MINUTES
I. ROLL CALL
President Mary Davey called the meeting to order at 7:30 P.M.
Members Present: Mary Davey, Nonette Hanko, Pete Siemens, Ken Nitz, Jed Cyr and
David Smernoff.

II. ORAL COMMUNICATIONS
Harry Haeussler, 1094 Highland Circle, Los Altos, thanked the Board and staff for:
numbering the agenda items; the clearing of the overgrown Hamms Gulch trail; and
beginning construction of a parking lot at Windy Hill Open Space Preserve. He spoke of the
recent dangers for women on East Bay trails and questioned if it is permitted for women to
carry mace or pepper spray for self-defense, and recommended cellular phones be carried for
emergency purposes. He mentioned there were seven or eight trails without names on the
Windy Hill Open Space Preserve trail map.
J. Escobar responded the District does not outlaw pepper spray but that mace, pellet guns or
pump rifles were not permitted.
M. Davey referred the naming of trails to staff to respond at a later date.
Patty Ciesla, Box 3189, Stanford, recommended the District name trails in segments rather
than in long strings such is the practice now, and she spoke of the discomforting reception
she experiences when addressing the Board as a representative of the mountain biking
community.
Joe Lavelle, 1503 Julie Lane, Los Altos, questioned the District's philosophy of posting
signs which advise visitors of sensitive areas and said he felt there was a need for posting
signs on canyon trails at Rancho San Antonio Open Space Preserve. M. Davey responded

the response to his written communication was being taken off the consent calendar and that
his concerns would be addressed at the time.
Richard Bourke, P. O. Box 7207, San Jose, thanked the Board for starting their meeting on
time and commented that the meeting minutes were excellent. He spoke of the need for
Brown Act improvements and felt that the closed sessions needed certain disclosures. S.
Schectman assured Mr. Bourke that closed sessions are conducted in full compliance with the
Brown Act.
III. ADOPTION OF AGENDA
Motion: N. Hanko moved that the Board adopt the agenda. J. Cyr seconded the
motion. The motion passed 6 to 0.
IV. ADOPTION OF CONSENT CALENDAR
N. Hanko removed the reply to written communication from Mr. Joseph Lavelle. D.
Smernoff requested clarification on what appeared to be an incomplete sentence in the
meeting 97-17 minutes on page 3, second paragraph. M. Smith responded the sentence
should state ...."will be closed to bikes and horses for the first season." H. Haeussler
removed agenda item 10, Scheduling of Special Meetings of the District's Board of
Directors on A uug st 23. 1997 and September 20. 1997 for the Purpose of Conducting Tours
of District Lands for Invited Local Public Officials and Scheduling of Special Meetings of the
District's Board of Directors on September 17, October 15 and November 5, 1997 for the
Purpose of Conducting Joint Meetings with San Mateo Count Parks Commission Santa
Clara CountyQpen Space Authority. and Santa Clara County Parks Commission to Discuss
the District's Regional('pen Space Plan.
Motion: D. Smernoff moved that the Board adopt the Consent Calendar, including
minutes of Meetings 97-17 and 97-18 dated July 9, 1997; responses to written
communications from Al and Jeanne Bell, 12130 Skyline Boulevard,
Woodside, Mr. Kelly P. Mulrey, P. O. Box 1113, Palo Alto, Ms. Linda S.
Cohen, 935 Scott Street, Palo Alto, Mr. Walter Droste, 12475 Skyline
Boulevard, Woodside, Mr. Robert Walker, 12475 Skyline Boulevard,
Woodside, Ms. Carolyn O'Connor, 135 Harkins Road, Woodside, and Mr.
Frank Adams 135 Harkins Road, Woodside; agenda item 7, Authorization for
Staff to Solicit Bids for Seismic Upgrade and Improvements to Foothills Shop

calendar. JCyr seconded the motion. The motion passed 6 to 0.

V. WRITTEN COMMUNICATIONS
N. Hanko proposed the reply to Mr. Lavelle be revised to include a paragraph which states
what the District has done in the past, such as posting "Area Closed - Restoration in
Progress" signs to advise visitors to stay on trails when hiking in fragile and sensitive areas.
P. Siemens suggested including a policy for posting signs in the trail use policies. J. Escobar
said there were various degrees of closure and that it was the District's practice to advise
visitors of closures using barriers and signage and now that staff is aware of this area staff
will be looking into posting signs in the area.
Motion: P. Siemens moved the Board adopt the written communication to Mr. Lavelle
as amended. J. Cyr seconded the motion. The motion passed 6 to 0.
VI. BOARD BUSH4ESS
A. Agenda Item No. 1 - Tentative Adoption of an Amendment to the Use and
Management Plan for the Kennedy-Limekiln Area of Sierra Azul Space Preserve to
Confirm the Closure and Restoration of Priest Rock Bypass Trail (Also Known as
Moody Trail) (Roport R-97-LW
J. McCullough familiarized the Board on the trail area under consideration for closure
due to erosion and over use. She showed slides which depicted the extent of erosion
damage. She said that District and Santa Clara County parks staff have been working
together on this trail, but neither have funding available to undertake a trail
development project; both have limited staff resources; there are two other trails
which offer access in the area; there has not been a long-term plan completed for the
Sierra Azul area due to interspersed private land; and Santa Clara County is not
interested in the realignment of this trail. She explained staff realizes that this trail is
the only single track trail in the area and therefore recognizes the importance of this
trail to the mountain biking community; and that it is the District's mission primarily
to protect the natural resources while secondarily providing opportunity for public
recreation.
N. Hanko spoke of the Board's history working with the County and the problems
involved in providing access in this area, and how this trail failed to become a
designated trail. D. Woods spoke of the confusion over the use of the words
"designation" or "trail use designation", and that in 1989-1991 the District began to
develop trail use guidelines and in it's efforts to designate trails in this area, the
District failed to follow through with the County on their plans for this trail.
Therefore, it never showed up on any maps as a designated trail.
Fred Stanke, 22873 Longdown Road, Cupertino spoke of his appreciation for the
variety of trails the District provides and would be willing to work on this trail to
keep it open.
James Ryan, 1080 10th Avenue, Redwood City, spoke of the history of this trail and
urged the Board to keep it open as it has become his favorite trail in the entire Bay
Area and to allow the mountain biking community to care for this trail.

P. Ciesla urged the District not to close the trail; to admit a costly mistake had been
made by the District; to restore the trail; and requested a process for involving
mountain bikers on the trail restoration for this project, and to consider the
alternatives to closing the trail.
Kathleen Meyer, 200 South First Street, Campbell would like to see more time given
to meeting notice postings and requested that the Board consider reopening the trail.
Keith White 116 Lu-Ray, Los Gatos, supports any alternative to closing the trail and
requested the mountain biking community be given the opportunity to work with the
County in an effort to allow mountain bikers to realign the trail.
Scott Schlachter, 92 Los Gatos-Saratoga Road, Los Gatos, said he would volunteer to
maintain the trail and asked the Board to consider the implications of closing this
trail.
Dan Fenwick, 126 Christel Oaks Drive, Scotts Valley, said he would like to see this
trail remain open due to its technical challenges and would like to volunteer in an
effort to keep this trail open.
Christine Parker, 16952 Kennedy Road, Los Gatos, concurred the trail should remain
open and felt it would be a constructive project for the District to work with mountain
bikers.
Mark Rosenberg, 21040 Summit Road, Los Gatos, said he believed keeping this trail
open would ensure support of open space in future generations.
Harry Haeussler proposed the Board give the mountain bikers an opportunity to get an
agreement with the County.
C. Britton responded that ample notice was given for this agenda item including
posting on the Internet and a special mailing to the cycling community.
N. Hanko asked J. Escobar if he would like to address the restoration issue. J.
Escobar responded the restoration practices are common forestry practices in restoring
trails.
P. Siemens asked about the time necessary for revegetation of this trail. J. Escobar
responded it would be a minimum of 10 years for this area to recover from the
scarring which has occurred.
K. Nitz asked if any reseeding will take place. J. Escobar responded reseeding will
take place in the fall after the first rains.
D. Smernoff asked when there will be a Comprehensive Use and Management Plan
for this area. C. Britton responded probably not within of 5 years.

M. Davey asked if the Board would like to discuss the proposal which was made to
make this an experiment for a creation of a trail and to work with the County to
develop it.
P. Siemens commented on his concerns as to how far the District should go to
provide for high risk recreation.
J. Cyr said he concurred with what was mentioned in the report and that the primary
responsibility of the District is to acquire the land and providing recreation on the
land is a secondary purpose. He said he would entertain mountain bikers working
with the County to develop a process but felt it would be a process which would take
a great deal of time.
Motion: K. Nitz moved the Board tentatively adopt the amendment to the Use
and Management Plan for the Kennedy-Limekiln Area of Sierra Azul
Open Space Preserve to confirm the closure and restoration of Priest
Rock Bypass Trail (also known as Moody Trail). J. Cyr seconded the
motion. The motion passed 5 to 1. D. Smernoff voted no.
B. Agenda Item No. 2 - Apl2roval of Residential Rental Agreement and Authorization
for the General Manager to Execute the Residential Rental Agreement with Jay and
Pegg Thorwaldson for the Former Landre Residence at LonRidge Q=n Space
Preserve (Report R-97-177)
M. Williams familiarized the Board with the area of the Landre residence and its
rental history; the need for replacing the roof, water system, driveway, and electrical
system in addition to the necessity to trim or remove seven oak trees as the house was
built within a grove of trees. He detailed the road and property damage this property
incurred due to the heavy rains of 1995 which made access very difficult. He
detailed the terms of the rental agreement with the Thorwaldsons which provides for
the repair and maintenance of the structures on the property, to be performed by the
tenants in lieu of rent during the initial term of the agreement.
K. Nitz requested clarification on the initial term of the agreement and improvements
to be made on the property. M. Williams responded the initial term is one year and
fifteen days commencing on September 15, 1997 and that repairs will be made only to
existing improvements.
N. Hanko requested more information on the size of the trees which may need to be
trimmed or removed and what materials the roof will be replace with. C. Britton
clarified that staff has made a thorough evaluation of the oak trees and that no trees
will be cut down that are not clearly a hazard to the residence. M. Williams
explained the roof will consist of tar and gravel.
D. Smernoff questioned how contingent this agreement was to the repair of the road.
M. Williams responded there was no obligation on the District's behalf to keep the
road open and that at this time the road is accessible. C. Britton explained the history
of the road with previous tenants, and that due to its location, it has been washing out

almost every winter. He also said that due to the heavy rains in 1995 it was badly
damaged and the District sought out funding from FEMA for it's repair. The road
has use as a patrol route and as a future trail connection to Portola State Park.
N. Hanko asked Mr. Thorwaldson for reassurance of his commitment to this
agreement. Mr. Thorwaldson spoke of his experiences both living in the area and
making similar repairs to other residences in the area and confirmed his willingness to
uphold the agreement.
Terry Gossett, 26600 Elena, Los Altos Hills, spoke neither for or against this
proposal but as a neighbor he wished to present realistic living experiences in this
area which at times could be rather rugged, and spoke of the support Mr.
Thorwaldson will receive from nearby neighbors. Mr. Gossett inquired as to the
District's philosophy on future use of the land.
C. Britton reviewed the District' policy on maintaining improvements versus
demolition and offered reasons why the District has chosen to maintain this
improvement which include possible future use as a ranger or caretaker residence or
hiker's hut.
Motion: P. Siemens moved that the Board authorize the General Manager to
execute the Residential Rental Agreement with Jay and Perry
Thorwaldson for the former Landre residence at Long Ridge Open
Space Preserve. D. Smernoff seconded the motion. The motion
passed 6 to 0.
C. Agenda Item No. 3 - Report on Regional Qpen Space Plan Public Input Phase and
Confirmation of Plan Review Process for Completion of a Draft Regional nal Qpen Space
Plan (R=rt R-97-116)
R. Anderson reviewed and the Board commented on the progress of the Regional
Open Space Plan to date. C. Britton proposed future meetings be scheduled for
completion of the draft Regional Open Space Plan. Meetings were scheduled for
October 7 and October 21, 1997 beginning at 7:30 P.M.
D. Agenda Item No. 4 - Award of Contract for Landslide Repair Projects at Monte
Bello and St Joseph's Hill Open Space Preserves; Authorization for the General
Manager to Enter Into a Contract for Performance of the Work with the Lowest
Responsible Bidder for the Landslide Repair Projects on Stevens Canyon Trail in
Monte Bello Open Space Preserve and Jones Trail in St Joseph's Hill Open Space
Preserve (Due to the Accelerated Schedule for this Prgject. Staff will Report on Bid
Results of the Bid Opening on Tuesday, August 12 and Final Staff Recommendation
at August 13 Meeting): Authorization for the General Manager to Increase the
Contract Amount for Terratech, Geotechnical Engineers from $43 to $84,000 to
Cover all Projected Services Through Completion of Construction on Five Landslide
Repair Projects; and Review the Overall Status of the Five FEMA-funded Landslide
Repair Projects, Including Skyline Ridge Long Ridge and Purisima Creek Redwoods
Q�n Space Preserves (Report R-97-120)

R. Anderson reported on the final bid results from the bid opening on Tuesday,
August 12. He recommended that the bid for landslide repair on Jones Trail in St.
Joseph's Hill Open Space Preserve be awarded to George Bianchi Construction in the
amount of$44,491 and requested the Board authorize the rebidding of Stevens
Canyon Trail project in Monte Bello Open Space Preserve due to the fact only one
bid was received.
Motion: N. Hanko moved that the Board Authorize the General Manager to
enter into a contract for the Jones Trail Repair Project at St. Joseph's
Hill Open Space Preserve with George Bianchi Construction as the
lowest responsive bidder in the amount of$44,491; reject all bids on
the Monte Bello Trail Restoration Project at Monte Bello Open Space
Preserve and authorize re-bidding of the project; and authorize the
General Manager to increase the contract amount for Terratech,
Geotechnical Engineers from $43,000 to $84,000 to cover all projected
services through completion of construction on five landslide repair
projects. J. Cyr seconded the motion. The motion passed 6 to 0.
Discussion: D. Smernoff requested clarification on the increased costs for
Terratech, Geotechnical Engineers. R. Anderson explained that the
true cost of this repair really could not be estimated until work actually
commenced.
E. Agenda Item No. 5 - Approval of a $3.000 Meritorious Pay Award for the District's
Controller for Fiscal Year 1996-1997 (Report R-97-112)
Motion: N. Hanko moved the Board approve a $3,000 meritorious pay award
for the District's Controller for fiscal year 1996-1997. P. Siemens
seconded the motion. The motion passed 6 to 0.
F. Agenda Item No. 6 - Authorization for the General Manager to Approve Various
District Actions on an Administrative Basis: Approval or Denial of Claims not to
Exceed $2.500: Extension of Expiration Date and Minor Amendments to Permits to
Enter: and Confirm Authority to Enter into Contracts Pursuant to Public Resources
Section 5549(2) (Report R-97-115)
S. Schectman stated the primary purpose of this proposal is to enable the General
Manager to approve minor matters of District business without the necessity of
agendizing these matters for Board approval. Staff believes this will allow the
District's business to be conducted more efficiently and promptly. The various
matters to be approved would be any Claims that do not exceed $2,500; approval of
Permits to Enter District property to government agencies or third parties to perform
emergency and/or minor work; and Public Works, Professional Service, and Other
Contracts the General Manager may approved that do not exceed $10,000 except for
new construction which may not exceed $25,000.

P. Siemens commented the term Claims was confusing as it is used in different
contexts. Discussion pursued on this issue and for clarification it was determined to
change the term Claims to Legal Claims on the resolution.
Motion: P. Siemens moved the Board adopt Resolution 97-30 a Resolution of
the Board of Directors of the Midpeninsula Regional Open Space
District Authorizing the General Manager to Approve or Deny Certain
Legal Claims Against the District, to Approve Amendments to Permits
to Enter District Property and to Contract for the Payment for Services,
Supplies, Materials, or Labor Pursuant to Public Resources Code
Section 5549(b) as amended. K. Nitz seconded the motion. The
motion passed 6 to 0.
G. Agenda Item No. 10 - Scheduling of Special Meetings of the District's Board of
Directors on August 23, 1997 and September 20, 1997 for the Purpose of Conducting
Tours of District Lands for Invited Local Public Officials and Scheduling of Special
Meetings of the District's Board of Directors on September 17. October 15. and
November 5. 1997 for the Purpose of Conducting Joint Meetings with San Mateo
County Parks Commission. Santa Clara County Oren Space Authority. and Santa
Clara Count Parks Commission to Discuss the District's Regional Open S12ace Plan

H. Haeussler asked for clarification on the procedure for noticing meetings. C.
Britton provided clarification.
Motion: D. Smernoff moved the Board schedule a Special Meeting of the
District's Board of Directors on August 23, 1997 and September 20,
1997 for the purpose of conducting tours of District lands for invited
local public officials and scheduled Special Meetings of the District's
Board of Directors on September 17, October 15, and November 5,
1997 for the purpose of conducting joint meetings with San Mateo
County Parks Commission, Santa Clara County Open Space Authority,
and Santa Clara County Parks Commission to discuss the District's
Regional Open Space Plan. P. Siemens seconded the motion. The
motion passed 6 to 0.

K. Nitz reported the antenna had been installed at Pulgas Ridge Open Space Preserve.
J. Cyr thanked staff for the land tour of the area in agenda item 1.
C. Britton reported 1) the Town of Portola Valley is having a School House Ribbon Cutting
Ceremony on Sunday, September 7; 2) SB 365 was vetoed by Governor Wilson; 3) AB 1366
passed the Senate and Assembly; and 4) the California Integrated Solid Waste Management
Board approved dump cleanup funding at Skyline Ridge Open Space Preserve.

J. Escobar reported on the recent fires in Los Gatos.
S. Schectman reported the court of appeals will be issuing an opinion shortly on the Santa
Clara County Open Space Authority's formation of an assessment District and that the
lawsuit regarding Driscoll Ranches went to trial and the judge ruled for Driscoll Ranches on
every aspect.

MINUTES
I. ROLL CALL
President Mary Davey called the Regular Meeting to order at 7:30 p.m.
Members Present: Mary Davey, Betsy Crowder, Jed Cyr, David Smernoff, Pete Siemens
(arrived at 7:32 p.m.), and Nonette Hanko.
Members Absent: Ken Nitz.

II. ORAL COMMUNICATIONS
Len Vasquez, 21290 Blue Hills Lane, Saratoga, described events that had taken place at
Fremont Older Open Space Preserve, and said he thought drug trafficking was occurring
there.
J. Escobar said he would contact the Sheriffs office and talk to Mr. Vasquez. C. Britton
said staff will provide a follow-up written informational report at the next meeting.
III. SPECIAL ORDER OF DAY
J. McCullough introduced Matt Freeman, Planning Technician, who will be primarily
responsible for the District's sign program.
IV. ADOPTION OF AGENDA
Motion: N. Hanko moved that the Board adopt the agenda. J. Cyr seconded the

VI. BOARD BUSINESS
A. Agenda Item No. 1 - Consideration of a Proposed Realignment of Trail B8 and
Reaffirm the Amendment to the Use and Management Plan to Allow Realignment and
Construction of Trail B8 at El Corte de Madera Creek Oven Space Preserve
Following the Original Alignment Flay Staff and Adopted by the Board of
Directors at the July 9 1997 Meeting-(Revort R-97-1321
M. de Beauvieres provided the history of the trail use plan and outlined the terms of a
grant related to trail construction. She said the reasons for bringing trails B8 and B10
to the Board separately had to do with two things: 1. Goal of the Task Force to
create a perimeter trail which would enable multiple use of the inside perimeter of the
Preserve, which this trail does. 2. During discussion of study area and trail use
plan, this trail did not appear to be controversial. She showed the area in question
and the three alternatives on an overhead.
B. Crowder commented on the last two paragraphs on page 2 of the staff report which
described trail use standards and methods of trail construction. She said she had great
regard for the staff who laid out and constructed the trails. She talked about her
history of hiking the trails and said she thought the trails constructed in recent years
are well done and of the highest quality. She favored reaffirming the July 9 action.
David Smernoff asked if it would affect the grant if alternate 2 were chosen. M. de
Beauvieres said the five-year grant term started July 1 and they need to complete the
trails that were outlined in the application.
M. Davey said she had walked the planned trail and felt it would be an asset to the
system. She had seen the alternate alignment and thanked participants.
Barry Stevens, 3265 Fair Oaks, Redwood City, representing 300 members of ROMP,
said there is no question that staff has outlined a beautiful trail. He said the issue is
the impact of the proposed alignment on the two trails it intersects. ROMP requests
that the District build no trail at this time, convene a task force to study and evaluate
all trails in Study Area 2 and put any new trails into the whole plan for that study
area, and specifically try for new solutions to the problems with the trails. He said
he thought there were ways to solve concerns or get them to conform to the District's
standards. He thought it would be appropriate for staff and the Board to work with

the cycling community to find mutually acceptable and creative compromises. He
said he hoped he was asked to serve on that task force.
Louis Mendelowitz, 2153 Oberlin St., Palo Alto, said his only objection is that the
proposed trail crosses two trails in such a way that could result in a lot of conflict.
He said he saw no reason why they cannot keep the same road between points A and
B.
Fred Stanke, 22873 Longdown Road, Cupertino, thanked the District for the trails
and said he used them a lot. He said trails are a matter of opinion and people have
widely ranging ideas. He urged them to not build a trail that would impact the use of
other trails that are so popular among bikers and to put together the task force to
come up with a wide range of trails to meet everyone's needs.
Ross Finlayson, Mountain View, said he was mystified to see messages from hikers
who felt trails would be closed to hikers. He said ROMP has proposed multi-use
trails from the beginning. He said one of the things they want to do in saving the two
trails is to have alternative ways of getting to the interior of the park so hikers and
equestrians can use the fire roads without having to worry about conflicts with
cyclists. He said he had the highest regard for staff and agreed they have built good
new trails. He said he was offended by the little regard staff has for the existing
trails system. He expressed confidence that staff could build trails that would
overcome the concerns about switchbacks.
P. Ciesla, Box 3189, Stanford, thanked the Board for allowing this meeting and the
on-site meeting. She thanked staff for their help and read from a prepared statement.
She said she thought recommendation 2 was excellent and they should not be limited
from taking another look at existing trail plan. She quoted from the Trail Plan and
said they would like to host a workshop. She said she didn't care if her proposal was
modified a little. She said she was speaking for some non-ROMP members.
Tom Williams, 400 Davey Glen Road, #4403, Belmont, said he supported Barry's
position. He said doing nothing would make more sense than P. Ciesla's
realignment. He said he liked the trail staff has proposed but it will create conflict.
He defined what he thought the conflicts might be.
M. Davey said she did not think there were blind intersections. B. Crowder agreed.
J. Escobar said while he did not anticipate conflicts, there would be fine tuning of
junctions as they are built.
Mary Bernstein, Palo Alto, said she hikes ECDM and said the proposed trail was a
pleasant one for hikers.
Ernest Breakfield, P. O. Box 390001, Mountain View, thanked the Board for the
opportunity to work with them and encouraged a close look at the whole area to get

input from people who have become more aware recently. He urged them to not do
anything that risks existing trails.
Scott Schlachter, 92 Los Gatos-Saratoga Road, Los Gatos, encouraged the Board to
choose alternate 2.
Pat Gallagher, 863 Elmira Dr., Sunnyvale, thanked the Board and asked them to the
make preservation their higher goal. He urged them to reaffirm the approved trail.
Bob Indig, 832 Seminole Way, Redwood City, said ECDM is unique and its diversity
is an asset. He was concerned that the location of a multi-use trail would cause
conflicts and urged further study of trail B8. He expressed support for a trail plan
that allowed a variety of preserve users to enjoy the preserve while on a variety of
types of trails. He said he supported the alternative that would minimize potential
conflict.
Cheri Hariri, 101 Club Drive, San Carlos, said she hoped they wouldn't close the
harder trails before she mastered them. She said she had seen trails closed to
mountain bikers at other parks and hoped the rumors of trail closures at ECDM were
not true.
Brandon Tomlinson, 1035 Chula Vista, Burlingame, supported no changes to "Nose
Break" and "Devil's Staircase" trails.
Brian Simon, 3100 Avalon, Palo Alto, said the preserve is unique and very wooded.
The District seems to be adding more and more trails, some of which seem
redundant. He asked that they consider reusing trails instead of "chopping up" the
preserve.
Christine Parker, Los Gatos, said she had hiked in the preserve and hoped to bike
there. She said she liked to hike there because the trails are challenging and urged
them to wait and re-evaluate the area. She did not think the District should cut new
trails that intersect others.
Charles Jalgunas, 1925 Shoreview, San Mateo, thanked staff and the Board. He said
he was drawn to ECDM specifically for its technically challenging single track trails
and would hate to see something done that would jeopardize two of his favorite trails.
He said there is already a parking lot near the sandstone formations and that would
probably be what he would use if he were looking for an easy hike.
Akkana Peck, 1994 Newcastle Drive, Los Altos, said she was confused as to what is
trying to be accomplished. She hoped they would re-evaluate area 2 as a unit and
not rush into anything She urged approval of recommendation 2.
Greg Messerian, 1875 Messina Drive, San Jose, expressed preference for
recommendation 2.

Theresa Sz, 640 Arbor Road, Menlo Park, said she did not see information on the
Web on studies as to who is using which trails. She favored postponing doing
anything until further study is done.
Dave Anderson, 372 A Bush, Mountain View, an avid hiker and mountain biker,
expressed strong support for alternative 2 which he thought would result in the best
multi-use experience.
Keith White, 116 Lu-Ray Drive, Los Gatos, said he was representing himself. He
said he appreciated staff and the Board addressing the concerns that had been
expressed. He believed something could be done to deal with the maintenance
problem of the switchbacks. He said he thought the standard trail alignment was fine
if they don't cross the two popular trails. He said the closing of the slide was not
addressed.
Sandra Wong, Menlo Park, agreed with recommendation 2. She said there will be no
problem getting volunteers.
Richard Turner, 312 Waverly St., #3, Menlo Park, made the following points. 1.
There must be a reason the bicyclists are here. There must be a strong fear that the
new trail would potentially be used as an excuse for closure of the steeper trails. 2.
Include in alternate 1 a clause that says the existence of these trails or conflict at these
intersections will not be used as an excuse to close the popular trails. 3. Put stop
signs on the new trails.
Harry Haeussler, 1094 Highland Circle, Los Altos, said he was confused. The only
objection he had heard is that trails were intersecting. He said bicyclists needed to
decide if they wanted a scenic trail or to save time getting from point A to point B.
John Escobar cited numbers gathered through the Regional Open Space Plan showing
that the District is probably the most bicycle-friendly land management organization
in the Bay Area. He said this group has expressed a willingness to help. The
District has worked with the bicycling community on 14 events in 11 months and
there are five projects scheduled for fall. He said they should not lose sight of their
commitment and the good working relationship.
B. Crowder said the Leaf Trail, built with significant volunteer help is very nice.
C. Britton summarized staff s recommendation which was for the Board to re-affirm
the Board's previous action. In regard to Alternate 2, he saw it only as delaying and
still thought it would be necessary to connect the future parking lot with Sandstone
Caves and other areas in the Preserve. In regard to the existing parking lot, it is
owned by Caltrans, is full most of the time, and you have to cross Skyline Blvd. to
get from there to the preserve. This lot is not seen as a long-term answer to the
parking needs at ECDM. He said if they don't go ahead on BS now, they will lose a
season. Staff gave consideration to Alternate 2 and included it for discussion but does
not recommend it.

Motion: P. Siemens moved that the Board reaffirm the amendment to the Use and
Management Plan for El Corte de Madera Creek Open Space Preserve to
permit realignment and construction of Trail B8 following the original
alignment flagged by staff, approved by the Use and Management committee,
and adopted by the Board of Directors at their July 9, 1997 meeting. J. Cyr
seconded the motion.
Discussion: P. Siemens said they need to build a trail for less strenuous use and that is not
now available at ECDM. He did not believe construction would imply
decisions on existing trails. He did not agree about conflicts at intersections.
Regarding tree configuration, staff can work with trees and not put them at
risk. He would like to see the District consider designating certain trails to be
maintained by another responsible group with District oversight. This needs to
be looked at from a policy point of view.
D. Smernoff said he was in favor of alternate 2. He thought delaying now
does not hurt the District at all. Going forward would hurt the process and
alienate a segment of the community. He thought it would help the District to
wait. He said he needs more time to evaluate solutions and he thought
everyone did.
N. Hanko said speakers were persuasive on Alternate 2 but was also persuaded
by P. Siemens and C. Britton. She said she did not think multi-use trails are
working very well. The District receives many letters from hikers who feel
alienated from the land and feel threatened by mountain bicyclists. There is
no trail now where hikers can be comfortable while the one proposed by staff
accomplishes that. She said she would like to see it hiking only, and is
convinced it does not jeopardize mountain biker's use of other trails. She
supported staff s two recommendations. She said she would support the
additional wording to Alternative 2.
C. Britton recommended a change in recommendation 2 to say that the
President would appoint the ad hoc committee of the Board. Staff would
contact those who might be interested in being on the task force and the Board
committee would make the final decision.
D. Smernoff said his vote against the motion would not imply that he did not
support creation of the ad hoc committee but rather is in favor of waiting on
that particular alignment until they can study the entire area as one piece.
J. Cyr said staff s proposal is in the context of the entire trail plan which has
been a 3-1/2 year process and has included a vast array of public input. After
hearing arguments he still believed that this trail (B8), in conjunction with
B10, will provide a different experience for that portion of the park and will
allow for a wider range of people to access the upper end of the preserve.

M. Davey thanked everyone for their participation. She said after walking the
proposed trail it seemed this is the best alignment. The recommendations state
that all remaining trails will remain open until study area 2 is revisited and a
final determination is made. She said she would vote for the motion even
though she had earlier thought it was best not to proceed.
The motion passed 5 to 1 (Director Smernoff voted no).
Motion: P. Siemens moved that the President appoint an ad hoc committee to work
with staff and a citizen task force in the formation of the trail use plan for
Study Area 2; and that construction of B8 and B10 would not be used to
prejudice consideration of other trail alignments. The motion passed 6 to 0.
RECESS: 9:10-9:20 P.M.
C. Britton announced that B. Crowder, D. Smernoff and J. Cyr volunteered to be on
the ad hoc committee.
B. Agenda Item No. 2 - Review and Comment on the Six Month Summary of Use and
Violations on Dog Access Compliance Assessment Hamms Gulch Trail, Windy Hill
Qn Space Preserve Focusing on the Issue of Compliance with Regulations for Dog
Access - (E.port R-97-124).
R. Anderson reviewed the staff report and noted that staff was disappointed with the
results. A third of the dogs were off-leash. These were not citations, just
observations.
C. Britton said staff will provide the statistics for actual violations in the year end
activity report.
Nancy Carter, 237 Canyon Drive, Portola Valley, said she did not think it was clear
what the Board wanted on waste control and that laws needed to make sense. She
thought there should be an area for dogs off leash as long as they are under control
and enforcement people need to use discretion.
Harry Haeussler disagreed with the report on dogs off leash. He recommended
changing the requirement to say dogs must be on leash or under control. He didn't
think dog owners should be required to pick up waste.
Discussion followed regarding how the waste was counted and how the regulation
requiring owners to pick up waste was worded.
Diane Thompson, 1043 Almanor Ave., Menlo Park, said she had been ticketed for a
dog off leash. She said she carries waste bags and thought consideration should be
given to those who have well-behaved dogs who are under control.

N. Hanko said the Board had directed the Use and Management Committee to
consider whether there could be an area in Windy Hill for off-leash dogs and asked
how it had been resolved.
R. Anderson said the study was done and the recommendation was that there was not
an appropriate place in Windy Hill. There was no direction to look for another site
but to wait and see how Pulgas works out. There had been a report a year after
Pulgas was opened. He said he would provide Board with that report. In the eight
months since the report was issued, they have been at Windy Hill considering the next
step which was this additional on-leash trail. He said there had been few complaints
as compared to quite a few letters of appreciation. R. Anderson and J. Escobar said
they were not aware of complaints at Windy Hill.
Dan Bernstein, Peninsula Access for Dogs (PADS), 8098 Cuesta Drive, Box 196,
Mountain View, said the survey showed that 4 out of 5 people are following the on-
leash rule. He suggested that compliance could be improved with an educational
program consisting of three parts: 1. State clearly what the rules are. 2. Express
the rationale for the rules. 3. Do not focus on examples of things that have gone
wrong because of poor compliance with rules. He said PADS members are fair and
reasonable people and will follow rules if they seem reasonable. He said he would
put the proposal in writing.
Anne Macaulay, 1809 Higdon Ave. #2, Mountain View, said keeping trails clean is
just a question of clear signing. She agreed with Harry Haeussler that the majority of
dogs off leash have been near their owner and were quickly called.
C. Britton said staff would consider the comments made tonight and apply the ideas
prior to coming back with a final report.
Scott Schlachter spoke of his experience as a biker and said he had yet to have a
negative encounter regarding dogs off leash.
J. Cyr said he hoped the matter of the scent of a dog affecting where wildlife goes
was addressed in staffs report. C. Britton said it is difficult to find empirical data,
but Sam McGinnis' report addressed the issue.

Regarding a safety inspection of the site, C. Britton said if a parcel is improved staff
look more closely for such things as wells and underground tanks. This is
undeveloped property so no detailed inspection will be done until after acquisition.

Quality Act as set out in the staff report; adopt Resolution 97-31 a
Resolution of the Board of Directors of the Midpeninsula Regional
Open Space District Authorizing Acceptance of Purchase Agreement,

Alternate B, and Add alternate D. D. Smernoff seconded the motion.

G. Agenda Item No. 8 - Authorization to Solicit Bids for Printing and Mailing_of
Approximately 300.000 Special 25th Anniversary Newsletters - (L?,Mrt R-97-127)
M. Smith answered N. Hanko's questions, stating that staff thought the concept of
putting out a special mailing for the 25th anniversary should focus on that as a
separate event. Discussion followed regarding whether the information on the 25th
anniversary should be included in the visitors map. M. Smith said the Legislative,
Finance and Public Affairs Committee would be able to see the wording of the
brochure. D. Smernoff suggested including a pull-out, 8-1/2 x II" map with the 25th
anniversary information. A note could direct that a detailed map could be obtained
from the District on request.
P. Siemens and N. Hanko expressed misgivings about spending that much money on a
newsletter, versus a visitors map.
Harry Haeussler suggested a pullout in the newspaper. M. Smith said they had not
found that effective.
Motion: P. Siemens moved that the Board approve the General Manager's
recommendation subject to approval by the Legislative, Finance and
Public Affairs Committee. D. Smernoff seconded the motion. The
motion passed 6 to 0.
It was decided that a draft of the proposal with the enclosure would go to the
Committee early next week.
VII. INFORMATIONAL REPORTS
B. Crowder showed leaf samples from the Leaf Trail. She reported as follows: 1.
Committee for Green Foothills had its 35th anniversary gathering. 2. Santa Clara County
Parks & Recreation Department will recognize Garnetta Annable on September 12. 3. She
gave N. Hanko the San Mateo County guidelines for donations. 4. Robert Zatkin will be
contacting the District regarding water quality at ECDM. 5. Dr. Goudy, who had an
interest in dog access at Windy Hill Open Space Preserve, has died.
N. Hanko had met with land conservation supporters on the coast. They are taking the
initiative in forming a steering committee on the District's involvement in coastal
preservation, and will want to meet Board members.

D. Smernoff said there had been a meeting tonight of a mid-coast community council on a
big development issue in Montara. He had passed out a flier about the work days at
Arastradero.
J. Cyr described his experiences at ECDM including Purisima and Skeggs Point where the
parking lot was full.
D. Smernoff said he had met the gentleman who complained about events at Rancho, and he
had seen a cougar. He also said he had seen no problems at the Rhus Ridge parking lot his
summer.
M. Davey complimented staff for the land tour for San Mateo County officials and the Board
tour of El Corte de Madera Open Space Preserve.
C. Britton reported as follows: 1. The Governor's veto message regarding SB 375 (San
Mateo County sales tax) was included in the FYIs. He said that AB 1366 (state riding and
hiking trail) had been signed and chaptered as law. 2. Administrative Services Manager -
there are eight finalists. An assessment center is scheduled for October 10.' 3. He, M.
Smith, and M. Davey met with San Mateo County LAFCO and Parks regarding preservation
efforts for the San Mateo County Coast. 4. Art O'Neal training - work groups have come
up with team agreements. One of the agreements is to treat everybody with respect.
J. Escobar reported on what had occurred following a citizen allegedly sighting a mountain
lion near the restroom at Rancho San Antonio Open Space Preserve.
M. Smith reported as follows: 1. This is the first newsletter that is on tree-free paper.
Staff will try other types. 2. September 18 is the staff appreciation event.
C. Britton informed J. Cyr that it was up to Board members how they responded to
constituents' e-mail messages.
N. Hanko reported on the Palo Alto Comprehensive Plan. She said she will continue to
follow and will send a letter of support from the District.

under its care. Now you are trying to develop a twenty year plan and I commend you for such an
ambitious effort.
I know that I am only one voice but hopefully you will listen. There seems to be a battle raging on our
trails and I can only hope that compromises can be made and the land does not suffer as a result. 1\4y
horse and I en)oy many of the trails open to us and we frequent Windy Hill, Russian Ridge, Coal Mine
Ridge, and Monte Bello Open Spaces because of the great trails. I try to get some of other riders to
come with me but they hesitate. The main reason is the bike riders. They are very rude, narcissistic,
and aggressive. I am sure there are a few reasonable riders but they are in the minority. They are also
visually illiterate for they don't seem to understand what it means when sign shows a bike with a red
line through it. The bike people think the trails are 'just
just for them and make horse and hikers yield to
them, often times one has to really hurry to get out of their way! The bikers have completely ruined
Monte Bello. They ride throughout the area like packs of wild dogs pushing everyone off the trails!
Try having a hike in Skyline Open Space on a nice Sunday afternoon and you will get run over by a
bike.
One of my favorite trail on my horse or foot is Hamms Gulch trail in Windy Hill Open Space. This
beautiful single track winds through large trees with a few openings revealing stunning views. If I
don't see a bike on the trail, then there is always a fresh set of tire tracks. The winter when the rains
start, I wait three days after the last hard rain to ride the trails. When I finally do ride, there are always
fresh tire marks that create deep ruts in the trail that I will see for the rest of the year!
We like to use the trails and want minimum rules but maybe some rules have to be established so the
bikers learn to share the trails with everyone and learn how to ride without damaging the land. I have
a few suggestions - 1. Do not open any more trails to bikes then already exist. A study could be
conducted to see if some other single tracks should be closed to bikes as well. Bikes have more places to
ride then we equestrians and we need all the few trails we have. 2. Post the fine (I was told by a ranger
that it was $130.00) at trail heads that display the no bike symbol and fine a few of them. Word will
get around and at the very least provide some money to help pay for the damage they have caused.
3. Close all rogue trails. I have noticed a number of trails that seem to have been made by the bikes.
Close them and let the land heal from the wounds. 4. In your newsletter, have articles about trail
etiquette and encourage staying off the trails during the very wet times of the year for this seems to be
when the most damage occurs.
I suspect that you hear from few equestrians for we are not a large user of the trails. Most see few signs
of horse use for we do try and tread lightly out of respect for the land and are grateful that we have
access to the open spaces. Please listen to the quieter voices. The belligerent bikers may be louder but
they will ruin the land that is in your stewardship and carefully consider this when planning for the
future.

At our regular meeting last night, the District's Board of Directors considered your September
24, 1997 e-mail letter concerning trail use. Thank you for taking the time to pass on your
thoughtful comments regarding trail use and bicycles. It is true that we don't often hear from
equestrian trail users. We appreciate your perspective on some of the difficult issues facing the
District.
You outline four suggestions for dealing with some of the trail use issues. I'd like go over each
individually.
Do not open any more trails to bikes.
The District currently has adopted policies governing trail use on the preserves. These include
designating appropriate use on any new trail at the time that trail construction is considered.
The trail can then be built to the physical characteristics necessary to accomodate multiple use,
if desired. In the case of many recent preserve additions, the existing trails of the property are
either being withheld from public use, or opened to hiking use only, until such time as a study
can be conducted to determine a trail use plan for the trails or area.
The District will be holding public hearings regarding updating the Trail Use Policy in the near
future. If you can supply us with a mailing address, we will notify you of upcoming meetings.
Please call us at (650) 691-1200 and request that you be added to the mailing list for upcoming
meetings regarding trail use.
Post fines at trailheads that display the "No Bike" symbol and cite violators.
While this may be a good deterrent for some, unfortunately fines can differ depending upon the
jurisdiction. The bail for each violation on District lands is set by the District, but each court
adds its own processing fees, making the amount the individual might pay differ depending upon
the jurisdiction. Rangers do issue citations for violators that are caught, however!
Close all rogue trails.
It is true that trails occasionally appear in inappropriate or unplanned areas. We try to post
these routes with signs stating that they are not trails, and directing people to remain on the

posted at its junctions, it is considered a designated trail and is open to public use. Other routes
are subject to closure. Our field staff attempts to proactively post rogue trails as soon as the
problems appear, but if there are specific trails you are concerned about, please call our main
office to request maps of each of the preserves. Our staff would appreciate your help in
identifying unmapped rogue trails.
Include trail etiquette articles in your newsletter and encourage users to stay off the trails during
the wet times of the year.
Including an article on trail etiquette in our newsletter is a great idea! Your suggestion has been
forwarded to the Public Affairs Department for their consideration for an article in an upcoming
newsletter.
Some trails are closed seasonally to bicycle and equestrian use during the rainy season. A list
of trails appropriate for seasonal closure is considered by the Board each fall. For example, the
Peters Creek Trail at Long Ridge or the Whittemore Creek Trail at Purisima Creek Redwoods
are seasonally closed to all uses except hiking due to the condition of the trail once winter rains
set in. The report identifying potential trail closures will be presented to the Board for their
consideration, most likely in November.

public discussions on Trail Use Policies.

Request for Proposals for the Operations Program Revie .

1. Accept the attached Request for Proposals (RFP) for the Operations Program Review.
2. Authorize the General Manager to solicit proposals for this project.
BACKGROUND
As part of the salary and benefits negotiations, the Board confirmed the process for an
Operations Program Review in a letter dated March 10, 1997 to Service Employees
International Union (SEIU), Local 715. In that letter, the District agreed to commission a
study by a qualified consultant to review the Operations Program, including, but not limited
to, law enforcement issues. This RFP is the first step in meeting that commitment.
DISCUSSION
In keeping with the provisions of the letter, the attached RFP has been prepared by office staff
and reviewed by representatives from SEIU, who will also be involved in reviewing the
submittals.
The objectives of this Operations Program Review include:
1. To conduct an overall review of the Operations program.
2. To conduct an analysis of each function (maintenance, emergency response, law
enforcement, and patrol) within the Operations program.
3. To conduct a comparison of the levels of service provided by the District, with those of
other agencies.

An issue which is of great concern to the field staff is the question of arming the rangers. This
RFP addresses the issue by requiring the Consultant to consider, as one of the models, an
armed force employed by the District.
In the RFP the Consultant is instructed to illustrate the continuum of service levels available
for each function and the associated costs and levels of liability. Based on this information,
the Consultant will create at least four models which the Board can consider and utilize in the
future.
Time Line
The following time line is proposed for this project:

Budget
Creating an estimated budget for this project has been hampered by the lack of similar projects
for comparison. Staff believe that the project costs could be in excess of$50,000. This is not
a budgeted project, so the Board will need to consider the budget implications for the 1997/98
fiscal year when selecting a consultant for the project.
Recruiting Consultants:
Notice of this RFP will be advertised in newspapers, professional publications, and electronic
media. If approved, the RFP will also be distributed to numerous consultants who will be
attending the League of California Cities Conference on October 14, 1997.

Authorize the general manager to execute a contract with Godbe Research & Analysis to conduct a
public opinion survey, at a cost of$25,717.
DISCUSSION
At your meeting of April 9, 1997 you authorized staff to investigate and report to the Board on
potential methods for preserving open space on the San Mateo County coast; directed staff to
return to the Board with a proposed budget; and designated Directors Crowder, Davey, and Hanko
as members of an uncompensated ad hoc committee representing the District on this issue (see
s report R-97-63).
Subsequently, at your meeting of April 23, 1997 you approved a budget of$25,000 for District
out-of-pocket expenses to research open space preservation on the San Mateo County coast (see
report R-97-74). Staff was directed to utilize that budget to research the feasibility of potentially
establishing a system of open space preserves, parks, and beaches on the San Mateo County coast
in coordination with existing and planned District preserves and trails.
The ad hoc committee then met with staff, with members of the Coastal Alliance grass-roots
organization, and with other stake holders, and has determined that one of the first orders of
business in such research is the implementation of a public opinion survey to determine the
perception and attitudes of the various public constituencies involved in this issue.
Staff contacted a well-known and respected local research firm, Godbe Research & Analysis,
located in Half Moon Bay, and determined that this firm's expertise, experience, and reputation are
best suited to carrying out this project. The ad hoc committee met with Bryan Godbe, Principle
Researcher, and agreed with his proposed survey strategy and scope.

Mr. Godbe has presented several options for the "sample size," that is, the number of
registered voters to be surveyed by phone, and the resulting cost associated with each option.
The most cost-effective tactic would be to sample a total of 1,100 people, geographically
separated as follows: 300 registered voters within the mid-coast area; 400 people within
existing District boundaries; and 400 people within the remainder of urbanized San Mateo
County.
Geographically separating the survey results in this manner will allow the District to more
accurately determine the attitudes of each of these groups, individually, and with a lower error
rate. In addition, somewhat different questions will be asked in the different geographic areas,
including some base-line tracking questions within District boundaries to follow up on the
District's previous surveys. Samples of this size will maximize the survey's accuracy,
effectiveness, and benefit.
I recommend that the Board authorize staff to hire Godbe Research & Analysis to conduct this
public opinion survey, at a proposed cost of$25,717. While this cost slightly exceeds the
amount previously budgeted by the Board, I feel it is absolutely crucial that the District gain as
much accuracy and detail as possible from a survey, in order to provide the Board with the
best available information with which to make decisions on this issue.
To date, there have been no out-of-pocket expenses related to researching potential District
coastal preservation methods; all staff time involved has been absorbed on a normal business
activity basis and integrated with other District assignments. The proposed budget presented at
your regular meeting of April 23, 1997 included $15,000 for a survey; however, staff and the
ad hoc committee determined that, in order to maximize its usefulness and accuracy, a more
significant survey is needed.
Attached is a standard letter of agreement provided by Godbe Research & Analysis outlining
the scope of their proposed work. With the Board's approval, this letter will serve as the
contract between the District and the consultant.

STANDARD BUSINESS TERMS AND CONDITIONS
Contracts and agreements between GRA and its clients include the following general terms and
conditions unless otherwise specified in a contract or agreement.
Flat Fees. Unless otherwise specified,the firm may charges a flat fee for all or a portion of its
services to a client in lieu of hourly charge.

Advance Payment. In order to finance the client's work,the firm's policy is to require advance
payment for telephone interviewing. Advance payment of fees or hourly charges is normally
required,particularly in the case of new clients or political campaigns.
Late Charggs. Invoice terms are 30 days net unless otherwise specified in the agreement. A late
charge of 1.5 percent per month will apply on any amounts not paid within thirty (30) days of
the date of an invoice.
Indemni . All copy will be approved by the client in advance of production. Each party shall
indemnify,defend and hold harmless the other party from and against any loss,claim, action,
course of action (including without limitation any defamation action), judgment, damage,
cost or expense (including attorneys' fees and costs) arising out of any actions of,or materials
written by,or information supplied by the other party.
Acting as Agent. In compliance with California sales tax regulation,GRA is designated as an
Agent for the acquisition of tangible personal property and services as they apply to its clients'
advertising and sales promotion activities.
Ownership of Materials. In producing finished products, it is expressly understood that
ownership of all materials purchased by GRA to complete the property to be produced passes to
its clients at the time of purchase and prior to any use by GRA.
Independent Contractor. The agency shall perform the services as an independent contractor
and shall not be treated as an employee of the client for federal,state or local tax purposes or for
any other purpose.
qR Applicable Insurance. The agency maintains in force a general liability policy of

$1 million, auto insurance of$1,250,000 for bodily injury, $1,500,000 for accidents and
$1,100,000 for property damages. The agency maintains required state workmens
compensation insurance.
Entire Agreement. This agreement constitutes the entire agreement among the parties with
respect to the subject matter and supersedes any prior negotiations, understanding or
agreement.
Successors. Any agreement between the agency and a client shall be binding upon, the heirs, +
successors and assignors of the parties.
Attomeys' Fees. Should any action be brought by one party against the other party to enforce
any agreement, the prevailing party shall be entitled to recover from the other party its
reasonable attorneys' fees,costs and expenses.
Governing Law; Venue. Any agreement between the agency and a client shall be governed by
California law and any action arising out of it shall be instituted and prosecuted only in the
Municipal or Superior Court of the County of San Mateo.

Resolution of Appreciation for Thomas L. Anderson of An on Niswander Construction,
Inc.
GENERAL MANAGER'S RECOMMEND
Adopt the attached Resolution of Appreciation for Thomas L. Anderson of Anderson
Niswander Construction, Inc. for his donation of materials and labor to the District.
DISCUSSION
Earlier this year, Mr. Thomas L. Anderson, principle with Anderson Niswander Construction,
Inc., completed a seismic retrofit on the residence structure at the McDonald Ranch in the
District's La Honda Creek Open Space Preserve. Mr. Anderson generously donated to the
District the labor and materials necessary for this work. In addition, Mr. Anderson donated a
heating unit for possible use at the residence in the District's La Honda Creek Open Space
Preserve.
The preparation of plans, twelve hours of labor, and appropriate materials for the seismic
retrofit are valued at $705. In keeping with the District's Site Naming and Gift Recognition
Policy, staff recommends that you adopt the attached Resolution of Appreciation, thanking
Thomas L. Anderson and Anderson Niswander Construction, Inc., for these donations.

WHEREAS, Mr. Thomas L. Anderson is a principle with Anderson Niswander Construction,
Inc., a local construction firm which has done business with the District; and

Dear Councilmembers:
Thank you for the opportunity to respond to you on this subject. We have received a copy of the
Draft Plan and also the recommendations of the Palo Alto Planning Commission. We are generally
supportive of not only the Draft Plan developed by the Planning staff, but also the thought and effort by
the Commission in the further improvement of the original document.
As you are no doubt aware,the District has been in existence now for 25 years. Although long
and difficult to remember,we would like to have the District's name accurately depicted in your
document, (Open Space N-1, on page N-2, line 5). Further,the name might be described in the Glossary
(page 10)as follows:
Midl2eninsula Regional Open Space District
Special District established by the voters in 1972 for the
purpose of acquiring and preserving open space lands.
Governed by an elected Board of Directors.
As to policies proposed under the Land Use and Community Design section of the Draft Plan
(Policy L-1, page L-5), we support the Planning Commission recommendation which would apply an
Urban Growth boundary to Palo Alto's existing Urban Service Area Boundary. In addition,we support
the Planning Commission amendment to the Open Space/Controlled Development section of-the Draft
Plan(Open Space land use definition L-9, page L-9)which would propose adoption of Santa Clara
County's 20-160 acre residential density for the Open pace/Controlled Development land use
designation for Palo Alto and Stanford's lands in the Palo Alto hillsides; for the reason of consistency on
a regional basis with the other communities of the County.

Dear Senator Bond:
On behalf of the Midpeninsula Regional Open Space District, I am writing to urge
you to reject the Senate language in Senate Bill 1034. This language would prohibit
Federal Emergency Management Agency (FEMA) funds from being used to restore or
repair natural features of parks and recreation facilities belonging to State or local
governments.
The Midpeninsula Regional Open Space District engages in providing open space
lands for low-intensity recreational use by the public. The language in question does not
seem to differentiate between an undeveloped open space area that is available at no cost
to the visiting public, and a stadium or other major public facility for high-intensity,
revenue-producing use. The District's historical use of FEMA funds has been related to
landslide repair on open space land, trails, and roads resulting from severe weather
conditions.
I urge you to reject any such restrictions in Senate Bill 1034, thus maintaining the
availability of FEMA funds for use by state and local parks agencies.

At its last Regular Meeting, the Board accepted proposals for printing and mailing of a
special 25th Anniversary newsletter (report R-97-138). The proposed costs were based on
a quantity of approximately 300,000 pieces. It was noted in the Board report that the final
cost of printing and distributing this newsletter would most likely be different than the
estimated costs noted in the proposals, due to the actual number of households
determined to be within the District.
The final household count is 325,000. This raises the printing cost (initially estimated at
$21,763 for 300,000 pieces) to $23,033. The mailing cost, initially estimated at
$34,875 for 260,000 pieces ($135 per thousand), is raised to $43,455 (also $135 per
thousand). These amounts are available in the appropriate accounts in the public affairs
budget.

Dear Mr. Hoyt:
The Midpeninsula Regional Open Space District welcomes organized hiking groups to its
network of open space preserves, and we're happy that the Audubon Society has had the opportunity to
enjoy these lands for bird watching, as noted in the September, 1997 issue of The Avocet.
The article referencing the Audubon hike at Skyline Ridge Open Space Preserve mentioned that
the District ranger opened the entrance gate at 7:45 a.m., even though the group met at 7:30 a.m.
Although the preserves are open at sunrise, visitors are advised that the gates to the parking lots are
normally opened by 8:00 a.m. This is because of the logistics involved in opening of all the Skyline area
gates at the beginning of the daily ranger shift. When planning an outing, we ask that this be taken into
account.
In the article, the author seems to object to the ranger asking if the group had a permit. Permits
are required for groups of 20 or more and for pre-advertised activities. This is to ensure the protection of
the natural resource, to avoid having numerous large groups use the same trail or preserve on the same
date, and to allow for adequate parking. Also, in the event of an early arrival time, provisions can be
made for prompt opening of the gate. Although a blanket permit has been issued for your
organization, this does not cover additional services, such as the early opening of parking lots.
Finally, I'd like to remind your readers that District rangers are well-trained in protecting the
resources and providing for a safe, enjoyable visit. The ranger who opened the gates in this instance was
carrying out the job she had been instructed to do. If a visitor is ever unsatisfied with their visit or with
the service received from District staff, we would appreciate being contacted directly. We invite the

Skyline Ridge 5/24
On Saturday May 24 we had a good
SCVAS field trip despite a rocky start.
We were scheduled to meet at 7:30 AM
but the"friendly"ranger did not open the
parking area(and the porta-potties)until
about 7:45. She also wanted to know if
we had a group permit---"It's the law."
Finally,there was some confusion over
the meeting place, incorrectly listed as
the southeast corner of Alpine and Sky-
line. (Oops!. . . Ed.)
Once things got started,Emelie Curtis
quickly found us a female Purple Finch
near Alpine Pond. We also had an Ash-
throated Flycatcher,a Warbling Vireo,
a Black-headed Grosbeak and a
selasphorus hummingbird (most likely
an Allen's) among other birds near the
pond. Further up the hill on Ridge Trail
we had Black-chinned Sparrows. La-
zuli Buntings,a male Purple Finch and
several Orange-crowned Warblers.
Chipping Sparrows were absent
from their usual location at the top of the
hill,but we did find a copulating pair on
the north side of the hill just west of the
old tennis court.A Black-throated Gray
Warbler and a Hutton's Vireo were
also seen and Western Tanagers were
heard. Later, while several of us were
having lunch in the parking lot, John
Meyer heard a Grasshopper Sparrow
which was subsequently seen, repeat-
edly,on a flower on the skyline of the hill
west of the parking lot. A fitting end to
any field trip.
