HomeMy Public PortalAboutResolution 86-2450-BRESOLUTION NO. 86- 2450--13 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 6. BE IT RESOLVED by the City Council of the City of Temple City as follows: 1. A Public Hearing having been called for August 19, 1986, at the hour of 7:30 p.m. in the Council Chamber of the Civic Center, Temple City, California, to ascertain whether the public necessity, health, safety, or welfare requires the removal of poles, overhead wires and asso- ciated overhead structures and the underground installa- tion of wires and facilities for supplying electric, com- munication or similar or associated service as more fully shown on the attached map marked Exhibit "A "; 2. Notice of such hearing having been given to all affected property owners as shown on the last equalized assessment roll and utilities concerned in the manner and for the time required by law; 3. Such hearing having been duly and regularly held, and all persons interested having been given an opportunity to be heard; NOW, THEREFORE, the City Council of the City of Temple City hereby finds and determines that the public necessity, health, safety and welfare require the removal of poles, overhead wires and associated structures, and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service in the area generally described as follows: Beginning at intersection of centerlines of Daines and Grace - wood proceeding north along the centerline of Gracewood a dis- tance of 720 feet to the north property line of Live Oak Park, then westerly along said property line to the easterly right of way line of Glickman Avenue, then northerly along said right - of -way line a distance of 30 feet to the extended centerline of Bogue Street, then westerly along said centerline a dis- tance of 600 feet to an extension of the westerly property line of Live Oak Park, then southerly along said property line to the southerly right -of -way line of Daines, then easterly along said right of way line to a point 6 feet east of the extended centerline of Gracewood Avenue, then north to the centerline of Daines Drive, then west along the centerline of Daines Drive to the point of beginning. The above described area is shown on map marked Exhibit "A ", and such described area is hereby established as Underground Utility District No. 6; such streets or roadways, or rights -of -way are extensively used by the general public and carry a heavy volume of pedestrian or vehicular traffic. SECTION 1. The following exceptions in said Underground Utility District No. 6 are authorized: (a) Any municipal facilities or equipment installed . under . the supervision and to the satisfaction of the City Engineer. (b) Poles or electroliers used exclusively for street lighting. (c) Overhead wires (exclusive of supporting struc- tures) crossing any portion of a District within which overhead wires have been prohibited, or connecting to buildings on the perimeter of a district, when such wires originate in an area from which poles, overhead wires and associated overhead structures are not prohibited. Resolution No. 86 -2450 - Page 2 (d) Overhead wires attached to the exterior surface of a building by means of a bracket or other fixture and extending from one location on the building to another location on the same building or to an adjacent building without crossing any public street. (e) Antennae, associated equipment and supporting structures, used by a utility for furnishing communication services. (f) Equipment appurtenant to underground facilities, such as surface mounted transformers, pedestal mounted terminal boxes and meter cabinets and concealed ducts. (g) Temporary poles, overhead wires and associated overhead structures used or to be used in con- junction with construction projects. SECTION 2. All poles, overhead wires and associated overhead structures shall be removed and underground installations made in said Underground Utility District within the following times: (a) Underground installation by utility companies and property owners and reconnections not later than November 30, 1987. (b) Removal of poles, overhead wires and other associated structures not later than Decem- ber 31, 1987. SECTION 3. All utility companies operating within the Utility District No. 6, as shown on the attached map, and all owners of property located within such area are hereby instructed and directed to carry out the terms of this Resolution as above set forth and pursuant to Ordinance No. 68-265; failure to do so will incur the sanctions and penalties as set forth in Ordinance No. 68 -265, passed, approved and adopted. Detailed instructions for property owners on the removal of above - ground facilities and installation of underground utilities in connecting from utilities to private buildings are available in the Office of the City Engineer. SECTION' 4. The City Clerk shall certify to the adoption of this Resolution. ADOPTED, SIGNED AND APPROVED this 19th day of August, 1986. ATTEST: Deputy Ci)y.
