Mayor Merritt called the regular meeting of the City Council to order at 7:35 p.m. 2. The invocation was given by Pastor A. R. Hagen, Seventh Day Adventist III Church, 9664 E. Broadway, Temple City. 3. The Pledge of Allegiance to the Flag was led by Mayor Merritt. 4. ROLL CALL: PRESENT: ABSENT: ALSO PRESENT: Councilmen - Briggs, Harker, Tyrell, Merritt Councilmen - Gilbertson City Manager Koski, City Attorney Martin, Planning Director Dragicevich, Parks and Recreation Director Kobett Councilman Briggs moved to excuse Councilman Gilbertson for business reasons, seconded by Councilman Tyrell and carried. 5. APPROVAL OF MINUTES: Councilman Harker moved to approve the minutes of the Regular Meeting of December 1, 1970, as written, seconded by Councilman Briggs and carried. Councilman Harker moved to approve the minutes of the Adjourned Meeting of December 7, 1970, as written, seconded by Councilman Tyrell and carried. IIIUNFINISHED BUSINESS: 6. ORDINANCE NO. 70 -315: 2nd read. Re. Change of Zone, 4810, 4812, 4816 Baldwin and 10015 E. Lower Azusa Road. City Attorney Martin presented Ordinance No. 70 -315 entitled AN ORDINANCE OF THE CITY OF TEMPLE CITY RECLASSIFYING AND REZONING CERTAIN PROPERTY FROM R -4 TO C -2 ( CASE NO. 70 -323 ) for second reading by title only. Councilman Harker moved to waive further reading and adopt, seconded by Councilman Tyrell and carried.. 7. ORDINANCE NO. 70 -316: 2nd read. Re. Change of Zone, 92.40 E. Longden Avenue. City Attorney Martin presented Ordinance No. 70 -316 entitled AN ORDINANCE OF THE CITY OF TEMPLE CITY RECLASSIFYING AND REZONING CERTAIN PROPERTY FROM ZONE R -1 TO R -2 (CASE NO. 70 -326) for second reading by title only. Councilman Tyrell moved to waive further reading and adopt, seconded by Councilman Briggs and carried. 8. RESOLUTION NO. 70 -1063: Vacation of Easement - Portion of Alley, south of Las Tunas, easterly of Kauffman Avenue. City Attorney Martin advised that in accordance with instruction of the Council at the December 1, 1970, meeting, a resolution to vacate the westerly 190 feet of the alley located south of Las Tunas Drive, between Kauffman and Golden West, had been prepared. He pointed out that resolution would not be effective until all of the conditions had been met. Councilman Tyrell suggested that in order that legal descriptions be thoroughly checked, that in addition to the City Engineer, that the City Attorney also review the dedications as described in Section 4, Item 3, which was then included in the Resolution. City Attorney Martin presented Resolution No. 70 -1063 entitled A RESOLUTION OF THE CITY COUNCIL OF City Council Minutes, December 15, 1970 — Page 2 THE CITY OF TEMPLE CITY VACATING THE WESTERLY 190 FEET OF THAT CERTAIN ALLEY LOCATED SOUTHERLY OF LAS TUNAS DRIVE RUNNING BETWEEN KAUFFMAN AVENUE AND GOLDEN WEST AVENUE IN SAID CITY, as amended. Councilman Tyrell moved to adopt, seconded by Councilman Briggs, and carried. 9. PROPOSED CITY CHARTER: City Attorney Martin advised that a redraft of the charter had been made, incorporating the changes discussed at the adjourned meeting of the Council held on December 7, 1970, and had been provided to the Council prior to this evening's meeting for review. An additional amendment was suggested by Councilman Tyrell relative to the carrying out of administrative functions in the absence of the City Manager. The City Attorney was instructed to include an additional phrase stating that the administrative authority related to the City Manager only, and not to the assistant. A communication from the Southern California Edison Company suggesting the inclusion of provision for granting of franchise, was received. The City Attorney advised that the draft, as presently written, incorporates existing state law for this purpose and that this amendment was not consistent with the charter as written. Councilman Harker moved that the tentative draft as amended be approved for purposes of clearance with the Legislative Counsel, and that the City Attorney and City Manager be authorized to pursue the matter with the Legislative Counsel prior to the January 5, 1971 Council meeting. The motion was seconded by Councilman Briggs and carried. NEW BUSINESS: 10. EXPLOSIVE PERMITS: City Attorney Martin advised that new legislation amended state laws regulating explosives, and that the issuing authority would be the Sheriff unless the city des, i gnates the Chief of the Fire Department or his authorized representative as the issuing authority, and that the Los Angeles County Fire Department has procedures already established to perform these services and that it was agreeable to both agencies that the Fire Department should continue that function. It was moved by Councilman Tyrell that pursuant to Section 12007 as added to the Health and Safety Code by Chapters 1421 and 1425 of the Statutes of 1970, the Forester and Fire Warden of the County of Los Angeles is hereby designated as an issuing authority to issue permits relating to explosives in the City of Temple City; and that this order shall be operative on the earlier of the following dates, the effective date of Chapter 1421, Statutes of 1970, or the effective date of Chapter 1425, Statutes of 1970. The motion was seconded by Councilman Harker and carried. 11. SUMMARY ACTIVITY REPORT FROM YOUTH COMMISSION: City Manager Koski advised that resignations had been received from the members of the Youth Commission in accordance with their previous recommendation so that a new 5- member board could be appointed. On motion of Councilman Harker, seconded by Councilman Tyrell, the resignations were received as submitted. The matter of appointments to the new 5- member board was referred to a Personnel Session of the Council, following the close of the meeting. Council- man Tyrell noted that the Youth Commission would appreciate interest and direction on the part of the members of the Council, and urged attendance at their meetings. Mayor Merritt advised that he had not attended Youth Commission meetings in order to provide the youth with a free approach to their deliberations without the feeling of being watched over. RECOMMENDATIONS FROM PLANNING COMMISSION — Meeting of December 8, 1970 A. Addition. of New Section to Municipal Code Relating to Structures with Nonconforming Setbacks in R Zones. Planning Director Dragicevich advised that this matter had been before the Planning Commission and that it was recommended that a Public Hearing be set by the Council for amendment of the Temple City Municipal Code as outlined in Resolution No. 70- 397PC. Councilman Tyrell moved to set Public Hearing for Tuesday, January 5, 1971, at 7:30 p.m. in the Council Chambers of the City Hall, seconded by Councilman Briggs and carried. B. Proposed General Plan. Planning Director Dragicevich advised that the Planning Commission had held Public Hearings on the General Plan and has adopted Resolution No. 70 -396 PC recommending its adoption. It was determined that Public Hearing on the matter should be held on January 5, 1971, at 7:30 p.m. in the Council Chamber of the City Hall, and it was so moved by Councilman Tyrell to set Public Hearing. The motion was seconded by Councilman Briggs and carried. 13. RECOMMENDATIONS FROM TRAFFIC COMMISSION: Meeting of December 2, 1970 A. OAK AVENUE: LEMON TO EMPEROR - Additional Regulations. Traffic Engineer Envall advised that the Traffic Commission recommended placement of an additional 94 feet of white passenger loading zone on the west side of Oak Avenue, extending southerly from the north property line of. Oak Avenue Junior High School to provide a more adequate area for loading and unloading passengers, and to eliminate unloading in unauthorized areas fronting the school.," It was moved by Councilman Harker to approve and to order the work to be accomplished, seconded by Councilman Tyrell and carried. B. LOWER AZUSA ROAD AT TEMPLE CITY BOULEVARD - Time Limit Parking. Traffic Engineer Envall advised that the Traffic Commission recommend- ed placing one hour time limit parking from 7:00 a.m. to 6:00 p.m. on the south side of Lower Azusa Road, extending from Temple City Boulevard easterly to the first driveway, and on the east side of Temple City Boulevard, extending from Lower Azusa Road to the first drive southerly to provide the necessary turnover to the fronting developments, with enforcement on a complaint basis only. Councilman Briggs moved to approve, seconded by Councilman Harker and carried. C. SULTANA AVENUE AT LAS TUNAS DRIVE - Parking Restrictions. Traffic Engineer Envall advised that the Traffic Commission recommended placement of signs reading "Two Hour Parking, 7 a.m. to 6 p.m., Sundays Excepted" on the east and west sides of Sultana from Las Tunas Drive to the first alley northerly, to alleviate the problem of all -day parking on Sultana and to provide customer parking for adjacent businesses, with enforcement on a complaint basis only. Councilman Tyrell moved to approve, seconded by Councilman Briggs, and carried. III 14. RESOLUTION NO. 70 -1064: WARRANTS & DEMANDS, Demand Nos. 3254 thru 3333, in the amount of $40,414.95. Councilman Tyrell moved to adopt Resolution No. 70 -1064 entitled A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $40,414.95 DEMAND NOS. 3254 THRU 3333, seconded by Councilman Harker and carried. COMMUNICATIONS: City Manager Koski advised that a communication from the League of Cal iforn is Cities relative to requiring railroads to landscape their right -of -way in cities had been studied by the Planning Commission, and that the Planning Commission indicated support of the requirement. Councilman Briggs called to the attention of the Council the matter of maintenance costs that would be involved which in due time would reflect back to the taxpayer. It was concurred in by the Council that no action be taken on the matter. TIME FOR THOSE IN AUDIENCE WHO WISH TO SPEAK: Charles Marshall, 8752 E. Leslie, San Gabriel, inquired as to the abatement of billboard: signs which had not been enforced, and for which no application for Conditional Use Permit had been made. The City Council discussed the matter of the continued existence of non- conforming outdoor advertising structures presently in C -2 zones, which were presently in violation, the three -year abatement period having been completed several months ago. The City Attorney was instructed to initiate proceedings immediately to terminate the existing illegal use. 17. MATTERS FROM CITY OFFICIALS: 1 A. PARKS & RECREATION COMMISSION RECOMMENDATIONS - Special Meeting of December 14, 1970. Director of Parks & Recreation Kobett advised that an offer had been received from the Temple City Senior Citizen's Club to donate a public address amplifier in the amount of $135 to the City for use at Live Oak Park in conjunction with the built -in system presently being installed, and that the Parks & Recreation Commission recommended its acceptance. It was moved by Councilman Tyrell to accept the donation of a public address amplifier from the Temple City Senior Citizens Club, and that a letter be forwarded expressing the City's appreciation. The motion was seconded by Councilman Briggs and carried. B. Councilman Harker noted that lights in the mall, south of Las Tunas, east of Temple City Boulevard were not in operation. City Manager Koski advised that the matter would be corrected. 18. ADJOURNMENT: 1 Councilman Tyrell moved to adjourn to a personnel session at 8:40 p.m. seconded by Councilman Briggs and carried. Following the personnel session the Council reconvened and the follow- ing appointments were made by Mayor Merritt and confirmed by Council. Environmental Study Committee: Mrs. Robert S. Allen, Darrell: Bender, Mrs. Marlene DiGrazia, Everett H. Greenberg, Rupert (Jim) Herrick, Dick Lucas, Mrs. Nancy Mesias, Mrs. Rochelle Taylor, and William Wells. The Youth Commission: Arnold GaffreK Judith Golden, Steven Johnson, Shirley Mosser, and Leslie Sunell. Following the confirmation of appointments the Council adjourned to the next regular meeting of the Council which will be on Tuesday January 5, 1971, at 7:30 p.m. in the Council Chamber of the City Hall.
