutcher,
M J Soares, Theo Gorner and Chris Schmidt.
On Motion of Trustee Ryan seconded by Trustee Beck
the petition was granted and license ordered issued

A bill of J H Dutcher was laid over for investigation
John Barry sent in a proposal to remove the sweepings
from the principal street in Town for the sum of $ 40.00
per month_ The matter was referred to the street
committee to investigate
It was moved by trustee Mathiesen(sic), Seconded by Trustee
Tax rate Murphy that the municipal tax rate for the year 1904-5
fixed, be and is hereby fixed at 65 cents for the general fund
65 cts Gen fd and 10 cents for the Library fund on each $100. of valuation

W S Almaida and Joe S Escobar, petitioned the Board
to grant them a Liquor License, to do business in the
building Known as the French Liquor Store on South side
of First Street between K and L streets, premises owned
by Frank Traversa_ The application was signed by
the following free holders of the Town of Livermore viz.
H Schulz, Frank Grassi, E Day, Carl Beu and
E Hendricsen, P Callaghan.
On motion of Trustee Mathiesen(sic), seconded by
Trustee Ryan, a license was ordered to be issued
by unanimous vote
A communication was read from the League of
California Municipalities requesting that as many of the
Board as possible would attend the meeting of the League
thth
at Santa Ana, Nov 16. 17 & 18.
On motion Trustee Ryan was appointed a delegate
to attend the convention.
It was ordered that Watchman P Coghlan be
allowed to purchase a new club at the expense of
the town
No other business offering, on motion the Board

The Street Committee was instructed to put in
Culverts on First street at the crossing of M street, on
both sides.
It was ordered that W H Wright be instructed to run
levels for the new culverts also for the gutter on First

Resolution of Intention N_
Resolved that it is the intention of the Board of Trustees
of the Town of Livermore to order the following street
work done in the Town of Livermore, to wit:
That a cement gutter be laid on the south side of

First Street between MLeod and Lizzie Streets being the

gutter on the Northerly line of Block 2 of the MLeod Tract.
Said order will be made at the Experation of 10 days after
notice of this Resolution
The above resolution was passed and adopted by
