HomeMy Public PortalAboutOrdinances-2013-323 CITY OF TIFFIN ORDINANCE NO. 2013-323 AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF TIFFIN, IOWA, FOR CERTAIN PROPERTY KNOWN AS WILLOW RIDGE, TIFFIN, JOHNSON COUNTY, IOWA, AND AS LEGALLY DESCRIBED HEREIN BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA: Section 1. Purpose. The purpose of this ordinance is to amend the official zoning map of the City of Tiffin, Iowa, concerning property locally described as Willow Ridge, Tiffin, Johnson County, Iowa. Section 2. Amendment. The following legally described property (also known as "Tract 1"): Beginning at the Northwest Corner of the Survey in the Northeast Quarter and the Southeast Quarter of Section 28, Township 80 North, Range 7 West of the Fifth Principal Meridian, Tiffin, Johnson County, Iowa, in accordance with the plat thereof recorded in Plat Book 27, at Page 67, of the records of the Johnson County Recorder's Office; Thence S89°07'00"E, along the North Line of said Survey, 418.44 feet; Thence S00°04'18"E, 236.07 feet; Thence S89°55'42"W, 165.00 feet; Thence S00°04'18"E, 430.11 feet; Thence N89°41'57"W, 113.43 feet; Thence Northwesterly 3.98 feet, along an arc of a 150.00 foot radius curve, concave Northeasterly, whose 3.98 foot chord bears N53°09'09"W; Thence Northwesterly 97.65 feet, along an arc of a 150.00 foot radius curve, concave Southwesterly, whose 95.94 foot chord bears N71°02'34"W; Thence N89°41'34"W, 43.81 feet, to a point on the West Line of said Survey; Thence N00°16'30"W, along said West Line, 638.47 feet, to the said Point of Beginning. Resultant tract contains 4.70 acres, and is subject to easements and restrictions of record. shall be changed from zoning classification from R-2 to R-4, Multi-family, 4-Plex Residential District and further, that the official zoning map of the City be amended to reflect the change described herein. Section 3. Amendment. Resultant tract contains 0.90 acre, and is subject to easements and restrictions of record. shall be changed from zoning classification from R-2 to R-4, Multi-family, 4-Plex Residential District and further, that the official zoning map of the City be amended to reflect the change described herein. The following legally described property (also known as "Tract 3"): Commencing at the Southwest Corner of the Survey in the Northeast Quarter and the Southeast Quarter of Section 28, Township 80 North, Range 7 West of the Fifth Principal Meridian, Tiffin, Johnson County, Iowa, in accordance with the plat thereof recorded in Plat Book 27, at Page 67, of the records of the Johnson County Recorder's Office; Thence N00°16'30"W, along the West Line of said Survey, 425.03 feet, to the Point of Beginning; Thence continuing N00°16'30"W, along said West Line, 324.94 feet; Thence S89°41'57"E, 137.57 feet; Thence Southeasterly, 98.74 feet, along an arc of a 150.00 foot radius curve, concave Northeasterly, whose 96.97 foot chord bears S72°46'12"E; Thence N88°22'20"E, 165.72 feet; Thence Southeasterly 211.95 feet, along an arc of a 1000.00 foot radius curve, concave Northeasterly, whose 211.56 foot chord bears S07°41'59"E; Thence Southeasterly 129.03 feet, along an arc of a 1000.00 foot radius curve, concave Southwesterly, whose 128.94 foot chord bears S10°04'31"E; Thence N85°19'30"W, 446.67 feet, to the said Point of Beginning. Resultant tract contains 3.11 acres, and is subject to easements and restrictions of record. shall be changed from zoning classification from R-4 to R-8, Multi-family, 8-Plex Residential District and further, that the official zoning map of the City be amended to reflect the change described herein. Section 5. Amendment. The following legally described property (also known as "Tract 4"): Commencing at the Southwest Corner of the Survey in the Northeast Quarter and the Southeast Quarter of Section 28, Township 80 North, Range 7 West of the Fifth Principal Meridian, Tiffin, Johnson County, Iowa, in accordance with the plat thereof recorded in Plat Book 27, at Page 67, of the records of the Johnson County Recorder's Office; Thence N00°16'30"W, along the West Line of said Survey, 749.97 feet, to the Point of Beginning; Thence continuing N00°16'30"W, along said West Line, 33.07 feet; Thence S89°41'34"E, 43.81 feet; Thence Southeasterly 97.65 feet, along an arc of a 150.00 foot radius curve, concave Southwesterly, whose 95.94 foot chord bears S71°02'34"E; Thence Southeasterly, 3.98 feet, along an arc of a 150.00 foot radius curve, concave Northeasterly, whose 3.98 foot chord bears S53°09'09"E; Thence N89°41'57"W, 137.57 feet, to the said Point of Beginning. Resultant tract contains 0.08 acre, and is subject to easements and restrictions of record. Section 6. Amendment. The following legally described property (also known as "Tract 5"): Commencing at the Northeast Corner of the Survey in the Northeast Quarter and the Southeast Quarter of Section 28, Township 80 North, Range 7 West of the Fifth Principal Meridian, Tiffin, Johnson County, Iowa, in accordance with the plat thereof recorded in Plat Book 27, at Page 67, of the records of the Johnson County Recorder's Office; Thence S00°28'59"E, along the East Line of said Survey, 665.76 feet; Thence N89°41'57"W, 177.67 feet, to the Point of Beginning; Thence Southeasterly 22.66 feet, along an arc of a 1000.00 foot radius curve, concave Northeasterly, whose 22.66 foot chord bears S00°58'42"E; Thence S88°22'20"W, 144.86 feet; Thence N00°04'18"W, 27.53 feet; Thence S89°41'57"E, 144.45 feet, to the said Point of Beginning. Resultant tract contains 0.08 acre, and is subject to easements and restrictions of record. shall be changed from zoning classification from R-4 to R-2, Two-family, Medium-density Residential District and further, that the official zoning map of the City be amended to reflect the change described herein. Section 7. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed. Section 8. Severability. If any section, provision, or part of this ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole, or any section, provision, or part thereof not adjudged invalid or unconstitutional. Section 9. Effective Date. This ordinance shall be in effect after its final passage, approval, and posting as provided by law. On the 13th day of February 2013, at a regular meeting of the Tiffin City Council, Tiffin, Iowa, Councilperson Kahler introduced Ordinance No. 2013- 323, and moved that it be given its first reading. The motion was seconded by Councilperson Bartels. Ayes: Kahler, Bartels, Upton, Phillips Nays: None Absent: Ryan Four members of the Council being present and having voted "Aye", Mayor Steve Berner declared the motion carried, and Ordinance No. 2013-323, was read the first time, discussed, and placed on record. The motion was seconded by Councilperson Kahler. Ayes: Phillips, Upton, Bartels, Ryan, Kahler Nays: None Five members of the Council being present and having voted "Aye", Mayor Steve Berner declared the motion carried, and Ordinance No. 2013-323, was read the second time and discussed and placed on record. On the 13th day of March 2013, at a regular meeting of the Tiffin City Council, Y � � g tY Tiffin, Iowa, Councilperson Ryan introduced Ordinance No. 2013-323, and moved that it be given its third and last reading. The motion was seconded by Councilperson Kahler. Ayes: Kahler, Ryan, Bartels, Upton, Phillips Nays: None Five members of the Council being present and having voted "Aye", Mayor Steve Berner declared the motion carried, and the ordinance was passed and adopted. Whereupon the Mayor declared that Ordinance No. 2013-323 be adopted and signified his approval of same by fixing his signature thereto.
