Regular Meeting
The Board of Town Trustees met
in regular monthly session at the
above - written time and place at 8 p.m.
President Knox in the chair.
The roll of members was called
with the following result: Present, Trustees
Beck, Knox, Mathiesen(sic) and Murphy;
absent, Trustee Ryan.
The minutes of the last regular
and subsequent adjourned and called meetings
were read and approved.
The regular monthly reports of the
Clerk, Marshal and Treasurer were read
and ordered placed on file

Trustee Beck offered the following reso-
lution:
Resolved, That the Clerk of the Town of
Livermore is hereby instructed to advertise
for two weeks in a newspaper of general
circulation printed and published in
the Town of Livermore, Alameda County,
California, for bids for the town adver-
tising required by law to be printed and
published in a newspaper printed in
said town.
All bids shall be made in accordance
with the following specification, terms
and conditions: The price per square con-
sisting of nine lines nonpariel type for
the first insertion and the price for each
subsequent insertion.
The contract for said printing
shall continue for one year from the date
of the letting of this contract.
Said bids shall be delivered in
sealed envelope addressed to the Clerk
of the Town of Livermore, in person, marked
Bids for Town Advertising" and must
be delivered to said Clerk before the hour
of 7:30 p.m. on Monday evening, February
1st., 1908.
Said bids shall be opened by
the Board of Trustees of Said Town of
Livermore in open session and exam-
ined and publicly declared.
Said Board reserves the right to
reject any and all bids.
The person receiving the award of
the contract for the advertising herein
shall within three days there after
enter into a written contract with the
Town of Livermore for the said adver-
tising for a period of one year, and
shall furnish to said Town a
good and sufficient bond in the sum
of $200, with two sureties who shall
be acceptable to the Board for the faithful
performance of said contract.
After said bond shall have been
approved by the Board it shall be filed
with the Clerk of the Town.
The work performed under the con-
tract shall be paid for monthly in the
manner provided by law.
The resolution was adopted by
the following vote: Ayes - Trustees Beck,
Knox, Mathiesen(sic) and Murphy; noes - none;
absent, Trustee Ryan.
Applications for liquor licenses
were received as follows:

The application were approved
by the License Committee and on
motion both were granted and licenses
ordered to be issued.
On motion of Trustee Murphy,
seconded by Trustee Mathiesen(sic), the
supplementary bond given by Town
Treasurer W. H. Taylor to cover the
expenditures for sewer construction
was ordered released.
Trustee Mathiesen(sic) offered the
following resolution:

Resolved , That the sum of 27.20
be transferred from the General Fund
to the Sewer Construction Fund to
balance overdraft in the latter fund
The resolution was adopted by
the following vote: Ayes - Trustees Beck,
Knox, Mathiesen(sic), Murphy; noes, none;
absent, Trustee Ryan.

The following application for a
liquor license was received:
Louis Adams - To do business in the
premises known as the Valley Hotel.
Recommended by Freeholders W. B.
Lowenthal, E. Hansen J. C. Reimers,
Laughlin Moy, P. Callaghan and
E. Pronzini.
The License Committee granted P.
M. O'Donnell's application to sell
and reported favorably upon the ap-
plication and upon motion the license
was ordered granted by unanimous
vote.
The Clerk was instructed to notify
Mrs. True to connect the Hotel d'Italia
premises with the sewer system at
once.
The Clerk was instructed to com-
municate with J. T. Williams, Dursini
Engineer of the Western Pacific Railway
Company in reference to the overflow
caused by the inadequate culverts
and diverted into the town by the
railway embankment, and to ask
that action be taken at once.
An application for a transfer
of liquor license was received
from T. B. Nunez to premises to
be stated at a future meeting

Laid on the table.
A petition, signed by Henry
Meyer and 61 others, was presented
to the Board asking that P. street
be opened from First Street to
Olivina Avenue H. P. Hansen, a

resident on P street, and C. M. Nissen,
secretary of the Farmers Warehouse
Company addressed the Board on
behalf of the petition The matter

was referred to the Street Committee.
The annual report of the
Livermore Water & Power Co. for 1908
to be used as a basis for establishing
rates for the ensuing year was
submitted and referred to the
Fire and Water Committee.
The bid of Elmer G. Still to do
the official advertising for the
ensuing year in the Livermore Echo
at the rate of 75 cents for the first-
insertion and 30 cents for each
subsequent insertion, was the only
one submitted. On motion the bid
was accepted and the contract
awarded to Mr. Still under the
terms of the resolution calling for
bids.

A communication was received
from J. T. Williams, Division Engineer of
the Western Pacific Railway Co., in which
he assured the Board that ample water
ways and diverting levies would be
constructed to avoid any further damage
from flood water as far as the Western
Pacific Roadbed is concerned. Filed

Govern of the Southern Pacific Company
in reference to opening up P. street
across the right of way of that com-

pany. Mr. MGovern stated that there
is at present a crossing on the line
of the proposed street which is open
to the public and as in the opinion
of the company's officials no additional
privileges or benefits would be derived
from dedication this strip of land.

Adjourned Meeting
The Board met of Town Trustees met
in adjourned session at the above-
written place and time at 8 o'clock
p. m.
Roll call - Present, Trustee Beck.
Knox, Mathiesen(sic) and Ryan; absent,
Trustee Murphy, President Knox pre-
sided.
In the matter of the application
of T. B. Nunez for a liquor license
to do business in the premises on
Livermore Avenue, between Railroad
Avenue and Oak street, owned by
Mrs. C. Gardemeyer, the Committee
of the Whole, to which it had been
referred at the last regular meeting
together with a subsequently filed petition signed by
A. Fiorio and 100 other colleagues recommending that it
be granted, reported adversely, Trustee
Ryan asking that his vote be recorded
as dissenting from the majority By

this action on the part of the Committee
the application was denied.
An application for a renewal of
liquor license was received from
Carl Ferrario to do business on the

and upon motion the license was granted

Applications for building permits
were received from the Masonic Hall
Association and Frank Gomes, Sr.
Both were granted.
Carl Holm appeared before the
Board in behalf of the family of
the late Paul Frydendal asking
for damages resulting from the accident
at the Lizzie street railroad crossing
last August by which Mr. Fryden-
dal was injured, it being represented
by Mr Holm that said accident
was due to an improperly filled
trench in the sewer system being
built for the town. In the absence
of a definite claim the Board de-
clined to take action at this time
Engineer R. H. Fry appeared before
the Board on behalf of F. W. Tetley
in regard to securing a deed to
the land purchased by the Town of
Livermore and granted to Mr. Tetley
for a site for the brick and terra
cotta plant. He was referred to
Trustee Murphy who had the
matter in hand and represents the
town as trustee.
On request of M. G. Callaghan
for the Western Pacific Railway Company
and W. B. Bagley for the Southern Pacific
Company, permission was granted
to both companies to connect the
roof drainage of their respective
depots and freight sheds with the
sewer system, subject to revocation
by the Board.
The Board adjourned to the call

A communication was received
from J. T. Williams, Division Engineer of
the Western Pacific Railway Co., stating that

Assistant Engineer MDonald had been
instructed to furnish gravel necessary for
all crossing s and to repair any damage to
streets resulting from flood waters diverted
into the town by company's tracks
A communication to C. H. Wente
from the California Wine Association and
referred to the Board, was read. The As-
sociation expressed a disinclination to
grant the request for a right-of-way
through their property for the proposed
extension of P street for the reason that
their property had already been badly
cut up by granting a right of way
for the Western Pacific Railway Co. and
that any further curtailment would
interfere with the use for which they
intended the property and prevent any possible
enlargement of their plant.
An application was received from
Oswill Bros. for a renewal of their liquor
license to do business in the Mednia
building on the south side of First
street between K and L Recommended

by Freeholders J. C. Reimers, Geo W. Beck,
Chas. E. Livermore, J. R. Merchant, J. H. Dutcher
and Geo. Beck. The License Committee
reported favorably and the license was
granted by unanimous vote.
A petition signed by L. Guanziroli
and thirty-three other citizens and asking
that the fire-bell be moved to a more
central location and raised to a
sufficient height so that it might be
heard throughout the town was received.
Referred to Fire and Water Committee
Ordinance No __, an ordinance es-
tablishing water rates and fixing the com-
pensation for water furnished for family
uses, for private purposes, for municipal
uses and all public purposes for the
year commencing July 1, 1909, and ending
July 1, 1910, 1 was read first time.
An application for leave of absence
for one month was received from Town
Marshal C. P. Lefever Granted

A notification was received from
Town Marshal Lefever that he had ap-
pointed D. A. Smith, Deputy Marshal to
serve during his absence The appointment was approved
x
The matter of laying a sewer on Sixth
street between Lizzie and H was left to
the Street committee with power to act.
The Clerk was instructed to request
the members of the Library Board to
attend a joint meeting on next Mon-
day evening.
The Clerk was granted permission
to purchase two additional sections to
his filing cabinet
The chair appointed a committee
consisting of Trustees Murphy, Ryan
and Beck to secure definite action
in the matter of obtaining rights of
way for the proposed drainage canal
across the lands of Nellsen, Wente, Coffmann,
et al.
The Board adjourned to Monday

The chairman stated that the
object of calling the meeting was to se-
cure action in the matter of establish-
ing a pound for dogs and cattle.
On motion of Trustee Ryan, sec-
onded by Trustee Murphy, a public
pound was established in accordance
with the provisions of Ordinance No 14,
on the premises of Al Leclair on L
street between Railroad Avenue and
Oak street, by unanimous vote.
No further business appearing
the Board adjourned.

The Board of Town Trustees met
at the above - written place and date
at 8 o'clock p. m. with al the members
present as follows: Trustees Beck, Knox,
Mathiesen(sic), Murphy and Ryan Presi-

The minutes of the last regular
and subsequent called meeting were
read and approved.
The regular monthly reports of
the Clerk, Marshal and Treasurer and
a special report of the Superintendent
of Streets on the construction of the
Sixth street Sewer were read and
approved and ordered place on file.

The License Committee reported
favorably upon the applications of Jos. Damas,

John Twisselmann, Raboli Bros., and MLeod &
Sangmaster and licenses were ordered is-
sued. The applications of Henry Garde-
meyer and Henry Schulz were laid
over until Wednesday.

Dr. H. G. MGill, Health Officer
appeared before the Board and reported
regarding the unsanitary condition
of a number of premises He was re-

quested to make a written report
and present same at a meeting to be
held on Monday evening
Ordinance No 54, " An ordinance
establishing water rates and fixing
the compensation for water furnished
for family uses, for private purposes,
for municipal uses and all public
purposes for the year commencing July 1,
1909, and ending June 30, 1910, was given
final reading and on motion of trustee
Ryan, seconded by Trustee Beck, was
adopted by the following vote: Ayes-
Trustees Beck, Knox, Mathiesen(sic) and
Ryan; noes, none; absent, none; excused
form voting, Trustee Murphy.
J. L. Weilbye, on behalf of the
Masonic Hall association, made ap-
plication for permission to connect
a portion of the roof drainage of the
new Masonic Temple with the
Lizzie street sewer in conformity
with the ordinance granted.

An application from Town Marshal
Lefever for one month extension of his leave of
absence was on motion granted.
An communication was received
from the Library Board asking a pledge
of support of $ 1000 a year for the Public
Library in the event that a donation
of $ 10,000 is received from Andrew
Carnegie for the erection of a library
building.
In accordance with this request
Trustee Beck offered the following
resolution:
Resolved, That the Board of Trustees
of the Town of Livermore hereby pledges
itself to provide the amount of $1000
annually for the support of the Public
Library, provided a donation sufficient
to erect a building of the value of
$
10,000 is secured.
Trustee Mathiesen(sic) moved the
adoption of the resolution It was

seconded by Trustee Murphy and
adopted by the following vote: Ayes-
Trustees Beck, Knox, Mathiesen(sic), Murphy
and Ryan; noes, none; absent, none.
The Clerk was instructed to prepare
a suitable memorial to forward to
Andrew Carnegie asking for a donation
of $ 10,000 for a Public Library.
The Clerk was further instructed
to request the attendance of the
members of the Library Board at a
meeting to be held on Monday evening
to make further arrangement toward
securing a library building.
The Board adjourned to met on
Wednesday at 9 a. m.

The application of Henry Gardemeyer
for a renewal of liquor license, which
had been laid over form the regular
meeting pending an investigation of
charges made that applicant was
selling liquor to minors and allowing them to
frequent his place of business was taken
up Mr. Gardemeyer, who had been

summoned to appear before the
board, was informed by the chairman
of the charges that had been made
against him He stated that he
x
had not been personally in charge
of his business for some time on ac-
count of illness and that if the
liquor had been sold as charged it
was done without his knowledge He
x
promised that if the license was
granted there would be no further
cause for complaint The License Com-
x
mittee took the matter under con-
sederation for to report Monday evening.
The application of Henry Schulz,
which had been laid over because
three of the signers were not freeholders,
was amended and the License Committee
reported favorably re same and on motion the
license was granted by unanimous vote.
W. B. Lowenthal appeared before
the Board and asked that the license
of Anspacher Bros., be reduced from
the first to the third class on account
of retiring from the merchandise business

On motion of Trustee Murphy,
seconded by Trustee Beck, the license
of $ 80, as charged against the Town
Marshal, be rebated
x
On the recommendation of the License
Committee, the license of Anspacher
$
Bros. was established at 52 ;per an-
num.
Town Marshal Lefever submitted
the appointment of Al Leclair as
Deputy Marshal to act as Poundmaster
in accordance with the provisions of
Ordinance No 14. On motion of Trustee
Ryan, seconded by Trustee Murphy,
the appointment was approved.
The Clerk was instructed to
notify J. C. Reimers and Hansen Bros.,
to connect the wash-racks of their
respective livery stables with the
sewer within thirty days.

The License Committee reported
favorably upon the application of'
Henry Gardemeyer for renewal of
liquor license under the conditions
imposed at the last meeting. On
motion of Trustee Mathiesen(sic), seconded
by Trustee Ryan, the license was
granted by unanimous vote.
The Health Officer reported in
writing upon the premises which in
'his opinion should be connected
with the sewer system at once.
On motion of Trustee Murphy,
seconded by Trustee Ryan, the Clerk
was instructed to communicate with
the owners or agents of the premises
mentioned and direct them to make
connection with the sewers within
thirty days.
The members of the Library Board
being present, the matter of securing
a public library from Andrew Carnegie
was discussed at length It was de-

cided to forward to Mr. Carnegie's secretary
at once the necessary application with
the resolution pledging the support of the
Town Trustees together with a memorial
prepared by the Town Clerk and the Secri-
tary of the Library Board

In the matter of the premises ordered
to be connected with the sewer system,
M. Horton, Hattie Smith, and M. Gruenig
were granted an extension of thirty days
and P. M. O'Donnell was granted an ex-
tension of sixty days.
The Clerk was instructed to notify
Susan Azazi Jadom to abate the
nuisance in the rear of her property
on the corner of First and J streets
within thirty days of the Board would
order the work done and the cost made
a charge against her property.
An application for removal of
liquor license was received from
Marcel Laffaille He was recommended

M. Granna, M. G. Callaghan, E. Pronzini
and Geo W. Beck.
The License Committee reported
favorably and the license was ordered
granted by unanimous vote.
Trustee Mathiesen(sic) offered the
following resolution which
on motion of Trustee Mathiesen(sic), seconded
by Trustee Ryan was adopted
by unanimous vote:

be and it hereby transferred from
the General Fund to the Bond Interest
and Redemption Fund.
On motion of Trustee Ryan, seconded

reappointed Chief Engineer of the Fire

The Chief Engineer asked for two
new fire-hose nozzles The matter

A special meeting of the Board
of Town Trustees was called for the
above date at 8 p.m. and there were
present the following named members:
Trustees Beck, Knox, Mathiesen(sic) and
Murphy; absent, Trustee Ryan.
President Knox presided
F. Mally and D. F. Bernal, owners
of adjoining property on the south
side of First street, between J and
K., were present at the invitation
of the Board with a view of securing a
perfect understanding of the fire
ordinance in view of proposed
building operations. The matter was
thoroughly discussed but there was
no definite action taken on the
part of the board.

Trustee Ryan offered the following
resolution:

be and it is hereby empowered to employ
an expert to examine the books and
accounts of the various municipal officers
and present a report at the next regular
meeting of the Board

On motion of Trustee Murphy, seconded
by Trustee Mathiesen(sic) the resolution was
adopted by unanimous vote.
Frank Fennon appeared before the
Board and asked for a rebate of license,
having sold his butcher business to
Moy Bros. He was instructed to
present a claim at the next regular
meeting of the Board and it would be
considered.
Action was deferred on the
application of F. Mally for a building
permit until Wednesday forenoon
at 9 o'clock to which time the Board
adjourned.

Your special committee, consisting of
Trustees J. D. Ryan and F. Mathiesen(sic), beg
to inform you that as a result of their
action they have arrived at the following
results:
T. D. Coffman will give the right
of way though land for the construction
of the proposed ditch for the sum of
$ 300.
Peter Nielsen will give the right
of way for the same purpose for a
lump sum covering 1.92 acres at the
$
rate of 100 an acre, and the same rate
for a triangular piece of land cut
off from the main body of his acreage,
said piece containing about one-fourth
or one-half an acre.
Edw. Hansen will give the right-
of way - about .27 of an acre - at the rate
$
of 100 an acre.
Trustee Murphy reports to the com-
mittee that C. H. Wente will donate the
right of way through his property, amounting
to .15 of an acre.

construction of a culvert across
County Road No 2010, as surveyed
by the County Surveyor, for the pur-
pose of diverting flood waters from
County Road No 1408, this Board
agrees to acquire the necessary right
of way from Edward Hansen, Peter
Nielsen, C. H. Wente and T. D. Coff-
man and to deed same to the
County of Alameda without re-
numeration from said Board of
Supervisors except the easement
contemplated in the before - men-
tioned undertaking

building committee to consist of two
members of the Board of Town Trustees

July 1, 1909, in the Treasurer's report. He has paid
in fifty cents too much to his bank account.
He should have had in his hands on

The Marshal was instructed to
appoint a number of deputies to preserve
order on Halloween and to arrest any-
one destroying property
Complaint was made to the
Board that plumbing was being done
at the Livermore Sanitarium by
workmen who had not filed the
proper bond and who were not doing
work in accordance with the plumbing
ordinance. The Clerk was instructed
to call the attention of Dr. Robertson
to the provisions of the ordinance.

Trustees Ryan and Murphy, the committee
appointed to investigate the matter of securing
a town dumping ground, was granted a week's
further time.
An application for renewal of liquor
license was received from Plath & Jensen

P. M. O'Donnell made application on
behalf of many citizens for a light on the
north side of First Street near the Catholic
Church Referred to Light and Water Com-

The Clerk was instructed to notify

next Monday evenings meeting in reference to
renewal of their bonds.
The Marshal was instructed to
notify property - owners to remove rubbish

An application was received from
Mithchell & Wilson for permission to
erect a corrugated iron shelter on
lumber supports on the site of the
old Fried warehouse. Referred to the
Building Committee.
A petition for the establishment
of street lights on the corners of O and
Elm, O and Locust, and O and Pine,
signed by Geo. L Monahan and none
other property-owners in the Northern
addition was referred to the Light and
Water Committee with power to act.
Trustee Murphy offered the following
resolution and moved its adoption:
Whereas, The public interest and necessity demand
the acquirement of a suitable site for
the erection of the library building do-
nated by Andrew Carnegie, and to be
used as a public park, and
Whereas, T. E. Knox, chairman of this
Board, acting as trustee for the Town of
Livermore, has secured an option on
Block 31, Mendenhall Plan, and eligible
site for both purposes, and
Whereas, The cost is too great to be
paid out of the ordinary annual income
and revenue of the town, be it
Resolved, That this Board submit
an issue of bonds to the amount of $10,000
to cover the purchased price and im-
provement of said grounds to the qualified
electors of the Town of Livermore.
The motion was seconded by
Trustee Beck, Knox, Murphy and Ryan;
noes, none; absent, Trustee Mathiesen(sic).
The resolution was formally approved in
writing by the chairman of the Board
and attested by the Clerk.
The bonds of the various plumbers
were refused approval on account of
being incorrect in form and the Clerk
was instructed to refer them back to the
surety company for correction.
The Clerk was instructed to notify
P. Callaghan to connect his premises with
the sewer system.
The Board then adjourned to Monday
evening.

having located street lights on the corners

two fire hydrants would be located on the

instructed to order two additional lengths
of fire hose form the Bowers Rubber
Works at the price paid on the recent

Trustee Ryan of the Building Committee reported that a house

enter into an agreement with T. M. Twohey
to erect the building in accordance
with his estimate.
W. H. Bissell, superintendent of the
Livermore Water & Power Company appeared
before the Board and submitted a
proposition to change the present street-
lighting system to a series Tungsten
installation with sixty-candle-power
units on the business streets and at
the railroad crossings to be burned all
night instead of until 1 a. m. as at
present, at the rate of $3 per light per
month The matter was referred to the

Fire and Water Committee with instructions
to report at the next meeting

The returns of the bond election
held on December 27th were opened and
canvassed by the Board Trustee Schrader

offered the following resolution and
moved its adoption:
Whereas, the Board of Trustees of the
Town of Livermore did, by Ordinance No 58
of said Board of Trustees, call and order
to be held in said town a special election
on the 27th day of December, 1909, for the
purpose of submitting to the qualified electors
thereof the following proposition: "Proposition
to incur a bonded debt of the Town of Liver-
more to the amount of $10,000 for the purpose
of the acquisition of a tract of land to be
used as a site for the erection of a library
building and as a public park and pro-
viding for the improvement of same, such
debt to bear interest at a rate not
to exceed five per centum per annum,
payable semi-annually; and
Whereas, said Ordinance No 58 was duly
published as required by law as appears
from the affidavit of Elmer G. Still, on
file in the office of the Town Clerk; and
Whereas, Said special election was
held on said 27th day of December, 1909,
and from the returns thereof filed in
the office of the Town Clerk, it appears that
said election was held and conducted in
form and manner required by law and
the ordinances of said Town, and the Board
of Trustees having canvassed the returns
of said special election on this, the
30th day of December, 1909, therefore be it
Resolved, by the Board of Trustees of
the Town of Livermore as follows:
1. That the total number of votes
cast at said special election was 261, of
which one was rejected as illegal.
2. That of the votes so cast 242
were cast and counted as being in favor
of said proposition so submitted and
in favor of authorizing the incurring of
said bonded debt.
3. That of the votes so cast 18 votes
were cast and counted as not in favor
of said proposition and not in favor
of authorizing the incurring of said
bonded debt.
4. That it is hereby declared and
determined that more than two-thirds
of the voters voting at said special
election voted in favor of, and that
mote than two-thirds of the voted
cast thereat were in favor of the afore-
stated proposition and did thereby
authorize the incurring of a bonded
debt to the amount of and for the purpose
stated in said proposition.
Trustee Ryan seconded the motion
and the resolution was adopted by the
following vote: Ayes-Trustees Knox, Ryan and
Schrader; noes none; absent Trustees Beck
and Mathiesen(sic).
The claim of W. H. Taylor, Town
$
Treasurer, for 540 in payment of
six months' interest on 24 sewer bonds
due on January 1, 1910, was approved and
on motion a warrant was ordered
drawn for the amount.
The Board then adjourned.
