LYNWOOD CITY COUNCIL, MARCH 15, 1994

The City Council of the City of Lynwood met in a Regular Session
in the City Hall, 11330 Bullis Road on the above date at 7:33
p.m.
Mayor Pro-Tem Byrd in the Chair.
Councilmembers Heine, Henning, Rea and Byrd answered the roll
call.
Also present were City Manager Gonzales, Interim City Attorney
Rudell, City Clerk Hooper and City Treasurer Pygatt.
It was moved by Mayor Pro-Tem Byrd, seconded by Councilmember Rea
and carried to excuse Mayor Richards.
City Clerk Hooper announced the Agenda had been duly posted in
accordance with The Brown Act.
It was then moved by Councilmember Heine, seconded by
Councilmember Rea and carried to approve the following minutes:
a) Special Meeting, February 12, 1994
b) Regular Meeting, March 1, 1994
It was then moved by Councilmember Heine, seconded by
Councilmember Rea and carried to recess to the Lynwood
Redevelopment Agency at 7:36 p.m.
Mayor Richards arrived at 8:03 p.m.
Council reconvened at 8:05 p.m.

PUBLIC HEARINGS
Mayor Richards then introduced the first Public Hearing on theRichard:
agenda - A Recommendation of the City Planning Commission to Planning
Approve Zone Change No. 6, changing the Zoning Classification forCO1~issic
Property Located at the Northwest Corner of Atlantic Avenue andZOning
Olanda Street from R-3 (Multiple Family) Zone to CB-1 (Controlled asifice
Business Zone).
It was moved by Councilmember Rea, seconded by Councilmember Byrd
and carried to open the Public Hearing.
Hearing no discussion, it was moved by Councilmember Rea,
seconded by Councilmember Byrd and carried to close the Public
Hearing.
It was then moved by Councilmember Heine, seconded by
Councilmember Byrd to adopt:
ORDINANCE NO. 1391 ENTITLED: "AN ORDINANCE OF THE CITY COUNCILOrd.139
OF THE CITY OF LYNWOOD AMENDING CHAPTER 25, THE OFFICIAL ZONINGZoning
ORDINANCE OF THE LYNWOOD MUNICIPAL CODE, CHANGING THE ZONING
CLASSIFICATION OF LOTS 24, 25 AND 36 AS SHOWN ON PAGE 013, COUNTY
ASSESSOR'S BOOK NO. 6186, LOS ANGELES COUNTY, LOCATED IN LYNWOOD,
CALIFORNIA".

Mayor Richards then introduced the next Public Hearing - ARichard;
Recommendation of the City Planning Commission to approve Genera]Plannig
Plan Amendment No. 6, Changing the Land Use Designation foxCommissic
Property Located at the Northwest Corner of Atlantic Avenue andand Use
Olanda Street from Multi-Family Residential to Commercial. Designati

Director of Community Development Blumenfeld stated this is in Sol
conformance with FIMA guidelines.
Councilmember Henning stated concerns and problems with the Hennig
Disposition and Development Agreement and the no interest loan. D.D.A
Feels these funds could be better utilized on assistance to the
library. Questioned the City Attorney on how the city is
protected under this contract.
Interim City Attorney Rudell stated he was not involved in the Rudell
preparation of the D.D.A. This document was prepared by Kane, D.D.A.
Balmer and Berkman, and his firm had not conducted an independent
review of the document.
City Manager Gonzales stated there was no one here from theGonzale;
preparing law firm, however the Redevelopment Agency had been L~
utilizing the assistance of this firm for a number of years. D.D.A.
They are redevelopment specialist and this is a standard D.D.A.
Mayor Richards stated this Disposition and Development Agreement Richard;
contains substantial information which protects the Agency and D.D.A.
after his initial review, feels comfortable.
Councilmember Henning stated he is not in favor of this project Henning
Also feels there is a certain amount of discrimination involved Home
in the sale of these homes. Sees this as a gift of public Sales
property.
Mayor Richards stated this project is consistent with the City's Richard:
desire to develop moderate income housing within the City. income
Councilmember Henning stated he is still concerned with how the Henning
properties are being sold, and these issues have not been propert
addressed.
Councilmember Rea recommended that the item be pulled for further Rea
review on the funding issue and consideration of the acquisition Coc~¢nunit~
of the property along with concerns and needs of the community.
Councilmember Heine stated the developer has been working on thisHeine
project for over a year. Feels it is time to move ahead. move

Councilmember Byrd concurred with Councilmember Heine. Byrd
Mayor Richards recommended amending the motion to instruct eitherRichard;
the City Attorney and/or Special Counsel, prior to execution City
review the document to insure that all the sufficient safeguardsSafeguarc
are in place for the city.
It was moved by Councilmember Heine, seconded by Councilmember
Byrd to include amendments made by the Mayor.

Mayor Richards then introduced the next item, a Joint PublicRichard:
Hearing to Approve a Disposition and Development Agreement D.D.A.
~ (D.D.A.) with Owens Engineering and Development corporation Wilbur
(Wilbur Owens) to Develop Southwest Corner of Lynwood Road and Qaens
Lindbergh Avenue.
It was moved by Councilmember Byrd, seconded by Councilmember Rea
and carried to open the Public Hearing.
At this time Mayor Richards reconvened the regular scheduled
meeting of the Lynwood Redevelopment Agency, to be held in
conjunction with the City Council meeting.

After further discussion, it was moved by Councilmember Byrd,
seconded by Councilmember Heine, to waive the first reading and
introduce:
ORDINANCE NO. 1392 ENTITLED: "AN ORDINANCE OF THE CITY COUNCIL OFOrd.1392
THE CITY OF LYNWOOD, CALIFORNIA, AMENDING IN ITS ENTIRETY SECTION Change
6-3.15 OF THE LYNWOOD MUNICIPAL CODE RELATING TO CHANGE ORDERS". Orders
Councilmember Henning recommended having the item brought back atHenning
a later time for the possibility of lowering the amount.

Adolph Lopez 11134 Plum, stated issues going back and forth ar~:LOpez

Bob Downs 3920 Carlin Ave, questioned dispersions and personalB.Downs
allegations made this evening. Feels for the ease of the public,dispersi
explanations are necessary.
Rod White 4608 Carlin Ave., questioned the zone change from R.White
residential to commercial on Atlantic & Olanda. Commended Zone
Councilmembers Henning and Rea for their concerns during Change
discussions pertaining to spending. Thanked City Manager andResidenti
Public Works Director for improvements made in his area. to Commer
Annette Martin 3910 Virginia, spoke regarding loitering problems A.Marti
on her street.
William Cunningham-Traffic & Parking Commissioner, 10821 Cornish W.Cunni
spoke regarding State regulations and guidelines prior to traffic
installing traffic signals in the city. signals
Connie Cooper 3901 Virginia spoke regarding loitering problems on C.Coope
her street. Stated she wishes to reemphasize the problems stated loiteri
by her neighbors.
COUNCIL ORALS
Councilmember Rea spoke regarding possibly reordering the agenda Rea
in order to allow the public to speak on agenda items closer to Justice
the consent calendar. Requested staff look into the intersection Center
at Peach & Beechwood. Also spoke regarding the scheduled tour of Grafitti
the Justice Center and the possibility of scheduling either an Departure
evening or a weekend tour. Questioned Graffiti Department and
their work schedule.
Councilmember Byrd spoke regarding a Health Conference held Byrd
within the City this week that he had recently attended. Also Health
introduced Dr. Carol Harris, soon to be Board Member at St.~nferenc
Francis Hospital.
Councilmember Heine stated concerns with the city ordinanceHeine
pertaining to commercial vehicles parked on private party and Ord.
asked staff to look into amending the ordinance to help solve theConunercia
problem. Also spoke regarding March being Child Abuse AwarenessVechiles
Month and the Blue Ribbons being worn as symbols. Parked
Councilmember Henning spoke regarding the complaints and Henning
recommendations made by Mr. White. Feels the residents have a Mr.White
better feel for what is needed in their neighborhood, because Complain
they deal with these problems every day. Spoke regarding the Church
restrictions being placed on the church located on California restrict
Ave. Would like to see Council utilize funds for more important
issues such as longer hours at the library.
