January 2 1906 Regular Meeting The Board of Trustees of the Town of Livermore met in regular session at the above written place and date at 7.30 oclock P. M. Present Trustees Knox, Mathiesen(sic), Ryan Absent Trustee Beck, Murphy President Knox presiding The minutes of the last regular and subsequent meetings were read and approved as read The regular monthly reports of Clerk, Marshal and Treasurer were read and ordered filed An application for a saloon license was received from Silver Florio and L Guanzerole, to do Application business on the Northeast corner of First and for Saloon L streets - The petition was signed by free holders license of E Pronzini, C Raboli, Chas Farrario, C H Acker Florio and and Henry Schulz. Guanzeroli On motion of Trustee Mathiesen(sic), Seconded by granted Trustee Ryan the Clerk was instructed to issue the necessary license A petition was received from the Western Petition of Pacific Railway Co asking for a franchise Western Pac granting them permission to construct and maintain Railway for a railway through upon and accross the streets Francise of Livermore_ The petition reads as follows; To the Honorable, the Board of Trustees of the Town of Livermore, State of California:- The petition and application of the Western Pacific Railway Company, a corporation, to your Honorable body respectfully shows: That your petitioner and applicant is a railroad corporation organized and existing under and by virtue of the laws of the Sate of California, and is authorized to acquire the rights, privileges, permissions, rights of way and franchises herein petitioned and applied for, and to construct, lay down, maintain and operate by a steam or other lawful motive power, a single or double track railroad of standard guage along, upon and across the streets, avenues, alleys, lanes, places and courts in said Town of Livermore as hereinafter named and designated, and upon, along and across the property, places and route in said Town of Livermore hereinafter described and as shown upon the map attached hereto and made a part here of. That your petitioner is organized for and is authorized to build a transcontinental railroad from or at a point on or near the Bay of San Francisco in the State of California, in a general easterly and northeasterly direction to a point in or near the City of Salt Lake, in the state of Utah and your petitioner desires to enter the said Town of Livermore with said line of railroad and to pass with the same in and through said Town of Livermore along the route hereinafter described Wherefore your said petitioner here by petitions and applies to your Honorable Body for the right, privilege, permission, right of way and franchise, for the term of forty-nine years, for itself, its successors and assigns, to construct, lay down, maintain, and operate by steam or other lawful motive power, a single or double track railroad of standard guage, along, upon and across the streets, avenues, alleys, lanes, places and courts, property, lands and places and route in said Town of Livermore as the same will be intersected by such railroad laid along a route the center line of which is described as follows, to wit: Beginning at a point on the Western boundary line on limits of the Town of Livermore 35 feet Southerly from the intersection of said line with the southerly line of Front or First Street, and running thence Westerly on a curve to the right with a radius of 2865 feet a distance of 509.5 feet to the end there of in Front Street; thence on a O tangent to the aforesaid curve and bearing South 77 and 7' West along and across Front Street and across Junction Avenue, and across H Street at or near its intersection with Oak Street, a distance of 1712.3 feet to a point in Oak Street between H and I Streets. the intersection of said center line with the Westerly line of Junction Avenue being 87.9 feet Northerly along said Easterly line of Function Avenue from its intersection with the Northerly line of Front Street; thence on a curve to the left with a radius of 5730 feet along and in Oak Street a distance of 264.5 feet to its intersection with the Easterly line of I street; thence continuing along said curve and crossing I street and running along and in Oak Street a distance of 235.5 feet to the end of said curve in the center of Oak Street; thence along the center line of Oak Street and bearing O South 727' West and in and along said Oak Street and crossing Livermore Avenue, K Street, L Street, M Street, and N Street, a distance of 1791.3 feet to an intersection with the Westerly line of N Street, said point of intersection being distant 38.7 feet southerly along the said Westerly line of N Street from its intersection with the Southerly line of Olivina Avenue; thence continuing on the same course and along the center line of Oak Street if produced, a distance of 3231.5 feet to its intersection with the Westerly boundary line or limits of said Town of Livermore. Said line of railroad being substantially delineated and set forth on the accompanying map, which in hereby referred to and made a part hereof Together with the right, privilege, right of way, franchise and permission to construct and maintain all the switches, crossings, sidings, turn outs, slip switches, spur tracks, yard tracks, depot tracks and terminal tracks, and all the connections in conjunction therewith, and such appendages adjunct thereto that the said Western Pacific Railway Company, its successors and assigns, may consider necessary of reasonable for the proper operation of said line of railroad. That said line of railroad as here in before described has been located so as to be most compatible with the greatest public good and the least private injury That your petitioner and applicant has already begun the construction of the above described portion of it through the Town of Livermore as soon as permission so to do shall have been granted by your Honorable Body Your petitioner and applicant further prays that said rights, privileges and franchises be granted to it upon the condition that it and its successors and assigns shall keep the streets in repair between the tracks and along and within the distance of two feet upon each side a said tracks occupied by the said Western Pacific Railway Company. That your petitioner has acquired, or will acquire, all the necessary property for its tracks and line of railroad for which these rights, privileges and franchises are asked other than where said tracks and line of railroad run upon streets, avenues, alleys, lanes and public places and courts in said Tow of Livermore. January 8 1906 Adjourned Meeting The Board of Trustees of the Town of Livermore met pursuant to adjournment at the above written place and date at 7.30 oclock P.M. Present Trustees Beck, Knox, Mathiesen(sic), Murphy, Ryan Absent None President Knox presiding C Attorney Olney and Mr MDonald, representing the Western Pacific Railway Company were present and the proposed franchise was discussed. A map showing the Railroad grade on Oak street was shown and several amendments agreed to to be incorporated in the ordinance. No action was taken towards passing the ordinance was taken and on motion the Board th adjourned to January 24 Attest W H Wright Clerk Approved T. E. Jany 24 1906 Adjourned Meeting The Board of Trustees of the Town of Livermore met pursuant to adjournment at 7.30 oclock P.M. Present Trustees Knox, Mathiesen(sic), Ryan Absent Trustees Beck, Murphy. President Knox in the Chair Mr Israal Horton appeared before the Board protesting against granting a franchise to the Western Pacific Railway Company to run on the proposed line, stating that it would destroy his property - His objections were C answered by Engineer Williams and Mr MDonald for the Company, they showing that the line as proposed did less injury to private property and was the most feasable route of any of the five, or six surveys made by them Mr Jas W Clarke asked that the engineers submit maps of the other surveys made for the consideration of the trustees. Mr Williams stated that he would have them for inspection at the next meeting On motion the whole matter was laid over until the next regular meeting An application for a saloon license was received from Hachman and Iverson, to do business in the Mint Saloon on North side of First street between K and L Streets _ The petition was signed by free holders J C Riemers, E Pronzinzi, M J Ivans, D F Bernal, W E Henz and Geo Beck __ It being shown to the satisfaction of the Board that it was not a new saloon but merely a change of ownership, the license was ordered issued No other business appearing the Board adjourned Attest W H Wright Clerk Approved T. Feby 5 1906 Regular Meeting The Board of Trustees of the Town of Livermore met in regular session at the above written place and date at 7.30 oclock P.M. Present Trustees Beck, Knox, Mathiesen(sic), Murphy, Ryan Absent None President Knox presiding The minutes of the last regular and subsequent adjourned meetings were read and approved The regular monthly reports of the Clerk, Marshal and Treasurer were read and ordered filed. Bids for the old Town Hall property were open, It was found that there was only one bid received, being from $ the Dania Society, The sum bid being 805.00 _ On motion the bid and subject matter was laid over for consideration. The Livermore Water and Power Co presented their annual Statement of names, residences and amount paid for water by each individual water-rate payer, revenue derived form all sources, and an itemized account of expenditures for supplying water during the year 1905. It was referred to the Ordinance Committee A communication was received from Jos Fletcher offering to remove the old town hall building to the site of the present library building on First street, and to fix up the same for the sum of $444.75 and the old library building The matter was laid over for consideration. Knox (signed) President of the Board of Trustees of the Town of Livermore Adjourned Meeting th February 12 1906 The Board of Trustees of the Town of Livermore met puruant to adjourment at the above date, at 7.30 oclock PM Present Trustees Beck, Knox, Mathiesen(sic), Murphy, Ryan Absent None President Knox presiding The president stated that the first business in order was the second reading of the Ordinance granting the Western Pacific Railway Company a franchise The Clerk then read the Ordinance as follows: O Ordinance N 37. Of the Town of Livermore Granting to the Western Pacific Railway Company a franchise to construct, Maintain and Operate a Railroad through the Town of Livermore and across certain streets therein _ _ _ _ _ _ The Board of Trustees of the Town of Livermore State of California, do ordain as follows: Section 1. The right, privilege, right of way and franchise is hereby granted unto the Western Pacific Railway Company, a railroad corporation organized and existing under and by vertue of the laws of the State of California, and to its successors in interest and assigne, insofar as it lies within the power of the Town of Livermore to grant the same, to use, for the term of forty-nine years from the date of the passage of tghi8s Ordinance, the streets, avenues, alleys, lanes, places and courts, and lands, places and route, and portions there of, in the Town of Livermore, State of California, here in after named and described: and to that end the said Western Pacific Railway Company, its successors in interest and assigns, onsofar as it lies within the power of the Town of Livermore to grant the same is here by granted the right, privelege, permission, right of way and franchise to construct, lay sown, maintain and operate by steam or other lawful motive power, a singler or double track railroad as here in after set forth of standard guage, together with the right, privelege, permission, right of way and franchise to lay down, construct, operate and maintain all the switches, crossings, sidings, turn outs, step switchers spur tracks, yard tracks, depot and terminal tracks, and all the connections in conjunction there with, and such appendages and adjuncts thereto as said Western Pacific Railway Company, its successors and assigns, may consider necessary for the convenient use of the dame along, across and upon the streets, avenues, alleys, lanes, places, courts, property, lands, places and route in the Town of Livermore, except as here in after provided in this Ordinance, as the will be intersected, occupied or encroached upon by a railroad constructed along a route in said Town of Livermore, the center line of which is particularly described as follows; Beginning at a point on the Eastern boundary line or limits of the Town of Livermore 175 feet southerly there on from the intersection of said line with the Southerly line of First o Street, and running thence South 83 52' West, and crossing First Street, a distance of 1152.1 feet ; thence on a curve to the left, with a radius of 2865 feet, and tangent to said last described line, a distance of 588.3 feet, crossing Junction Avenue, the point of intersection of said center line with the Easterly line of Junction Avenue being at a point 175 feet Northerly along said line of Junction Avenue from its intersection with the Northerly line of First Street ; thence on o a tangent to the aforesaid curve and bearing South 72 and 7' West to the Easterly end of Oak Street, and thence along the center line of Oak street a distance of 2746.3 feet to the Westerly line of N Street at a pointy 38.7 feet Southerly there on from the intersection of said line of N Street with the Southerly line of Olivina Avenue ; said center line from the end of said curve to the Westerly line of N Street crossing the following streets, to wit: H Street ; I Street, Livermore Avenue, K Street, L Street, M Street, and N Street ; thence from said point on the on the Westerly line of N Street continuing on the same course and along the center line of Oak Street if produced, a distance of 3231.7 feet to the Westerly boundary line or limits of the Town of Livermore. Section II. Wherever the railroad track of tracks of the said Western Pacific Railway Company, or its successors in interest or assigns, hereby authorized to be constructed, are laid upon any public streets, highway or place, said track or tracks shall be laid and maintained flush with the present established grade of said street, highway or place, and the said Western Pacific Railway Company, its successors in interest or assigns, shall be required to pave and keep in repair said street, highway of place between the tracks and along and within the distance of two feet upon each side of the track occupied by the said Company, in the same manner in which the balance of the street, highway or place at the point so occupied by said tracks is paved and kept in repair Whereoer main line double tracks are laid along any public street, highway or place under the permission granted by this Ordinance, the same shall be laid no farther apart than fifteen feet between the center lines of said tracks, Said Western Pacific Railway Company shall also maintain an efficient alarm bell, or other efficient means of protection, at the crossings of Livermore Avenue and First Street by said track or tracks and at the crossings of other streets, when deemed necessary by the Board of Trustees of the Town of Livermore. Provided, However, that no tracks save main line tracks shall be constructed or maintained on or across First Street and that no street shall be utilized for railroad yard purposes, that is for purpose of switching, handling and storing cars for purposes other that those of loading of unloading the same, or receiving or discharging passengers, and in this behalf no yard track as so defined shall be maintained along the course of any street lengthwise, but all yard tracks in any street shall be for the purpose of reaching railroad yards on private or railroad property from such street. Provided, Also, that culverts of cement, ironstone or other material satisfactory to the Board of Trustees shall be place under said tracks on the gutter line of all streets crossed by said tracks Section III This Ordinance shall take effect and be in force from and after its passage On motion of Trustee Murphy, Seconded by Trustee Mathiesen(sic) the Ordinance granting franchise was adopted and passed by the following vote Ayes Trustees Beck, Knox, Mathiesen(sic), Murphy, Ryan, Noes None Absent None The Ordinance Numbered 37 was then signed by the President and attested by the Clerk The matter of sale of the old town hall and site came up for consideration, On discussing the condition of title is was suggested that the old records be looked into to see how the matter stands and as to the towns right to dispose of the same, It was so ordered and all proceedings th were postponed to Feby 14 The propposition of Joseph Fletcher to remove the old town hall building to the present library site was considered and on motion it was rejected th On motion the Board adjourned to Feby 14 Attest W H Wright Town Clerk Approved T. February 14 1906 Adjourned Meeting The Board of Trustees of the Town of Livermore met in adjourned session at the above written place and date at 7.30 P.M. Pre3sent Trustees Beck, Knox, Mathiesen(sic), Murphy, Ryan Absent None _ President Knox presiding. The matter of taking action on the bid of the Dania Society for the old town hall and site was taken up. After some discussion and it being stated that the town had a right to dispose of the property, the following Resolution was offered and read Resolution Whereas the bids for the old town hall and site were th opened at the regular meeting held on February 5_ And it was found that there was only one bid, being that of the Dania Society in the sum of $805.00 And Whereas it is the opinion of this Board that the bid of the Dania Society should be accepted at the price $ offered, namely 805.00 Now Therefore be it Resolved that the bid of the said Dania Society be accepted and that a good and sufficient deed be prepared and the President of this Board. sign the same, Attested by the Clerk in favor of said Dania Society, as the as the act of the Corporation of the Town of Livermore through its Board of Trustees. Possession to be given in 90 days. On motion of Trustee Murphy, seconded by Trustee Mathiesen(sic) the Resolution was adopted and passed by the following vote_ Ayes Trustees Beck, Knox, Mathiesen(sic), Murphy, Ryan __ Noes None, Absent None The President was requested to get plans and specifications drawn up for new fire house, and also for removal of improvements reserved from sale on old town hall site. Several applications were received for the position of Night Watchman made vacant by the death of P Coghlan they were laid over for action to be taken by the Board th after the Municipal Election of April 9 O Ordinance N - was introduced, being "An Ordinance providing for a General Municipal Election in the Town of Livermore appointing a Board of Election fixing their compensation and Establishing an Election Precinct and Polling Place", The Ordinance was read for the first time and laid over the regular five days before passage T B Jackson appeared before the Board and requested permission to erect a shed on the read end of the property of Fiorio and Guanzirole near corner of First and L streets _ The necessary permission was granted. Town Marshal Smith was instructed to notify JC Reimer to clean the gutter in front of his stable premises on First street, the stagnant water there creating a nuisance On motion Board adjourned to Saturday the th 10 instant. March 10 1906 Adjourned Meeting The Board of Trustees of the Town of Livermore met pursuant to adjournment at 7.30 oclock P.M. Present Trustees Beck, Knox, Mathiesen(sic), Murphy, Ryan. Absent None President Knox in the chair O Ordinance N Entitled "An Ordinance providing for a General Municipal Election in the Town of Livermore, Appointing a Board of Election fixing their compensation, And Establishing an Election Precinct and Polling Place" was read the second time. On motion of Trustee Murphy, seconded by Trustee Beck the ordince was adopted and passed by the following vote. Ayes Trustees Beck, Knox, Mathiesen(sic), Murphy, Ryan. Noes None _ Absent None. The Ordince was signed by the President and Clerk, Numbered 38 and ordered published _ And the President instructed to issue the usual Election proclamation. The Committee of the whole was instructed to investigate the matter of establishing side walks on College Ave and to prepare on ordinance to that effect: Also to look into the matter as to the advisability of having more street lights in the Southern part of town A communication was received from the Livermore Relief Fund Committee, requesting the Board of Trustees of Livermore, to take charge of the fund subject to the following resolution passed by unanimous vote of the committee Liv Releif Resolution Committee Whereas, There are now very few demands upon this asks to have committee and the funds it hold in charge, and it is the the Board desire of a majority of it s members to be releived of further take charge responsibility of a safe and permanent body can be found of the fund to administer the trust, be it Resolved, That the Board of Town Trustees be and it is hereby requested to assume the responsibility of carrying out the wishes of the original contributors of the Releif Fund, and be it further Resolved, that if the said Board accepts the trust that it be asked to carry the Releif Fund separately on its books; that claims be made against it in the regular manner prescribed by the Board for claims against it other funds, and that warrants drawn upon it appear under a separate heading in its official report of expenditures so that contributors to the original fund may know what disposition is being made of all moneys turned over to the Board by the Relief Committee The above resolution was introduced and passed by unanimous vote at a regular meeting of the Livermore Releif Committee, held August 25, 1906, at which a majority of the members were present and voted (signed) d J Murphy, Chairman Attested by A L Henry, Secretary.
