RESOLUTION 2008-23
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE
SUMMARILY VACATING PUBLIC UTILITY EASEMENTS
WHEREAS, California Streets and Highways Code Section 8333 et seq. authorizes the
summary vacation by cities of public utility easements meeting, specified criteria;
WHEREAS, the Truckee Town Council has determined that the public utility easements
described in Exhibit A hereto meets the statutory criteria and contains no utilities.
WHEREAS, vacating the public utility easement is necessary for the acquisition of the
property by CalTrans; and
WHEREAS, the Town Council entered into an agreement with Caltrans on December
21, 2006, authorizing the construction of a roundabout and vacation of the public utility
easement is required for conveyance of title and construction; and
WHEREAS, the Town Council entered into an agreement with Gray's Station, LLC on
December 21, 2006, authorizing the construction of the project requiring any necessary
abandonments; and
WHEREAS, prior to approving action, the Town Council considered the Mitigated
Negative Declaration and any comments received on the Mitigated Negative Declaration during
the Public review process; and
NOW THEREFORE BE IT RESOLVED, the Town Council hereby vacates any and all
interest in the public utility easements described in Exhibit "A and B", attached hereto and
incorporated herein under the provisions of State and Highway Code Section 8333 et seq.
BE IT FURTHER RESOLVED, the Council hereby authorizes and directs the Town
Clerk to record this resolution in the Nevada County Recorders Office and the Town Manager to
execute any and all other documents to effect the vacation and complete the recordation.

The foregoing Resolution was introduced by Council Member Anderson,
seconded by Council Member Dee, at a Regular Meeting of the Truckee Town Council,
held on the 1st day of May, 2008 and adopted by the following vote:
AYES: Council Member Anderson, Council Member Dee, Council Member
Susman, Vice Mayor Brown, and Mayor Green.
NOES: None
