AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ACCEPTING AND APPROVING
THE FINAL- SUBDIVISION PLAT OF A REPLAT OF LOT 4 OF AMERICAN SUBDIVISION
SECTION TWO, A SUBDIVISION OF THE CITY OF JEFFERSON, MISSOURI.
WHEREAS, Lowe's Home Centers Inc., owner of the real estate hereinafter described, having
submitted to the City Council a plat of said real estate, being located in Jefferson
City, Cole County, Missouri, and described as Part of the Southwest Quarter of the
Northwest Quarter of Section 10 and part of the Southeast Quarter of the Northeast
Quarter of Section 9, Township 44 North, Range 12 West in the City of Jefferson,
Cole County, Missouri, Being more particularly described as follows: Beginning at
the Southeast corner of the Southeast Quarter of the Northeast Quarter of said
section 9; Thence South 86 Degrees 02 Minutes 00 Seconds West, along the
Quarter Section Line, 634.04 feet to a point intersecting the Easterly line of Tract A of
a Tract Division Survey of Record in Survey Record Book A, Page 255, Cole County
Recorder's Office; Thence North 13 Degrees 22 Minutes 27 Seconds West along
the Easterly line of said Tract A, 99.34 feet to the Northeasterly corner thereof;
Thence North 84 Degrees 42 Minutes 03 Seconds West, along the northerly line of
said Tract A and along the Southerly line of Tract B of said tract division survey,
282.12 feet to the Northeasterly corner of Lot No. 3 of American Subdivision, Section
One, as per plat of record in plat book 11, Page 543, Cole County, Recorder's Office;
Thence North 74 Degrees 31 Minutes 58 Seconds West, along the Northerly line of
said American Subdivision Section 1, 408.98 feet to a point on the Easterly right of
way line of Wildwood Drive; Thence Northerly along the said Easterly right of way
line north 15 degrees, 30 minutes, 02 Seconds East, a distance of 31.65 feet; thence
continuing 211.04 feet along a curve to the left having a radius of 879.39 feet, a
chord bearing north 08 degrees 37 minutes 32 seconds east, a distance of 210.53
feet; Thence continuing north 01 degrees 45 minutes 02 seconds east, a distance of
484.00 feet to the intersection of said easterly right of way line with the southerly
right of way line of Missouri Boulevard; Thence along said southerly right of way line
south 88 degrees 12 minutes 13 seconds east, a distance of 301.80 feet; thence
continuing north 67 degrees 34 minutes 07 seconds east, a distance of 109.66 feet;
thence continuing south 88 degrees 12 minutes 13 seconds east, a distance of
400.00 feet; thence continuing south 69 degrees 46 minutes 07 seconds east, a
distance of 158.11 feet; thence continuing south 88 degrees 12 minutes 13 seconds
east, a distance of 47.39 feet; thence leaving said southerly right of way line south 28
degrees 22 minutes 56 seconds east, a distance of 503.33 feet; thence south 48
degrees 02 minutes 25 seconds east, a distance of 417.32 feet; thence south 34
degrees 37 minutes 22 seconds west, a distance of 164.00 feet to a point on the
south line of the northwest quarter of section 10-44-12; thence along said quarter
section line south 84 degrees 30 minutes 58 seconds west, a distance of 180.00 feet
to the point of beginning, containing 1,117, 203 square feet or 25.65 acres, more or
less;
and
WHEREAS, it appearing that said plat has been fully and properly signed and accepted by the
owner of said subdivision, known and referred to as the Final Subdivision Plat of
Replat of Lot 4 of American Subdivision Section Two, that all taxes have been paid,
that in all respects the requirements of Chapter 445, RSMo, entitled "Plats" have
been fully complied with by the owner of said subdivision, and that in all respects the
requirements of the Planning and Zoning Commission of the City of Jefferson,
Missouri, relating to plats and subdivisions have been complied with.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1. That the Final Subdivision Plat of Replat of Lot 4 of American Subdivision
Section Two, lying, being and situated within the corporate limits of the City of Jefferson, Missouri,
as shown by the said plat attached hereto and made a part of this ordinance, is hereby approved
and accepted by the City Council of the City of Jefferson, Missouri.
SECTION 2. The Mayor and City Clerk are hereby authorized and directed to endorse
acceptance of said plat hereon and to certify the approval of said plat under the seal of the City of
Jefferson.
SECTION 3. This ordinance shall be in full force and effect from and after the date of its
passage and approval.

Other New Business
Case No. P12023 — Resubdivision of American Subdivision, Section Two. Application filed
by Lowe's Home Centers Inc, property owner, for a Final Subdivision Plat of 25.65 acres
consisting of two lots. The property is zoned C-2 General Commercial and is located to the
southeast of the intersection of Missouri Boulevard and Wildwood Drive. The property is
described as Lot 4 of American Subdivision, Section Two(GBC Design, Consultant).
Mr. Barron described the proposal and explained that the purpose of the plat is to create an outlot
in the Lowes parking lot that would be developed with a Chick-fil-a drive through restaurant. He
stated that a sewer extension plan to serve the new outlot has been submitted. Mr. Barron
explained that a plan to construct sidewalks along Missouri Boulevard has been submitted.
Mr. Gary Rouse, GBC Design, 565 White Pond Drive, Akron, Ohio, spoke regarding this request.
He explained that Chick-fil-a will be located between the two existing access drives on the current
site of Lowes home improvement store. Mr. Rouse stated that sidewalks will be constructed per city
requirements. He explained that there will be an approximate 150 foot sanitary sewer extension
from the northeast corner of the Lowes sanitary sewer to Chick-fil-a. Mr. Rouse stated that the
sanitary sewer will be constructed to city standards and within an easement. He explained that the
building will consist of 4,900 square feet with 50 parking spaces. Mr. Rouse commented that
MoDOT will not require a traffic study for the proposed development. He explained that the
proposed building will have a double drive through lane with one drive through window. Mr. Rouse
stated that construction is slated for late summer 2013.
No one spoke in opposition to this request and no correspondence was received.

Mr. Jordan moved and Mr. Dutoi seconded to recommend approval of the final subdivision plat
subject to the following conditions to the City Council:
1. Compliance with the comments and technical corrections of the Engineering Division.
2. Finalization of improvement plans and plat prior to introduction to City Council.
The motion passed 8-0 with the following votes:

Backiround
This Minor Subdivision Plat is to divide lot 4 of American Subdivision, the site of a Lowes home
improvement store, into two separate lots. The purpose of the plat is to create an outlot in the Lowes
parking lot that would be developed with a Chick-fil-a drive through restaurant.
Description of Proposed Plat
Zoning: C-2 General Commercial
Size of Property: 25.65 Acres

ENGINEERING STAFF RECOMMENDATION-
Recommend approval of the final plat subject to items highlighted below being addressed on a revised version of the
plat.
Existine Infrastructure Summary
* Infrastructure needed to serve this development exists in the vicinity.
-An existing detention basin is on the property.
-Existing drainage systems traverse the property. Drainage exits the property to the south and east in the
existing drainage channel.
-Sanitary sewer exists to serve this property.
-Other utilities exist to serve this property.
-Sidewalk exists in the vicinity.
-Property is already served by existing roadways.
Improvements Summary
Roadway,Storm Water/Erosion and Sediment Control
* Roadways are existing to serve this subdivision and need no improvements.
-Storm water detention exists to serve this development.
-Erosion and sediment control plans have been submitted with site improvements and are currently under
review.
Sanitary Sewer
* All lots are to be served by sanitary sewer,by the existing main, upgrade of an existing service to a new
main and a new main extension. Improvement plans are currently being reviewed and seem to be in
substantial conformance with City Standards.
* No off-site easements are necessary for this subdivision. A new easement is being proposed along the
existing upgrade and the new extension of the sewer main.
Sidewalk
* A five(5)feet wide sidewalk is required and being proposed along Missouri Blvd.
Street Access /Traffic Impact
* Access to the development is already existing and not being proposed to change.
Utilities/Fire Hydrants/Street Liehts
* Facilities exist in the area and meet current City Standards and requirements.
Technical Comments
* Minor technical corrections to the plat and improvement plans remain. These will need to be addressed on
a revised version of the plat and improvement plans.
