HomeMy Public PortalAbout86-044A (05-20-86)RESOLUTION NO. 44A A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, DECLARING ITS INTENTION TO ORDER THE FORMATION OF A LIGHTING ASSESSMENT DISTRICT WITHIN SAID CITY PURSUANT TO THE "LANDSCAPING AND LIGHTING ACT OF 1972", AS AMENDED, (COMMENCING WITH STREETS AND HIGHWAYS CODE ' SECTION 22500 ET SEQ.): DESCRIBING THE DISTRICT TO BE BENEFITED AND TO BE ASSESSED TO PAY THE COSTS AND EXPENSES THEREOF; FIXING THE TIME AND PLACR FOR HEARING PROTESTS AND OBJECTIONS TO THE FORMATION AND LEVY OF ASSESSMENTS FOR THE FISCAL YEAR 1986-87; AND FIXING THE TIME AND PLACE OF THE REGULAR MEETING TO HEAR PROTESTS AND OBJECTIONS TO THE ASSESSMENT OF THE ANNUAL INSTALLMENT. (Assessment District No. 86-A Lynwood. Lighting and Assessment Distr.i.et). WHEREAS, the Director of Public Works/City Engineer has submitted a proposed map of Assessment District No. 86-A indicating by a boundary line the extent of said territory included in the proposed assessment district; and, WHEREAS, the City Council has directed and the Director of Public Works/City Engineer has prepared and filed a report in writing containing all matters required by Council under Streets and Highways Code, Section 22565, et seq.; and, WHEREAS, said report has been presented to the City Council for consideration and has been received and approved; NOW, THEREFORE, the City Council does hereby resolve, order and determine as follows Section 1. Pursuant to the Landscaping and Lighting Act of 1972 as amended, the City Council of the City of Lynwodil hereby declares its intention to order formation of an assessment dis-trict and to levy and collect, assessments for those improvements described as: Installation or construction of public lighting facilities for any facilities which are appurtenant thereto or which are necessary or convenient for the maintenance or servicing thereof, including but not limited to, electric current, repair of street light standards and fixtures and incidental costs including labor, material and equipment. The area within which improvement shall be made is within the boundaries of the City of Lynwood as shown on the accompanying /°'^ map identified as Assessment District Map No. 1986-A, Section 2. The report of the Engineer approved by Council on May 20, 1986, in Resolution No. 86-~, and on file in the office of the City Clerk, describing in detail. the improvements to be made, the boundaries of the assessment district and any zones therein, and the proposed assessments upon assessible lots and parcels of land. within the District remain substantially unchanged. and i_s therefore incorporated herein by this reference as though fully set forth. Section 3. Notice is hereby given that June 3, 1986, at the hour of 7:30 p.m., in the Council Chambers of City Hall, 11330 Bullis Road, Lynwood, California, is the date, hour and place fixed for the hearing of protests and objections by the City Council. Any and all persons having any protest or objection i;o sae-d proposed maintenance, the extent of said assessment district, or the levy of the proposed assessment may appear before the City Council at said hearing and show cause why said maintenance should not be carried out and the proposed assessment and diagram confirmed, all in accordance with said Resolution of Intent and report. Prior to the conclusion of the hearing, any interested person may file a written ~ protest with the City Clerk, or, having previously filed a protest, may file a written withdrawal of protest. A written protest shall si;ate all grounds of objections. A protest by a property owner shall contain a description sufficient to identify the property owned by him. All interested persons shall be afforded the opportunity to hear and be heard. The city Council shall consider a1.1. oral statements and written protests or communications made or fi]-ed by an interested person. Section 4. Notice is further given that beginning in June, 1987, pursuant to Streets and Highways Code, Section 22565, the regular meeting to consider the annual installment shall be held on the date, hour and place of the first regular meeting in June as specified in any ordinance or resolution or order of the City Council fixing the time and place of its regular meeting. Section 5. The City Clerk is hereby directed to cause notice of the passage of this resolution to be given at the time and place in the form and manner provided by law. Section 6.
