ROLL CALL President P. Siemens called the Special Meeting to order at 7:07 P.M. Members Present: Pete Siemens, Mary Davey, Teena Henshaw, Nonette Hanko, Betsy Crowder, and Wim de Wit. Personnel Present: Craig Britton, Jean Fiddes, and Sue Schectman. S. Schectman was present for only the Closed Session portion of the meeting. CLOSED SESSION P. Siemens stated that the Board would be meeting in Closed Session for the purpose of discussing Closed Session agenda item number one. The Board recessed to Closed Session at 7:08 P.M. The Board adjourned the Special Meeting Closed Session at 7:25 P.M. and reconvened for the Special Meeting at 7:35 P.M. Ill. ORAL COMMUNICATIONS There were no oral communications. IV. ADOPTION OF AGENDA Motion: T. Henshaw moved that the Board adopt the agenda. M. Davey seconded the motion. The motion passed 6 to 0. V. WRITTEN COMMUNICATIONS There were no written communications. VI. BOARD BUSINESS A. Initial Interviews of Applicants for the Position of Director— Ward 4 J. Fiddes stated that Mr. Wun Chiou had withdrawn his application. P. Siemens reviewed the process to be used for the initial interviews. J. Fiddes reviewed the specific procedure to be used for the opening statements by the candidates. Britton stated that Mr. Wun Chiou, Sr. had withdrawn his application because of a potential conflict of interest, and his desire to continue donating to the District a "homepage" on the Internet computer network. Siemens called the Special Meeting to order at 7:32 P.M. Members Present: Pete Siemens, Mary Davey, Teena Henshaw, Nonette Hanko, Betsy Crowder, and Wim de Wit. Each candidate was questioned by Directors for twenty minutes. Following the Board's questioning of the candidates, there was a random drawing for order of appearance for final statements. Motion: T. Henshaw moved that the Board adopt Resolution 95-24, a Resolution of the Board of Directors of the Midpeninsula Regional Open Space District Appointing David T. Smernoff Ward 4 Director. M. Davey seconded the motion. The motion passed 6 to 0. The District Clerk administered the oath of office to David Smernoff, and Director Smernoff took his seat with the Board. Jean Fiddes District Clerk Open Space MIDPENINSULA REGIONAL.OPEN SPACE DISTRICT R-95-92 Meeting 95-18 July 12, 1995 AGENDA ITEM Authorization for Director Crowder to Attend the 1995 T st Alliance Rally GENERAL MANAGER'S RECOMMENDATION ] Authorize Director Crowder to attend the 1995 Land Trust Alliance Rally at a projected cost of $700. DISCUSSION The 1995 Land Trust Alliance Rally will be held October 15 to 18 at the Asilomar Conference Center in Pacific Grove. Concurrent workshop sessions to be covered in the program include: land transactions/negotiations, federal policy and partnerships, organizational management, fundraising, state/local partnerships and planning, stewardship, special resources, legal aspects of land preservation, public relations/outreach/education, and biological diversity. The fee for the rally is $280. Total projected expenses for the rally, including fees, lodging, meals, and mileage reimbursement, are estimated at $700. Funding is available in the 1995- 1996 budget for Director Crowder's attendance. DISCUSSION Former Director Babbitt's 1995 committee assignments were the Use and Management Committee and the Acquisition and Enterprise Committee. It is recommended that Director Smernoff fill the current vacancy on these two committees. The other members of the Use and Management Committee are Directors de Wit and Crowder. Directors Hanko and Crowder serve on the Acquisition and Enterprise Committee. At your June 28, 1995, you discussed disbanding the Dog Committee. The Board actually disbanded the Dog Committee at its January 25, 1995 meeting, combining the committee's assignment with those of the Use and Management Committee since the committee members were the same. Staff will work with the Use and Management Committee on follow-up items from your June 28 meeting at which proposed expansion of dog access on designated District preserves was discussed. DISCUSSION Effective January 1, 1995, California workers' compensation laws changed in two important areas: 1)public agencies are no longer requiredd to obtain workers' compensation insurance from State Compensation Insurance Fund if not self-insured; and 2) the laws requiring all insurers to charge the same minimum rate uniformly to all employers within a given classification has been repealed. This latter change is referred to as "open rating" and means that insurance companies can establish their own rates for workers' compensation coverage. As required by law, State Compensation Insurance Fund (State Fund) has been the District's workers' compensation insurance carrier since the District was formed. Dealings with State Fund have been less than satisfactory in terms of overall claims administration and management. In light of the two changes cited above and the lack of satisfaction with State Fund, staff has been working with Dennis C. Rodeen of Sylvester, Schwartz & Tugaw Insurance Brokers to research other insurance companies that offer competitive rates along with significantly improved claims management services. With Mr. Rodeen's assistance, staff has identified CalComp (California Compensation Insurance Company) as a workers' compensation insurance company which offers competitive rates and more personalized claims administration services. CalComp will provide a dedicated claims examiner to handle all claims for the District; face-to-face meetings to review claims as needed; monthly claims activity reports; and a half-day seminar for selected District staff on claims management programs and procedures. These services are not offered by State Fund. As shown below, CalComp's proposed net rates for fiscal year 1995-1996 are also slightly less than State Fund's proposed net rate. The rates proposed by both companies are significantly less than the current rates with State Fund. The District will receive the same level of coverage from CalComp as it would from State Fund and anticipates improved service from CalComp. California Compensation Insurance Company, established in 1933, has an A- (Excellent) Best's rating. Other insurance companies contacted to determine whether they were interested in providing the District's workers' compensation coverage were California Indemnity, AETNA, and General Accident. These companies did not submit bids, primarily because the District's coverage includes District volunteers. Because of the January law changes, CalComp is pursuing workers' compensation coverage in the public sector. They will be providing coverage for the Sacramento-Foothills School District, a major school District in the Sacramento area, and are in the process of discussing coverage with other school districts and water districts throughout the state. The District will pay approximately $50,000 for its workers' compensation coverage. Huff Chairman of the Board California Integrated Waste Management Board 8800 Cal Center Drive Sacramento, CA 95826 RE: Cleanup of Skeggs Point Solid Waste Disposal Site in El Corte de Madera Open Space Preserve Dear Mr. Huff: I am writing to express my support for the pending grant application from the San Mateo County Health Services Agency to the Solid Waste Disposal and Codisposal Site Cleanup Program. The funds will be used for the cleanup of the Skeggs Point Solid Waste Disposal Site in El Corte de Madera Open Space Preserve. This 2,800-acre preserve is owned and operated for the public benefit by the Midpeninsula Regional Open Space District. The Open Space District acquired this preserve in 1988, after the disposal site was already established. The previous owner initially agreed to participate in the cost of the cleanup, but has since gone bankrupt and will not be sharing the estimated $450,000 cost. In addition to the expense of acquiring the property, the District has already expended significant funds towards a cleanup plan and has removed miscellaneous surface debris. Unfortunately, much of the debris is buried and significant work will be required for removal and site restoration. The District is proposing to take responsibility for restoration of the site from its own funds. El Corte de Madera Open Space Preserve is one of the District's most-visited areas. Visitors are drawn to its beautiful environment of redwood groves, fragile sandstone formations, shaded forest, and riparian habitat. The disposal site is particularly disturbing in light of the beauty of the surrounding area. It is not only an eyesore, but constitutes an environmental hazard with significant risk to public health and safety. I urge you to give this grant application full consideration, and to fund the cleanup of the Skeggs Point Solid Waste Disposal Site in El Corte de Madera Open Space Preserve. Hiking or riding in hot weather can easily result in dehydration, so the first rule is to drink plenty of water during a visit. The preserves generally do not have any running water available, so visitors are encouraged to carry enough water for the day. Secondly, visitors should not attempt to hike or ride beyond their skills or experience, a good rule for any visit to a preserve. Keeping to the tree-covered, cooler areas of a preserve, taking a moderate instead of long hike or ride, and not attempting the steepest of trails are all good ideas in hot weather. Hiking or riding in the morning or evening hours will keep you out of the hot midday sun. Wearing a hat and using sunscreen are two easy things that visitors can do to minimize the sun's effects. "Some visitors come unprepared for a hot-weather hike," said Tom Lausten, Supervising Ranger with the Foothills Area of the District. "This can result in some real problems, such as a simple sunburn or exhaustion, or even heat stroke and collapse. Visitors to the open space preserves should always plan their visits around the type of weather expected, and prepare accordingly." The District permanently protects wildlife habitat,watershed, and a variety of ecosystems,restores damaged natural resources, and provides trail improvements for passive recreational use by the public. The District's goals are to acquire a continuous greenbelt of protected open space lands for public use and enjoyment, and to preserve open space for future generations to enjoy. There are approximately 20,000 - 30,000 acres of land still at risk of being lost to development within the District's planning area. The District is divided into seven geographic wards, each represented for a four year term by an elected Board member. The Board holds public meetings on the second and fourth Wednesdays of each month at 7:30 p.m., at the District offices.
