HomeMy Public PortalAbout87-022 (02-17-87)RESOLUTION NO. 87-22 A RESOLUTION Or THE CITY COUNCIL OF THE CITY OF LYNWOOD DECLARING ITS INTENTION TO VACATE AND ABANDON SANBORN STREET BETWEEN LONG BEACH BOULEVARD AND PEACH STREET, CHESTER STREET BETWEEN SANBORN STREET TO A POINT 340 FEET NORTH OF FERNWOOD AVENUE, COURT STREET (WESTERLY 25 FEET) BETWEEN PLAZA STREET TO A POINT 200 FEET SOUTH OF PLAZA STREET, PLAZA STREET (EASTERLY 20 FEET) BETWEEN COURT STREET AND A POZNT 95 FEET NORTH OF MULFORD AVENUE, PLAZA STREET BETWEEN COURT STREET AND SANBORN AVENUE WHEREAS, the City Council entitled to vacate all or part. public service easement within and Highways Code Section 8312; of the City of Lynwood is of a street, highway or the City pursuant to Streets and WHEREAS, the City Council has determined that it is necessary and appropriate to undertake proceedings pursuant to Streets and Highways Code Section 8300 through 8325, inclusive, to consider the vacation of certain easements in the vicinity of the Lynwood Towne Center Redevelopment Project; and WHEREAS, California Streets and Highways Code Section 8320 requires adoption of resolution of intention to initiate such proceedings; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lynwood as follows: Section 1. The City Council hereby declares its intention to vacate and abandon those streets and an alley described below and more particularly described in Exhibits 1 through 6, inclusive, attached hereto and incorporated by reference. Sanborn Street between Long Beach Boulevard and Peach Street. Chester Street between Sanborn street to a point 390 feet North of Fernwood Avenue. Court Street (westerly 25 feet) between Plaza Street to a point 200 feet South of Plaza Street. Plaza Street (easterly 20 feet} between Court Street and a point 95 feet North of Mulford Avenue. Plaza Street between Court Street and Sanborn Street The first alley West of Long Beach Boulevard between Beechwood Avenue and a point 95 feet North of Mulford Avenue. Section 2. The vacation proceedings initiated hereby are conducted under Chapter 3 of Part 3 of Division 9 of the California Streets and Highways Code (Section 8300 through 8325, inclusive). Section 3. The general location and extent of the streets and alley to be vacated are shown on a map attached as an exhibit to this resolution, which map is also on file in the Office of the City Clerk. Section 4. The City Council hereby determines that the public convenience and necessity may require that easements be retained for construction and maintenance of utility lines within the limits of the street vacation described above. Section 5. The City Clerk is hereby directed to give and post, as required by law, notice of the passage of this resolution of intention, and give therein the legal description of the streets proposed to be vacated and abandoned, and specify the time and place of hearing of the proposed vacation and abandonment, which is hereby fixed as follows: Hearing to be before the City Council of the City of Lynwood, at 11330 Bullis Road, in the City Council Chambers of the City Hall of said City of Lynwood, at the hour of 7:30 p.m. or as soon thereafter as the matter may be heard, on March 17, 1987, at which time and place all persons interested may appear and object or protest ~o the proposed vacation and abandonment of said streets and alley. If the City Council finds from the evidence submitted that the streets are unnecessary for present or prospective use, it may make its order vacating all or part of the streets and alley. 4930k/1269/000 _ 2 _ Section 6.
