The Council of the City of Medina met in regular session on Tuesday, October 1, 1974
at 7 : 4.5 P M
members present: Mayor Wayne Neddermeyer, Councilmen, Arthur Theis, Thomas Stevens
Donald DesLauriers, Robert Franklin and Clerk Donna Roehl
Motion by Robert Franklin, seconded by Arthur Theis to ac ept minutes of Regular meeting
- of September 3, 1974, as received.
Motion carried unanimously
Motion by Arthur Theis, seconded by Donald DesLauriers to accept minutes of special
meeting of September 16, 1974 as received.
Motion carried unanimously
Donald Galloway, Henn. Co. Rd. 19 upgrading
C1D; onald Galloway, design engineer of Hennepin Co. Highway Dept. appeared at the request of
Council to explain the latest plans for upgrading Co. 19 from Co. Rd. 24 and Co. Rd. 29
to State Hwy. 12.
He stated that plans call for upgrading existing road to 12 ft. lanes and 10 ft. shoulders,
a bike path 8 ft wide on the West and North side of road and changing the alignment.
The latest plans will make it necessary to acquire 5 or 6 lots and perhaps one mew home
in Independence Heights addition.
Don Spielman, Chief Design Engineer for County said that the Park Board had accepted the
plans and Medina, Maple Plain and Independence were being asked to do likewise.
Homeowners of the area were concerned about the alignment taking home sites and asked if
plans could be changed; Several alternatives were asked to be considered.
Mrs. Heinzen inquired as to the possibility of a number of large trees being destroyed on
Co Rd. 29 and was informed that trees would be paid for.
Mr. Galloway stated that road construction would cost $450,000 and he was not certain as to
amount determined for land acquistion.
Robert Franklin expressed view that road should be aligned so as to avoid all lots and
presery a loop road to serve Independence Heights.
Motion by Robert Franklin, seconded by Arthur Theis that Council decline to concur with
Hennepin Co. Highway Dept. on plans of Co. Rd. 19 and 29 and request that they return
with plans to preserve Independence Heights intact and preserve looped road to serve
that area and not to destroy trees on East side of Co. Rd. 29.
Motion carried unanimously
Engineer Herb Klossner stated that he would like to have a work session with the council
to resolve plans.
nayor Neddermeyer reported that there is a hazardous washout on Homestead Trail which has
,been there for quite some time and needs to be repaired as soon as possible.
2. Cates Construction, final bill
Motion by Robert Franklin, seconded by Donald DesLauriers to pay Cates Const. $12,769.20
as work has been completed and wording of the well contract must be resolved by Mr. Cates
attorney and the attorney for the architect.
Motion carried unanimously
3. Flood Insurance Hearing
Robert Franklin stated that the purpose of the hearing was to determine if Medina would
benefit from this kind of insurance and that he would attempt to explain the program as he
could get no one from the Dept of Natural Resources to attend meeting.
One June 28/74 we received formal notification from the Federal Insurance Adm. stating that
we are not participating in the flood program, we are in a flood area and must either join
or appeal if we refute that data presented.
Medina must be in the program by June 30, 1975 and if not FHA loans may not be secured.
If we get into the program,flood insurance must then be taken out by these homeowners.
C.O. Dorweiler explained one reason municipalities should be involved is that mortgage
purchaserers needing knowledge of property could contact villages and get information.
Jim Lane stated that he had contacted the Dept. of Natural Resources and found that maps
are incomplete and may '.,e modified we could use Wetlands and Soil Survey maps and HUD
would work with localengineer o formulate maps.
Robert Scott inquired if city could get into program after maps were modified.

Motion by Robert Franklin, seconded by Donald DesLauriers to instruct clerk to write
letter to Federal Flood Insurance Office with a copy to DNR notifying them that we
are appealing the determination that Medina is in a flood zone and that they should
refine their data and return to council for further determination. Also further study
should be made by zoning administrator.
Motion carried unanimously
4. Leo Leuer, Road Supervisor
Mr. Leuer discussed with council sewer service construction to Fidel Theis property.
Motion by Donald DesLauriers, seconded by Robert Franklin to extend sewer line as
recommended to serve Theis property and Leo should inform engineer of decision.
Motion carried unanimously
He reported that McCombs -Knutson and the engineer for the Mannix Corp. are determining
our cost for gravel and blacktop on Arrowhead Road.
5. Dick Hanley, North Shore Community Council Program Director
Mr. Hanley explained the programs, policies and budget of the organization and reason
for the increased dollar amount being asked of the various communities.
Art Theis said that he would serve on their board of directors as a representative from
this area and Mr. Hanley stated that any other resident would be welcomed also as a
board member.
Council decided to take their request for payment of $616.00 under advisement as it
may be designated as a necessary public expenditure and not as a donation.
6. George Cleveland, Tamarack Road 0i1
Mr. Cleveland discussed with council oil bill of $90.00 for 1973, inquiring as to whether
or not other residents of Tamarack has paid toward the project. He was informed that
Eleanore Reiser and Dr. Karpeles had paid and he stated that he would reimburse the
city for said amount.
7. Jeff Carson, Attorney
Mr. Carson explained to council that he had received a request from Christine Piper,
via her attorney, Jim Lane, regarding reversion of old city hall property. A resolution
passed by the council would be necessary for signing deed if land and buildings are no
longer used for public purposes. He also stated that no payment to Mrs. Pipers attorney
should be made by the city.
Council decided to take request under advisement and act on matter at a later date.
Mr. Carson and Robert Franklin had appeared for a hearing regarding hazardous buildings
on Cunningham property on Lot Six, Block 8, Independence Beach. After discussion by
parties involved it was agreed that if settlement stipulation were to be signed by
Mayor Judge Nicholson would sign an order setting forth itmens that must be carried
out regarding the property.
Motion by Robert Franklin, seconded by Arthur Theis to approve stipulation regarding
8unningham property.
Motion carried unanimously
Mr. Carson stated that an affidavit of expense had been prepared regarding razing of
dance hall on Block 16, Independence Beach. Total expenses were 81385.05 and could be
placed on tax rolls after signature of Clerk.
Motion by Thomas Stevens, seconded by Donald DesLauriers to approve affidavit.
Motion carried unanimously
8. Unpaid bills
Discussion as to response received regarding letters dated September 9, 1974 asking
for payment of bills or action that would be necessary if not taken care of.
Motion by Robert Franklin, seconded by Donald DesLauriers to charge -off fire call bills
of Francis Miller and Emil Jubert and to send the remainder of unpaid bills to concil-
iation court.
Motion carried unanimously
6 9. County -State Aid Roads
Donald DesLauriers asked that Council table until next meeting the engineers plans
for stipulation of County-Sdiaie Aid Roads
10. Planning Commission Member
Thomas Stevens will find several choices for Planning Commission member to fill vacancy
and Council will appoint member at November meeting.
11. Bills
Motion by Donald DesLauriers to withhold payment to Architect until well problem is
resolved. Seconded by Arthur Theis.
Motion carried unanimously
Motion by Thomas Stevens, seconded by Arthur Theis to pay the bills, Order checks in
the amount of $38,499.65 and Payroll in the amount of $6435.97.
Motion carried unanimously
12. Chestnut Road
Leo Leuer informed Council that he and Officer Jerry LaFond had driven across Chestnut
Drive on this date, October 1, 1974, also Wilfred Scherer with farm machinery.
Wayne Neddermeyer thanked Leo Leuer on behalf of the city for his part in the purchase
of road grader and pick-up truck.
13. 1975 Budget
Donald DesLauriers presented salary information and other items regarding street and
alley budget.
Motion by Robert Franklin, seconded by Thomas Stevens to pay Leo Leuer $100.00 per month
garage rental beginning October 1, 1974.
Motion carried unanimously
Motion by Donald DesLauriers, seconded by Thomas Stevens to notify Medina residents that
city snow plows will no longer plow private roads.
Motion carried unanimously
Motion by Arthur Theis, seconded by Thomas Stevens to raise the salaries of councilmen
by $10.00 per monthfor total of $50.00 per month.
Voting yes: Theis, Stevens, DesLauriers, Neddermeyer. Voting no: Franklin
Motion by Donald DesLauriers, seconded by Thomas Stevens to raise salary of Mayor by
$20.00 per month or total of $70.00 per month.
Voting yes: Theis, Stevens, DesLauriers. Voting no: Franklin. Abstaining: Neddermeyer
Motion by Thomas Stevens, seconded by Donald DesLauriers to raise salary of Treasurer by
$10.00 per month for a total of $50.00 per month.
Motion carried unanimously
Council spent remaining time on budget
Motion by Arthur Theis, seconded by Thomas Stevens to hold a special meeting on Tues.
October 8th at 7:30 P M to finalize budget, decide pay raises for Street and Alley work,
and any other items that may need attention.
Motion carried unanimously
Motion by Arthur Theis, seconded by Donald DesLauriers to adjourn.
