Mayor Merritt called the regular meeting of the City Council to order at 7:30 p.m. 2. The invocation was given by the Reverend Edward Clark, Temple City Brethren Church, 5537 N. Temple City Boulevard. 3. The Pledge of Allegiance to the Flag was led by Mayor Merritt. 4. ROLL CALL: PRESENT: Councilmen - Briggs, Gilbertson, Harker, Merritt ABSENT: Councilmen - Tyrell ALSO PRESENT: City Manager Koski, City Attorney Martin, Civil Engineering Assistant Linares Councilman Gilbertson moved to excuse Councilman Tyrell from the meeting because of absence from the City, seconded by Councilman Harker and carried. APPROVAL OF MINUTES: Councilman Briggs moved to approve the minutes of the regular meeting of October 20, 1970, as printed, seconded by Councilman Harker and carried. UNFINISHED BUSINESS: 6. PUBLIC HEARING: 7:30 p.m. Re. Garibaldi - Temple City Boulevard to Camellia Avenue - Street Improvements (Curb, gutter and drive approaches, pursuant to Chapter 27 of the Streets and Highways Code..) City Manager Koski presented background material on the street improvements needed, including curbs, gutters and drive approaches and stated this was a General Fund Project. Mayor Merritt declared the Public Hearing open, and invited those present who wished to speak in favor or against to come forward. No one came forward to speak. Councilman Harker moved to close the Public Hearing, seconded by Councilman Gilbertson and carried. After brief discussion Councilman Harker moved to find the project in the public interest and instruct the Superintendent of Streets to cause the work to be performed, seconded by Councilman Gilbertson and carried. 7. PROPOSED ENVIRONMENTAL QUALITY CONTROL COMMITTEE: Re. Study on Ecological Developments. City Manager Koski presented staff recommendations regarding formation of a Citizens Advisory Committee for Environmental Studies. The report included using a cross section of residents on a volunteer basis and recommended responsibilities inc ludi.ng the date of February 1, 1971 for submitting a report to the City Council. Councilman Gilbertson suggested the list of responsibilities needed: to be more specifically outlined with special emphasis on study of detergents. Councilman Briggs suggested that a specific number of members be stated which should not be toolarge in size to be able to make quick conclusions. City Council Minutes, November 3, 1970 - Page 2 Mayor Merritt moved to form a Citizens Advisory Committee for Environmental Studies consisting of seven members, with volunteers as applicants and the Mayor to make appointments, seconded by Councilman Harker and carried. 8. AMENDMENT TO MUNICIPAL CODE: Re. Possession and Use of Air Guns City Attorney Martin presented suggested amendments to Section 3503 et seq of the Municipal Code relating to Firearms. Councilman Gilbertson moved to waive further reading of an Ordinance relating to above sections of the Municipal Code, seconded by Councilman Harker. After discussion the second was withdrawn and the motion died for lack of second. Item was tabled to a later date. 9. APPEAL SHELL OIL COMPANY: Re. Conditional Use Permit No. 70 -324 Concerning Reverse Bay Conditions. City Manager Koski presented background information on Conditional Use Permit No. 70 -324 granted by the Planning Commission to operate an automobile service stati:on with limiting conditions. City Manager Koski also stated there was to be a Public Hearing on a Zone Change for this property on November 17, 1970. Councilman Gilbertson moved to defer action on Conditional Use Permit Case No. 70 -324, northeast corner of Baldwin and Lower Azusa until November 17 at which time a decision will be made on the record, seconded by Councilman Harker and carried. 10. RESOLUTION NO. 70 -1054: Vacation of Alley, south of Las Tunas Dr., between Kauffman and Golden West Avenue. City Manager Koski presented background information for construction of a new medical office building on the southeast corner of Las Tunas Drive and Kauffman and that the vacation of the alley would provide better utilization of the property contiguous to the alley. The City Attorney presented Resolution No. 70 -1054 providing for a Public Hearing on the matter to be set for December 1, 1970 at 7:30 p.m. in the Council Chambers of the City Hall. Councilman Harker moved to adopt Resolution No. 70 -1054 entitled, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, DECLARING ITS INTENTION TO VACATE THE WESTERLY 190 FEET OF THAT CERTAIN ALLEY LOCATED SOUTHERLY OF LAS TUNAS DRIVE RUNN_LNG BETWEEN KAUFFMAN AVENUE AND GOLDEN WEST. AVENUE IN SAID CITY', AND FIXING A TIME AND PLACE FOR HEARING OBJECTIONS -TO THE PROPOSED VACATION, seconded by Councilman Gilbertson and carried. 11. PARKING COMMISSION RECOMMENDATIONS: - Meeting of October 21, 1970. Re.: Random enforcement of posted 2 -hour parking restrictions. City Manager Koski reported relative to the Parking Commission recommendation that random enforcement of posted 2 -hour parking restrictions on all public parking lots from Thanksgiving to Christmas, with the exception of Lot No. 7 be initiated. Councilman Gilbertson stated he felt the 2 -hour limit should be enforced at all times not just specified times of the year. Councilman Briggs moved to approve Parking Commission recommendation on random enforcement of 2 -hour parking restriction, seconded by Councilman Harker and carried by the following roll call vote: AYES: NOES: ABSENT: Councilmen - Briggs, Harker, Merritt Councilman - Gilbertson Councilman- Tyrell City Council Minutes, November 3, 1970 - Page 3 12. PERSONNEL APPOINTMENTS: A. RESOLUTION NO. 70 -1052: Re. Employment of Custodian Caretaker City Manager Koski presented Resolution No. 70 -1052 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING PERSONNEL, Councilman Harker moved to adopt, seconded by Councilman Gilbertson, and carried. B. RESOLUTION NO. 70 -1053 Re. Employment of Temporary Personnel. City Manager Koski presented Resolution No. 70 -1053 entitled, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING TEMPORARY PERSONNEL, Councilman Gilbertson moved to adopt, seconded by Councilman Briggs and carried. 13. RESOLUTION NO. 70 -1055: Warrants & Demands, Demand Nos. 3059 thru 3122, in the amount of $24,990.06. Councilman Harker moved to approve Resolution No. 70 -1055 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $24,990.06 DEMAND NOS. 3059 THRU 3122. Councilman Gilbertson seconded and the motion carried. 14. COMMUNICATIONS: A. City Manager Koski presented a letter from the Temple City Unified School District requesting permit for a fireworks display during Homecoming game on Friday, November 6, 1970. Included was a Fire Department Inspection report stating that all regulations had been met. Councilman Harker moved to grant permit for a Fireworks Display at the Temple City High School on Friday, November 6, 1970, seconded by Councilman Briggs, and carried. B. City Manager Koski presented a petition from Willmonte residents regarding several issues affecting the neighborhood i.e., parking, sanitation conditions, children's safety, access to school buses and unsightly condition of vacant private property. There was discussion regarding placing 2 -hour limited parking signs on the east and west sides of Wi 1 lmonte. Mr. George Swanson of 4908 Willmonte Avenue, Temple City and Mr. J. A. White of 4851 Willmonte Avenue both spoke briefly to the City Council in regard to the petition. After discussion Councilman Briggs moved to place "No Parking" restrictions, specifying a certain time of the day, approximately 6 to 9 a.m. and 3 to 5 p.m. which would not allow parking at those timeson both the east and west sides of Willmonte, north of Lower Azusa for approximately 150 ft., seconded by Councilman Gilbertson and carried. City Manager Koski advised that the property owner has been contacted and will cooperate in cutting back the shrubs and maintaining the right -of -way in such a manner as to provide an adequate walkway for pedestrian use, which together with the parking restriction should assist in the safety of children going to and from school. School district officials have been contacted and requested to consider reestablishing a bus stop pick -up point at Willmonte to alleviate theneed for school children using the unimproved pedestrian parkway on Lower Azusa Road. City Council Minutes, November 3, 1970 - Page 4 Mayor Merritt moved that in order to minimize unauthorized access to the vacant property on the northeast corner, the property owner be contacted relative to installing barricades or other devices to prevent unauthorized entrance of vehicles to the property which is already posted with "No Trespassing" and "No Dumping" signs. The motion was seconded by Councilman Briggs and carried. III 15. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: No one came forward. 16. MATTERS FROM CITY OFFICIALS: A. Councilman Gilbertson expressed his satisfaction with the railroad crossing at Lower Azusa Road and suggested the City send a letter of appreciation to SPRR officials. B. Councilman Gilbertson gave strong rebuke relative to the brochure mailed by the County with current tax bills, which was printed at taxpayers expense. He stated that the content of the brochure did not coincide with information provided by Supervisor Bonelli earlier in the year. C. Councilman Gilbertson referred to legislation regarding payment for care of injured animals picked up on the streets and inquired how much cost would be incurred by the City. Staff will investigate and prepare a report. D. City Manager Koski read an invitation to the Council to attend the Southern California Planning Congress at the Santa Fe Inn, Thursday, November 12, 1970, at 7:30 p.m.) Temple City to be host for the evening. 17 ADJOURNMENT: Councilman Briggs moved to adjourn at 9 :10 p.m. to a study session, seconded by Mayor Merritt and carried. The next regular meeting of the City Council will be held on Tuesday, November 17, 1970, at 7:30 p.m. in the Council Chambers at the City Hall. 1 MAYOR-
