HomeMy Public PortalAboutResolution 86-24581 RESOLUTION NO. 86 -2458 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DECLARING CERTAIN PREMISES TO BE A PUBLIC NUISANCE AND ORDERING ABATEMENT THEREOF. FOR THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE AS FOLLOWS: WHEREAS, the Planning Commission of the City of Temple City has by Resolution No. 86- 1262PC determined that a public nuisance as defined in the Municipal Code exists on certain premises and recommends abate- ment thereof; and WHEREAS, upon hearing duly noticed and considering all relevant evidence and testimony, said Council found and determined that such nuisance exists and should be abated; NOW, THEREFORE, THE CITY COUNCIL OF THE'CITY OF TEMPLE CITY DOES RESOLVE: SECTION 1. That a public nuisance, as defined in the Municipal Code of the City of Temple City, exists on the premises designated as 5738 -40 Kauffman, City of Temple City, California, and more particularly described as portion of Lot 502 of Tract 6561 Map Book 72, Pages 34 -35 of Maps in the Office of the County Recorder, County of Los Angeles, State of California in the following particulars: 9316 In an "R" Zone, a view - obscuring wall, fence or hedge thirty -six inches in height, or a 42 -inch non - view obscuring fence or wall may be located on any part of a lot. A wall, fence or hedge not more than six feet in height may be located anywhere on any lot except those areas comprising the front yard. 4230(h) Overgrown vegetation likely to harbor rats, vermin and other nuisances or causing detriment to neighboring properties or property values. SECTION 2. The property owner is ordered to abate the nuisance within sixty (60) days by the following methods: 1) Reduce the height of view - obscuring hedges in the front yard to no more than 36 inches. 2) Reduce the height of the hedge if non -view obscuring to no more than 42 inches in height. SECTION 3. If said abatement is not accomplished by the expiration of sixty (60) days, the City Manager is hereby authorized and directed to cause said public nuisance to be abated by City forces or private contractor pursuant to the Municipal Code. SECTION 4. The City Clerk is hereby directed to cause a copy of this Resolution to be served on the owner of said premises pursuant to the Municipal Code. SECTION 5. The City Clerk shall certify to the adoption of this IResolution. • APPROVED AND ADOPTED THIS 5th day of August, 1986.
