HomeMy Public PortalAboutResolution 85-2396RESOLUTION NO. 85 -2396' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DECLARING CERTAIN PREMISES TO BE A PUBLIC NUISANCE AND ORDERING ABATEMENT THEREOF. FOR THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE AS FOLLOWS: WHEREAS, the Planning Commision of the City of Temple City has, by Resolution No. 85- 1216P.C. determined that a public nuisance as de- fined in the Municipal Code exists on certain premises and recommends abatement thereof; and • WHEREAS, no appeal has been taken from said determination with respect to time in which to abate the nuisance; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE: SECTION 1. That a public nuisance, as defined in the Municipal Code of the City of Temple City, exists on the premises designated as 5117 and 5121 Rosevale, City of Temple City, California, and more particularly described as portions of Lots 4 and 5 of Tract 29316 MBP 751 -62 and 63 of maps in the office of the County Recorder, County of Los Angeles, State of California, in the following particulars: A. Premises maintained so as to constitute a fire hazard by reason of woods rank overgrowth or accumulation. Section 4230(D) B. Dead trees weeds and debris constituting unsightly appearance or dangerous to the public welfare or detrimental to nearby property values. Se ^tion 4230(I) SECTION 2. The property owner is ordered to abate the nuisance within thirty (30) days by the following methods: A. Within 30 days resolve all Fire Department concerns (i.e. cleaning all combustables from the lot adjacent to the garage including old lumber and miscellaneous waste products. B. Within 90 days or by February 12, 1986 eliminate and /or store all miscellaneous items completely within building except for fire wood, not to exceed 2 cords, and all illegal building and or structures shall be either removed or modified to comply with zoning and building code standards. SECTION 3. If said abatement is not accomplished by the expira- tion of thirty (30) days, the City Manager is hereby authorized and directed to cause said public nuisance to be abated by City forces or private contractor pursuant to the Municipal Code. SECTION 4. The City Clerk is hereby directed to cause a copy of this Resolution to be served on the owner of said premises pursuant to the Municipal Code. SECTION 5.
