MIDPENINSULA REGIONAL OPEN SPACE DISTRICT Meeting 97-10 SPECIAL AND REGULAR MEETING BOARD OF DIRECTORS April 9, 1997 MINUTES I. ROLL CALL President Mary Davey called the Special Meeting to order at 5:00 P.M. Members Present: Mary Davey, David Smernoff, Betsy Crowder, Ken Nitz, Jed Cyr, Pete Siemens, and Nonette Hanko. Personnel Present: Craig Britton, Sue Schectman, II SPECIAL MEETING M. Davey stated that the Board would begin the Special Meeting for the purpose of a Communication, Skills workshop presented by Mr. Art O'Neal. The Board concluded the Special Meeting at 7:20 P.M. and M. Davey called the Regular Meeting to order at 7:30 P.M. M. Davey announced that the Board had had a Special Meeting for the purpose of a Communication Skills Workshop and that no action had been taken. Additional Personnel Present: Mike Williams, Malcolm Smith, Del Woods, Randy Anderson, John Escobar, Mary de Beauvieres, and Mike Williams. III. ORAL COMMUNICATIONS Harry Haeussler, 1094 Highland Circle, Los Altos, noted that the trail maps in the FYI's had inconsistent descriptions for the various trails. C. Britton responded that he would look into the matter and report back to the Board. In response to H. Haeussler's and N. Hanko's concerns regarding trail use markings on District maps, D. Woods said staff will continue to standardize them. Al Bell, 12130 Skyline Blvd., Woodside, representing the Save Skyline Open Space Committee, presented an update of the Committee's activities. He said they are asking for a complete environmental review up front. He said he would provide a copy of their presentations to Board members. Box 7207, San Jose, said he thought the Board had interfered in the Russian Orthodox Church matter and asked how much taxpayers are paying for the appraisal ordered by the Board. Michael Marshall, Los Altos, spoke about his statements at the last meeting regarding the caretaker at La Honda Creek, stating that the caretaker does not mind leaving, and he is withdrawing his objections. IV. ADOPTION OF AGENDA At N. Hanko's suggestion, the Board moved Item 8 to the top of the agenda. Motion: N. Hanko moved that the Board adopt the agenda. P. Siemens seconded the motion. The motion passed 7 to 0. V. ADOPTION OF CONSENT CALENDAR J. Cyr removed agenda item 3, Response to 1996 Santa Clara County Grand Jury, Final Report on the Review of the Implementation of the New Brown Act by Local Government Agencies and Authorization for the President of the Board to Sign Letter on Behalf of the District Motion: P. Siemens moved that the Board adopt the Consent Calendar, including minutes of the March 26, 1997 Special and Regular Meeting; responses to written communications from Mr. Harry H. Haeussler, Jr., 1094 Highland Circle, and Mr. Richard J. Bourke, P. O. K. Nitz seconded the motion. The motion passed 7 to 0. VI. BOARD BUSINESS A. Agenda Item No. 8 - Request from the Coastal Alliance and Half Moon Bay Citv Council that the District Devote Staff Resources and Explore Methods to Preserve Coastside Open Space - (Report R-97-63) C. Britton pointed out that Board members had received additional signatures to the petitions and an e-mail. He showed the location of the area on a map. M. Davey said that she, N. Hanko, B. Crowder and D. Smernoff had held meetings with supporters on the coast side and are enthusiastic about the proposal. Chuck Kozak, P. O. Box 917, Moss Beach, said he lives in Montara and is a member of the steering committee of Coastal Alliance. He said the climate is right to begin this exploration and there are a lot of people who want to preserve open space. He said he had heard no outright opposition. He said the Mid Coast Community Council is an advisory council to the San Mateo County Board of Supervisors. Leonard Woren, P. O. Box 1375, El Granada, said he represented Citizens for the Preservation of El Granada (CPEG). He stated that the problem they are facing is because of the Local. Coastal Plan (LCP) which preserves the south coast and would destroy the mid coast which is zoned for intense development, and he feels that people recognize that it is not appropriate. He said they understand the legal procedure the District has to go through and urged the District to take measures to compress the time frame. He repeated,that there is a large group of people who will support preservation. B. Crowder expressed concern that the groups may think the District can do something right away, but there will have to be a lot of research. A parcel tax might not be the method proposed to finance the preservation. She emphasized that the District was glad to receive their request for a study but could not make a response in concrete terms. N. Hanko added that they had received a fax from the Pescadero City Council mentioning concerns including feral pigs and retaining existing housing and agriculture. She did not consider these as being outlandish requests or concerns. Part of the District's study would be addressing financing. M. Woren said they were trying to set the stage and let people know they would have to come up with money if they wanted to save open space. Kit Dove, 633 Palma Street, El Granada, named the organizations with which he was affiliated, and shared some thoughts in terms of how MROSD might play a part, including where the money would come from. He said he thought there was Meeting 97-10 Page 4 potentially a good support base in the rest of San Mateo County and encouraged them not to just look at coast side lands. He said he thought the District would have lots of opportunities. H. Haeussler said he was not against preserving open space, but pointed out that visitors to the coast would not help pay. He said he did not think the District had the resources to administer more land, and he would rather see them help the coast side people form a separate district and perhaps join them in the future. He also said he believed the District ought to put a limit on the money we will spend in helping them. N. Hanko spoke regarding Mr. Haeussler's fears regarding the cost to the District, stating that the informal committee would like to continue as an ad hoc committee of the Board, without compensation. There would be a limited amount of financing for the staff report. She said that 27 years ago on this date the first group had met at her home to discuss establishing the District. Peter Dreckmeier, representing Bay Area Action, said preservation of open space is very important and he liked the idea of including the coast side in the District. Bay Area Action would put their energy into it. C. Britton said staff could develop a "not to exceed" budget so there would be a limit on spending, and thought H. Haeussler's idea of a budget was a good one. He thought a ceiling was necessary and stated staff will have to spend time mapping and analyzing the costs that might be incurred for acquisition. P. Siemens said he would like to see those figures too and that the single biggest hurdle will be money. Any tax should be equitable to everyone. He said he was more concerned with operating costs. L. Woren stated that historically voters of all of San Mateo County have been protective of the coast and he thought that would continue. M. Davey said the four issues to look at would be the District boundary, legal requirements to set up a District, a survey to make sure that success would be very possible, and financing. C. Britton said expansion of the District is only one idea. He urged them to look at the boundaries and be sure to ask questions carefully to determine which communities supported the idea. Motion: B. Crowder moved that the Board authorize the General Manager to utilize District resources to research possible methods or processes for preserving open space on the San Mateo County coast and to report findings to the Board; and authorize Directors Crowder, Davey, and Hanko to be members of an uncompensated ad hoc committee representing the District on this issue. D. Smernoff seconded the motion. Meeting 97-10 Page 5 Amendment: N. Hanko asked that there be a report back to the Board in six months. This would be part of the first recommendation. P. Siemens added that the General Manager would return with a budget at the earliest possible meeting. The maker and seconder of the motion agreed to the two amendments. Discussion: Following discussion, Board members agreed not to specifically include Bay side lands and other open space in San Mateo County. The ad hoc committee's report could contain that information however. The motion as amended passed 7 to 0. There was a recess from 8:37-8:48 P.M. B. Agenda Item No. 1 - Proposed Acquisition of 157-Acre Paul Propertv to Long Ridge Open Space Preserve for $580,000, and Authorization for Grant of a Conservation Easement over the Propgrty to Save-the-Redwoods-Leagues Determine that the Recommended Actions are Categorically Exempt from the California Environmental Quality Act: Tentative Adoption of the Use and Management Plan for Property_ Authorization to Enter into a Five-Year Caretaker/Rental Agreement: and Indication of Board's Intention to Dedicate the Property as Public Open Space - (Report R-97- M. Willliams presented the staff report, including maps and slides. He said the caretaker house would probably be demolished after the five years of the agreement. C. Britton stated that demolition policies have not been modified and none will take place until the policies are adopted by the Board. M. Williams said the current tenant had agreed to the terms of the agreement and explained how the acquisition came about. M. Williams said there will be no obligation on the part of the District to maintain the house, and Mr. Paul has agreed to fix the roof. He informed Board members that there is a trail on the lower portion of the property through the Boy Scout property It is an old logging road. Motion: D. Smernoff moved that the Board Determine that the recommended actions are categorically exempt from the California Environmental Quality Act as set out in the staff report; adopt Resolution No. 97-17, a Resolution of the Board of Directors of the Midpeninsula Regional Open Space District Authorizing Approval and Acceptance of the Purchase Agreement and Authorizing the Grant of a Conservation Easement Over the Paul Property to Save-the-Redwoods-League; tentatively adopt the Preliminary Use and Management Plan recommendations contained in the staff report, including naming the property as an addition to the Long Ridge Open Space Preserve; authorize entering into a Caretaker Rental Agreement with the current tenant, Robert Baxter, for a period of up to five years and authorize the General Manger to execute said Agreement; and indicate their intention Meeting 97-10 Page 6 to dedicate the property as public open space. P. Siemens seconded the motion. The motion passed 7 to 0. C. Agenda Item No. 2 - Progress Report and Scheduling of a Public Workshop on May 21, 1997 at 7:30 P.M. for the Regional QWn Space Plan - (Report R-97-58). R. Anderson presented an update on the plans for the workshop. He said he would find out about having workshops in other parts of the District. C. Britton said the plan was to have several workshops in different areas. When they have a draft of the plan there will be joint meetings with the parks commissions of both counties. Motion: P. Siemens moved that the Board confirm the tentative agenda and date of May 21, 1997 at 7:30 p.m., for a public workshop. J. Cyr seconded the motion. The motion passed 7 to 0. C. Britton thanked R. Anderson and said he was doing a great job. D. Agenda Item No. 3 - Response to 1996 Santa Clara County Grand Jury Final Report on the Review of the Implementation of the New Brown Act by Local Government Agencies and Authorization for the President of the Board to Sign Letter on Behalf of the District - (Report R-97-61) J. Cyr said he removed the item to note the statement on page 7, third paragraph, regarding the response from the District, and commended staff. N. Hanko said the Chair of the San Mateo County Grand Jury was here and got a copy of the report. C. Britton explained that it was S. Schectman who keeps the District on track relative to the Brown Act. Motion: J. Cyr moved that the Board approve the draft response to the recommendation contained in the 1996 Santa Clara County Grand Jury Final Report on Review of the Implementation of the New Brown Act by Local Government Agencies, and authorize the President of the Board to sign the letter on behalf of the District. D. Smernoff seconded the motion. The motion passed 7 to 0. VII. INFORMATIONAL REPORTS B. Crowder reported on the San Mateo County Alternative Funding Committee meeting she had attended the previous Monday. She said there is a new supervisor in San Mateo County, and she thought he would be a good friend to District. N. Hanko commented that the new supervisor is supportive of the study of the San Mateo County coast. D. Smernoff reported that the NASA Ames Directorate has given the go ahead to complete their segment of the Bay Trail. He said he had spoken at the Citizens Advisory Committee Meeting 97-10 Page 7 on the future of Moffett Field and it might be appropriate to send a letter to Diane McKenna on that issue. He announced a public forum on forests of the future tomorrow sponsored by Bay Area Action and Earth Day Coalition, and the Web of Life on Saturday. He referred to his memo regarding goat grazing and said he would like the matter re-agendized. K. Nitz asked that the matter be put on the agenda of April 23, as he originally voted against the matter and Roberts Rules of Order require a member of the majority request the reconsideration. J. Cyr thanked staff for the tour of the south part of the District. M. Davey said she would be testifying tomorrow before a subcommittee of the San Francisco Board of Supervisors regarding allowing a trail through the watershed, stating this is an integral part of the Bay Area Ridge Trail. N. Hanko reminded those present of J. Fiddes retirement dinner tomorrow. C. Britton reported as follows: 1. A $10,000 grant from the Comptons for Nature Center exhibits. 2. Palo Alto approved the management exchange agreements. 3. M. Davey and her husband are hosting a ridge trail reception on May 18 . 4. A controlled burn in June - All Board members expressed interest in observing. 5. He and M. Smith met with P. Sanchez on T. Lempert's bill SB1366. 6. Saturday afternoon retirement party for J. Fiddes. M. Smith said he had attended the Portola Valley council meeting tonight and they supported Sher's bill SB1048 unanimously. He showed the proposed draft logo for the 25th anniversary event. S. Schectman reported on the court decision invalidating California term limits for legislators. She said settlement discussions are going on regarding the lawsuit challenging the Santa Clara County trails plan. J. Escobar announced California Trail Day will take place on April 26 and there will be events at El Corte de Madera and Picchetti Ranch. VIII. CLOSED SESSION M. Davey stated that the Board would adjourn to Closed Session for the purpose of discussing Closed Session Agenda Items 1 and 2. The Board recessed to Closed Session at 9:35 P.M. and the Closed Session commenced at 9:40 P.M. IX. ADJOURNMENT The meeting was adjourned at 11:00 P.M. Agenda Item No. 1 - Approval of Proposed Budget of $25,000 for District Research of Possible Methods of Preserving Qpen Space on the San Mateo Coast. Including Potentially Establishing; a System of District Open Space Preserves, Parks, and Beaches - (Report R-97-74J C. Britton referred to the staff report. M. Davey noted that she and N. Hanko and B. Crowder have been serving on a subcommittee pursuing this matter. Motion: B. Crowder moved that the Board approve a budget not to exceed $25,000 for District out-of-pocket expenses to research possible methods of preserving open space on the San Mateo coast including potentially establishing a system of open space preserves, parks, and beaches on the San Mateo County Coast in coordination with existing and planned District preserves and trails. Agenda Item No. 3 - Reconsideration of Inclusion of Goat Grazing in the District's Grassland Management Plan for the Russian Ridge Open Space Preserve - (Report R- 7-7 C. Britton pointed out D. Smernoff s memo and a follow-up memo from staff and mentioned that when this was originally brought to the Board, it included the goat grazing and he did not recommend that goat grazing occur. However, he said it is a policy matter and up to the Board for a final decision. N. Hanko asked if there are any other agencies that are doing similar studies. C. Britton said J. Isaacs had listed those in staff s memo. B. Crowder referred to an article in the Royal Horticultural Society Journal regarding goat grazing experiments. N. Hanko said she had questioned whether there were studies done regarding cattle grazing for fire control. J. Isaacs said Santa Clara County Parks has started a cattle grazing program at Grant Ranch. This is a two-year study which just began. The new project includes a much more strict management practice than previous grazing programs. In answer to N. Hanko's question, D. Smemoff said the primary difference between this study and the one East Bay Regional Parks is doing is the amount of rainfall in the Santa Cruz Mountains versus the East Bay. He said he was not convinced that the results will be directly comparable to the lands that we manage. He said the valuable aspect is that District staff gains experience as an agency in looking at all the tools and seeing how their effectiveness compares. There have been a lot of studies of goat grazing and it is a very effective tool. He said he strongly believes the District wants to get the experience of using all these tools so they can evaluate cost effectiveness. He said they need to evaluate them all together so they can do that in-house cost benefit analysis. In regard to cattle grazing, D. Smernoff said some of his constituents have said they would be opposed to cattle grazing because of the extensive damage they have seen them do. In addition, it is easier to get goats on and off the sites that you want to manage. J. Isaacs said there have been some published results of studies, but some are not completed. She said all methods proposed in the implementation project, including goat grazing, have been shown effective. The cost for goat grazing is about $1,000 per acre for a total of $17,000. H. Haeussler asked who would own the goats. He asked if they wanted to save just grassland or get rid of poison oak. Meeting 97-11 Page 4 Claire Kremen, research ecologist, Stanford University Center for Conservation Biology, reiterated that there is a value in doing site specific studies, although studies done elsewhere add to the collective knowledge about how to manage these invasive species problems. She pointed out that goat grazing is a tool and all the tools have their specific purposes. Goat grazing can be used in areas where other methods cannot be used as effectively, such as steep or rocky areas which cannot be mowed. She noted that goat grazing would also help get rid of other invasive species. Nick Moll, Star Route 2, Box 408, La Honda, 94020, spoke in favor of including goat grazing in the study. He said none of the techniques included in the study have been examined in the sort of ecosystem that exists at Russian Ridge. He strongly urged them to find a way of including goat grazing in the study. D. Smernoff said there are two goals: 1. Scientific assessments to get solid numbers on the various techniques in an ecological sense. 2. Develop guidelines of how we want to manage invasives and reestablish grasslands in other areas of the District. Motion: D. Smernoff moved that the Board include a goat grazing element in the District's grassland management plan for the Russian Ridge Open Space Preserve. B. Crowder seconded the motion. The motion passed 6to0. In answer to a question about budget, C. Britton said staff will move money around within the project and come back to the Board if they need any additional budget authorization. C. Agenda Item No. 5 - Tentative Adoption of an Amendment to the Use and Management Plan for Monte Bello Open Space Preserve to Allow Reconstruction of the Old Ranch Trail and to Designate the Trail as a Multi-Use Trail and Determination that the Project is Categorically Exempt from the California Environmental Quality Act - (Report R-97-69j M. de Beauvieres reviewed the staff report, stating that the reconstruction would detour bicycle traffic back to Montebello Road before it gets to the steep part, which could then be closed to all trail use. She said that area is disked each year as a fire break, and described how the trail would be located to eliminate the steepest portions. Michael Marshall, Los Altos, said he would prefer that the trail remain a foot path because bicycles can use the road. N. Hanko asked why this is being proposed as a multi-use trail. M. de Beauvieres replied it is because it is currently multi-use and bicycle traffic can be directed back to the road. Motion: J. Cyr moved that the Board determine that the proposed project is categorically exempt from the California Environmental Quality Act (CEQA) based on the finding in the staff report; and tentatively adopt Meeting 97-11 Page 5 an amendment to the Use and Management Plan for Monte Bello Open Space Preserve to allow reconstruction of the Old Ranch Trail and to designate the trail as a multi-use trail. Agenda Item No. 6 - Amendment of Public Employees Retirement system ERS) Contract for Local Miscellaneous Members to Provide 2 Percent at 55 Retirement Formula Including an Extension of the Funding Period to the Year 2016 - (Report R- 9769) C. Britton reviewed staffs recommendations. Motion: N. Hanko moved that the Board adopt Resolution 97-18 a Resolution of the Board of Directors of the Midpeninsula Regional Open Space District of Intention to Approve an Amendment to Contract Between the Board of Administration of the Public Employees Retirement System and the Board of Directors of the Midpeninsula Regional Open Space District. While there were some initial concerns about the nomination process, following discussion those concerns were alleviated. Motion: B. Britton presented the staff report, noting there was a net increase of 1.5 positions. He outlined the reasons staff was recommending the use of an executive search firm for the administrative services manager position. There will be some budget transfers as a result of the reorganization, and the overall cost for the first year will be about $50,000. C. Britton said he would provide Board Members with a copy of the job description for the administrative services manager position and Board Members will be able to meet with the executive search firm. Affected staff members have been contacted regarding the reorganization. M. de Beauvieres said the reorganization of the planning program and moving toward a team approach has been in process for about two years. H. Haeussler said he would like to see an organizational chart of what the Board is planning to do. M. Davey said the Board will come back to this item at the end of the agenda to allow time for review of the chart. G. Agenda Item No. 10 - Approval of 1996-1997 Salary Adjustment and Meritorious Pay Award and Amendment to General Manager's Employment Agreement - (Report R- 7- 7) M. Davey summarized the recommendations of the Ad Hoc General Manager Evaluation Committee. She said the Board had met with the General Manager and agreed that they are blessed to have a General Manager who has done terrific service for the District for 20 years. Motion: D. Smernoff moved that the Board adopt Resolution 97-19 a Resolution of the Board of Directors of the Midpeninsula Regional Open Space District Approving 1996-1997 Salary Adjustment and Meritorious Pay Award for the General Manager and Approving Amendment to General Manager's Employment Agreement. Agenda Item No. 11 - Approval of 1996-1997 Meritorious Pay Award and Amendment to District Legal Counsel's Employment Agreement - (Report R.-97-80). M. K. Nitz seconded the motion. The motion passed 6 to 0. J. Agenda Item No. 13 - Denial of Damage Claim Filed by Mr. Eric Diesel - Report R- 7-79 In answer to K. Nitz's questions, S. Schectman said the denial is a procedure under the California Tort Claims Act and does not foreclose the District from continuing to discuss any disputes they have with Mr. Diesel. She explained what led to the claim and how the claims process works. Motion: N. Hanko moved that the Board deny the claim against the District filed by Eric Diesel. D. Smernoff seconded the motion. The motion passed 6 to 0.. K. Agenda Item No. 16 - Cancellation of May 14 Meeting - (RR=rt R-97-Tn C. Britton noted the reasons staff was recommending cancellation of the meeting. N. Hanko said she usually speaks against cancellation of regular meetings but could understand why staff was recommending it. C. Britton commented that the June 11 might also be canceled because there might not be a quorum of Board Members. Motion: J. Cyr moved that the Board cancel their May 14, 1997 regular meeting. N. K. Nitz seconded the motion. The motion passed 6 to 0. VIL INFORMATIONAL REPORTS K. Nitz noted an article in Sunset Magazine article on the Skyline Ridge Trail. He said POST had issued their Bair Island brochure. D. Smernoff said he had met that day with the ad hoc South Bay Trail Committee and it appears that NASA is prepared to move ahead on the segment of the trail that would join the District's property to the Shoreline Study Area. In addition, they may be prepared to complete the trail around the whole perimeter. They will be meeting again to go over the work plan. B. Crowder reported that she had attended the installation of the new San Mateo County Supervisor, Rich Gordon. She referred to a newspaper article regarding the San Francisco Board of Supervisors approving a study of including the Ridge Trail through the watershed. She said the Bair Island item was on yesterday's agenda of San Mateo County Board of Supervisors. They sent a letter to Congress asking them to approve money for the acquisition. M. Davey reported that the hope is that the San Francisco Board of Supervisors will open the Bay Area Ridge Trail by summer. M. de Beauvieres had determined that there is 20.3 miles of the Trail in the District, with the potential of another 1.5 miles to be dedicated later this year. Meeting 97-11 Page 9 C. Britton reported on the following: 1. The need to have workshops in other parts of the District regarding the Regional Open Space Plan. He suggested three others to be held in Los Gatos, the Skyline area, and the Redwood City/San Carlos area. The proposed dates were June 4, June 18, and July 16. 2. C. Britton said he and W. de Wit Board had testified at the Bair Island meeting. He showed the full page ad in Mercury News. He informed the Board that he had sent a letter to Tom Henning regarding making the Bay Trail a condition of the Bair Island purchase. 3. H. Haeussler had brought up that there were two maps for Pulgas and St. Joseph, and he showed that there are no inconsistencies on the maps for trail designation. 4. There will be dedication of a "thank you" sign for Ralph Brown at Skyline Sanborn Park on May 3. 5. The San Francisco Board of Supervisors voted 10-0 on the Ridge Trail. Now there will be discussion between the Board and the PUC regarding water department land. 6. He and M. Smith had gone to committee hearings in Sacramento on SB1048 and AB1366 which were both passed. 7. Jean Fiddes' retirement party. 8. He announced he would be leaving for vacation and will return May 19. J. Escobar will be in charge during his absence. J. Escobar mentioned the memo from him to C. Britton regarding restoration of the fire break at Sierra Azul. In addition, there was a copy of correspondence to Mr. Clifford from J. McCullough regarding the El Corte de Madera Trail, and staff will give it closer inspection based on what he said. S. Schectman said there was a report that the Court of Appeals overturned the California term limits. She will get a copy of the opinion for Board Members. M. de Beauvieres announced that June 18 from 5:30 - 7:30 had been scheduled for a neighborhood and agency reception at the Skyline Field Office, and it was agreed that the neighborhood meeting regarding the Regional Open Space Plan would be held following the reception. C. Britton added M. Smith asked him to mention the statistics in the FYIs regarding the 3200 calls received by the District over the last several months. Discussion followed regarding whether the hang gliding matter brought up under oral communications would be placed on a future agenda. M. Davey will work with staff to amend the letter approved earlier in regard to this matter. H. Haeussler said the Board had written to Joyce Lohmiller and he understood that you can walk anywhere on the preserves including off the trails. Staff explained that off-trail exploration is not encouraged. At 8:56 P.M. the Board adjourned. S. For many years as a student at Stanford and subsequently as a resident of San Francisco I enjoyed the excellent open spaces of the Peninsula under your stewardship. At that time I mostly ran and hiked the trails. In recent years I have become an avid mountain biker. I will not rehash the many arguments about the use of mountain bikes on public lands. I know the members of the public who have previously written you and spoken to you as well as ROMP have ably presented their viewpoints. I will ask that you cease the current actions of trail alteration at El Corte de Madera. It is one of the only places one can legally ride challenging and beautiful singletrack trails. Bulldozing these trails to fireroads is ill advised. If the concern is safety, I feel that the public's best interest is not being served--the inexperienced or unwise biker will attain much greater speeds on such trails if they are smoothed and widened than if they are left intact. If the concern is erosion, I think alternative strategies are preferable, and ROMP can address these. If the concern is aesthetic, there is no rationale for bringing in heavy equipment. If the concern is serving the user groups of the public lands, then steep, "technically demanding" trails should be available to mountain bikers. If the concern is liability, I think there must be some parallel to skiing, snowmobiling, or rockclimbing on public lands-4 find it hard to believe that the current course of action is going to protect the Open Space District from liability problems. Maybe enough of us users aren' t expressing our opinion, but if you were to stop by El Corte de Madera on any weekend and take a poll, I am positive all of the regular users would disagree with "sanitizing the trails" as the Amendment proposes . So why are the trails being closed, flattened, widened, etc . . ??? Who are you serving by doing this? I am a biker and hiker of the park, and this is not serving me . It is my understanding the the MROSD has plans to widen many of the singletrack trails in El Corte De Madera preserve . my first ride at ECdM was several weeks ago. While I do not claim any expertise in trail management, it is easy to see why ECdM is unique . The preserve has quality, technical singletrack trails which are virtually impossible to find elsewhere in the Bay Area. If you would like to see the direct result of trail widening, look at the East Bay. There are virtually no technical trails open to mountain bikes . Each year, the East Bay Regional Park District uses bull dozers and graders to widen and "groom" the trails . This leaves the trail surface extremely rough and subject to erosion. The surface that is left is basically gravel and loose dirt - not a lot of fun to ride on, and not very safe . There are some very dedicated volunteers in the ROMP organization (which I recently joined) . I urge you to work closely with this group and to turn over as much of the trail maintenance as possible to them. It would be a shame for mountain bikers to loose one of the last remaining areas of quality riding available to them. Again, look at the East Bay or Marin for example . It reminds me of an important leason I learned as a boy in the Boy Scouts while on a camping trip . I thought to myself that the hill to my tent was too steep and proceeded to hack-out steps along the side of the hill to make it easier to ascend. Luckily a troup leader patiently explained the error in my thinking. I 'm currently employed as an engineer and still have that overwelming need to solve problems but force myself to step back and look at the big picture : does solving this problem actually reduce the overall quality of life? There ' s lots of examples I 'm sure you can recount . There doesn ' t seem to be any troup leaders to help the MROSD board attain that clairity of consideration though. Please send me a list of the people making decisions about this and about your organization in general . What are your ultimate goals and why? Have you really taken a fair assessment of the actual users of the trails or are you trying to supplant them with another set of target users? We found the preserve outstanding for its natural features, but overrun with mountain bikers. We feel the wilderness quality has been significantly downgraded and cheapened by the dominating effects of mountain bikers. The trails we used ::,ere barren of leaf litter as busy tire tracks mar the surface and created an over-used look and feel. Most of the time we felt oil-guard, waiting for the next bikers to come along from behind or in front or from around the comer. Frequently we would hear the crys and calls of bikers, or hear their bikes rattling down the trails from some distance away. For people like us, who hike simply to experience the feeling of being at home and in harmony with the natural world, Long Ridge Open Space Preserve is definitely not a potential location for a return hike. We have learned the value of engaging nature on its own terms and thereby gain a sense of peace and serenity. This very special experience is simply not available at the Long Ridge Preserve. As beautiful as the area is, we shall never again risk wasting our valuable weekend for a return hike, it simply isn't worth it. But where can individuals like us go in the various open space preserves to hike? Most of the trails we have used in the past are now dominated by bikers. If you would please review the accompanying statement by George Santayana. He expresses many relevant reasons for restoring the natural integrity to your preserves. As a result of the neighborhood meetings, the District is aware of the neighborhood concern regarding pedestrian use of Rhus Ridge Road. This is why the Board of Directors approved installation of the overflow parking area beyond the caretaker's trailer. We recognize that in order to minimize pedestrian use along Rhus Ridge Road, parking needs to be provided at the entrance to the preserve. In addition, it is our understanding that there is a town trail easement that runs along Rhus Ridge Road. The Town of Los Altos Hills Pathways Map, dated 1994, identifies the trail and states that the "system was design ed to provide safe and convenient non-vehicular travel throughout the community." We have a wide diversity of constituents, and the Board makes every effort to try to balance and accommodate the interests of all types of user groups. Recently, El Corte de Madera Creek Open Space Preserve underwent a thorough, two-year planning process which culminated in the June, 1996 adoption of a trail use plan for the preserve. The plan was formulated with the assistance of a citizen task force, composed of District staff, a Board member, and members of the public representing mountain bicycle users, hikers, and equestrians. The public was also involved in the process as numerous public workshops and hearings occurred prior to the plan's adoption. The plan is currently undergoing implementation. During the summer of 1996, District staff constructed about 3 miles of trail. The trail work which was performed was consistent with the trail use plan. The District desires to protect the natural resources of the preserve, while accommodating a variety of safe, enjoyable trail experiences for all our visitors. We feel that the new trails at El Corte de Madera help us accomplish this objective. Phase II will begin later this summer. Staff and the Board's Use and Management Committee will also be considering the trails within the area adjacent to Skyline Boulevard between the Skeggs Point and Gordon Mill Trailhead entrances to the preserve. During our discussions of this issue, members of the Board expressed our hope that some portion of the work could be performed by the use of volunteers, thus reducing the expense to be borne by the District. Upon further discussion, however, it was determined that little of the initial work could be performed by volunteers. The bulk of the expenses noted will be for a public opinion poll, to be implemented by a professional polling service. It is crucial that such a poll be scientifically valid, statistically sound, interpreted accurately, and the resulting information presented credibly. Our belief is that it is not possible for a group of even the best-intentioned volunteers to meet these exacting criteria in carrying out a public opinion poll. Additionally, certain other tasks mentioned are best carried out by staff or other professionals in order to assure the accuracy, precision, and timeliness of the resulting information. However, if the District does determine that expansion to the coast is desirable and feasible, the District will consider which tasks can be performed through volunteer effort. The District has an active volunteer program and we are always looking for ways to utilize volunteers where it is appropriate. I understand that you're concerned with the District funding such activity. However, it is appropriate to expend District resources in this way when it concerns possibly expanding the District's boundaries and when it may lead to establishing additional open space preserves in coordination with existing and planned District preserves and trails. We are also aware that it is very steep and eroded, and it does not meet our trail standards. The route was constructed as a firebreak during the Loma Prieta fire of the mid-1980s. Due to its eroded nature, and location in close proximity to the Priest Rock Trail it will be closed to all trail use. One of our goals is to protect the natural resources of the preserves, while accommodating a variety of safe, enjoyable trail experiences for all our visitors. We feel the closure of this firebreak to trail use and its restoration to a natural condition is consistent with this goal. Trail alignments and trail use are designated by the Board. Typically, a designated trail is shown on District maps and has trail signs installed at its junction with other trails. Staff looked at the possibility of realigning this route, in order to correct the erosion problem and enable its designation as a trail. However, in order to do this, the route would need to be doubled in length to properly install the needed drainage features. Since the route duplicates the Priest Rock Trail, we did not pursue this option. Instead, we try to minimize the impact of trails on the natural features of the preserves by discouraging duplicate routes. I ' m a lifetime Saratoga resident . I have been hiking all of the these trails in this and other areas since late 701s . I have witnessed, first hand, the explosion of trail usage as well as population in this area . I wish it wasn' t so populated as everyone else . What comes with population growth are troubles like increased erosion, injuries and damage in general . What we don' t need, right now, are more trail closures . If anything, we need more trails built to minimize and spread out the ecological impact . That ' s a subject in itself . Of all of the trails in the area, the Sierra Azul single track is one of the best mountain bike trails in the area . Deletion of yet another mountain bike trail will only create more animosity for trail users . It may even create more erosion, because frustrated mountain bikers will create and forge new dangerous trails where trails shouldn' t be created in the first place . Please save my tax dollars and do not delete the Sierra Azul single track trail . Please leave well enough alone, and concentrate your efforts and money on trail improvement and enforcement, NOT deletion. I have and will volunteer time for trail improvement in this area if that is what it takes to save this trail . While I commend and support the spirit of your decision, bulldozing a highly favored single-track trail is not the best outcome for this . I lived in Los Gatos for more than 4 years and learned my riding skills on this trail . Turning this trail into a fire road would be a serious mistake, especially since it is common knowledge among serious riders that fire roads are really more dangerous and injury-prone than single-track trails . Considering the speeds of 20+ mph vs . perhaps 8-12 mph and the injury rate, turning Moody into another fire road not only destroys one of the best single track trails in the county, but adds yet another dangerous fire road to the Kennedy complex. Please re-consider the bulldozing! I think this is a great idea given that the improvements maintain the trail ' s challenging and technical nature . The trail is one of the most enjoyable trails in all of the MROSD lands as it exists . Any changes to widen or sanitize the trail would greatly reduce the joy of navigating the trail . I understand there my be concerns about liability relative to the trail, but I think statistics show most injury accidents are occurring on wider fire roads and the like . This trail requires very slow speeds and any accident is likely to only require one to wash the dirt off of his/her clothes . A possible suggestion is to post a sign at the entrance which states something to the effect of "Advanced Skills Only" , much like ski resorts use on more challenging trails . The accident rate study was done by me for ROMP, not by MROSD. The conclusions I came up with where that 7 . 3% of the 1995 accidents were on single track and 92 . 61 were on fire roads . This is based on a total of 41 bicycle accidents which we could determine the location on based on the report . I don ' t think that there is any question of these numbers within MROSD. Where there is question is the amount of singletrack trails open. A lot of assumptions were made due to the lack of a detailed survey for the whole district . I ended up using that the district has about 200-. singletrack (and have some support to back it up) and the district preferred a number of about 12-159. (with their own supporting info) . We were unable to come to agreement on this . In either case, it does seem to show that the accident rate is lower on singletrack. But with all the assumptions on how much singletrack and the low number of incidences, it is hard to come up with something that would hold up statistically. It is my hope that I can get the information regarding accidents for 1996 . They have changed their reporting procedures to include trail type where the incident occurred, so that will help at one end. The trail survey to come up with an accurate percentage of singletrack will occur slowly over the years, so many assumptions will have to be continued to be used. The logic behind this all is that even though technical single track trails are difficult to ride, and we may fall more often than on fire roads, we are going at slower speeds so the falls do not result in injuries . On fire roads, we fall less, but the falls are much more dangerous . Feel free to use this logic in your letters . I would definitely still send letters to the board and/or go to the meetings and speak in person. Tell them that you don ' t want to see the trail turned in to a fire road. And there is some history of single track trails being turned in to fire roads in El Corte de Madera - which bicyclists have let them know that we don' t like . This trail is one of the only *narrow* trails within the southernmost parks of the Midpen district, whereas most all other trails are actually fireroads . However, I also learned that your current intent is to bulldoze this trail, effectively making it just like all of the other trails/roads within this preserve and the other surrounding parks . I urge you to please reconsider that decision. It has been a favorite trail for many, particularly because it is narrow, steep, and challenging - a favorable thing for advanced bike riders that choose to ride it as an optional detour from Priest Grade . I understand that your decision is based on concern over liability, but I believe that a choice to bulldoze this trail would only increase the chances of accidents at a place that previously had slim to none . Bulldozing that trail would effectively work against what seems to be your original concern. My belief with this is not based on just intuition. I learned of a study done by one of the officers of ROMP (Responsible Organized Mountain Pedalers) , based on information provided by the District on 1995 accidents within the various Open Spaces that you manage . Although this is not any kind of official study, I think that the results were quite informative : based on the data of 41 bicycle accidents, 92 . 6% were on fire roads . Even considering that the amount of narrow (or "singletrack" ) trails within the districts parks might even be as low as 1201-150, the statistics seem to show that the narrow trails are *less* accident prone . For me, this came as no surprise, and the reasons are obvious : on a narrow, windy, rough and challenging trail cyclists are forced to keep their speed down. If your intent is to keep accidents to a minimum while still allowing access to this excellent trail, than I believe a better solution would be to keep it a narrow, windy, un-graded, but *improved* and *maintained* trail . I consider myself a safe and responsible mountain bike rider. I recently became a member of ROMP. But, even before that I volunteered my time and labor to participate in volunteer trail work within the Midpen District , as well as other park systems . Now, many of you may know of the fact that Midpen themselves did a study where they compiled the statistics of all Bicycle-related accidents in their parks; they found that almost all of these - statistically - were on fireroads, and not singletrack. It doesn ' t make sense, does it? According to my source, there was only 2 reported accidents on Moody' s in the last *5* years to the best of their knowledge . What can you do? DISCUSSION At your May 22, 1996 meeting, you tentatively adopted the Trail Use Plan for El Corte de Madera Creek Open Space Preserve as an amendment to the preserve's Comprehensive Use and Management Plan. For easier review by the citizen task force involved in the formulation of the plan, the preserve was broken into five study areas (see attached map). Study Area 2, which contains the Skyline Boulevard frontage south of CalTrans' Skeggs Point, was excluded from the adoption of the plan, pending further study. A public workshop held on May 15, 1996 focused on the popular mountain biking trails in the interior of this study area. Staff intends to hold additional public workshops with the Use and Management Committee later this summer to further discuss these interior trails. Final adoption of the remainder of the plan occurred at your June 26, 1996 meeting. The Phase I trails identified in the plan were constructed during the summer and fall of 1996. The trails were recently opened to all trail users following several volunteer workdays to complete the finish work and repair the damage suffered during the winter months. In July, 1996, staff submitted a National Recreational Trails Fund grant application to fund development of the Phase II trails on the preserve. The application was successful and the District expects to enter into a grant contract with the State in July. The grant funds all Phase II trails (B priority trails in the Trail Plan), installation of a bridge at the Virginia Mill Trail crossing of El Corte de Madera Creek, and new footings for the vehicle bridge at the Lawrence Creek Trail junction with Lawrence Creek. The grant has a two year term with no possibility of an extension. Most other grant projects have a five year term with a possible one year extension. This tight time limit restricts the trail development to two construction seasons. Staff feels that these two trails will be included in any reconfiguration of Study Area 2 which may occur in the future. The trails parallel Skyline Boulevard and will become part of a perimeter trail serving the entire preserve. Staff proposes amending the Trail Use Plan to include the realignment and construction of trails B8 and B 10 as indicated on the map. Staff discussed (with an active member in the ROMP leadership)the possibility of amending the Trail Plan to include these two trails. He is supportive of this proposed amendment. DISCUSSION At your January 22, 1997 meeting, you authorized the General Manager to enter into contract with Callander Associates for $19,698 to provide design and engineering services for the Windy Hill parking lot improvements (see report R-97-08). The contract was based on the preparation of one set of revisions to the plans and engineering services to be required during the course of construction of the project. At your March 12, 1997 meeting, you considered conceptual design revisions to the 50-car parking area planned for the Portola Road entrance to the Windy Hill Open Space Preserve (see report R-97-34). The design revisions involved relocating the parking area driveway entrance to coincide with the existing driveway entrance to the lower portion of the preserve on Portola Road. They also included a left turn lane for southbound traffic on Portola Road and an acceleration and deceleration lane for northbound traffic. At your March 12 meeting, you also authorized staff to proceed with the Town of Portola Valley's Site Development Permit process in order to amend the permit for the development of the parking area. Staff submitted the revised plans to the Town for review. Review by the Architectural Site and Control Commission (ASCC) raised concern over the level of proposed improvements to Portola Road. Based upon these comments, the Town Planner recommended the District's Traffic Engineer and Town Traffic Engineer meet on-site to discuss the Portola Road improvements at the driveway junction. A meeting occurred between the two engineers, landscape architect and staff on April 2, 1997. Both traffic engineers were in agreement that an acceleration/ deceleration lane was unwarranted. They also agreed a left turn lane was unnecessary. The plans were re- drawn to represent the traffic engineer's concerns and they were submitted to the Planning Commission for review at their May 7, 1997 meeting. A reducedd copy is attached. At the May 7 meeting, concern from the commissioners and public focused on the perceived need for a left turn lane and the size of the turn-around adjacent to the gate, in the event the gate is locked. Consideration of the item was continued to allow the District's consultants an opportunity to prepare a conceptual design for a left turn lane. The item will be considered by the Town Planning Commission at their June 18 meeting. Should the Planning Commission take action on June 18, the item would then be considered by the Town Council at their June 25 meeting. Once approvals from the town are received, the District's consultants will begin work on the construction drawings. The consultant has now prepared two additional sets of revisions which were not anticipated at the time the original contract with them was authorized. The cost of one set of the revisions was absorbed by them, but they have submitted a proposal to amend the original contract to include other additional services. These include attending additional public hearings. To minimize the cost increase, staff proposes eliminating some construction observation services which were included in the original contract. These can be performed by the engineer recently retained by the District for specific capital improvement projects (see report R-97-78). A copy of the revised scope of services for the contract with Callander Associates is attached. Grant funding for $132,080 is available for this project through the federal Land and Water Conservation Fund program. The grant project completion date is June 30, 1998. A one year time extension to the grant deadline is possible in the event the project cannot be constructed this fiscal year. The District has requested and received extensions in the past. $350,000 is included in the 1997-1998 fiscal year planning budget for this project. This amount includes the design revisions, permitting costs and construction costs. Staff also requests your authorization to solicit bids once the plans and specifications are approved for permits from the Town. Staff will bring the Town-approved plans back to you in the form of an informational report in the event there are any changes to the plans. DISCUSSION At your March 26, 1997 meeting, you authorized the General Manager to contract with Terratech, Inc. of San Jose for geotechnical engineering services toward the repair of landslides at five open space preserves (see report R-97-45). Repair of the landslides is funded by the Office of Emergency Services (OES) and the Federal Emergency Management Agency (FEMA). Repairs must be completed by September 1, 1997 in order to be eligible for grant reimbursement. Terratech, Inc. has completed the necessary survey work in order to prepare plans and specifications for each of the five landslides. They have prepared plans and specifications for the projects within San Mateo County at Long Ridge, Purisima Creek Redwoods and Skyline Ridge Open Space Preserves. Plans for the three projects were submitted for permits on May 6, 1997. Santa Clara County is the permitting agency for the Monte Bello project and the Town of Los Gatos will issue the permit for the St. Joseph's Hill project. Plans and specifications have not yet been prepared for either of these projects. Due to the restricted time period in which these projects must be completed, staff requests authorization to solicit bids for all five projects at this time. They may be bid as one project if it is deemed cost effective. Once bids are received, staff will return to you for authorization to enter into contract with the lowest responsible and responsive bidder. The total cost of the repairs was roughly estimated by Terratech, Inc. at $112,708 in their proposal to provide engineering services. DISCUSSION In the regular course of District business, a manager or supervisor may find it necessary to purchase supplies from retailers or purchase services over the phone, on very short notice or with other circumstances precluding the normal processing of a District payment. Some examples include purchase of emergency or after-hours repair supplies for-vehicles or equipment, rental of equipment or vehicles, purchase of supplies or safety equipment over the phone, making flight or hotel reservations for out-of-town conferences, paying for services during an out-of-town conference, or making payment over the phone or via fax for seminars, training, or other services. Some of these transactions may take place on a weekend or otherwise after office hours. These are circumstances that are most conveniently and efficiently accomplished with the use of a credit card. Currently, managers and supervisory staff often use their own credit cards to complete such transactions, then file the paperwork to receive reimbursement from the District. The process of generating a reimbursement, which can amount to hundreds of dollars, can take up to several weeks, depending on the Board meeting schedule. It would be more efficient and equitable to provide District credit cards to specified managers and supervisors in order to preclude their need to use their own funds for District transactions. The District's bank, Mid- Peninsula Bank, through its affiliate, Cupertino National Bank and Trust, will provide the credit cards at no cost to the District. Authorize the General Manager to execute the attached Permit to Enter, for the purpose of conducting a controlled burn on a portion of the former Rancho de Guadalupe property in the Sierra Azul Open Space Preserve. BACKGROUND The District has received a request from the Santa Clara County Fire Department (Appendix B) and the Silicon Valley Defense Space Consortium, Inc. (Appendix C), to conduct a controlled burn on a portion of the former Rancho de Guadalupe property in the Sierra Azul Open Space Preserve. The request is to burn approximately six acres of grassland, adjacent to the Cherry Reservoir (see Exhibit 1 of Permit to Enter). This project was originally scheduled to take place at Kaiser Cement's Permanente Plant. However, the conditions became so restrictive that the Fire Department started a search for an alternative site. The Fire Department contacted the District in early May regarding potential sites for this project. DISCUSSION The project will involve burning approximately six acres of grassland. The area is open with gentle slopes. During the event, satellites will be utilized to test advanced tracking, remote sensing, and communications technologies. For a more detailed explanation see Appendix B (request letter from Silicon Valley Defense/Space Consortium). This particular site was chosen because the gentle slope, combined with light fuels, are appropriate for an easily controlled burn. The site has easy access and availability to water. A number of high-ranking Federal government officials are also scheduled to attend. In addition, the County Fire Department will also be doing some site preparation on June 3 and 4. This would involve some vegetation clearing and a small amount of burning around the edge of the site (black-lining) to provide further protection against escape of the fire. Santa Clara County Fire Department will be the lead agency in conducting the burn. They will be responsible for: controlling site access, conducting the burn, providing public notification and complying with Bay Area Air Quality Management District regulations. For a more detailed explanation see Appendix B (Request letter from Santa Clara County Fire Department). The California Department of Forestry (CDF) may also participate in the training. The project will provide the following benefits: I. Reduction of fuel load in the burn area and subsequent reduction in fire danger. 2. Wildland fire and Incident Command System training for District and County Fire Department staff. 3. Improved working relationship with Santa Clara County Fire Department. 4. Increased availability of data from the Geographic Information System database, at no cost to the District. Additional information developed as a result of this project would also be available to the District, at no cost. 5. Research in using defense/space technology for wildland fire and vegetation management. RESOURCE MANAGEMENT ISSUES To evaluate the spectrum of environmental concerns, Staff used an environmental check list developed by California Department of Forestry for vegetation management burns. The results of the checklist show no significant impacts on water resources, soil stability, vegetation, habitats., wildlife, air quality, or visual aesthetics. The vegetation community of the burn area is approximately 85% non-native annual and perennial grassland. A burn in this area will enhance native vegetation diversity by reducing competitive species and thatch accumulation. Monitoring efforts will be conducted before and after the burn to assess the changes in species composition and distribution. The effect of a grassland burn on wildlife is minimal due to the seasonal timing and the low intensity of the burn. No rare or endangered species inhabit the burn area. Red-legged frogs are suspected to be in the vicinity but there have been no confirmed sightings. Horned lizards have R-97-83 Page 3 been sighted on the upper chaparral slopes of the preserve, but not in the burn area. Resource Protection Issues To ensure adequate protection of the area, staff have placed certain constraints on the project. These are specified in the Permit to Enter (Appendix A). Among the conditions are the following: • County Fire must fully restore any compacted areas to their pre-event condition. • District staff will be on-site for the duration of the event. • County Fire will minimize off-road driving of vehicles. Archeological Issues: At the District's request, The Consortium is paying the cost of an archaeological review. The review should be complete by the evening of the Board meeting and the results will be presented orally to the Board. CEQA COMPLIANCE Due to the short deadline, the District has taken the lead role on researching CEQA compliance. Project Description The project consists of burning approximately six acres of grassland for the purpose of training and scientific study. CEQA Determination The District concludes that this project will not have a significant effect on the environment. It is categorically exempt from CEQA (the California Environmental Quality Act) under sections 15304 and 15306 of the CEQA Guidelines as follows: Section 15304 allows activities resulting in minor alterations to land such as: grading, landscaping, filling of earth, trenching, and backfilling. The proposed control burn is similar to these activities, in that it is only a temporary alteration to the land. In comparison to other agencies who regularly conduct control burns of areas greater than 50 acres, the proposed six acre burn is considered small, resulting in little impact to the land. The vegetation community is a grassland. No trees will be removed and the reduction of thatch and competitive species from the area will result in habitat improvements. Further exemption is covered under section 15306 which allows for -basic data collection, research, experimental management, and resource evaluation activities." This project will R-97-83 Page 4 research the feasibility of using defense/space technology for wildland fire and vegetation management. Additional information, useful in the management of biotic communities, will also be generated. PUBLIC NOTIFICATION Notification of the meeting when this report is being presented was sent to property owners adjacent to the burn site. If the Board approves this project, the Santa Clara County Fire Department will notify neighbors of the details of the project. This training is an integral component of Project WILDFIRE, a demonstration utilizing advanced tracking, sensing, and communications technologies coordinated through the Onizuka Air Station. The burn would be performed by the Santa Clara County Fire Department during the first week of June, 1997. We would like to thank the District for its quick response to our request. The Project WILDFIRE demonstration is a key part of a State of California "Highway to Space" Commercial Space Industry investment program. The Silicon Valley Project - Onizuka Air Station Realignment is one of four funded efforts in this state program. As a contractor to the City of Sunnyvale the DSC is managing the Silicon Valley Project - the Onizuka Air Station ( "the Blue Cube", realignment effort. The Project WILDFIRE demonstration will show by example how a facility like the proposed Western Disaster Information Network Facility (WDINF) that is being proposed to be developed at Onizuka Air Station could provide near-real time support to local and regional disaster operations. The successful implementation of the WDINF at Onizuka Air Station would retain over three thousand high technology jobs in the Silicon Valley region. A wild land fire scenario is being used for the Project WILDFIRE demonstration. The availability of a controlled burn for the demonstration is considered vital to the overall success of the demonstration. The controlled burn will provide a target for research aircraft and satellite systems operating advanced remote sensing and imaging systems. The controlled burn near the Gualdalupe Reservoir is an ideal site for this exercise. The controlled burn will also provide much needed training for the Santa Clara County Fire Department staff and will reduce the fire danger in this area by reducing the fuel load. The DSC Council on Civil and Commercial Space (M), chaired by Dr. Robin N. Parker Sunnyvale councilmember, has been organized to focus public sector, academic and industry efforts on the Onizuka Air Station realignment project. The County of Santa Clara has been a supporter of this project since its inception and all of the Silicon Valley communities, including San Jose, Santa Clara, Sunnyvale, Mountain View and Palo Alto, are active supporters of the project. The Project WILDFIRE demonstration is sponsored by the California Department of Transportation and supported by the California Department of Forestry and Fire Resources (CDF) and the California Office of Emergency Services. At the Federal level both NASA Ames Research Center, the US Air Force contingent at Onizuka Air Station, the US Forest Service and the US Geological Survey are also actively involved in the project. All local members of the State legislative contingent and the California Congressional delegation are active supporters of Project WILDFIRE and the Onizuka Air Station realignment effort. As part of this demonstration we are developing a significant Geographic Information System database of the proposed controlled burn site. This information will be made available to MROSD at no cost. Following the demonstration we will be proceeding with the implementation of a prototype WILDFIRE system as partners with CDF. We plan to continue the prototype system development with additional State of California and National support. COUNTY FIRE will ensure that the wildland burn is conducted under standard Incident Command procedures, including the provision for a Safety Officer, and will be responsible for the overall safe operation of the event. d. COUNTY FIRE will ensure that MROSD staff have an opportunity to use the event as a training opportunity by involving MROSD staff in the fire fighting and in the planning and execution of the event. COUNTY FIRE will allow at least one MROSD staff member of supervisor or higher level to be present at the command post at all times. Other District staff or agents may be present as observers. e. COUNTY FIRE will limit off-road driving by fire apparatus to minimize soil compaction. f. COUNTY FIRE will provide MROSD with a schedule of operations and keep MROSD informed of any changes in the schedule. g. COUNTY FIRE will be responsible for clean up of the burn site and any staging and transit areas, which are on MROSD property. h. COUNTY FIRE will patrol the burn site at least twice on each evening after completing a day's burning. Any signs of re-ignition will be immediately extinguished and any re-ignitions will be reported to MROSD. i. COUNTY FIRE will be responsible for discing or otherwise restoring the staging area and any other areas impacted by the exercise. MROSD shall have final say as to the completeness of the restoration and may require additional work be done to ensure full restoration of the area. j. In no event, shall equipment or materials be left unattended on MROSD property. k. MROSD shall provide COUNTY FIRE lock combinations for access to any necessary gates. 1. COUNTY FIRE shall be the lead agency for fire suppression and control, for the duration of the event. in. A copy of this permit shall be maintained on site at all times while the event is taking place. n. COUNTY FIRE will be responsible for informing neighboring residents and adjacent land owners of any site preparation activities which involve burning (i.e. black-lining). o. In the event that COUNTY FIRE produces for distribution a news release or other type of media advisory pursuant to the project, MROSD will be provided with a draft of the release for review prior to distribution and will be given the opportunity to include in that document a typical MROSD descriptive paragraph. If COUNTY FIRE engages in any other publicity 2 APPENDIX A activity pursuant to the project, MROSD shall be named as a cooperating agency. 4.0 Term Access to the site for the purposes of this permit is limited to Wednesday and Thursday, June 4 and 5, 1997. In the event that the event must be rescheduled, this permit will still be valid as long as MROSD has written notification of the new dates and MROSD has agreed to the new dates in writing. In order to do site preparation, COUNTY FIRE may also access the site on Monday and Tuesday, June 2 and 3. COUNTY FIRE and its agents shall have sole responsibility for the safeguard of their equipment, property, and personnel (i.e., employees, agents officers and guests) from any and all injury, death, or damage. 7.0 Insurance Throughout the term of this agreement, COUNTY FIRE, at its sole cost and expense, shall maintain in full force and effect comprehensive automobile and general liability insurance covering bodily and personal injury and property damage arising out of the COUNTY FIRE's activities pursuant to this Permit to Enter. Limits shall be not less than $5,000,000 per occurrence for bodily injury and $500,000 per occurrence for property damage. This permit is not valid without COUNTY FIRE's insurance in effect as shown on the attached Certificate of Insurance (Exhibit 2), which is made a part of this permit. The policy shall name MROSD as an additional insured. Throughout the term of this agreement, COUNTY FIRE, at its sole cost and expense, shall maintain in full force and effect a policy of Worker's Compensation Insurance covering all its employees as required by law. Each agency is responsible for the Workers Compensation coverage for their own employees, volunteers and agents. Such insurance policies shall not be canceled or materially changed without thirty (30) days' advance written notice to MROSD at the address shown under NOTICES. These insurance requirements may be met by membership in a California Government insurance pool. Santa Clara County Sheriffs Office was notified and a search was conducted. L. Paterson and B. Malone assisted. More bones were discovered and a criminal investigation is being conducted by the Sheriffs Office. The bones were thought to have been on the preserve for several years. April 6: P. Hearin issued citations to four people for after-hours violations in Fremont Older. T. Lausten and a count deputy sheriff were requested. One man was also issued a Y P Y �l citation for a $2,500 vehicle code warrant. Another man was arrested for a $16,000 warrant for failure to appear, assault, and vehicle code warrants. April 8: A bicyclist at St. Joseph's Hill swerved to miss two hikers and crashed. He estimated his speed at 30 -35 mph. He sustained a possible broken right clavicle. The accident was handled by Central Fire, AMR Paramedics, and a Los Gatos ranger who later notified the District. The bicyclist was under the influence of alcohol. P. Hearin handled the follow-up and report. April 13: B. Malone warned a group of four cyclists at El Corte de Madera OSP to stay on designated trails. One hour later he saw the group riding on a closed trail. The leader of the group was issued a citation and the others received written warnings. April 17: K. Miller responded to a bicycle accident at St. Joseph's Hill and interviewed the three cyclists involved. One bicyclist was issued a citation for unsafe operation for passing others at 15 mph, hitting the fence with his handlebar, and then falling into the cyclist he had passed. The other cyclist sustained minor injuries. April 18: A section of fence at Russian Ridge OSP was damaged when the operator of a vehicle spun donuts on the muddy surface of the parking lot and hit the fence. The person responsible is unknown. April 22: The caretaker's wife at Ravenswood attempted to secure the gate when she was assaulted, kidnapped, and robbed before being released in the parking lot. East Palo Alto Police responded and handled the incident. The suspects and their vehicle were gone when the police arrived. April 26: B. Malone issued a citation to a person riding without a helmet at El Corte de Madera. The person had been warned earlier by an OST not to ride without a helmet. In that letter we requested the courtesy of a reply. You have not replied. This weekend visitors to the MROSD property off of Rhus Ridge parked in our driveway. (For your reference, our driveway is a long paved road, with a "no trespassing" sign posted clearly on a fence at the entrance.) In addition, cars were parked along Rhus Ridge and in the lot at the comer of Rhus Ridge and Moody Roads. To have the cars removed, we called the MROSD number and was informed that no rangers were available. We called the Sheriffs Department, which promptly dispatched an officer. This forced the people who had left their vehicles in our driveway to knock on our door. When asked why they parked on our property, they replied "they didn't see the sign" which turned into "the lot was full". When we pointed out the sign directing visitors to Foothill College, they indicated they did not know where Foothill College was. In the month since our last correspondence, on weekdays we have had large school buses parked at the entrance to the trail. On weekends and weekdays we have had cars parked along Rhus Ridge Road and at the corners of Moody and Rhus Ridge Roads. This weekend was not an isolated event. This situation is intolerable. It is not going away. We call upon you to fix the problem now. For your information, we are providing copies of all correspondence to our Rhus Ridge Association and to the Town of Los Altos Hills. As you appear unwilling to take action to remedy the blight you are visiting upon us (and, in fact, plan further harm to us), we shall seek relief through our Association, through our local government, and, if necessary, through the legal system. The District will most likely buy up the 300 acres along Skyline Blvd. in order to save it from the Russian Convent of Our Lady of Vladimir who would rather destroy plant and animal habitat to build a new monastery on the site (5/19/97 San Francisco Chronicle "Neighbors Want To Block Nuns' Building Plans"). The highest and best use for the entire Skyline area is keeping it free of human development while at the same time allowing people to visit and explore its natural wonders. Anyone sensitive to the world around them knows the powerful effect nature has on ones personal psyche. Joseph L. Sax wrote: "To be able to draw satisfaction from a walk in the woods, without calling on others for entertainment..., the capacity to appreciate again and again, freshly and naively the basic good of life, with awe, pleasure, wonder, and even ecstasy. The feeling of being at home and in harmony with things, the satisfying fatigue after a hard day of self-imposed labor, the pleasures of elemental truths intensely felt, the movement of one's body along the trail, the color of a flower, the form of the landscape, can all be fully realized..." With all this available - who needs to build a monastery. George Santayana stated it another way when he wrote about nature: "It is no transcendental logic that [it teaches]; and [it] gives no sign of any deliberate morality seated in the world. It is rather the vanity and superficiality of all logic, the needlessness of argument, the fainted of morals, the strength of time, the fertility of matter, the variety, the unspeakable variety, of possible life. The Russian Orthodox nuns could play an very important role exactly where they currently are in the Mission District. They could do immense good for the community and themselves if, while in silent prayer, they would clean-up the graffiti, litter and handbills that now blights the Mission. As for the subject of "beliefs". The truth stands on its own. If something is true - it is true whether believed or not. RECOMMENDATIONS: Staff recommends that Council approve the proposed 1997/98 Arastradero Steward Workplan, and incorporate into the 1997/98 Interim Budget $50,000 in revenues and expenditures related to Steward activities, utilizing funding obtained from the Arastra Fund. EXECUTIVE SUMMARY: On April 28, 1997, Council approved an agreement with Bay Area Action for stewardship activities on the Arastradero Preserve. That agreement included: • A request for $50,000 in funding for the first year, to support stewardship activities on the Preserve, to be obtained from the Arastra Fund. • A means of reviewing performance of the Steward that would be similar to the City's Mission Driven Budget process. City and Steward staff met on May 9, 1997 to develop the attached proposed Arastradero Stewardship Workplan for 1997/98. The Workplan has been developed following the City's Mission Driven Budget format and includes a mission statement and key-plans. CMR:252:97 Pagel of Staff has developed compr,-..crosive key plans, but intends to use tnis first year to develop meaningful impact measures, after some experience has been gained on the work that is performed by the Steward under the direction of City staff. The new impact measures will be incorporated into the 1998-00 Two Year Budget. City staff will meet with the Arastra Fund Advisory Committee in June to present a request for$50,000 in funding from the Arastra Fund, to support the activities of the Steward on the Preserve during 1997/98. FISCAL IMPACT: The Arastra Fund provides financial resources for uses approved Council,through the budget process, including the activities to be performed by the Steward. Bay Area Action proposes to utilize donations, grant funding and money obtained through fundraisers for the remainder of its expenditures. ENVIRONMENTAL IMPACT AS E MENT• The Arastradero Preserve Workplan for 1997/98 represents a continuation of the same use of existing facilities; therefore, it carries a Class I facility exemption under Section 15301 of CEQA. As we have discussed, the policies of the McAteer-Petris Act, the Commission's enabling legislation, and the San Francisco Bay Plan encourage the acquisition and restoration of former areas of San Francisco Bay for wildlife habitat and other public purposes. In addition, Inner Bair Island is designated on the Bay Plan Maps as a waterfront park priority use area. We fully agree with the need to acquire this important area for public purposes and we understand that considerable planning remains to be done with regard to its future restoration and management. We have read POST's brochure about the acquisition efforts and were heartened that POST believes that"[e]xpanded recreational opportunities, such as fishing and boating, will become possible and `passive' land use, such as jogging, bicycling, and dog walking, should be able to continue on certain parts of the Island subject to a public process."We were further reassured about continued recreational uses of the Island in reading the National Wildlife Refuge's March 5, 1997 news release in which it is stated that it is"considering Inner Bair Island as the future site of nature walks, bird watching, hiking and other public use activities that are compatible with wildlife....[and] Inner Bair Island could potentially become one of the Refuge's more important public use areas...." With these comments in mind, we believe that acquisition of Bair Island for such public purposes is consistent with the Commission's laws and policies and support your efforts. The message contained some errors in regards to the trail commonly called 'Moody's Trail' at Sierra Azul Open Space Preserve. The following information was posted on the internet on Tuesday, May 6 to correct the information. The Midpeninsula Regional Open Space District has received a number of e-mail messages regarding the route known as 'Moody's Trail' at Sierra Azul Open Space Preserve. A message posted yesterday on a number of e-mail lists contained errors in regards to the trail. I'd like to correct some things. The route commonly called 'Moody's Trail' was created as a firebreak during the Loma Prieta fire of the mid-1980s. Use of the firebreak as a trail has increased, bringing with it a dramatic increase in erosion. Because the route is steep, the water has nowhere to go but straight down the 'trail,' causing further erosion. It has become a resource issue. It is not a designated trail, meaning it has never been shown on any District map, it is not maintained, nor is it signed. Staff researched the possibility of making it a trail, but based on its characteristics and location, did not feel it was appropriate. In order for it to be designated as a trail, it would need to meet certain standards and would require Board action. It would need to be widened and the steep sections realigned so that proper drainage features could be installed. We estimate the realignment would nearly double the length of the trail. The route also duplicates the Priest Rock Trail, which is a designated route. Typically, we don't designate duplicate routes; one trail servicing an area is adequate. We recognize that there is a difference between 'single track' and wider patrol roads. However, in this case, protection of the resource is our primary goal. The firebreak will be ripped in the near future and reseeded later this fall. The use of it as a trail will be blocked with fencing. Signing will be posted to deter use. Please honor the closure. Because this route was never designated as a trail, no Board action was required to close it. However, the Board was alerted at their Wednesday, April 23 meeting that staff would be closing the route. Thank you for the opportunity to address this issue. Regional Open Spac j 1 MIDPENINSULA REGIONAL OPEN SPACE DISTRICT May 8, 1997 Michael Nevin, President and Members of the Board of Supervisors San Mateo County 401 Marshall Street Redwood City, CA 94063 Re: Support for Approval of Edgewood County Park Master Plan Dear President Nevin and Honorable Members of the Board: The Midpeninsula Regional Open Space District has participated in the planning process for the Master Plan for Edgewood County Park and Preserve as an owner and manager of adjacent open space and as a holder of a conservation easement over the Edgewood site. We find that the plan is in keeping with the objectives of the conservation easement and we urge its adoption. The development of the Master Plan has been a challenging process for all concerned because of the unique resources at the site in close proximity to the urban area, and the strong knowledge and opinions that many groups and individuals hold about the site. The report represents a thorough, thoughtful effort to identify and address all the complex issues confronting the planning for this site. The proposed Master Plan properly places emphasis on protection of natural resources over public use and development, based on thorough review of the full range of information, ideas and concerns, including input from our District. Overall, the draft Master Plan provides an excellent foundation for the future management of Edgewood Park and Preserve. The proposed plan is a reasonable combination of measures to accommodate public access while ensuring that resource protection comes first. We commend the excellent work of the Friends of Edgewood Natural Preserve in pulling together the original base data and management ideas and concerns. We also complement the Parks and Recreation Division staff for organizing and completing the input process and the document, along with all the community groups and members that contributed. We commend County staff and representatives for their hard work on this important regional issue. We believe the proposed ordinance will make a major contribution to protecting the natural resources of the West Valley Hillside area. Our understanding is that design review and this zoning ordinance will be applied to the entire hillside area. We support this approach as being the most rational way to assess and manage visual impacts on a regional basis. We hope that the impact of this requirement on staff will be recognized early in the process to ensure that adequate resources are made available. We'are disappointed that a maximum house size is not included in the draft. Other communities have total lot coverage and building square footage limits based on lot size and average slope that have proved to be a successful way to manage impacts. We recognize that each case is different, but size limits provide a valuable guideline for applicants, and serve as a valuable tool for staff, project review committees, and officials in the decision-making process. Such maximum limits should include detached units and other assessory structures, while making allowances for barns and other agricultural structures. In any case, we are pleased that assessory structures over 500 square feet will require design review. We appreciate the proposal, outlined in the staff report, to address the potential visual impacts on park and open space areas by referrals to parks and open space agencies during the design review process. We are committed to doing our part to make this process responsive and realistic. As you know, in the last five years the San Mateo County budget for parks, open space, and libraries has significantly decreased, resulting in a serious degradation of services. The Alternative Funding Committee, representing the stakeholdeFs involved in these issues, studied alternative methods of funding for parks, schools, and libraries. The Committee ultimately concluded that a combined sales tax measure was the most viable way to address the needs of the financially strapped institutions so fundamental to our quality of life. Your bill, SB 375, would give the citizens of San Mateo County the opportunity to vote on whether to impose a tax on themselves to provide the necessary relief to our local parks, schools, and libraries. This is true regional control over regional issues, and I applaud you for carrying such thoughtful and much-needed legislation. I find this situation disturbing and respectfully request that you work closely with Mr.James Burton to ensure that such language does appear in the final shareholder resolution presented on May 22n4. As a Director with the Midpeninsula Regional Open Space District I sponsored a resolution to CalPERS asking for divestiture of all financial holdings in Maxxam Corp. It is unimaginable to me that CalPERS could not find other more suitable corporations in which to invest state employees retirement funds. However, I would be willing to see CalPERS maintain financial holdings in Maxxam,should they become willing sellers of Headwaters forest or engage in meaningful debt for nature negotiations. As a public official responsible for my staffs retirement funds I am deeply concerned that should Maxxam not alter their current posture regarding Headwaters Forest, public employees retirement funds could be jeopardized. Within my constituency there is strong support for a debt for nature swap and even stronger dismay that public employee pension funds are at risk due to the questionable financial dealings of Maxxam. It is my sincere hope that CalPERS will present a shareholders resolution on May 22nd which includes debt for nature language and encourages Maxxam to bolster it's failing financial state. Box 7207 San Jose, CA 95150 Dear Mr. Bourke: The District's Board of Directors received your March 12, 1997 request for a copy of the 1985 Master Plan Map Overlay at their March 27, 1997 meeting and directed staff to respond. Since this is an obsolete document, it was difficult to locate. We appreciate your patience while staff tried to locate a copy. District Clerk Jean Fiddes was finally able to locate the original Master Plan Overlay and a copy was prepared for you. The list of owners, dated September 27, 1989, and also obsolete, is enclosed. In 1990, the Attorney General stated that the adoption of a resolution listing all parcels of real property larger than twenty acres within the District's planning areas as the potential subject of negotiation for purchase would not satisfy the disclosure prerequisite for a closed session regarding the purchase of any one or more of such parcels. As,a result, the District revised its procedures to comply with the Brown Act and discontinued use of the property owner list and map. (See the enclosed November 16, 1990 report to the Board.) Because of this 1990 Attorney General's Opinion, both the overlay map and the listing of property owners are obsolete and no longer used by the District. The Ralph M. Brown Act permits a legislative body of a local agency to hold a closed session with its negotiator prior to the purchase, sale, exchange, or lease of real property by or for the local agency to instruct its negotiator regarding the price and terms of payment for the purchase, sale, exchange, or lease. In accordance with the Brown Act, the District's agendas identify the real property or real properties which the negotiations may concern and the person or persons with whom the District's negotiator may negotiate. The Board reviewed your letter last night at its regular meeting. While the District is interested in trying to accommodate a variety of recreational uses for our constituents, there are a number of factors which we feel preclude hang-gliding and paragliding at Sierra Azul at this time. As a public agency, we are greatly concerned with allocating our limited resources in the best interest of our constituents, and in the most effective manner possible. Without decreasing patrols elsewhere, the District does not have an adequate staffing level that would allow us to reasonably monitor and maintain this additional use at Sierra Azul. And, since Sierra Azul is a "patchwork" of public land interspersed with a great number of private parcels, we are unaware of an adequate landing zone for your proposed activity. As you may know, each preserve undergoes a "use and management" (U&M) planning process. Currently, there is no comprehensive U&M Plan for this preserve, in part due to the interspersed private land, as well as the continuing clean-up and potential for structural demolition activities at Mt. Umunhum. We don't expect completion of a plan for at least several years. However, the District is willing to put your request on an agenda for Board consideration at a meeting in July when Director Siemens, who represents Ward 7 (Los Gatos), is back in town. Let me assure you.that the District shares your desire to see the Bay Trail be constructed in the area of Bair Island as well as around the entire Bay. We have been and will intend to continue to work toward completion of the Bay Trail. I've assigned Mr. Del Woods, the District's Senior Management Specialist and long-time senior planner, to work with all of the affected agencies involved to develop a plan that will allow for the Bay Trail to continue through the area of Bair Island. The District has worked for close to 20 years with the various administrations at Moffett Field to make the Bay Trail a reality in that area. That segment is finally nearing a resolution, and I can assure you we will put that same commitment into the other sections of the Bay Trail within the District's jurisdiction.
