AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI PROVIDING FOR THE
VOLUNTARY ANNEXATION OF REAL PROPERTY CONTIGUOUS TO THE PRESENT
CITY LIMITS, INTO THE CITY OF JEFFERSON, MISSOURI, LOCATED AT 2239 AND
2243 RIDGE ROAD; DESCRIBED AS LOTS 28, 29 AND PART OF LOT 30,
LONGVIEW SUBDIVISION, IN THE COUNTY OF COLE, STATE OF MISSOURI; AND
AMENDING SECTION 1-17 OF THE CODE OF THE CITY OF JEFFERSON,
MISSOURI, DEFINING THE EXISTING CITY BOUNDARY BY ADDING ONE NEW
SUB-SECTION PERTAINING TO THE SAME SUBJECT.
WHEREAS, pursuant to Section 71.012.2 RSMo, the City Council of the City of
Jefferson desires to annex the unincorporated area of land described in
Section 1; and
WHEREAS, the property addressed as 2239 Ridge Road is owned by Joshua and
Sherry Carlyle; and
WHEREAS, the property addressed as 2243 Ridge Road is owned by Charles
Howard; and
WHEREAS, the property is adjacent to the City; and
WHEREAS, a public hearing concerning the annexation was advertised in advance of
the hearing in the Jefferson City News Tribune.
NOW THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The City Council intends to and shall proceed to annex, as provided
by law, the unincorporated area of land described as follows: The westerly part of Lot
No. 30 of Longview Subdivision, per plat of record in Plat Book 5, Page 55, Cale County
Recorder's Office; said Longview Subdivision being a subdivision of part of the
southeast quarter of the northeast quarter of Section 19, Township 44 North, Range 12;
the said westerly part of Lots No. 30, being more particularly described as follows:
Beginning at the most southerly corner of said Lot No. 30; thence northeasterly along the
line between Lots Nos. 30 and 29, 200 feet, to the most southerly corner of a tract
conveyed to Fred M. Helseth and Wife, by deed of record in Book 172, Page 262, Cole
County Recorder's Office; thence North 27 Degrees 25 Minutes West, along the westerly
line of the said Helseth Tract, to the northerly line of said Lot No. 30; thence
southwesterly along the line between Lots Nos. 30 and 31, to the most westerly corner
of said Lots No. 30; thence southeasterly along the westerly line of said Lots No. 30, 85
feet, to the Point of Beginning; AND Lots Nos. 28 and 29 of the Longview Subdivision,
per plat of record in Plat Book 5, Page 55, Cole county Recorder's Office; said Longview
Subdivision being a subdivision of park of the Southwest Quarter of the Northeast
Quarter of Section 19, Township 44 North, Range 12 West.
Section 2. The City Council finds and declares that the land described in Section
1 is contiguous to the City boundary; that the annexation is reasonable and necessary to
the proper development of the City; and further, did determine the City has an ability to
furnish normal municipal services to this area.
Section 3. A public hearing was held on January 7, 2013, as provided by law,
concerning the annexation of the unincorporated area described in Section 1.
Section 4. The land described in Section 1 shall be zoned RS-3 until such time
as the zoning may be changed in the manner provided for by State Statute and City
Code.
Section 5. Section 1-17 of the City Code of the City of Jefferson, Missouri is
hereby amended by adding one new subsection which shall read as follows:
U The City's boundaries shall also include the following parcel: The
westerly part of Lot No. 30 of Longview Subdivision, per plat of record in Plat
Book 5, Page 55, Cole County Recorder's Office; said Longview Subdivision
being a subdivision of part of the southeast quarter of the northeast quarter of
Section 19, Township 44 North, Range 12; the said westerly part of Lots No. 30,
being more particularly described as follows: Beginning at the most southerly
corner of said Lot No. 30; thence northeasterly along the line between Lots Nos.
30 and 29, 200 feet, to the most southerly corner of a tract conveyed to Fred M.

Section 6. The annexed area shall be in Ward 4 of the City.
Section 7. The effective date of this Ordinance and the annexation of the area
described in Section 1 will be immediately upon passage, provided that no written
objections to the proposed annexation are filed with the City Council. If sufficient
objections are filed, this ordinance shall not become effective until such time as the
annexation issue has been resolved pursuant to the provisions of Chapter 71 RSMo.

ANNEXATION AGREEMENT
This agreement entered into this 13th day of November, 2012, between the City of
Jefferson City, Missouri, a municipal corporation (hereinafter "City") and Joshua C Carlyle and
Sherry Lynne Carlyle(hereinafter"Owners").
The parties agree as follows:
1. Owners represent that they are the sole Owners of the following real estate Iocated in
Cole County,Missouri:
THE WESTERLY PART OF LOT NO. 30 OF LONGVIEW SUBDIVISION, PER
PLAT OF RECORD IN PLAT BOOK 5, PAGE 55, COLE COUNTY RECORDER'S
OFFICE; SAID LONGVIEW SUBDIVISION BEING A SUBDIVISION OF PART OF
THE SOUTHEAST QUARTER OF THE NORTHEAST QUARTER OF SECTION 19,
TOWNSHP 44, RANGE 12; THE SAID WESTERLY PART OF LONG NO. 30, BEING
MORE PARTICULARLY DESCRIBED AS FOLLOWS:
BEGINNING AT THE MOST SOUTHERLY CORNER OF SAID LOT NO. 30;
THENCE NORTHEASTERLY ALONG THE LINE BETWEEN LOTS NOS. 30 AND
29, 200 FEET, TO THE MOST SOUTHERLY CORNER OF A TRACT CONVEYED

SUBJECT TO EASEMENTS AND RESTRICTIONS OF RECORD (hereinafter
"Owners' property").
2. In exchange for the City's agreement to allow Owners to connect their property to the
Jefferson City Waste Water System,the Owners,on behalf of themselves, their heirs and assigns,
do hereby convey unto the City the irrevocable and perpetual right to file on their behalf a
Petition of Annexation at any time after annexation becomes possible.
3. City shall allow Owners to connect sanitary sewer lines serving Owners' property to the
City's sanitary sewer system. Owners shall make this connection at their expense. Owners shall
obtain all necessary permits for the sewer connection and pay all fees required to connect to the
City's sewer system. Owners shall become sewer customers of the City and shall pay all sewer
fees and charges established by the City.

4. All sewer lines and appurtenances serving Owners' property shall be located within
standard sewer easements dedicated to the public use and constructed in compliance with City
regulations and standards. Construction of the sewer lines and appurtenances shall be inspected
by the City as though the property were within the City limits and shall be subject to City
approval. The sewer lines and appurtenances shall be deeded to the City after they have been
constructed and pass City inspection.
5. Sewer lines serving property other than Owners' property shall not be connected to the
sewer lines serving Owners' property without the City's consent.
6. All sewer lines and mains constructed by the Owners shall conform to all City ordinances
and standards as though the property were within the City limits. All common lines of sanitary
sewers shall be dedicated to the public use.
7. If any conflict exists between a County regulation and a City regulation, Owners, to the
extent required by law, shall follow the County regulation. Owners acknowledge that no conflict
is involved where a City regulation imposes a more stringent minimum requirement than a
corresponding County regulation and where the City imposes regulations that are not imposed by
the County.
8. To the extent allowed by law, City may annex Owners' property into the City, without
further action of the Owners, after Owners' property becomes contiguous to the corporate limits
of the City.
9. Owners irrevocably appoint the City Administrator of Jefferson City, Missouri, as their
attorney-in-fact for the sole purpose of presenting a verified petition requesting annexation of
Owners' property to the City Council of Jefferson City, Missouri. The City Administrator may
exercise this power of attorney at any time after Owners' property becomes contiguous to the
corporate limits of the City. Owners on their behalf, and on behalf of their heirs successors and
assigns do hereby waive any notice of the filing of the petition, do hereby consent to the granting
of the petition, and do hereby waive any objections, statutory or otherwise, to the annexation of
the property into the City of Jefferson. Owners do hereby authorize the City to take whatever
action necessary to complete the annexation of this property.
10. If requested by the City Administrator, Owners shall, within such time as specified by the
City Administrator, submit a verified petition requesting annexation of Owners' property to the
Director of Planning and Development for presentation to the City Council of Jefferson City,
Missouri. The City Administrator may request Owners to present an annexation petition at any
time after Owners' property becomes contiguous to the corporate limits of the City. The
provisions of this paragraph shall be enforceable by specific performance.
11. Owners further agree that they shall not to consent to voluntary annexation by any other
municipality without the consent of the City.

12. Owners shall give a copy of this agreement to each person who buys all or a portion of
Owners' property.
13. If Owners fail to comply with any of the provisions of this agreement, or repudiate the
terms of this agreement, City may terminate sewer service to Owners' property and disconnect
the sewer lines serving Owners' property from the City's sanitary sewer system. City shall give
Owners six months prior written notice of its intent to terminate sewer service.
14. This agreement is not intended to confer any rights or remedies on any person other
than the parties.
15. The benefits and burdens of this agreement are intended to attach to and run with the
land and shall be binding on and inure to the benefit of the parties and their respective legal
representatives, successors, heirs and assigns. All persons claiming under the parties shall
conform to and observe the provisions of this agreement.
16. This agreement shall be recorded in the office of the Cole County Recorder of Deeds at
the City's expense.

ANNEXATION AGREEMENT

RECORD IN PLAT BOOK 5, PAGE 55, COLE COUNTY RECORDER'S OFFICE;
SAID LONGVIEW SUBDIVISION BEING A SUBDIVISION OF PART OF THE
SOUTHWEST QUARTER OF THE NORTHEAST QUARTER OF SUBDIVISION 19,
TOWNSHIP 44 NORTH, RANGE 12 WEST.

This letter is to advise you that an application for voluntary annexation into the City of Jefferson, Missouri
and zoning plan have been filed by Sherry and Joshua Carlyle, 2239 Ridge Road and Charles Howard,
2243 Ridge Road:
Case No. P12021 — 2239 and 2243 Ridge Road — Establish Zoning for Properties
Requesting Voluntary Annexation. Applications filed by Joshua and Sherry Carlyle,
owners of 2239 Ridge Road, and Charles Howard, owner of 2243 Ridge Road, for
voluntary annexation pursuant to Section 71.012 RSMo and zoning plan of RS-3 Single
Family Residential. The properties are located on the north side of Ridge Road 1000 feet
east of South Country Club Drive and are described as lots 28, 29, and part of lot 30,
Longview Subdivision, Cole County, Missouri. (see map on reverse).
The processing of this application involves the following steps:
• The Jefferson City Planning and Zoning Commission will meet at 5:15 p.m. on Thursday,
December 13, 2012 to consider zoning the property as RS-3 Single Family Residential.
• The City Council's public hearing is tentatively scheduled for January 7, 2013, at 6:00 p.m., after
which the annexation petition may be accepted by the Council.
• Both meetings will be held in the Council Chamber of the John G. Christy Municipal Building (City
Hall), 320 E. McCarty Street, Jefferson City, Missouri 65101.

Case No. P12021 — 2239 and 2243 Ridge Road — Establish Zoning for Properties Requesting
Voluntary Annexation. Applications filed by Joshua and Sherry Carlyle, owners of 2239 Ridge Road,
and Charles Howard, owner of 2243 Ridge Road, for voluntary annexation pursuant to Section 71.012
RSMo and zoning plan of RS-3 Single Family Residential. The properties are located on the north side
of Ridge Road 1000 feet east of South Country Club Drive and are described as lots 28, 29, and part of
lot 30,Longview Subdivision,Cole County, Missouri.
Nature of Request
The purpose of the request is to incorporate the two subject properties into the city limits of the City of
Jefferson with a single family residential zoning designation. The property owners have petitioned the
City for voluntary annexation. The purpose of the request is to be eligible to connect to the City sewer
system.

Staff Analysis and Recommendation
Voluntary Annexation and Zoning Plan:
The property owners have submitted petitions to annex their properties into the city limits of the City of
Jefferson. The properties sit adjacent to an existing RS-3 single family residential zoning district and the
properties meet the lot standards for the RS-3 district. The property is contiguous to the current city
limits. Staff recommends approval of the annexation petition and designation of the property as RS-3
Single Family Residential on the Zoning Map.
Form of Motion:
Approval of the zoning plan for the property to be zoned RS-3 Medium Density Detached Residential.

Mr. Barron gave the Planning Division staff report. He explained that the request is to incorporate
the two subject properties, which are contiguous to the city limits, into the city with a single family
residential zoning designation. Mr. Barron explained the purpose of the request is to be eligible to
connect to the City's sanitary sewer system. He stated that staff proposes to zone the properties
RS-3, as they are adjacent to Covington Gardens Subdivision, which is zoned RS-3 single family
residential, and the lots meet the standards for the RS-3 district.
Mr. Deeken inquired whether the City will take care of snow removal just for these two properties.
Mr. Barron explained that the voluntary annexation is only for the two properties, and that the
County will continue to maintain the street.
Ms. McMillan added that the properties will be served by Jefferson City emergency services, and
will be benefit from the City's rates on other services.
No one spoke in opposition to this request and no correspondence was received.
Mr. Nunn moved and Mr. Dutoi seconded to recommend approval of the zoning plan for the
properties to be zoned RS-3 Medium Density Detached Residential to the City Council. The motion
passed 8-0 with the following votes:
