Applicant: Rose Cilari. On 8/8/95, the Planning Office received a request from Rose Cilari to change the name of Wayside Drive to Rose Path. The application was not completed, in that the Assessor' s Map and parcel numbers were omitted. However, Paul Halkiotis said that this office can complete the application. He recommended approval of the request. MOTION:Nate Pulling moved that the Board authorize the applicant to change the name of Wayside Drive to Rose Path. VOTE: 5-0-0, unanimous . Update Paul updated the Board on the activities of the Zoning Bylaw Task Force. Tree Hearing. Applicant - NYNEX. Location - Pochet Road, Cedar Land Road, Beach Road, Nauset Heights Road, Nauset Road. George Walker read the legal ad for this hearing, which appeared in both the 7/25/95 and 8/1/95 issues of The Cape Codder. Also present: Shawn Shea, Tree Warden; Ron Thibodeau, NYNEX Shawn Shea said that he had no problem with the trimming and removal of the advertized trees . MOTION:Tad Vautrinot moved that the Board vote to authorize NYNEX corporation to trim a 3 ' x 3 ' window of clearance on trees located on Pochet Road, Cedar Land Road, Beach Road, Nauset Heights Road at the locations specified in the legal advertisement notice; and to remove 2 black cherry trees on Pochet road. VOTE: 5-0-0, unanimous . Continued Public Hearing - Argo Definitive Subdivision Plan. Also present: Attorney Michele Belmont; Tim Brady, East Cape Engineering; Elizabeth Argo, Applicant Planning Board 818195 Minutes 2 The Board received a memo addressed to them from Paul Halkiotis, dated 8/8/95, regarding the Argo Subdivision Plan, Arena Drive. In this memo, Paul updated the Board on waiver requests and correspondence received regarding the plan. Tim Brady explained the changes shown on 8/7/95 revision of the Argo plan: Water line - The Argos have agreed to replace the 1" water line with a 2" water line that will run from Main Street to the two existing Argo dwellings . Location of the driveway - Abutter Mr. Bosset had met on the site with Attorney Belmont and Tim Brady, and it was agreed that the proposed way will be located 10 ' from the Bosset property line. Drainage - Steve Haas, Eagle Engineering, has reviewed the drainage and has recommended that a Vane type catch basin grate be used. The Board of Health has approved, with conditions, the variance request from Title 5 and the Board of Health regulations to allow creation of a subdivision lot line which is proposed to run in between the dwelling at 7 Arena Drive and the septic system serving it. Paul reported that he had met with Mike Ford, Town Counsel, and asked him if the Board could approve the plan prior to DEP approval of the 2 septic systems on 1 lot, and Mr. Ford said that the Board could approve the plan with the condition that if DEP approval is not granted, the applicant will have to relocate the system to comply with State law. Regarding the drainage, Paul said that, according to Steve Haas, the drainage calculations were done only for the proposed way, not for the entire parking lot of the Academy which contributes to drainage. Consequently, a note was placed on the plan saying that if the access is constructed prior to the Academy Parking area, then a 1 . 5 ' wide berm must be installed along both sides of the way to prevent parking area drainage from entering the access way. The utility pole will have to be relocated and there should be a note on the plan to that effect. Argo, Scale 1" = 40 ' ; dated 6/21/95, and having a final revision date of 8/7/95; prepared by East Cape Engineering, 44 Rte 28, Orleans, MA. MOTION:Tad Vautrinot moved that the Board waive the requirement to show location of existing underground utilities (water service) - Section 192-2-E 1 (a) 5 VOTE: 5-0-0, unanimous . MOTION:Tad Vautrinot moved that the Board waive the requirement to show water main location on Main Street, Sections 192-2-E 1 (a) 5 + 192-2-E 1 (18) VOTE: 5-0-0, unanimous . MOTION:Tad Vautrinot moved that the Board waive the requirement of Section 192-3 F Underground Utilities; that the Board require that the relocation of the utility pole be shown on the plan; and that the cross section showing the underground electricity line be deleted. VOTE: 5-0-0, unanimous . The Board discussed surety bonds, and that discussion will be continued and completed prior to endorsement of the plan. MOTION:Stan Hart moved that the Board vote to approve a Definitive Subdivision Plan in Orleans, MA, being a division of Plan Book 492, Page 63, prepared for Elizabeth B. Argo, Scale 1" = 40 ' ; dated 6/21/95, and having a final revision date of 8/7/95; prepared by East Cape Engineering, 44 Rte 28, Orleans, MA. Said plan is approved contingent upon the following conditions : 1 .Prior to endorsement of the plan, the applicant shall submit: (a) a standard maintenance agreement; (b) a standard covenant which prohibits further residential development of the property; (c) easement documents for the water service. If the applicant does not receive the required variances from the DEP, allowing the septic system serving Lot 2 to remain on Lot 1, the applicant must relocate the septic system onto the same lot as the structure it serves (Lot 2) . 3 . In the event that the Orleans Board of Water Commissioners do not grant the waiver request to install a 2" water service instead of the required 8" water main, the applicant shall submit a revised plan showing the location of the 8" water main. 4 .All roadway, drainage, water, and other improvements shown on Sheet 2 of the plan, associated with the reconstruction of the access to the Argo property, shall be made prior to August 1, 1998 . In the event that said improvements are not completed by that date, the Board shall schedule a public hearing to consider recision of the Subdivision Plan. 5 .The Planning Department shall be contacted at least 48 hours prior to reconstruction of the access road in order to establish a construction inspection schedule. 6.Prior to endorsement of the plan, the applicant shall post a surety bond acceptable to the Planning Board, in an amount equal to 1150 of the estimated construction costs . 7 .Following recording of the Definitive Plan, easements, covenant and maintenance agreement, the applicant shall provide the Planning Office with evidence of recording from the Barnstable County Registry of Deeds . 8 .The subdivision plan shall be revised to identify the easement area and reserve area for the future septics to serve Lot 2 . VOTE: 5-0-0, unanimous . Business Discussion occurred regarding the need to review the Zoning Bylaw as it pertains to signs . MOTION:George Walker moved to adjourn. VOTE: 5-0-0, unanimous
