Mr. Landis moved to adjourn. Motion seconded by Mr. White and unanimously voted. ATTEST: Village Clerk COUNCIL MINUTES AUGUST 28, 1965 Mayor The Council of Bal. Barbour Village met at 9:9O A. M, August 28, 1965 at the Village Hatt. Present: Messrs: Faulkner, Landis, Taplin and White. Absent: Mr. Frank C. Hart, Jr. Also present were W. H. Webb, Village Manager; Mary T. Wetterer, Village Clerk; and Thomas H. .Anderson, Villa,«e Attorney. On motion of Mr. Landis, seconded by Mr. White and unan- imously voted, the minutes of the previous meeting of July 91st, recessed to August 4, 1965 were approved as submitted. The first item on the :wenda was the proposed "Stop and Frisk"ordinance which Mr. Anderson read to the members. Chief of Police, Dulany J. Dupuy, asked to be heard on this ordinance. He stated that; the connotation of the name "Stop and Frisk" has given the wrong impression to the general public and this proposed ordinance simply allowed the Police Officer to stop a suspicious person for questioning and, for reasonable cause, have the right to search said person. The Chief further stated that in view of the present nationwide lawlessness, and the ever increasing need to combat crime, this ordinance would offer the Police Officer an effective tool to help in crime prevention. Mr. Landis made :a motion to adopt August 28, 1965 218 ORDINANCE NO. 118 Motion seconded by Mr. White and unanimously voted. Mr. Landis then briefed the members on the informal meeting held on August 24, 1965 to discuss the water situation. He stated that in view of the fact that the survey has not as yet been received from the City of North Miami regarding the proposed water line across Broad Causeway, in his opinion some approach should be made to the City of North Miami Beach regarding their indication to him that they could supply an additional source over the Haulover Bridge. Mr. Webb then asked if Mr. Crowen of Peoples Gas System was going to undertake the survey of ob- taining additional water from North Miami Beach, with no cost to Bal Harbour Village, as Mr. Landis had indicated at the July 31st meeting. At this point, Mr. George V. Justin of Peoples Gas System asked to be heard to clarify this matter. He in- troduced Mr. Bollinger, also of the Gas System, and stated that the only interest he and Mr. Crowen had in the water situation was that they were Officers in Neworc Corporation, said corporation owning a residence in Bal Harbour and, as such, were interested in this problem. Mr. Justin advised that it was not the intention of Peoples Gas System to supply an engineering survey. After discussion, upon motion of Mr. Taplin, seconded by Mr. White and unanimously voted, the Village Manager was instructed to contact the City of North Miami Beach to find out just what that City is willing to do with supplying us with water and reportback to the Village Council; this proposal, together with the one received from the City of North Miami, should then be reviewed by our Village Engineers to determine which route is most advantageous to Bal Harbour. The Village Clerk advised that due to the resignation of Alan P. Harold in the Police Department, the members of that department had voted that Robert R. Rowe be nominated as Trustee, replacing Officer Harold, for the Bal Harbour Municipal Police Officers' Retirement Fund, and requested the Council to confirm this nomination. Mr. Landis moved to appoint Robert R. Rowe Trustee. Motion seconded by Mr. Taplin and unanimously voted. Mr. White moved to adjourn. Motion seconded by Mr. Landis and unanimously approved.
