HomeMy Public PortalAbout86-017 (02-18-86)RESOLUTION N0. 86-17 A RF.SOLUI'ION OF TILE CITY COUNCIL OF THE CITY OP LYNWOOD PERTAINING TO VAZ f, LANE, INC. dba LITTLE ANNIE WANNIE'S APPEAL WHEREAS, the City Council held a public hearing on January 21, 1986, at which certain evidence was made available to tiie Ciiy Council; and WHEREAS, the City Council has carefully considered said evidence. NOW, THEREFORE, be it resolved as follows: On January 21, 1986 the Lynwood City Council heard an appeal from Vaz F, Lane, Inc. The appeal was from the C.i.ty's protest against any issuance o:[ a liquor license for the premises located at 5162 Fast Imperial Highway in the City of Lynwood. IIaving considered all the evidence, the City Council hereby makes the fol.lotaing findings: 1. From about October 1965 to June 1983, Vaz ~ Lane, Inc. operated a business known as Little Annie I9annie's at 5162 East Imperial IIi.ghway, in the City of Lynwood. 2. On August 30, 1983, the liquor license for the business was revoked for one year. 3. Vaz F, Lane, Inc. has not done any business on the premises since approximately June, 1983. 4. After the suspension was over, Vaz ~, Lane, Inc. applied with the Department of Alcoholic Beverage Control for a liquor license for the premises. S. The Department o:f Alcoholic Beverage L'ontrol has not yet acted on Vaz ~ Lane's application. 6. The consumption of alcoholic beverages on the premises is prohibited by the currently applicable zoning. 7. On October 1, 1984 the City sent a protest letter to the Department of Alcoholic Beverage Control. Based on the above findings, the City Council reaches the following conclusions: 1. Vaz $ Lane is not entitled to a liquor license, pursuant to Business and Professions Code Sect.i.on 23790, because the premises are located i.n a territory where the exercise of the rights and privileges conferred. by the license would be contrary to a valid zoning ordinance of the City of i,ynwood. 2. Vaz ~, Lane has no rights based. on its prior use because, contrary to Business and Professions Code Section 23790 ~°^ (b), the licensed premises have not been operated continuously since the ef:Eective date of the zoning ordinance without sub- , stantial change in mode or character of operation. 3. Vaz ~, Lane's appeal of the City's protest letter is denied, and the City Council affirms the Ci.ty's position as taken i.n the October 1, 1984 letter.
