ORDINANCE NO. 005,
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ALLOWING THE CITY
TO ENFORCE STATE OR COUNTY HEALTH ORDERS.
NOW BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. Chapter 18 (MISCELLANEOUS PROVISIONS AND OFFENSES)
Article I (OFFENSES AGAINST PUBLIC HEALTH AND SAFETY) is amended by added
a new Section 18-290 to read as follows:
Sec. 18-290. Compliance with Health Orders.
A. "Health Order" shall mean ay order duly-issued12y the Director of the Missouri
Department of Health and Senior Services or a County Health Department Director having
jurisdiction within the City of Jefferson relating to the prevention, spread, control or
mitigation of infectious contagious. communicable, or dangerous diseases.
B. All persons, businesses and organizations within the City of Jefferson shall fully comply
with the provisions of my Health Order.
C. Any violation of a Health Order shall be considered a nuisance and an offense.
D. Any violation of a Health Order la any business or organization having a business license or
liquor license issued the City of Jefferson shall constitute grounds for suspension or
revocation of such business license and/or liquor license.
E. In any civil action commenced b the City to enforce the provisions of this Section or in any
appellate action in which the City prevails, the City may recover its costs of the action,
including reasonable attorney's fees as awarded12y the court.
Section 2. This Ordinance shall be in full force and effect from and after the date
of its passage and approval.
