COUNCIL MINUTES
OCTOBER 6,. 1970
INITIATION:
1. Mayor Merritt called the regular meeting of the City Council
to order at 7:40 p.m.
2. The invocation was given by Councilman Briggs.
3. The Pledge of Allegiance to the Flag was led by Mayor Merritt.
4. ROLL CALL:
PRESENT: Councilmen - Briggs, Gilbertson, Harker, Tyrell,
Merritt
ABSENT: Councilmen -None
ALSO PRESENT: City Manager Koski, City Attorney Martin,
County Regional Engineer Kiregel
5. APPROVAL OF MINUTES:
Councilman Gilbertson noted that the motion for Item 6, page 1,
of the minutes of September 15, 1970, incorrectly stated that
he had made the second, instead of Councilman Harker. Council-
man Gilbertson moved to approve the minutes as corrected,
seconded by Councilman Briggs and unanimously carried.
Mayor Merritt welcomed Deputy Price and the Citizen and the Law
Class from Oak Avenue School, who were present at the meeting.
UNFINISHED BUSINESS:
There was no unfinished business.
NEW BUSINESS:
6. RESOLUTION No. '70-1045: Designating City Manager as Superinten-
dent of Streets.
City Attorney Martin presented Resolution No. 70 -1045 entitled
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
DESIGNATING THE CITY MANAGER AS SUPERINTENDENT OF STREETS FOR
PURPOSES OF CHAPTER 27 IMPROVEMENT PROCEEDINGS. Councilman
Briggs moved to adopt, seconded by Councilman Gilbertson and
unanimously carried.
7. ACCEPTANCE OF BIDS: KAUFFMAN AVENUE, GARIBALDI TO LONGDEN
- Street Improvements (Curb, gutter and drive approaches,
pursuant to Chapter 27 of the Streets and Highways Code).
City Manager Koski advised that sealed bids for improvements
on Kauffman Avenue, Garibaldi to Longden, were opened on
September 29, 1970, following readvertising, with low bid
in the amount of $16,378.$0 submitted by Sully Miller Contracting
Company of Long Beach, and recommended acceptance. Councilman
Gilbertson moved to accept, and to authorize the Mayor and
City Clerk to sign the agreement, seconded by Councilman
Harker and unanimously carried.

8. ORDINANCE No. 70 -312: 1st read. Re. Amendment to Sanitary
Sewer and Industrial Waste Ordinance.
City Attorney Ma rt i.n advised sed that .the. City of Temple City follows
the County ordinance in regard to industrial waste, and that the
proposed amendments were 'prescribed by the County Engineer in
readopting the County Ordinance as amended. He presented
Ordinance No. 70 -312 entitled AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF TEMPLE CITY AMENDING THE SANITARY SEWER AND INDUS-
TRIAL WASTE ORDINANCE OF THE CITY OF TEMPLE CITY for introduction
and first reading by title only. Councilman Harker moved to
waive further reading, seconded by Councilman Tyrell and
unanimously carried.
RESOLUTION No. 70 -1046: Re. Employment of Temporary Personnel.
City Manager Koski presented Resolution No. 70 -1046 entitled
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
APPOINTING TEMPORARY PERSONNEL., Councilman Briggs moved to
adopt, seconded by Councilman Gilbertson and unanimously carried.
10. RESOLUTION No. 70 -1047: Warrants and Demands, Nos. 2885 thru
2973 in the amount of $107,044.03.
Councilman Gilbertson moved to adopt. Resolution No. 70 -1047
entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $107,044.03,
DEMAND NOS. 2885 THRU 2973, Councilman Harker seconded and the
motion carried unanimously.
11.. COMMUNICATIONS:
City Manager Koski presented a communication from Californians
for Clean Water, urging support of "Clean Water Bonds" on the
November ballot, with sample resolution for consideration by
the Council. Mayor Merritt moved to support and to adopt
Resolution No. 70 -1048 entitled A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF TEMPLE CITY ENDORSING "CLEAN WATER BONDS" MEASURE
(PROPOSITION 1) ON THE CALIFORNIA NOVEMBER BALLOT, seconded by
Councilman Gilbertson and unanimously carried.
12. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK:
No one came forward.
13. MATTERS FROM CITY OFFICIALS:
A. Councilman Gilbertson reported on Sister City visit to
Magdalena, Mexico, expressing appreciation for the opportunity
to participate in their civic ceremonies. He expressed
enthusiasm for the efforts of the new Mayor to improve the
Sister City relationship at government level.
B. Councilman Gilbertson reported on comparative tax costs
for Temple City residents as they related to special districts
and city taxes, as compared to various cities throughout the
county. He reiterated previous concern for the irresponsibility
of the 3oard of Supervisors in allowing the County Tax Rate to
be increased, which was concurred in by Councilman Tyrell.
C. Councilman Tyrell called attention to problems at Live Oak
Park involving tennis court striping and private use of a
Shetland pony on the grounds, which had now been corrected.

D. Councilman Tyrell provided background information relative
to regulatory aspects of sale of detergents containing phos-
phates, which had been referred to the City Attorney for research
and drafting of controlling ordinances for consideration. City
Attorney Martin presented Ordinance No. 70 -313 entitled AN ORDIN-
ANCE OF THE CITY OF TEMPLE CITY ADDING NEW SECTION 5120 TO THE
TEMPLE CITY MUNICIPAL CODE RELATING TO THE SALE OF DETERGENTS
CONTAINING PHOSPHATES, which would ban the sale of phosphates
within the City, and Ordinance No. 70 -314 entitled AN ORDINANCE
OF THE CITY OF TEMPLE CITY ADDING NEW CHAPTER lA TO ARTICLE V
OF THE TEMPLE CITY MUNICIPAL CODE REQUIRING THE POSTING IN
CERTAIN PUBLIC PLACES OF PHOSPHATE CONTENT OF DETERGENTS,
which would require the posting of signs in markets as to phos-
phate content. Councilman Tyrell moved to introduce Ordinances
Nos 70 -313 and 70 -314 and to waive further reading, seconded by
Mayor Merritt. Councilman Harker requested full reading of
Ordinance No. 70 -313. Councilman Tyrell moved to introduce
Ordinance No. 70 -313 with full reading, seconded by Mayor Merritt
and carried, and the ordinance was read in full by the City
Attorney. On the motion of Councilman Tyrell, as seconded by
Mayor Merritt, and carried, Ordinance No. 70 -314 was introduced
by title only, and further reading waived.
E. Mayor Merritt welcomed representatives from local radio
station DSA who were present in the audience, and held brief
dialog with them.
F. City Manager Koski presented a request for authorization
to draw warrants for League of California Cities Conference to
be held in San Diego October 25 -28, 1970, for registration,
advance hotel reservation deposits and expense warrants for
delegates. Councilman Gilbertson moved to approve, seconded
by Councilman Briggs and unanimously carried.
14 ADJOURNMENT:
Councilman Tyrell moved to adjourn to a personnel session
at 8:30 p.m., seconded by Councilman Gilbertson and unanimously
carried. The next regular meeting of the City Council will be
held on Tuesday, October 20, 1970, at 7:30 p.m. in the Council
Chambers of the City Hall.
