HomeMy Public PortalAbout038-2001 - Vacation - Alley running West off 100 blk N 9th St.ORDINANCE NO. 38 - 2001 A SPECIAL ORDINANCE VACATING AN ALLEYT RUNNING WEST OFF OF THE 100 BLOCK OF NORTH 9TH STREET WHEREAS, First Bank Richmond and Indiana Football Hall of Fame have petitioned Common Council of Richmond, Indiana, requesting the vacation of an alley located between First bank and the Indiana Football Hall of Fame; and WHEREAS, this alley runs West from the West line of the 100 block of North 9th Street to intersect the East right-of-way line of the alley running North and South midway between North 9th Street and North 8th Street; and WHEREAS, Richmond Common Council, pursuant to Indiana Code 36-7-3-12, conducted a public hearing on said petition ___________, 2001, after publishing, legal notice thereof at least ten (10) days in advance of said hearing as required by statute; and WHEREAS the Richmond Advisory Plan Commission, pursuant to Richmond Code 155.04(b), conducted a public hearing on said petition _____________,2001, after publishing legal notice thereof at least ten (10) days in advance of said hearing as required by ordinance; and WHEREAS it is desirable to vacate said portion of alley. NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that subject to the preservation of easements for existing utilities, the portion of public way described below is hereby vacated and First Bank Richmond and Indiana Football Hall of Fame shall acquire ownership of such land heretofore dedicated as a public way as indicated below, to wit: See Exhibit A attached hereto Passed and adopted this 2nd day of July, 2001, by the Common Council of the City of Richmond, Indiana. s/s Karl Sharp, President (Karl Sharp) Attest: s/s Norma Schroeder, City Clerk (Norma Schroeder) PRESENTED to the Mayor of the City of Richmond, Indiana, this 3rd day of July, 2001, at 9:00 a.m. s/s Norma Schroeder, City Clerk (Norma Schroeder) APPROVED by me, Shelley D.
