A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD
AUTHORIZING THE DEDUCTION FROM THE CITY'S COMMERCIAL
FRANCHISE FEE OF THE ADDITIONAL CONSUMER PRICE INDEX
ADJUSTMENT OF 2.5%; PURSUANT TO THE TERMS OF THE CONTRACT
FOR THE MONTHS OF NOVEMBER 2008, DECEMBER 2008, AND JANUARY
2009
! WHEREAS, the solid waste disposal contract with Consolidated Disposal
Service started on November 1, 2003 and is scheduled to terminate on October
31, 2013; and
WHEREAS, the contract allows the contractor to request an annual rate
increase equal to the lesser of 2.5% or the prevailing percentage increase of the
applicable Consumer Price Index; and
WHEREAS, the contractor has submitted a request for a rate increase of
2.5% that is in conformance with the contract; and
WHEREAS, the contractor has agreed to make the CPI rate increase
effective early next year.
NOW, THEREFORE, the City Council of the City of Lynwood does hereby
find, proclaim, order and resolve as follows:
Section 1. That the City Council, pursuant to the terms of the contract,
authorizes the deduction of a rate increase equal to 2.5% from the commercial
Franchise Fees for the months of November 2008, December 2008 and January
2009.

Section 2. That the Contractor shall provide sufficient documentation to
~ support the amount to be deducted for each month noted.
Section 3. This resolution shall take effect immediately upon its adoption.
Section 4. The City Clerk shall certify as to the adoption of this
Resolution.
