HomeMy Public PortalAbout1965-07-31 Meeting214 COUNCIL MINUTES JULY 31, 1965 At 9:30 A. M. July 31, 1965, after Roll Call, having only Messrs. Faulkner and Landis present, the Village Clerk announced that a quorum was not present for the meeting. Mr. Faulkner stated that the meeting would be adjourned until Wednesday, August 4, 1965 at 8:30 A. M. The Council of Bal Harbour Village met at 8:30 A. M. Wednesday, August 4, 1965. Present: Messrs: Hart, Landis, Taplin and White. Absent: Mr. Fred Faulkner. Also present were W. H. Webb, Village Manager; Mary T. Wetterer, Village Clerk; and Thomas H. Anderson, Village Attorney. After roll call, the Council convened as a Board of Equalization for the 1965 Tax Roll. Mr. Webb informed the members that no complaints were registered with his office and no taxpayers were present. Whereupon, Mr. Taplin made a motion to accept the assessment roll for 1965 as presented by the Tax Assessor. Motion seconded by Mr. White and unan- imously approved. Mr. Taplin then moved that the Board of Equalization adjourn. Mr. White seconded the motion and it was unanimously voted. The Council then reconvened to con- sider the business of the regular meeting. Upon motion of Mr. White, seconded by Mr. Taplin and unanimously voted, the minutes of the previous meeting of June 26, 1965 were approved as submitted. The Council unanimously agreed to table the discussion on the "Stop and Frisk" ordinance until the next meeting when Mr. Anderson will present a proposed ordinance. Mr. Anderson read ORDINANCE NO. 116 Amending Ordinance No. 6 clarifying the method of measuring the distance of travel for our Liquor License Ordinance. Mr. Taplin made a motion to adopt Ordinance No. 116. Motion seconded by Mr. White and unanimously voted. The Village Manager reported on the results of the letters forwarded to the property owners in the Residential Section of Bal Harbour regarding the repaving of the residential streets. 43 replies were received, 21 yes; 12 yes with a condition attached; and 10 definitely no. The Council agreed to table this item until more interest could be generated among the property owners, and also to remove the three traffic bumpers now in the Village streets. July 43119M65 Fuo. 215 Mr. Webb reported on the replies received from the res- idents regarding a proposed ordinance 1iiniting the .number of pets allowed in each residence. 23 replies yes; 9 no; N said they thought we could use some other method of enforcing the ordinance we now have. In this connection. Mr. Webb ad- vised that we had been in communication with the City of Rye, New York inquiring as to their method of controlling this nuisance and they advised they contract with the Humane Society to come in periodically, picking up any stray animals not properly tagged and the owners must come to the Society to claim their pets and pay a fine. After discussion, the Council decided to table this matter until a future date, and Mr. Webb was instructed to inform the residents of the results in the next Newsletter. Mr. Landis then appraised the Council members of the fact that he had been in discussion with the officials of the City of North Miami Beach and had made a study of the possibility of bringing water down to the Village from the City of North Miami Beach. This would necessitate a pipeline over the Haul - over Bridge into Bal Harbour and in these discussions it was tentatively agreed that the price to us would be between 18 to 22 cents per thousand gallons. He also advised that he had been in touch with Mr. Philip Crowen, a Bal Harbour res- ident, and Chairman of Peoples Gas System, and Mr. Crowen had indicated to him that his engineers would make the survey at no cost to the Village taxpayers. In this connection Mr. Webb advised that Bay Harbor Islands Engineers have practically completed their survey on obtaining another source of water from the City of North Miami, which will be piped across the Broad Causeway and Bal Harbour could he supplied off this new source. Mr. Hart suggested that. Zurwelle-Whittaker, Inc., our engineers, make a compari.sion of the two surveys to deter- mine which would be more advantageous for Bal Harbour and Mr. Landis stated that his study is not an engineering survey, and that is the reason he would like Mr. Crowen to make the survey. After discussion, Mr. Landis was appointed a committee of one to contact Mr. Crowen and set up an evening meeting devoted to this one subject. The next item for consideration were the 196-1966 budgets. After discussion, Mr. White moved to adopt RESOLUTION NO. 131 ADOPTING CURRENT FUND BUDGET RESOLUTION NO. 132 ADOPTING WATER DEPARTMENT BUDGET RESOLUTION NO. 133 ADOPTING SEWER DEPARTMENT BUDGET Mr. Taplin seconded the motion and it was unanimously voted. July 11, t.965 Div, a S..i[.r. 216 Mr. Taplin moved to adopt RESOLUTION NO. 134 MAKING A TAX LEVY FOR 1965 Mr. White seconded the motion and it was unanimously voted. The nine month audit was then presented to the Council and upon motion of Mr. White, seconded by Mr. Landis and unanimously voted, the audit was approved as submitted. Mr. Webb advised that several of the gardeners, also work- ing outside Bal Harbour, were dumping trash into our bins in the Village and he had requested that Mr. Anderson prepare an amendment to this ordinance making it illegal to dump trash in the bins which did not come from Bal Harbour. Thereupon Mr. Anderson read ORDINANCE NO. 117 Amending Ordinance No. 101 stating these disposal areas shall be used for trash disposal of property owners in Bal Harbour Village and not otherwise. Motion to adopt amending Ordinance No. 117 was made by Mr. Landis. Motion seconded by Mr. Taplin and unanimously voted. The Village Manager advised of a letter received from Mr. Bowen, Town Manager of Surfside, asking if our Council would be agreeable to a meeting to be held among the members of our tri-city area on the possibility of establishing a Fire Dis- trict. The Council was of the opinion that at this time this is strictly an administrative matter, and directed the Village Manager to meet with the two other Town Managers and then pre- sent his recommendation to the Council. The Village Clerk advised that the Municipal Finance Officers Association requested that all members propose action by their individual cities to promote Federal legislation to offset the effect of the Life Insurance Company Act of 1959, Public Law 86-69. They requested that a Resolution be for- warded to all members of the Florida delegation to the United States Congress to support the introduction and passage of Federal legislation to protect the immunity of interest on state and local obligations. In this connection, Mr. Anderson read RESOLUTION NO. 135 Mr. Taplin moved to adopt Resolution No. 135. Motion seconded by Mr. Landis and unanimously voted. Mr. Webb explained that the Balmoral Hotel had requested the Council's permission to again renew their lease with the Gulf American Land Corporation for another year. After con- sideration, on motion of Mr. White, seconded by Mr. Taplin and A hy4. 1965 65 217 unanimously voted, the Balmoral Hotel was ;;ranted permission to renew their lease with the Gulf American Land Corporation and to obtain an occupational license from the Vill:a,;-e Clerk. Mr. Landis moved to adjourn. Motion seconded by Mr. White and unanimously voted, Mayor ATTEST: Village Clerk COUNCIL MINUTES AUGUST 28, 1965 The Council of Bat Harbour Village met at 9:30 A. M. August 28, 1965 at the Village Hall, Present: Messrs: Faulkner, Landis, Taplin and White. Absent: Mr. Frank C. Hart, Jr. Also present were W. H. Webb, Village Manager; Mary T. Wetterer, Village Clerk; and Thomas H. Anderson, Village _Attorney. On motion of Mr. Landis, seconded by Mr. White and unan- imously voted, the minutes of the previous meeting of July 31st, recessed to August 4, 1't61 were approved as submitted. The first item on the agenda was the proposed "Stop and Frisk"ordinance which Mr. Anderson read to the members. Chief of Police, Dulany J. Dupuy, asked to be heard on this ordinance. He stated that the connotation of the name "Stop and Frisk" has given the wrong impression to the general public and this proposed ordinance simply allowed the Police_ Officer to stop a suspicious person for questioning and, for reasonable cause, have the right to search said person. The Chief further stated that in view of the present nationwide lawlessness, and the ever increasing need to combat crime, this ordinance would offer the Police Officer an effective tool to help in crime prevention.
