CITY OF TEMPLE CITY
COUNCIL MINUTES
ADJOURNED MEETING
December 7, 1970
INITIATION:
1. Mayor Merritt called the adjourned meeting of the City Council to order
at 5:40 p.m. in the north meeting room of the City Hall.
2. ROLL CALL:
PRESENT: Councilmen- Gilbertson, Harker, Merritt
ABSENT: Councilmen - Briggs, Tyrell
ALSO PRESENT: City Manager Koski, City Attorney Martin
Mayor Merritt moved that Councilmen Briggs; and Tyrell, who would
possibly be arriving late, be excused for cause. The motion was
seconded and carried.
Councilman Briggs arrived at the meeting at 6:00 p.m. and Councilman
Tyrell at 6:18 p.m., which is further noted in these minutes.
PROPOSED CITY CHARTER:
City Attorney Martin advised that a 34 -page draft of a charter had
been submitted to the Council for review. He stated that the draft was
the most elementary charter it was possible to draw, retaining all
of the aspects of being a general law city, but providing a charter for
such purposes to be within the charter by amendment; that it was merely
the chartering of a general law city. The City Attorney called to
the attention of the Council, that in each instance where action of
the Council was delineated in the charter, affirmative vote of three
persons was necessary, rather than a majority of quorum present.
Each page of the proposed charter was reviewed, and recommendations
made for redraft where necessary. Councilman Briggs arrived at
6:00 p.m. at the time of review of Section 501, and Councilman Tyrell
arrived at 6:18 p.m. at the time of review of Section 603. They
were advised of items previously referred for redraft which were
acceptable to them.
The City Attorney was instructed to rewrite Section 609 - Inter-
ference with Officers and Employees, as outlined in discussion.
City Attorney Martin advised that a fourth draft of the charter would
be prepared to include all corrections, and resubmitted to the
Council. He advised that the matter of submitting a proposed
charter to the Legislature for approval had been discussed with
Assemblyman Harvey Johnson and other legislators, and that if the
preliminary draft were approved, Assemblyman Johnson was prepared
to take it to the Legislature late this month. Legislative
concurrence is required by both the Assembly and Senate by a
majority vote.
City Manager Koski advised that the resolution calling for the
election should probably be adopted at the first meeting of the
Council in January, and the election tentatively scheduled for a
Tuesday in early March.
4. ADJOURNMENT:
Councilman Tyrell moved to adjourn to a personnel session, seconded
by Councilman Briggs and unanimously carried, and the meeting
adjourned at 7:15 p.m. Next regular meeting of the 'Council will be
held on Tuesday, December 15, 1970, at 7:30 p.m. in the Council
Chambers of the City Hal 1 .
