I. ROLL CALL
Vice President Mary Davey called the meeting to order at 7:00 p.m.

M. Davey stated that the Board would adjourn to the Special Meeting Closed Session for the
purpose of discussing Closed Session agenda item 1.
The Board recessed to Closed Session at 7:00 p.m. and the Closed Session commenced at
7:01 p.m. The Board recessed the Special Meeting at 7:28 p.m. and M. Davey called the
Regular Meeting to Order at 7:32 p.m.

IV. ADOPTION OF AGENDA
Motion: D. Smernoff moved that the Board adopt the agenda. P. Siemens seconded the

V. ADOPTION OF CONSENT CALENDAR

Motion: P. Siemens moved that the Board adopt the Consent Calendar including the
minutes of March 13, 1996 Regular Meeting; agenda item 5, Approval of
Annual Claims List, Including Debt Service Payments, for 1996-1997 Fiscal
Year; agenda item 8, Authorization to Contract with Pacific Gas and Electric
Company for $69.143 to Underground Utilities Along Portola Road and
Reroute Existing Service to the Adjacent Parcel and Windy Hill Oren Space
Preserve and Determination that Project Categorically Exempt from California

the motion. The motion passed 4 to 0.
In regard to Item 8, PG&E undergrounding for Portola Road, M. deBeauvieres said the
report states that the PacBell fees are included in the cost estimate. She said the trenching is
included but there may be an additional fee due to PacBell of about $2,000 that could appear
on a future claims list.
VI. BOARD BUSINESS
A. Agenda Item No. 1, Adoption of the 1996-1997 Action Plan for the Implementation
of the Basic Policy of the Midpgninsula Regional Oren Space District (port R-96-
J. McCullough said when the Action Plan was tentatively adopted, there was an
amendment adding the construction of the trail to the Hayfield at Fremont Older Open
Space Preserve and deleting the Sevens Spring Road Bypass Trail. She said the
change has been addressed in the form of the amendment before the Board this
evening. She proposed a revision to the amendment to include construction of the
Seven Springs Road bypass trail and the trail to the hayfield, so that the end of the
last sentence of Key Project No. 2 on page 8 of the Plan would read, ". . . and
construct Seven Springs Road bypass trail and trail to the hayfield at Fremont Older
Open Space Preserve." She said the reason for this is that there has been a change in
the availability of the trail building consultant which will allow staff to build both
trails at Fremont Older if they can proceed immediately. Funding for the bypass trail
will be provided from funds designated for the trail to the hayfield in the 1996-1997
budget. If additional funds are needed to complete the hayfield trail, she said the
Board will be asked for a midyear funding budget adjustment.
Motion: B. Crowder moved that the Board adopt the 1996-1997 Action Plan for
the Implementation of the Basic Policy of the Midpeninsula Regional
Open Space District as amended. D. Smernoff seconded the motion.
The motion passed 4 to 0.
B. Agenda Item No. 2 - Acceptance of 1996-1997 Insurance Premiums for District's
PE=M and General Liability. Umbrella Liability, Automobile, Fidelity Bond. and
Public Entity Errors and Omission Insurance Coverage - (RQ= R-96-44)
J. Fiddes reviewed the bids contained in the staff report, noting the bid package
totalled $150,539. Skip McIntyre from Flinn, Gray & Herterich, the District's
insurance broker, was present to answer questions.
B. Crowder noted that the bid was for a one-year period and asked if there were
penalties for early cancellation. Mr. McIntyre stated that there would be a short-rate
cancellation penalty which begins at a maximum of 10% and would decline
throughout the year depending on when the cancellation took place.

Motion: D. Smernoff moved that the Board accept the 1996-1997 Insurance
Premiums for District's Property and General Liability, Umbrella
Liability, Automobile, Fidelity Bond, and Public Entity Errors and
Omission Insurance Coverage. P. Siemens seconded the motion. The
motion passed 4 to 0.
C. Agenda Item No. 3 - Approval of 1996-1997 Salary and Benefit Adjustments for
Office, Supervisory, and Management Staff- (Report R-96-36)
J. Fiddes reviewed the staff report which she said was prepared by D. Dolan. She
outlined proposed changes in salary, sick leave conversion, and basic life insurance.
Staff answered questions about the method of computing the percentage of total
increase.
Motion: P. Siemens moved that the Board approve the 1996-1997 salary pay
plan, that includes a 2% adjustment for the District's office,
supervisory, and management classifications effective April 1, 1996;
approve the implementation of a sick leave conversion program
whereby office, supervisory, and management staff who leave the
District in good standing with a minimum of 10 years of service
receive a cash payout of accrued sick leave as follows: 20% of accrued
sick leave for 10 to 15 years of service; 25% of accrued sick leave for
16 to 20 years of service; and 30% of accrued sick leave for 21 or
more years of service; approve an increase in basic life insurance from
the current $10,000 for each employee to an amount equivalent to the
employee's annual salary. D. Smernoff seconded the motion. The
motion passed 4 to 0.
D. Agenda Item No. 4 - Approval of Budget t for Fiscal Year 1996-1997 (RR=rts R-96-
34 and R-96-0
C. Britton said there are no changes proposed from when the Board last reviewed the
budget and staff recommends approval.
Motion: B. Crowder moved that the Board accept the Administration and Budget
Committee's recommendations contained in report R-96-34 and adopt
Resolution No. 96-12, a Resolution of the Board of Directors of the
Midpeninsula Regional Open Space District Adopting Budget For Fiscal
Year 1996-1997. D. Smernoff seconded the motion. The motion
passed 4 to 0.
Board members commended staff for the way the budget process was carried out.
E. Agenda Item No. 6. - Proposal to Exercise Right of First Refusal to Repurchase the
Former Fee Determinable 12-Acre Estate of Kyle Bach Adjacent to Skyline Ridge
Q= Space Preserve for $275.000: Tentative Aft tion of Preliminary Use and
Management Plan Recommendations for the Parcel: Intention to Withhold Prop. M

After M. Williams pointed out the location of the property on a map, C. Britton
summarized the District's historical experience with the property.
J. McCullough described details of a map of the property including potential trail
alignments which would connect Skyline Ridge with the Russian Ridge Open Space
Preserve. She showed slides of the property and views from the property. She said
staff is recommending acquisition for the following reasons:
• The need to reevaluate the best trail alignment through the property to make the
best connection between Skyline Ridge and Russian Ridge Open Space Preserves.
• The necessity to have patrol access through this property.
• The need to have more control over the use of the life estate area to make sure
uses that occur are compatible with trail uses.
J. McCullough said that when staff structured the agreement in 1988 the connection
between Portola State Park and Skyline Ridge via Old Page Mill Road was really
thought to be a long term project. Since then the District has acquired a majority
interest in the Big Dipper Ranch and has applied for a potential grant that would
connect the Big Dipper Ranch with the Skyline Ridge Open Space Preserve. She said
staff anticipates that when this trail is constructed it will be one of the more popular
trails. As a result, staff thinks that once the Page Mill Trail is opened there will be
more of a demand to connect up to Russian Ridge, so that trail system has become
more of a high priority project. In addition, once visitors are on Page Mill Trail it
will be important to have patrol access to respond to emergencies and to be able to
have routine patrols to monitor usages occurring on Page Mill Road. In summary, J.
McCullough said staff is recommending acquisition of this property so the District can
gain more control over the use and ensure that the activities on this property are
consistent with the type of uses the District would want for visitors.
M. Williams said the party who had made the $275,000 offer was at this meeting.
There are two alternatives presuming that the Board approves the proposal for right of
first refusal: 1. Continue negotiations with buyers for a more compatible estate
purchase agreement. Staff is hopeful that they will be able to negotiate with the
buyers on a resale of the estate and would be seeking to improve patrol access on the
property, improve the trail alignments, and the overall visual aspects of the property.
2. Do necessary repairs for the property to be an enterprise rental. He said staff will
be coming back within the next three months with recommendations on the disposition
of this property.
In answer to B. Crowder's question regarding resale and acquisition, M. Williams
said staff asked for an extension from Bank of America to re-negotiate this sale
agreement so it would be more compatible with the District's surrounding uses. That
extension was not granted so to regain control the District needs to exercise the right
of first refusal (buy the property). He said if the Board approves the right of first

refusal, staff will continue negotiations with the buyer for an agreement that is more
compatible, including use and management provisions that J. McCullough outlined.
D. Smernoff asked if staff had more information about the potential gasoline leakage.
C. Britton said when the District bought the property there were questions about this;
tests were done and no leakage was found. He said the District would sell the
Property as is.
P. Siemens said he would like the Board to exercise the option but agreed with staff
and B. Crowder that it should then be resold if possible. However, if the option is
exercised and the property is rented, there will be a return greater than the interest
payment while staff looks for a buyer.
P. Siemens said the optimum situation would be to negotiate an agreement and
actually handle everything in the same escrow. C. Britton agreed but said it is a tight
time period and that is why an extension was requested. He said he had talked to
officers at Bank of America and they said denying the extension was a business
decision.
Frank Hughes said he and his wife Laurie wish to purchase the property and thought
they could reach an agreement regarding the special terms. He asked if staff would
object to him contacting the bank and asking for an extension. C. Britton encouraged
him to do so.
Motion: P. Siemens moved to adopt Resolution No. 96-13, a Resolution of the
Board of Directors of the Midpeninsula Regional Open Space District
Exercising its Right of First Refusal to Repurchase the Former Bach
Fee Determinable Estate, Authorizing Officer to Execute Certificate of
Acceptance of Grant to District, and Authorizing General Manager to
Execute Any and All Other Documents Necessary or Appropriate to
Closing of the Transaction (Skyline Ridge Open Space Preserve - Fee
Determinable Estate - Bank of America); tentatively adopt the
Preliminary Use and Manager Plan recommendations; indicate intention
to withhold the property from dedication as public open space at this
time; and determine that the recommended actions are categorically
exempt from the California Environmental Quality Act. D. Smernoff
seconded the motion. The motion passed 4 to 0.
F. Agenda Itm No. - Presentation fFi - i1 Activity
Miscellaneous Enforcement Activities Report - (Report R-96-41)
J. Escobar said this is the first annual report on field activities. If the Board likes the
format, staff will use it and will try to issue it by February of each year. He
described the efforts to improve the activity summaries by changing and adding
categories to make it more descriptive. He said it is still not a good instrument to
compare from year to year, although this year's numbers are better than last year's
because there are more categories and some categories are double checked against

planing statistics. J. Escobar highlighted items in Appendix B and observations on
page 2 of the report. He stated that the number of rangers present at the May 23
incident should be changed from 2 to 1.
B. Crowder said it was important to get this report and the monthly reports. J.
Escobar said statistics can be compiled by site. B. Crowder said she would like this
information for her area.
C. Britton stated that staff is folding information from sites into the planning process.
J. Escobar commented on the auto burglary data and the future use of graphical
presentations in the report.
Motion: D. Smernoff moved that the Board accept the Five-Year Activity
Summary and the 1995 Miscellaneous Enforcement Activity Summary.
P. Siemens seconded the motion. The motion passed 4 to 0.
VIE[. INFORMATIONAL REPORTS
D. Smernoff said he had been to El Corte de Madera Open Space Preserve with staff and
toured trouble spots. He gave staff information on a Broom Symposium in Portland on April
17 and 18 and a Natural Resources in the Environment Symposium in Pennsylvania in May.
M. Davey said she attended the Ridge Trail Council meeting in San Francisco. She heard
reports from counties where the Ridge Trail is located, including gap committee reports.
Also, the work plan for the coming year was presented as well as a presentation of a
comprehensive list of studies and reports about various activities throughout the Bay Area,
including seven major areas of study. She had a copy of the Trails section which she said
was available for review. She said she has volunteered to serve on the Santa Clara County
gap committee and will continue to attend the council meetings.
P. Siemens reported on the Grant house restoration at Deer Hollow Farm, noting he and
other volunteers have moved furniture and artifacts to the house which is close to being
finished.
C. Britton referred the Board to the notice of the dedication of the Peninsula Open Space
Trust Learning Pavilion on April 20, noting he would not be able to attend. He also
mentioned a memo on a grassland/thistle study, an invitation to the new Palo Alto Mayor's
address, and an announcement of a Sequoia Audubon Society award to W. de Wit on May 9.
In addition, he said that by March 29 the improvement for the off leash area at Pulgas Ridge
should be completed. He also pointed out how changes are indicated on the revised claims
list.

J. Escobar reported that during the last three weeks various staff members had been at the
Oak Symposium in San Luis Obispo, the Parks Rangers Association Conference in Ventura,
and the Trails Conference at Asilomar. He said a Use and Management Committee meeting
has been scheduled on April 15 to review the El Corte de Madera Trail Plan. J. Escobar
said there are 17 or 18 people in the training class for the volunteer patrol program, mostly
hikers, and the class is more diverse in age than previous classes. C. Britton said training
has started for the volunteers who will open the Nature Center on Sundays.

Dear Directors,
I am writing to the MROSD in regard to its proposed trail plan for El Corte de Madera Open Space Preserve. I
appreciate that the MROSD included - in its task force - a broad cross-section of the community that enjoys this
park. However, I am disturbed that the resulting trail plan does not reflect the concerns of this conununity, and
by the fact that during the open meeting held on January 25th, the directors seemed determined to proceed with
the plan, in spite of the considerable criticism expressed by the public at that meeting.
The numerous preserves owned by the MROSD span the spectrum from gentle open spaces located next to
urban areas (such as Fremont Older), to wild and rugged land located in more rural settings (such as El Corte de
Madera). I feel that this wide diversity of preserves is important, and that because of this, the MROSD's trail
guidelines should be flexible, instead of a "one size fits all" policy being applied uniformly to all preserves. In
particular, the wide, smooth, gently-sloped trails found in preserves such as Fremont Older and Saratoga Gap
would be less appropriate in E1 Corte de Madera, especially in the southwestern section of the park. far from
Skyline Boulevard. Many of the trail modifications in the MROSD's proposed plan would diminish the special
character of El Corte de Madera, and spoil much of its natural beauty.
I also note that El Corte de Madera is currently very popular with mountain cyclists. I am concerned that the
widespread trail closures and realignments outlined in the MROSD's plan will make this park much less popular
with this group of trail users, increasing the possibility of trail conflicts occurring in other preserves.
In summary, I ask the MROSD directors to consider amending their El Corte De Madera trail plan as follows:
- Limit the major trail realignment, widening and leveling to the area of the preserve that closest to Skyline
Boulevard. - Leave the trails in the other areas of the preserve (especially in the south and southwest)
untouched, with possible exceptions made, on a case-by-case basis, for areas of extreme erosion. - Meet with
the owner of the private property at the northwest corner of the park, to discuss whether some arrangement can
be made to permit park visitors to cross this land. (I note that there is already a precedent for this - namely, the
Garrod Farms land adjacent to Fremont Older O.S.P.)

I am sending this message to provide my perspective on the closure of trails in the El Corte De Madera Open
Space Preserve. I have been riding my mountain bike in this area for about the past year. It is one of the best
locations I have ever ridden in the Bay Area. It is beautiful and provides a pleasent experience for those who
hike or ride there. As a matter of fact, in the year I have been going to ECDM, I have only seen two hikers. This
is most likely because ECDM is located in a dense area of forest growth, and many do not know about it. This is
primarily a very big mountain biking area.
My premise is this. Please do not close any of the trails. What would be the point. Mountain bikers and hikers
alike both respect the area and condition of the trails. We ride for the fun and the pleasure. We use safety
precautions and we respect each other(hikers, bikers and or horses). Consideration must be taken for those who
use the preserve and what they get out of it. This is a place where people can get away from some of the stresses
experienced in life and go have fun. The more that is taken away, the more we as citizens become restricted by
guidelines that do not necessarily reflect those of the citezens...but rather the Board.
We are hurting nothing out there. From an erosive perspective, it is going to happen whether or not hikers,
bikers or equestrians are on the land. Rain, wind, earthquakes and pretty much nature in general taken care of
this on a much larger scale. As a matter of fact, the storms in Novemeber and December sent down hundreds of
trees, eroded many of the trails and non trails, and pretty much reshaped the area in many ways. A few people
on the trails pales in comparison to what nature does on a regular basis.
Please consider how keeping these areas open impact the economy. Hiring, mountain biking and (Horsing?)
stimulate the economy in positive ways.
1. Products are purchased so people can participate in these activities.
2. Businesses local to ECDM experience positive effects. Foods stores sell more inventory, Alices restauraunt
gets more business, Gas stations benefit,and more.
3. As word gets out that this is a pleasent area, more come from afar to experiece it, further stimulating the local
economy.
I hope my point is clear...please don't take away places of pleasure. We already have a difficult time getting
away on "vacations" to regenerate our productivity in the economy.

Dear Commission:
The Commission should consider the ideas and suggestions put forth by the local mountain bike groups
seriously, because if trails are closed and the suggestions ignored San Mateo County will soon be expierencin�g,
the same problems with outlaw trails and illegal mountain biking that Marin has encountered. Marin is having
trouble because they put outrageous restrictic)ns on nx)untain bikers without paying attention to their requests.
Typically. the majority of-open space preserve users are mountain bikers and it is wrong to exclude them from
future trail planning. It has been my experience that planning commissions have a negative bias towards
mountain bikes and their planning reflects this in the closing of trails and general exclusion of mountaining
groups from planning sessions.
So when your making any fi►ture plans. consider adding an avid mountain biker to the group to help design
trails which are both safe and environmentally friendly.

Thank you for your April 1, 1996 email concerning trail use at El Corte de Madera Creek Open Space
Preserve. The Board reviewed your correspondence at its regular meeting last night.
Many individual mountain bicycle riders, as well as representatives from Responsible Organized Mountain
Pedalers (ROMP), have been very involved in the development of a plan for the trails at this preserve, as well as
our overall Trail Use Guidelines. The District makes every effort to be as inclusive as possible in our trail
planning process, providing for a number of public meetings and planning sessions in which individuals are
encouraged to participate.
I might also add that the District is considered by groups such as ROMP and the International Mountain
Bike Association (IMBA) to be one of the most "mountain bike-friendly" park or open space agencies in the Bay
Area. Over eighty-percent of our trails, including a significant portion of single-track, are currently open to
mountain bicycles. The Board takes very seriously the views and concerns of our mountain-biking constituency; in
fact one of our Board members, Mr. David Smernoff, is an avid mountain bicyclist and brings that point of view
directly to the Board's deliberations.
I'm sure you understand that the Board must balance the needs and desires of particular user groups with
those of the District's entire constituency, and its overall planning objectives and resource management goals.
Finding that balance is no easy task, but with the involvement of our visitors, including mountain bicyclists,
hikers, and equestrians, we feel that we're making good progress.

Dear Board Members:
I am concerned about recently announced plans to severely alter the El Corte de Madera Open Space Preserve.
This preserve is unique in it's wild, untamed nature. Residents of the Bay Area are able to visit the preserve and
come within close contact with remote wilderness via the many winding, beautiful trails throughout the park.
The plans now under consideration by your board, however, would ruin the distinct character of this area.
Plowing fire roads and eliminating trails and trail access for visitors would diminish the exceptional qualities of
E1 Corte de Madera. Too many parks in the Bay Area are full of fire roads that take away the natural
intimateness that El Corte de Madera offers its human guests.
Please reconsider this plan. You have one of the finest natural areas for visitors in the entire state. Thank you
for your consideration.

Dear Directors,
I read the following letting posted on the World Wide Web recently and I would like to register my support for
Mr Finlayson's recommendations. Just last year I started mountain biking in El Corte de Madera and it find it to
be a very special place for mountain biking due to the fact that the trails are steep and narrow. I understand that
many park users may not appreciate these trails, but then again there are many parks off Skyline Road where
trails are not so steep and narrow. I believe it would be beneficial to the community to provide a range of trail
types for the users of the mid-Peninsula open space preserves and perhaps letting parts El Corte de Madera
reside at one end of this range would provide an interesting and diverse range of recreational opportunities for
park users. I enjoy El Corte de Madera's trails just as much as I enjoy Saratoga Gap and Montebello's more
gentle terrain. I enjoy the variety, I would urge you to strongly consider Mr. Finlayson's recommendations as a
way of preserving this variety and range of recreational opportunities.

woods, trails, and a feeling of remoteness fairly close to an urban population. Of the many open space preserves
I've visited, El Corte de Madera is the one that seems most nature-like. I would hate to see its natural character
diminished.
I am an active member of the Sierra Club and also of ROMP, the mountain-biking advocacy organization.
From both perspectives, I am concerned about potential trail modifications and use restrictions, and would ask
the following:
- Limit trail widening and leveling to trails closest to Skyline, those most accessible to the general public.
- Leave trails in other areas untouched except for extremely eroded or swampy areas.
- Continue to support multiple-use access to the trails throughout the area.

I am writing to voice my objection to the new trails plan proposed for El Corte de Madera Open Space
Preserve. This OSP is one of the few more "natural" areas in the South Bay. Its trails are narrower and more
secluded than those of many other OSPs. This combined with some fantastic natural views makes E1 Corte de
Madera one of the most enjoyable places for hikers and bicyclists.
The Mid Penninsula Open Space District does fantastic work keeping the many OSPs open and safe for the
public. I would like to see you preserve El Corte de Madera in its current state. In no other OSP do I come
across so many sun-speckled trail areas, natural looking vistas, and cozily overgrown passages. Replacement of
these trails with roto-tilled roads and fire roads would hinder the beauty of this OSP.
Thank you for your consideration. While I disagree with the District on this issue, you have my appreciation for
a lot of hard work.

In regards to the proposed trail plan for El Corte de Madera Open Space Preserve.
It appears that the board is proceeding without concern for the community that will use
the preserve as expressed in the open meeting January 25.
Please leave the area as natural as possible. We really do not need wide,featurless trails.
Many of us in the mountain bike community agree that the trail plan be amended acording
to the following points:
• Limit the major trail realignment, widening and leveling to the area of the preserve that
closest to Skyline Boulevard.
• Leave the trails in the other areas of the preserve(especially in the south and
southwest) untouched, with possible exceptions made,on a case-by-case basis,for
areas of extreme erosion.
• Meet with the owner of the private property at the northwest corner of the park, to
discuss whether some arrangement can be made to permit park visitors to cross this
land. (I note that there is already a precedent for this- namely, the Garrod Farms
landadjacent to Fremont Older O.S.P.)

Staff is continuing to discuss this matter with the intereste.�"' -es and will formulate a
recommendation by the time of your meeting of April 10, 1996.
DISCUSSION
At your meeting of March 13, 1996, you voted to continue the proposed sale of the
Thornewood Surplus Property agenda item (see Report R-96-25) to your meeting of April 10,
1996. Neighbors present at the meeting requested a continuance to better evaluate the
implications of the proposed action. Neighboring property owners who attended the March
13 meeting were notified of this continuance. Also, as a result of the comments from some
of the neighbors, staff has realized that the District's notification policy needs updating to
include adequate review period for situations where the District is considering disposing of
land rights. Proposed revisions to the public notification policy have already been sent to
your Legislative and Public Affairs Committee.
The private parties involved in the proposed Option agreement, Jonathan and Roberta Parmer
and Paul and Marcia Cook, have extended their offer to enter into an option on the sale of
the Thornewood surplus property until April 10, 1996. In addition, the Option Agreement
has been amended to include notification of the Town of Woodside's Planning Department of
the proposed sale of property for review as to conformity to its general plan in accordance
with Government Code 65402. On Thursday April 4, a representative on behalf of one of
the neighbors indicated an interest in purchasing the property at a price substantially higher
than the current offer. Since no written offer or other written communication has been
received as of the mailing of this report, staff will continue to work with the interested
parties and provide you with additional information and a revised recommendation, if
warranted, at the time of your meeting.

GENERAL MANAGER'S RECOMMENDATION
Approve closing the District's administrative office on December 23, 26, and 27, 1996
DISCUSSION
I propose the District try on a one-year pilot basis the closing of the administrative office at
330 Distel Circle on Monday, December 23, Thursday, December 26, and Friday, December
27. The administrative office is already slated to be closed on Tuesday, December 24 and
Wednesday, December 25; these two days are 8-hour holidays for the District's
administrative, supervisory, and management staff. This proposal applies only to the
administrative office; District preserves and trails will be "open" and available for the
public's use and enjoyment as weather permits.
This holiday week is a fractionalized workweek. Productivity tends to be low and it is
difficult to conduct business as usual because of the number of people at other jurisdictions
and companies, including vendors and suppliers, who take some time off during this holiday
week. Because of the limited number of staff here at the District in certain job
classifications, vacation and time-off requests during this holiday week cannot always be
approved; this is particularly true for members of the support staff and the receptionist.
This closure directly benefits those employees who might otherwise not be able to take time
off during this holiday week. The Monday of this 1996 holiday week is also a 9-80 Monday,
a day participants in the 9-80 flexible work schedule program are already scheduled to be
off.
Typically few, if any, members of the public coming to the District office to request maps or
other information about the District during this holiday week.
If you approve the closing of the District office on December 23, 26, and 27, the front door
would remain locked the entire holiday week. A special recorded message would be placed
on the District's incoming phone line advising callers of the administrative closure. A notice
explaining the closure will be placed on the front door in case any member of the public
were to drop by. The special recorded message and notice will include who to contact in the
event of an emergency.
Any staff member who wants to work on December 23, 26, and/or 27 will have the
opportunity to do so. At least one District manager will be working in the office each day or
be available by telephone in the event there is some type of an emergency or
situation warranting a manager's involvement.

Extension of Consulting Services Agreement with George Sipel Associates for Organizational
Management and Personnel Services
GENERAL MANAGER'S RECOMMENDATION
Authorize the General Manager to execute the attached six-month Consulting Services
Agreement Amendment with George Sipel Associates to provide organizational management and
personnel services at the cost of $75 per hour not to exceed $4,200 per month for the months
of April, May, and June 1996 and not to exceed $2,100 per month for the months of July,
August, and September 1996.
DISCUSSION
In October 1995, the Planning Department began a process to develop a self-managed work
team. George Sipel was retained on a half-time consulting'basis to direct and facilitate the
process for a six month period. The Resource Planner position was to remain vacant to allow
staffing flexibility help and provide funding for the effort.
Over the past six months substantial progress has been made. Accomplishments include:
• Promotion of two Planning Technicians to Open Space Planner I and hiring of a
Planning Technician.
• Reallocation of duties and assignments as a result of two resignations and a
reassignment. j
• Revision of the work program and capital improvement processes.
• Assimilation of the Acquisition program into the Planning program.
• Assignment of management duties to team members.
• Provision of team building training.
Work remains to be done in order for the Planning Team to function effectively without a
manager in the traditional sense. Over the next six months the team needs to work on several
tasks:
• Enhancing team skills, such as working together as a group, meeting
effectiveness, and group problem solving.
• Improving interpersonal skills such as communication, giving and receiving
feedback, and conflict resolution.
• Developing a team performance appraisal process.
• Encouraging and assisting the growth of team members in their jobs.
• Strengthening relationships with other parts of the organization.

To assist the team, I recommend continuing Mr. Sipel's services on a reduced basis. In addition
to team building activities, his assistance will be utilized on other important District projects
including a review of work processes involving project management and consultant selection,
development of an improved salary incentive program, and promotion of enhanced
communication and participation by employees in District programs.
The plan is to have Mr. Sipel work an average of 14 hours per week for the next three months
and seven hours per week for the succeeding three months. The cost of this amendment to
George's contract, based on Mr. Sipel's hourly rate of$75, will be $18,900; $12,600 for the
months of April, May, and June and $6,300 for the months of July, August, and September.
Funding for this contract extension is included in the 1996-1997 Planning Program budget.
The initial six-month contract called for George Sipel Associates to provide organizational
management and personnel services at the cost of$75 per hour not to exceed $6,000 per month
or $36,000 for the duration of the initial contract. Actual expenditures through march 31 for
this contract totalled $30,450.

CONSULTING SERVICES CONTRACT AGREEMENT AMENDMENT
THIS CONSULTING SERVICES AGREEMENT AMENDMENT, entered into this day
of April, 1996 by and between MIDPENINSULA REGIONAL OPEN SPACE DISTRICT
(hereinafter called "District") and GEORGE SIPEL ASSOCIATES (hereinafter called
"Contractor")
WITNESSETH
WHEREAS, the District entered into a Consulting Services Agreement (hereinafter called
"Agreement") with the Contractor on September 27, 1995 to render special and professional
personnel and organizational relations services.
WHEREAS, the term of the Agreement concluded on March 31, 1996.
WHEREAS, the District desires to continue to engage the Contractor for a period of six months.
NOW, THEREFORE, the parties mutually agree as follows:
1. TERMS OF AGREEMENT AMENDMENT
The term of this Agreement Amendment is to commence April 1, 1996 and to conclude
on September 30, 1996 unless terminated earlier as specified in Section 6, 7, or 8 of this
contract.
2. COMPENSATION FOR AGREEMENT AMENDMENT
The District agrees to pay the Contractor, as compensation for the services set forth
herein and in the Agreement of September 27, 1995, at the rate of$75.00 per hour not
to exceed $4,200 per month for the months of April, May, and June 1996 for an
expected average of 14 hours of services per week and not to exceed $2,100 per month
for the months of July, August, and September 1996 for an expected average of 7 hours
of services per week.
3. ADDITIONAL SERVICES TO BE PROVIDED
In addition to the Scope of Services described in Exhibit A of the Agreement of
September 27, 1995, Contractor will be utilized on other District projects including a
review of work processes involving project management and consultant selection,
development of an improved salary incentive program, and promotion of enhanced
communication and participation by employees in District programs.
4. Except as noted above, the other terms and conditions of the Agreement of September
27, 1995 remain in effect.

On behalf of the Board of Directors and staff of the Midpeninsula Regional Open Space District, I'd like
to thank you for your generous donation in memory of Stan Norton.
As you know, Stan was one of the District's original founders, and he was crucial to the District's
emergence as one of the most respected and successful open space organizations in the country. In addition to
his behind-the-scenes activism,he was one of the original signatories of the ballot argument in favor of Measure
R, the 1972 grassroots initiative which formed the District in Santa Clara County. Stan was the District's legal
counsel from its inception until his retirement in 1994, and in that capacity he helped guide the District to its
present prominence. His wisdom, good humor, and friendship will be sorely missed.
Through the kind wishes of Stan's wife Carole, memorial donations were requested to go to the District.
and your contribution to open space'preservation on Stan's behalf is very much appreciated. I will let Carole
know of your generosity. You can be sure that your donation will be pert to good use and will help to protect

Skyline Ridge Open Space Preserve. It is rare that I am
moved to write a letter, but the experience certainly so
warrants .
I congratulate your trail architect and your trail
maintenance crew. Never have I seen trails so well designed
and maintained. The differing environments and views one
encounters are just thrilling. The trail markers and guides
are so extensive and fully explanatory.
During my hike I chatted briefly with two of your
maintenance technicians who were repairing a rest room at
one of the parking lots. Seeing their enthusiasm for their
work and their love for the Preserves, one can readily see
why hiking the the Mid peninsula Open Space Preserves is such
a Joy.

TAKE OUR DAUGHTERS TO WORK DAY
Thursday, April 25, 1996
The objective of Take Our Daughters to Work Day is to focus on girls' ideas,
needs, and dreams, to help ensure that girls remain confident, strong, and in
school throughout their teen years, and to show girls that they are not limited
in their career choices. It was begun in 1993 by the Ms. Foundation for
Women, which expected the event to be limited to New York City. But the
idea drew an enthusiastic response and Take Our Daughters to Work became
a national event. In 1995, millions of girls took part across America.
This year the District is excited to begin participating in the Take Our
Daughters to Work program. If your daughter is between the ages of 9 and
17, bring her to work with you on April 25. (Be sure to let your supervisor
know of your plans in advance.) The idea will be to give her a sense of what
your job is, as well as to expose her to other types of jobs here at the District.
If you're interested in participating in the program this year, let your
supervisor know, and contact Deirdre or Jean by Tuesday, April 23. We may
want to organize a pizza lunch for participants if everyone is interested.

you weren't going to make my case for me.
Your letter of January 22, 1996 raises more questions and has given me much to think about. But for
the present, let's stick to the same items.
1. Please consider my letter of January 12th, 1996 written notice of my desire to receive individual
notice of future annexations to the Midpeninsula Regional Open Space District (MROSD) in San Mateo
County.
2. Where did you send your notification to the Portola Park Heights Property Owners Association?
Because we only get a few days notice, please be sure to send individual notification to both the President
and the Secretary.
3. Are you really saying that San Mateo County LAFCo has no jurisdiction over District annexations
in San Mateo County? Hasn't this public agency been voted for by the electorate in part of San Mateo
County? Please cite the law that limits your power to impose conditions.

example, the small section of Page Mill Road in San Mateo County near Skyline Boulevard is currently in
need of repair. Meanwhile, increasing numbers of tourists from all over continue to use the deteriorating
road in order to visit MROSD lands. These lands have been taken out of the tax rolls before development,
depriving this area of the very money it could use to fix Page Mill Road.
Could you please copy this letter to your Commission members and to Autum Arias of Santa Clara
County LAFCo? I'll take care of MROSD and San Mateo County Planning.

East Bay Regional Park District Board members and staff are very much looking forward to
attending the 1996 Special Districts Forum to be hosted by Lake County Forest Preserves District
this June. I am sure you all agree that the program is a strong one with many interesting special
tours and events which will make for an all around outstanding forum. Our Board and staff
always look forward to the forums as a special opportunity to meet with elected officials and staff
from similar agencies facing similar challenges. We always find that we learn a great deal from
this interactive conference.
Because the Special Park Districts Forum has always had an informal organizational structure,
selection of the Annual Forum's host occurs in a somewhat ad hoc fashion. Recognizing
everyone's very busy schedules and full organizational agendas, I would like to get a jump on
planning for 1998 by offering East Bay Regional Park District as host for 1998. Unfortunately,
the press of current projects during 1996 and early 1997 preclude our hosting of the 1997 Forum.
The East Bay Regional Park District last hosted the Forum in 1991 and hosted one of the earliest
forums in 1981.
While we will be pleased to host our third forum, we would also be very interested in visiting one
of the other forum members' agencies that have not served as host in recent years. Please let me
know if your agency is interested in hosting the Special District Forum, and we will then plan for
a date further in the future.
We will look forward to seeing you all in June at Lake County Forest Preserves District.

Subject: Caltrans Oak Mitigation Project - St. Joseph's Hill
Caltrans has submitted copies of their proposed plans and specifications for the St. Joseph's
Hill Oak Mitigation Project. A full set of these plans are available in the planning department
for review.
Caltrans anticipates construction to start this summer. We will be issuing Caltrans and its
contractors a permit to enter that identifies specific conditions by which Caltrans and its
contractors must abide during all phases of the three year project (installation, maintenance,
and monitoring). This permit will implement the contractual agreement the Board of
Directors signed on November 30, 1994. Attached is a map of the project area and the
access road that the contractor will utilize.

Water Bugs Seen at Open Space District Nature Center

Los Altos, CA -- Visit and explore the world of water boatmen and dragonfly nymphs, the pond
habitat of turtles and crayfish, and the other exciting natural communities at Skyline Ridge Open Space
Preserve and the David Daniels Nature Center. Beginning April 14, the public is invited to visit the
Midpeninsula Regional Open Space District's nature center, which will be open every Sunday from

11:00 am-4:00 pm. (except some holidays - please call the District for information).
Staffed by knowledgeable District volunteers, this rustic nature center is nestled on the edge of
beautiful Alpine Pond. With both an aquatic lab and larger-than-life pond strata mobiles, visitors can get
a close-up look at the pond community from inside the nature center, then go out and explore the natural
surroundings in this 1,612-acre open space preserve. Other habitats are also featured in our natural
communities exhibits, and the friendly volunteers are happy to answer questions about everything from
Daphnia to red-winged blackbirds.
The David Daniels Nature Center is about a half-hour drive from Palo Alto, and just 45 minutes
from most other communities in the midpeninsula area. Visitors may park in the Russian Ridge Open
Space Preserve parking lot at the intersection of Page Mill Road and Skyline Boulevard (Route 35), then
take the short walk to the David Daniels Nature Center. For additional information about the nature

The Midpeninsula Regional Open Space District, extending from the City of San Carlos to the
Town of Los Gatos, is a public agency which has preserved over 41,000 acres of diverse open space and
manages 23 open space preserves.
Funding is provided by a small share of the annual total property tax revenues collected within
District boundaries. The District permanently protects wildlife habitat, watershed, and a variety of
ecosystems, restores damaged natural resources, and provides trail improvements for passive recreational
use by the public. The District's goals are to acquire a continuous greenbelt of protected open space lands
for public use and enjoyment, and to preserve open space for future generations to enjoy. There are
approximately 20,000 - 30,000 acres of land still at risk of being lost to development within the District's
planning area.
The District is divided into seven geographic wards,each represented for a four year term by an
elected Board member. The Board holds public meetings on the second and fourth Wednesdays of each
month at 7:30 p.m., at the District offices.

RE: Annual Statistics on Information Request Calls
Attached are pie charts illustrating the quantity, origination, and source of the 1,701 information request
calls received by the District for the one-year period of April, 1995 through March, 1996.
Of great interest is the "source" of such calls, that is, where the caller heard about the District. More
people said "art and wine festival"than any other category (21%),plus another 3% if you add in "other
displays." Second to that was "newspapers/magazines" (18%). "Personal Referral" was third (17%).
By way of explanation, the"random mailing"refers to the 5,000 extra newsletters we send to random
addresses within a specified zip code, along with a cover letter explaining that it is a free newsletter and
that they may call to subscribe. That is a 2.2%response; by direct-mail industry standards, that is a good
response rate.
The conclusion I draw from that set of statistics is that we should Continue and expand our participatiotl
at the art and wine festivals, and other municipal festivals or events, as well as the various other
corporate or agency displays that we staff. This appears to be an extremely good way of reaching people.
In addition, the high percentage of"newspapers/magazines" tells us that it would be valuable to continue
our media outreach via press releases and feature stories, as well as advertising when appropriate.
The variety of"sources" indicates that it continues to be necessary for the District to perform outreach in
all of these different areas in order to maintain a public awareness. There is not a singular category that
was the overwhelming source of most of the calls, which would enable us to focus on fewer areas. Since
there are so many €� people g
categories from which eo le get their information, it remains necessary to try to
reach the public through each of them.
The geographic distribution of the information request calls shows that 61% come from within the
District, and an additional 35% from outside the District but within San Mateo and Santa Clara
Counties. Within the District, Sunnyvale, Palo Alto, and Mountain View provide the highest number of
calls, totaling 45%. This can be partially attributed to our presence at the Sunnyvale and Mountain View
art and wine festivals, and to our long-standing reputation and awareness within Palo Alto. Outside the
District, San Jose and San Mateo provide for the vast majority of calls.
One on-going objective of the public affairs program has been to expand and continue outreach to the
widest possible public audience, particularly in geographic areas that have previously not been reached
with the District messages. I believe these statistics show some real progress in reaching some of those
areas such as Sunnyvale, Mountain View, Redwood City, Cupertino, and Menlo Park. They also help to
show that some of our outreach efforts should perhaps shift focus to the areas from which we are not
receiving as many calls, such as Los Gatos, Saratoga, San Carlos, and East Palo Alto, for example.

Open Space District Rangers Rescue Missing Woman
Los Altos, CA -- Rangers of the Midpeninsula Regional Open Space District, working with the
San Mateo County Sheriff's Office, rescued a woman who was missing for two nights in the 1,580"acre
Russian Ridge Open Space Preserve off of Skyline Boulevard.
After receiving reports from Palo Alto Police on Thursday of a woman missing since
Wednesday, rangers spotted her car in a pullout on Skyline Boulevard and notified the San Mateo
County Sheriff. After an incident command center was set up, a search was initiated in three areas:
Russian Ridge, Coal Creek, and Skyline Ridge Open Space Preserves, comprising nearly 3,000 acres of
District land. At it's peak, an estimated two dozen people were involved in the search, including District
rangers, San Mateo County Sheriffs deputies and search and rescue-personnel, Explorer Scouts, Palo
Alto Police, and the California Rescue Dog Association.
The search was suspended at sunset Thursday, to resume the next morning. At daybreak on
Friday, District rangers searching Russian Ridge found the woman's purse and other belongings, then
located her semi-conscious and suffering from hypothermia. District rangers are trained in emergency
first aid and were able to stabilize her, after which she was flown by helicopter to Stanford Medical
Center where she is reported in stable condition.

The Midpeninsula Regional Open Space District, extending from the City of San Carlos to the
Town of Los Gatos, is a public agency which has preserved over 41,000 acres of diverse open space and
manages 23 open space preserves.
Funding is provided by a small share of the annual total property tax revenues collected within
District boundaries. The District permanently protects wildlife habitat, watershed, and a variety of
ecosystems, restores damaged natural resources, and provides trail improvements for passive recreational
use by the public. The District's goals are to acquire a continuous greenbelt of protected open space lands
for public use and enjoyment, and to preserve open space for future generations to enjoy. There are
approximately 20,000- 30,000 acres of land still at risk of being lost to development within the District's
planning area.
The District is divided into seven geographic wards, each represented for a four year term by an
elected Board member. The Board holds public meetings on the second and fourth Wednesdays of each
month at 7:3)0 p.m., at the District offices.

Dear Del:
I am writing you to ask your participation on a trails planning task force for Almaden
Quicksilver County Park. As many of you may know, this park was the site of
extensive mercury mining for many years. In the late 80's the Department received a
remedial action order from the State Department of Toxic Substances (DTSC) that
recommended closure of areas assumed to be highly toxic. Further it restricted use
for the entire park and set a moratorium on park development or any increased use of
the park. After lengthy testing of the park and the "hot spots" within it, we
completed our plan to remediate the highly toxic areas.
At our Department's request, DTSC has agreed to lift the restrictions on increased
public use of the park for areas not within the remdiation sites. Only four of the five
"hot spot" areas scheduled for remedial activities, will remain restricted from public
access. These areas are in the Hacienda Furnace Yard, the Mine Hill area, the
Enriquita Mine Retort area, and the San Mateo Mine Retort area. A map showing
these areas is enclosed. We will have limited access around the Rotary Furnace site,
provided we fence off the areas deemed to be highly toxic. Also, we will have some
limited access around the Mine Hill area.
We will begin work remediating the areas soon and can probably remove public
access restrictions after that work is completed. It is important to realize that due to
the large amount of soil that we must move to cover the "hot spot" sites, some trails
and areas will be closed temporarily during the remediation process. With the
removal of the public use restrictions, we can open the park to more users and fulfill
the Department's mission of "Providing, Preserving, and Protecting, Regional
Parklands for the Enjoyment, Education, and Inspiration for this and future

generations." We also can begin to complete a network of trails in the park.
Most of you attended our first public meeting of this the process to begin a
comprehensive trail plan for the park. In that meeting we heard comments from the
public on the types of trails development and uses they would like to see considered
for the park. This included new and existing trails and staging areas.
Our next step is to develop a park trail draft plan for the consideration of the public
and the Park and Recreation Commission. To accomplish that task, I am forming a
task force representing the various major stakeholders in the park's trail planning
concerns.
I am including one representative from each (or occasionally a combination of) these
groups to serve on the task force. As you can well imagine, facilitating planning
particulars with a group larger than about 20 persons is not an efficient or effective
way of completing a plan. Therefore I have limited the group to about 11 citizens
and about 5 staff members. This will give us a workable group to accomplish our
task. I will also have an auxiliary list of about 6 or 7 persons to act as resources to
the task force. These persons will not be formal task force members, nor attend all
meetings, but will bring vital information to us on specific items important in our
planning deliberations.
Because of your background and expertise in MROSD interests, I have selected you
to serve as a task force member. I expect that each member will not just represent
their personal interests, but act as a liaison to the stakeholders at large whom they
represent. I will also expect that they keep them informed of our planning processes
and bring those groups' concerns and reactions to our task force meetings and to our
draft materials. Finally, I am expecting that while each task force member will
represent their stakeholders' interests, that they also will be completely objective in
their endeavors on the team.
I think you will find this project interesting and very rewarding. Unless there are
very significant issues to resolve, I do not anticipate a long drawn► out process for this
plan. If for some reason you cannot serve on this task force, I would ask that you
please let me know as soon as possible and kindly recommend another person with
similar qualifications I might contact. Once I have confirmation from all prospective
task force members, I will send you a list of them. Also I will send a list of resource
persons to the task force and let you know when our first meeting will take place.
In anticipation of that, I am enclosing a few items for your review. Our staff
prepared these and I am circulating them for initiating discussion only. We will get
into the specifics of these during our meetings. One document is draft Goals and
Criteria for park trails planning and the other is a Public Access and Trail Uses
matrix. The matrix lists existing and some proposed trails and staging areas for the
park, along with a listing of different types of uses that may or may not be
appropriate. Most of the new trails will occur in the area around Mine Hill. Again,
we will discuss specifics in our meetings.
I look forward to working with you on this project and hearing of your acceptance to
join us to plan for park improvements that serve all the public. Please call me at

Dear Assemblyman Rainey and Members of the Local Government Committee:
The quality of life enjoyed in San Mateo County is at immediate risk. The parks are
suffering from deferred maintenance, cutbacks in community programs and activities, and a lack
of new acquisitions for parks and open spaces. Local libraries have endured drastic cutbacks in
staffing and hours, and are lacking funds for new books and materials. San Mateo County
schools are being left behind by funding inequities, by limited funds for technology, and a lack
of funds to provide a safe school environment.
Assembly Bill 3239, authored by Byron Sher, is the first step in reversing that devastating
trend that threatens our quality of life. This bill will allow libraries and parks to join forces with
schools to develop a ftinding measure for voter approval by a two-thirds majority vote in 1997 or
1998.
I strongly urge your support of AB 3239 when it comes before you in the Local
Government Committee on April 10. Give the voters in San Mateo County the opportunity to
provide a local solution to a local problem, without fiscal impact to the State. Thank you for your
