Mayor Merritt called the regular meeting of the City Council to order at 7 :40 p.m. 2. The invocation was given by the Reverend Walter Fennel, Church of Christ, 5272 N. Sereno Drive, Temple City, 3. The Pledge of Allegiance to the Flag was led by Mayor Merritt. 4. ROLL CALL: PRESENT: Councilmen - Briggs, Gilbertson, Harker, Tyrell, Merritt ABSENT: Councilmen -None ALSO PRESENT: City Manager Koski, City Attorney Martin, Parks and Recreation Director Kobett, Traffic Engineer Envall 5. APPROVAL OF MINUTES: Councilman Gilbertson moved to approve the minutes of the regular meeting of October 6, 1970, as printed, seconded by Councilman Harker and unanimously carried. The appointment of Carl L. Clark, Sr. as a member of the Parking Commission was confirmed by the Council and he was sworn into office by Mayor Merritt. UNFINISHED BUSINESS: 6. ORDINANCE NO. 70 -312: 2nd read. Re. Amendment to Sanitary Sewer and Industrial Waste Ordinance. City Attorney Martin presented Ordinance No. 70 -312 entitled AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING THE SANITARY SEWER AND INDUSTRIAL WASTE ORDINANCE OF THE CITY OF TEMPLE CITY for second reading by title only. Councilman Harker moved to waive further reading and adopt, seconded by Councilman Gilbertson and unanimously carried. 7 PHOSPHATE CONTENT IN DETERGENTS: Consideration of Second Reading of Ordinance to Ban Sale of Detergents Containing Phosphates, or to Require Certain Postings Relative to Phosphate Content. City Attorney Martin advised that two ordinances relating to pollution control had been given first reading at the previous meeting of the Council, and were now presented for second reading, deferrment or dismissal on either or both. He advised that the first ordinance, No. 70 -313, would place a ban on the sale of detergents containing phosphates, effective July 1, 1971, and that the second one, Ordinance No. 70 -314, would require certain postings relative to phosphate content in detergents. Councilman Tyrell moved to waive further reading of Ordinance No 70 -314 entitled AN ORDINANCE OF THE CITY OF TEMPLE CITY ADDING NEW CHAPTER IA TO ARTICLE V OF THE TEMPLE CITY MUNICIPAL CODE REQUIRING THE POSTING IN CERTAIN PUBLIC PLACES OF THE PHOSPHATE CONTENT OF DETERGENTS; which motion was seconded by Councilman Gilbertson. Gardner McFarland, 5202 Sultana, Temple City, spoke to the point that he did not feel adequate study had been made as to whether phosphates were a pollutant. Ron Satter, Manager, Ralph's Market, 9470 E. Las Tunas, expressed concern for Temple City markets if a ban were placed on the sale of certain items, particularly if sufficient consideration was not given to the time element needed to prepare for it, and additionally the effect on local business if Temple City should be the only city adopting such restrictions. He advised that approximately 250 cases of detergents containing phosphates are sold per week, against a single box or two of a product which contains no phosphates. He Council Minutes, October 20, 1970 - Page 2 He expressed willingness to cooperate with the proposed posting requirement, and concurred that if detergents and soaps containing phosphates were to be banned, that a July 1, 1971 requirement was not unrealistic. John Ballard, 9611 Blackley, suggested that large market chains might well get together to discuss the problem of phosphates to see what might be done on their part. Following Council discussion, there were no objections to the motion to waive further reading of Ordinance No. 70 -314 and the motion carried. Councilman Tyrell moved to adopt Ordinance No. 70 -314, seconded by Councilman Gilbertson and the motion carried unanimously. City Attorney Martin advised that Ordinance No. 70 -313 remained on first reading and would be placed on the next Council agenda unless further action was taken. Councilman Tyrell expressed the desire to waive further reading and adopt Ordinance No. 70 -313, with an effective date of July 1, 1971. Councilman Briggs stated that he did not believe it would be wise to adopt the ordinance until the people realize that they are destroying themselves and something needs to be done; that we need to get more people involved to study the problems. Councilman Gilbertson stated that a committee involving housewives may be helpful in studying this and other problems of environmental pollution. Councilman Harker moved that Ordinance No. 70 -313 entitled AN ORDINANCE OF THE CITY OF TEMPLE CITY ADDING NEW SECTION 5120 TO THE TEMPLE CITY MUNICIPAL CODE RELATING TO THE SALE OF DETERGENTS CONTAINING PHOSPHATES be referred to an ecology study committee which is to be formed, with the City Manager to report back at the next meeting on the proposed structure. The motion was seconded by Councilman Briggs and carried by the following roll call vote: AYES: Councilmen: Briggs, Gilbertson, Harker, Merritt NOES: Councilmen: Tyrell 8 RECOMMENDATIONS FROM THE PLANNING COMMISSION - Meeting of October 13, 1970 A. Change of Zone from R-4 to C -2 - 4810, 4812, and 481.6 North Baldwin Avenue and 10015 East Lower Azusa Road, Temple City City Manager Koski presented the recommendation from the Planning Commission to set public hearing for a change of zone on the described property. Councilman Tyrell moved to set for Public Hearing on Tuesday, November 17, 1970, seconded by Councilman Briggs and unanimously carried. B. Change of Zone from R -1 to R -2, 9240 Longden Avenue City Manager Koski presented the recommendation from the Planning Commission to set public hearing for a change of zone on the described property. Councilman Tyrell moved to set for Public Hearing on Tuesday, November 17, 1970, seconded by Councilman Harker and unanimously carried. RECOMMENDATIONS FROM THE TRAFFIC COMMISSION - Meeting of October 6, 1970 A. WILLMONTE AVE - Additional Red Curb Markings. Traffic Engineer Envall advised that the Traffic Commission recommend placement of 65 feet of red curb marking on the east side of Wi l lmonte Avenue from Lower Azusa Road to the first drive northerly to alleviate the problem of congestion at this inter- section. Councilman Gilbertson moved to approve, seconded by Mayor Merritt and unanimously carried. 1 1 Council Minutes, October 20, 1970 - Page 3 B. LIVE OAK AT BALDWIN AVENUE - Striping Modificaton. Traffic Engineer Envall advised that the Traffic Commission recommended modification of the existing striping on Live Oak Ave. at the east approach to Baldwin, to include three lanes with a painted left -turn pocket, to alleviate congestion primarily during the racing season, and to aid in the movement of traffic at all other times during the year as well. Councilman Briggs moved to approve, seconded by Councilman Gilbertson and unanimously carried. C. LA ROSA DRIVE, WEST OF ALESSANDRO - Additional No Parking Restrictions. Traffic Engineer Envall advised that the Traffic Commission recommended extending no parking restrictions from 7 a.m. to 5 p.m. on school days, approximately 112 feet westerly of this intersection, and to add appropriate arrows on the north side of La Rosa Drive, westerly of Alessandro Avenue north approach to provide additional protection for the school frontage and at the pedestrian crosswalk. Councilman Gilbertson moved to approve, seconded by Councilman Harker and unanimously carried. D. DAINES DRIVE AT ARDEN - Additional Red Curb Marking. Traffic Engineer Envall advised that the Traffic Commission recommended placement of 15 feet of red curb marking on the north side of Daines Drive, immediately east of the Driveway into the Santa Anita Convales- cent hospital to alleviate the visibility problem. Councilman Harker moved to approve, seconded by Councilman Gilbertson and unanimously carried. E. ENCINITA AVENUE - Pentland to Eaton Wash - Modification of Parking Restriction. Traffic Engineer Envall advised that the Traffic Commission recommended rescinding the "No Stopping at Any Time" regulation on the east side of Encinita Avenue, from Pentland Avenue to the Eaton Wash, which was no longer necessary since the recent widening of Encinita Avenue. Councilman Briggs moved to approve, seconded by Councilman Gilbertson and unanimously carried. F. STATE PROPOSAL FOR INTERIOR ILLUMINATED MAST ARM SIGNS - Rosemead Boulevard. Traffic Engineer Envall advised that the State Division of Highways is proposing placing interior lighted signs on Rosemead Boulevard, from Pasadena to Long Beach, and have asked the cities involved to cooperate. The Traffic Commission recommended that four mast arm signs be included for budget submission for the 1971 -72 fiscal year, at an approximate cost of $2,100, for placement at the Broadway and Las Tunas intersections on Rosemead. Councilman Briggs moved to deny, seconded by Mayor Merritt and the motion carried unanimously. 10. RECOMMENDATIONS FROM PARKS & RECREATION COMMISSION - Meeting of October 7, 1970. Director of Parks & Recreation Kobett advised that a request had been received from the Temple City American Little League to re- paint two permanent bleachers located on the north baseball diamond at Live Oak Park, and that the Commission recommended approval. Paint, to be supplied by the City, was estimated to be $120. Councilman 3riggs moved to approve, seconded by Councilman Gilbertson and unanimously carried. 11. ENCINITA AVENUE - Broadway to SPRR (Cash Contract 0294X) Re. Request for Additional Work. City Manager Koski presented a request from I. L. Morhar, County Superintendent of Streets, to authorize additional work performed by the Vernon Paving Company under Cash Contract 0294X for Encinita widening project, in the amount of $1,429.46. Council- man Harker moved to approve, seconded by Mayor Merritt and unan- imously carried. Council Minutes, October 20, 1970 - Page 4 12. RESOLUTION No. 70 -1049: Re. Employment of Temporary Personnel. City Manager Koski presented Resolution No. 70 -1049 entitled A'RES- OLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING TEMPORARY PERSONNEL. Councilman Gilbertson moved to adopt, seconded by Councilman 3riggs and unanimously carried. 13. RESOLUTION No. 70-1050: Warrants and Demands, Demand Nos. 2974 thru 3058, in the amount of $59,551.35. Councilman Gilbertson moved to approve Resolution No. 70 -1050 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $59,551.35, DEMAND NOS. 2974 THROUGH 3058, Councilman Harker seconded and the motion carried unanimously. 14. COMMUNICATIONS: A. City Manager Koski presented communications from the cities of Rosemead and Norwalk, with sample resolutions, requesting the State Legislature to adopt legislation authorizing the establishment of police protection districts in general law cities. Councilman Tyrell moved to adopt Resolution No. 70 -1051 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY REQUESTING THE STATE LEGISLATURE TO PROVIDE LEGISLATION AUTHORIZING THE ESTABLISHMENT OF POLICE PROTECTION DISTRICTS IN GENERAL LAW CITIES, Councilman Harker seconded the motion and it carried unanimously. B. City Manager Koski presented a communication from Church Women United, requesting permission to solicit funds for UNICEF at the Halloween time. Councilman Gilbertson moved to approve, seconded by Councilman Harker and the motion failed by the following roll call vote: AYES: Councilmen- Gilbertson, Harker NOES: Councilmen - Briggs, Merritt ABSTAINING: Councilmen- Tyrell The City Attorney advised the City Council on the provisions of the Temple City Municipal Code re. granting or denying permits and the City Manager was instructed to handle the request with the applicant. 15. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Jerry DeLaunay, 10661 E. Freer, operator of local radio station DSA, requested a study session with the Council relative to providing public information to the community, taping of Council meetings, etc. City Manager Koski was instructed to schedule such a study session. 16. MATTERS FROM CITY OFFICIALS: A. Parks & Recreation Director Kobett presented a recommendation from the Parks & Recreation Commission to accept an offer of the Temple City Kiwanis Club to remodel Live Oak Park maintenance building to a crafts building. Frank Knudsen and Joe Startin of the Kiwanis Club spoke relative to the project undertaking. Council- man Briggs moved to approve, accepting the offer of the Kiwanis Club with appreciation, and to authorize the necessary . expenses as outlined in memorandum to the City Council dated October 20, 1970. Councilman Gilbertson seconded the motion which carried unanimously. The request for a suitable sign designating the crafts center, measuring 18" x 96" was discussed, and it was agreed that a smaller plaque, approximately 15" x 18" located on the interior of the facility would be suitable and would also recognize Mr. Hersperger and the Kiwanis Club for their efforts in making the project possible. B. Councilman Gilbertson inquired as to the .status of the frame.. house on Rio Hondo, which is in a dangerous and deplorable condition. City Manager Koski advised as to previous commission action on this dwelling and will check on progress of demolition or repair. C. Councilman Harker advised that a similar dwelling on the north- west corner of Halifax and Daines should also be checked out. 1 1 Council Minutes, October 20, 1970 - Page 5 D. Councilman Briggs reported on a hazard at Golden West and Garibaldi, proposing sidewalk construction at curb return. E. Mayor Merritt reported on a light out on Cloverly, on the west side in the 5700 block. F. City Manager Koski called attention to the Contract Cities meeting to be held on Wednesday, October 21, 1970. G. STREET IMPROVEMENTS - Garibaldi: Temple City Boulevard to Camellia Avenue. City Manager Koski requested that a public hearing be set relative to curb, gutter and drive approach improvements for the north side of Garibaldi Avenue, Temple City Boulevard to Camellia Avenue, under Chapter 27 proceedings of the Streets and Highways Code. Councilman Tyrell moved to set Public Hearing for Tuesday, November 3, 1970, at 7:30 p.m., seconded by Councilman Briggs and unanimously carried. H. City Attorney Martin presented a proposed code amendment re. use of air guns, which was discussed briefly and referred for further study as to the relation of this section with other sections of the Municipal Code. I. City Manager Koski advised that the school district had been contacted as to possible bus service for students west of Rosemead and north of Longden, and that the school district may be receptive to an official request from the Council that such service be pro - vided in lieu of having a crossing guard at this location. Council- man Gilbertson moved that the Council officially communicate with the school district in this regard, seconded by Councilman Tyrell and unanimously carried. J. PERSONNEL ITEMS: City Manager Koski requested Council confirmation of study session recommendation for salary increase for the position of Administrative Assistant, from schedule 47.5 to 49, 3rd step, effective September 15, 1970, with reimbursement for auto expense at flat rate of $35 per month. Councilman Briggs moved to approve, seconded by Councilman Gilbertson and unan- imously carried. City Manager Koski also presented the request for authorization to employ a part -time administrative intern and transfer of funds for part -time personnel. Councilman Harker moved to approve, seconded by Councilman Gilbertson and unanimously carried. 17. ADJOURNMENT: Councilman Tyrell moved to adjourn at 9:30 p.m., seconded by Councilman Briggs and unanimously carried.
