HomeMy Public PortalAbout85-115 (09-03-85)RESOLUTION NO. °5-115 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ESTABLISHING UNDERGROUND tJTIt_ITY DISTRICT N0. 7 The City Council of the City of Lynwood does hereby ' resolve as follows: WHEREAS, try Resolc.rti.on No. 85-98, a public hearing was called for September 1985, at the hour of 7:39 p. m., in the. Council Chambers in the City Hall, Lynwood, California, to ascertain whether the public necessity, health, safety, or welfare regt.iires the removal of poles, overhead wires and associated overhead str-r-4ctures, and the i-rnderground installation of wires and facilities for supplying electric, communication, or similar associated servicev within that certain area of the Cit.v described as follows: The full road easement on Imperial. Highway from the west property line of Carson Drive and continuing eastwards on Imperial Highway to the west property ]i.ne of Cornish Avenr-re WHEREAS, notice of such hearing has been given to al.l affected property owners as sr-rr_h are shown on the last equalized assessment role and to all utilities concerned in the manner- and within the time require 6y law; and p-. WHEREAS, such hearing has been duly and regularly held, II and all persons interested have been given an opportunity to be heard. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lynwood as (allows: 1. Pursuant to Ordinance. No. 848 of the City of Lynwood, the above-described area is hereby declared an Underground Utility District, and is designated as Underground Utili.t_y District No. 7 of the City of Lynwood. Attached hereto, marF::ed E::hibit "A", and hereby incorporated as a part. of this resolution, is a map and legal description delineating the boundaries of said District. 2. The Coc.~ncil does hereby fi:; IVavember i. 1986„ as the date on which affected property owners must be ready to receive underground service, and does hereby order the removal of all pale:>, overhead wires and assnci.ated overhead structures and the undervr-ound installation of wires and facilities for supplying electric, communication, or similar ar associated service within Underground tJtili.ty District No. 7 on or before May i, i987, date of cornpleti.on may 6e e.:tended 6y written agreement of both parties: _. The City Clert:: is hereby instructed to notify a7.1 ~ affected utilities and all persons owning real property within Underground Utility District No, 7 of the adoption of this resol.~.ri:i.oh within ten (1t1) days after the date of such adnpti.on. Said City Cl.ert:: shall further notify said property owners of the necessity that. if they or any person occupying such property desire to continue to receive electric, r_ommunication or other similar ar associated service, they or such occupant shall., by the date fi>;ed in this resolrtion. provide all necessary facility changes on their premi=_~es so as to receive such service from the lines of the supplying utility or utilities at a new location, subject to applicable rules, regulations and tariffs of the respective utility ar ixtil.i.tie~a; r_~n file with the Public Utilities Commission of the State of Ca.l:ifor-nia. Such notification shall be made by mailing a copy of this resolution together with a copy of said Ordinance Nv. 848, to all affected property owners as sc.rch as shown vn the last equalized assessment r-ol.l anri t.o the affected utilities. 4. The City Council hereby finds and determines that the lJndergrnund Utility District herein created is in the general. public interest for the following reason: The streets, road or right-of-way in the district are a>;tensively used by the general public and carry a heavy volume of pedestrian and vehicular traffic...
